MOORE — Plenty of successful people get their start with jobs in the fast food industry. For most it’s just that — a start. They move on as soon as they can to any opportunity that doesn’t require working around hot grease and wearing a paper hat. But Kurt Dinnes built a small fast food empire long before he started building houses — such as the one at 725 Carol Ann Ave. that is featured in the 2010 Parade of Homes organized by the Central Oklahoma Home Builders Association. Neighborhoods and homes will be open at no charge for tours from 1 to 7 p.m. today and Sunday. Parade plan guides, with photos, maps, descriptions and features, are available for free at Metro-area Lowe’s Home Improvement Warehouse locations. In addition, the Parade of Homes has gone digital with a first-of-its-kind iPhone application. The app, available free at the Apple iTunes store, allows people

2,340-square-foot, three-bedroom design, is on a lakeview lot in Lake Woods, one of six additions featured in this year’s parade. Lake Woods is on the northwest corner of SW 34 and Eastern Avenue.

Curb appeal especially important for quick sale Are you facing foreclosure and want to sell your home before the bank takes it away? If so, you’re one of many, said Rick Sharga, a senior vice president of RealtyTrac, which follows foreclosure activity throughout the United States. By the end of 2010, he estimates that the yearly total of households in foreclosure will reach 3.2 million, despite the technical postponements announced recently by some banks. Those who know they’ll be unable to make their mortgage payments, with or without their bank’s help, are smart to recognize this reality early and put their home up for sale as promptly as possible, Sharga said. Here are several pointers for those who need to sell quickly to avert foreclosure:

first on how your house looks from the outside. When you’re in a hurry to sell, your home’s curb appeal is especially important, said Ashley Richardson, a veteran Coldwell Banker agent. No matter how low your asking price, you’re not going to attract a purchaser if it goes on the market in poor condition, said Richardson, who is affiliated with the Council of Residential Specialists (www.crs.net). Richardson urged home sellers to keep their front lawn and the greenery that surrounds their home
weeded and trimmed. They should also make sure that any junk cars languishing in the driveway are towed away or donated to charity. Clean and clear away clutter from your place. Not all home upgrades are expensive. In fact, Richardson said, two of the most powerful home improvement steps you can take, cleaning and decluttering, are not pricey. During the purging process, Richardson said, sellers should remove family photos and other personal mementos — especially those attached to the front of the refrigerator with magnets. Paint as many parts of your home as time allows. The first priority for your painting, she said, should be the front door of your dwelling, which is highly visible. Once that’s done, move to the first room inside the front door.

Then proceed through the home, painting as many areas as time allows — especially the bathrooms and kitchen, because “buyers are very insistent that these rooms look fresh and clean,” Richardson said. Create a deadline for yourself by scheduling an open house. You may need a welldefined deadline to complete your home-improvement project in a timely way. Assuming that’s the case, Richardson encouraged you to give yourself a hard deadline by scheduling a broker’s open house right after your home goes on the Multiple Listing Service. This is an event to which real estate agents throughout your area are invited; these agents are most likely to be working with serious buyers. (It’s likely to be especially successful if

your place is accessibly located and has ample parking.) Don’t give up without trying more than one approach to selling. Even if you live in a neighborhood where “for sale” signs are numerous, a successful sale is plausible if your property is in good condition and is priced a notch below the competition, Sharga said. If your home doesn’t sell promptly through traditional methods, he suggested you consider putting it up for auction, making sure you are protected with a “reserve figure,” a dollar amount that reflects the lowest sum you’re willing to accept for the property. Sharga recommended homeowners contact local auctioneers and ask about their success rate for residential real estate. Also, ask for references.

Here’s a weight off your shoulders. USG Corp. recently introduced a lighter weight gypsum wallboard that’s easier for do-ityourselfers to carry and to install. Sheetrock UltraLight is engineered to be up to 30 percent lighter than regular types of drywall. The halfinch-thick panels are for use in non-firerated applications, such as residential construction, remodeling and repair projects. They come in standard lengths and can be installed on steel or wood framing. Sheetrock UltraLight is available at Home Depot. A manufacturer’s suggested retail price was not available because gypsum board prices change with market conditions, but a 4-by-8-foot sheet costs about 50 cents more than regular Sheetrock. with construction came when he started building franchises for Taco Mayo — the company he cofounded in 1978. He said he saw right away that he could do the job “cheaper and way better” himself. Soon, Dinnes was building for his own and other restaurant chains, as well as other commercial spaces. Suddenly, after 20 years in another career, Dinnes knew what he wanted to do when he grew up. “Building homes has been a blessing job,” he said. “There’s nothing I ever wanted to do more than this.” Dinnes said he chose to build in Lake Woods — with 15 acres of common space in addition to a central lake — because the “affordable high end” homes there are “a pleasure to design and build.” Lake Woods, which welcomed its first residents in 2005, is set to expand into a sixth phase later this year, developer John Woods said. “We’re 80 percent built or occupied overall now,” Woods said, with about 40 lots remaining in phase 6. In Lake Woods, “that’s been the story since the beginning,” he said. “You always see more ‘sold’ signs than ‘for sale’ signs.” Floor plans for Lake Woods homes average about 2,000 square feet with most homes selling from $190,000 to $220,000, Woods said. Dinnes’ featured home — an Old World, French country design with custom stone and ironwork details — includes a master suite with walk-in shower, formal dining room, a “fully loaded” kitchen and an upstairs bonus room with a balcony that looks out over the adjacent greenbelt surrounding the lake. ASK MI-LING Recently, my husband and I joined friends on a cruise to celebrate those of us who turned 50 this year. The cruise was called Golden Jubilee and several friends attended this event, which was organized by my old friends, baseball great Joe Carter and his wife, Diana. There were a number of folks from Oklahoma City who attended and others from Kansas City and Texas. We began our cruise in Port Canaveral, Fla., and then visited Labadee, Haiti; Ocho Rios, Jamaica; George Town, Grand Cayman Island; and Cozumel, Mexico. I was excited about finding treasures on these islands to incorporate into the decor of my home and use as inspiration for my next design project. When the cruise ship pulled up to the port of Labadee, I wasn’t sure what to expect. I was a little hesitant to disembark knowing that the people of Haiti, just miles away, still were dealing with the effects of a
devastating earthquake, and I was feeling somewhat guilty that we were going to enjoy this beautiful private island. However, after arriving on the island and meeting some of the artisans at the village market, it became clear to me that they were delighted that we were there. I was amazed at all of the beautiful hand-carved items, from large statues to trays and boxes as well as beautiful paintings. Wishing I had more space in my suitcases, I settled on a large hand-carved statue of a man that will fill a space in my family room, a beautiful keepsake box perfect for my bedroom and handmade bracelets and necklaces that will be placed in a vase in the dining room. A colorful dress that I purchased could easily be framed and hung on the wall as a piece of art.

For low-income families, cranking up the heat when temperatures fall is not always an option, even with upward of 14 percent of their annual income going for energy compared with 3.5 percent for other households. The U.S. Department of Energy’s Weatherization Assistance Program reduces the energy burden on low-income families by installing cost-effective, energy efficiency measures. Find out more at the Weatherization Day event from 10 a.m. to noon Wednesday in the lobby of Community Action Agency of Oklahoma City, 319 SW 25. Vendors will be on hand to discuss the types of materials used to weatherize a home, representatives of the Oklahoma Department of Commerce, Department of Human Services, Oklahoma Natural Gas and Oklahoma Gas and Electric Co. will talk about how they assist in the weatherization process, and technicians will answer questions about how to perform an energy audit. The eight-hour CAPS II course is “Design/Build Solutions for Aging and Accessibility.” The National Association of Home Builders developed the CAPS program to help homebuilders and remodelers meet this growing market. “Agingin-place” means remaining in one’s home safely, independently and comfortably, regardless of age,
income or ability level, according to the builders group. “The CAPS I course was quite revealing to me a builder. It became evident that design solutions can be implemented into a home to make it more accessible and livable for mature residents and those with special needs,” said Kimmi Houstono, of Edmond, state chairman
of the Oklahoma Professional Women in Building Council. “All the while, those same design solutions can be almost undetected, so the appearance of the home is quite normal.” CAPS II focuses on codes and standards, common barriers and solutions, product ideas and resources. The course will be taught by Chuck Brei-
denstein, a lifelong builder and educator. He has worked with numerous colleges, Journal of Light Construction programs, the International Builders Show and others in the industry. The CAPS designation provides a means for people to identify those skilled in remodeling homes for older adults. Builders and remodelers must complete

The seller insisted on an as-is sale, so we relied on the home inspector to find any serious problem. In the basement, he noticed old water stains in an alcove that had been paneled and carpeted. We asked the seller to replace the paneling and carpet, but he refused to do any kind of work on the property. So we agreed to replace the stained materials after the sale in exchange for material costs. But when we removed the paneling, we found a foundation wall that was crumbling and leaning. A contractor friend tells us that the patio will need to be removed and the exterior excavated to enable replacement of this wall.

Do we have any recourse with the seller for nondisclosure? Marci DEAR MARCI: The seller had the right to an as-is sale, but he also had the obligation to disclose all known defects. The underlying question is whether or not he knew about the faulty foundation. If the paneling was installed during the time he owned the property, he was probably aware of the damage and should have disclosed it. When you agreed to do
the repair work yourselves, you should have removed the paneling before completing the purchase. That would have been part of your discovery process. Then the extent of the problem would have been revealed before you bought the property. Home inspectors often recommend evaluation of concealed conditions before the close of escrow, especially where evidence of past leakage is apparent. Now that the extent of the problem is known, you’ll have to decide whether to pursue the seller for nondisclosure or simply accept the outcome as a learning experience. A real estate attorney can advise you regarding the costs and likely outcome of pursuing the seller. In some cases, a strongly worded letter is all that is
needed. DEAR BARRY: My husband and I bought our home about a year ago. It was inspected, and no major defects were found. The previous owner renovated the interior, including the basement, and installed a French drain system. We asked if there was ever a problem of water in the basement, and the seller said there never was. But now, we get water in the basement every time it rains. There’s no way the previous owner did not know about this, especially if he installed a French drain. Do you think he is liable for the cost of repairs? Valerie DEAR VALERIE: If your state requires seller disclosure, the seller should have informed you of this condition, especially if the
question of drainage was raised at the time of the sale. You should notify the seller of your concerns immediately and ask that he address this problem. Communication should be made by certified mail so that you have documentation. To determine the cost of repair, the problem should be evaluated by a geotech-
nical engineer or a licensed contractor who specializes in drainage repairs. If the cost of repair is within the range of small-claims court, you’ll have the seller in a vulnerable position. Mind your L’s and C’s when house hunting By now, we’re probably all familiar with the famous three L’s of real estate: location, location, location. But if you’re shopping for a house and limiting yourself to those three L’s, you might be doing yourself something of a disservice. Keep the L’s in mind while you’re on the real estate trail, but I’ll show you how to use them to expand your thinking a little. We’ll also look at how the four C’s can help with your search as well.
The three L’s One of the L’s definitely still needs to be location. When you’re buying a home, there’s no substitute for location, since you can’t move the house after you’ve bought it. (Well, technically you can, but that’s obviously not your first choice for how to approach things). Location can mean different things to different people. It might be a short commute to work. It might be a particular school district. It might be an older established neighborhood, or an area with lots of parks or

shopping, or an active social scene. If you need to be in a particular location, that should be one of the first criteria for your search. The next L is for “land” or “lot size.” This is another thing you can’t readily change about a house, so pay close attention to it. You may find the perfect house in the perfect neighborhood, but if the lot’s too small, or on a busy corner, or has a slope or an odd shape that won’t fit that pool you want to put in some day, then no amount of rationalizing about how great everything else is will ever change that. The third L is “layout.” Pay particular attention to how the house is laid out and whether that layout is going to work well
for your needs. Is it the one- or two-story house that you wanted? Is the kitchen open the way you want? Are the bedrooms on the floors where you want them? Layouts can be changed to some degree, but often not easily. The changes can sometimes require extensive — and expensive — remodeling work. So it’s definitely better to get what you want from the outset.
Don’t sweat the C’s Those three L’s are all either impossible or potentially very costly to change. But a lot of buyers can get hung up unnecessarily on another group of real estate letters: the four C’s. This group can sometimes blind you to the potential in an otherwise ideal home, so be aware of where they lurk when you’re shopping. The first of the C’s is “condition.” It’s easy to be turned off to a great home in a great location because the overall condition is rundown or outdated. But remember, as long as there are no major structural issues, condition problems can be taken care of. And they can also represent a
great negotiating point, especially with a motivated seller. This can also apply to specific components of the house, such as the roof, the windows, the flooring or the heating system. If you’re not sure exactly when a condition item crosses the line from rundown or outdated to a genuine problem that affects the structural integrity of the house, that’s when you need to rely on the experts. If this is a house you’re seriously considering, it’s time to call in a home inspector or other professional to help you evaluate how extensive any potential problems might be. The second C is “color.” Before you walk away from that cute house on the big lot with the ideal layout because of the pink bedrooms and the flocked wallpaper in the dining room and living room, stop for a moment. Those things are easily changed. A couple of long weekends of sweat equity and a few hundred dollars can make a huge difference in how a house looks. It also gives you the opportunity to put your personal stamp on the home and really make it into something you
can call your own. Next on the list is “clutter.” For some reason, a lot of sellers don’t take the time to declutter their homes before they list them for sale, and that can make for a poor showing. Don’t let that throw you. If you’re a savvy buyer, you can learn to look past the clutter and visualize how your furniture will look in the space. Take a tape measure with you. If necessary, you might even ask if there’s a floor plan drawing of the house available. If so, there are scale furniture cutouts available inexpensively online that will let you quickly place your furniture in the existing rooms to see how things will fit. The final C that you don’t want to sweat too heavily — no matter how much it might gross you out — is “cleanliness.” If the sellers are foolish enough to leave the house dirty, they’re simply inviting lower offers, so take advantage of it. U.S., Ohio investigate foreclosure fraud allegations BY THE ASSOCIATED PRESS
WASHINGTON — The government is looking into allegations that mortgage lenders in the foreclosure crisis have been evicting homeowners using flawed court papers, Attorney General Eric Holder said. President Barack Obama’s financial fraud enforcement task force has a mortgage component to it, Holder noted during a news conference. In a letter, House Speaker Nancy Pelosi and dozens of Democratic lawmakers urged bank regulators and the Justice Department to probe whether mortgage companies violated any laws in handling foreclosures and borrowers’ requests for loan assistance.
It could be the first in a wave of suits by state attorneys general over what appear to be widespread problems in documents used by the nation’s largest mortgage lenders. In Ohio, state Attorney General Richard Cordray is suing Ally Financial Inc. and its GMAC Mortgage division, alleging fraud that could involve hundreds of foreclo-
sures in the state. It could be the first in a wave of suits by state attorneys general over what appear to be widespread problems in documents used by the nation’s largest mortgage lenders. “It certainly seems likely that other states will follow,” said Diane Thompson, counsel at the National Consumer Law Center. The lawsuit by the Ohio attorney general claims the company’s employees signed and filed false affidavits to mislead courts. Cordray called the alleged fraud the “tip of an iceberg of industrywide abuse of the foreclosure process.” A spokeswoman for Ally, Gina Proia, said in an e-mail that there was “nothing
fraudulent or deceitful” about the company’s practices. “If procedural mistakes were made in the completion of certain legal documents, GMAC Mortgage reacted proactively to the situation,” Proia said. The company, she added, also believes its right to foreclose on borrowers who are in default is not in dispute. In addition to Ally, JPMorgan Chase and Bank of America Corp. have halted foreclosures in 23 states after evidence surfaced that their employees or outside lawyers signed documents without reading them or filed inaccurate paperwork. State and federal officials have been increasing pressure on the industry over concerns about potential legal violations.

Add-on fees discourage home refinancing WASHINGTON — With mortgage rates at unprecedented lows, why are more people not taking advantage of them to refinance or buy houses? The answers are complex and include sagging consumer confidence in the economy and high unemployment rates. But some mortgage lenders point to what they see as overreactions within their own industry that are discouraging and disqualifying potential borrowers — sharply increased credit score requirements, higher down payments, and addon fees imposed by mortgage giants Fannie Mae and Freddie Mac, who control about two-thirds of marketplace loan volume. The most controversial Fannie-Freddie fees, which were introduced as the housing bubble began deflating, are known in the industry as “loan-level pricing adjustments.” Many mortgage executives think they are excessive, given the stricter underwriting standards now in place that reduce the longterm risk of new loans be-

Bruce Calabrese, president of Equitable Mortgage Corp., a mortgage banking firm in Columbus, Ohio, said he considers them “simple cash grabs by Fannie and Freddie because they can, not because of any increased risk.” Fred Kreger, branch manager of American Family Funding in Stevenson Ranch, Calif., said the fees, which can add thousands of dollars in upfront costs to borrowers or raise their interest rates, seem to be out of line with the actual risk in the marketplace, as evidenced by the fact that “portfolio lenders like small- to mediumsized credit unions or banks do not charge them,” even though they are lending to the same customers as Fannie and Freddie.

On top of that come fees calibrated to a sliding scale of down payment amounts, credit scores and housing types. Say, for example, you want to buy or refinance a condominium. Under Fannie’s latest add-on matrix, a condo unit buyer who has less than a 25 percent down payment gets hit with a three-quarters of 1 percent add-on fee for starters. On a $300,000 condo loan, this comes to $2,250, which must either be paid in cash or rolled into a higher mortgage rate. The same matrix imposes additional fees based on

applicants’ credit scores. For instance, anyone with a FICO credit score of 679 who is buying a house with between 20 percent to 25 percent down — substantial money for most budgets — is assessed a 2.5 percent “loan-level price adjustment” fee. Asked for comment on what justifies the continuing imposition of costly add-ons that date back to lower-quality underwriting conditions, officials of the two companies either did not comment or said the fees are needed to cover loss potentials in the future. Freddie Mac spokesman Brad German said, “We feel we are pricing risk appropriately.” Fannie Mae had no comment.

Private mortgage insurance companies, which provide coverage against loss to Fannie and Freddie on loans with down payments below 20 percent, are especially critical of the continuing add-on fees. They say the extra charges on top of their own insurance premiums routinely discourage borrowers from taking out conventional loans and push them instead to the Federal Housing Administration, whose market share has exploded from under 3 percent to more than 30 percent in recent years. Beginning early in 2011, Congress is planning a major debate on their existence, their structures and how they relate to consumers who simply want to get the best-priced mortgage they can.
