Water Resources Supreme Court Rules Discharges to Groundwater Regulated under the Clean Water Act

In 2018, the Clean Water Act (CWA) jurisdiction was flipped on its head in Oregon when the Ninth Circuit Court of Appeals issued a decision endorsing the “groundwater conduit theory.” While discharges of pollutants into groundwater has historically not been regulated under the CWA, proponents argue that such discharges should be regulated when groundwater acts as a “conduit” between the discharge of a pollutant and jurisdictional Waters of the United States (WOTUS). In Hawaii Wildlife Fund v. County of Maui, the Ninth Circuit held that the County’s injection of treated wastewater into wells, a portion of which traveled through groundwater approximately “The Agency’s view is that the best, if not the only, reading of the statute is that all releases to groundwater are excluded from the scope of the NPDES program, even where pollutants are conveyed to jurisdictional surface waters via groundwater. The United States Supreme Court issued its decision on April 23, 2020, ruling that discharges to groundwater may be regulated under the CWA, but only in more limited circumstances than the broad test adopted by the Ninth Circuit. The Supreme Court set forth a standard by which a CWA discharge permit is required if “the addition of the pollutants through groundwater is the functional equivalent of a direct discharge from the point source into a half-mile and reached the Pacific navigable waters.” The Court explained Ocean, required permitting under the Clean Water Act that time and distance are the most important factors, and because the discharge was “fairly traceable” to the injection provided an example where the standard “clearly applies” wells and not de minimis.
