ORLA’s Framework Will Fire on All Cylinders
T
here have been a number of changes taking place at your industry association over the past year and more changes are on the way. Recently, the ORLA Board of Directors approved what I’ll refer to as our organizational playbook to keep us focused on industry priorities that are of value to the membership. On the following page you will see the playbook and its content which focuses on core areas of responsibility - industry leadership, engagement, advocacy, education, and service to our communities. I’ve never been a huge fan of “strategic plans” as far too often they seem to be an exercise in time investment with the end result being the plan collecting dust on a shelf somewhere in the office. Our goal with this document is to provide a straightforward overview of our association identity and the path we see ahead. We want to be the association of choice for Oregon’s hospitality employers. If we’re not the first association industry employers want to join when assessing their membership organization options then we’re not doing enough to showcase the value of ORLA membership and the importance of investing in the success of our own industry first. I would argue that active engagement and industry mobilization have never been more important. And we have worked hard to improve our accessibility and availability to make sure you have the guidance and answers you seek when issues arise in your operation. A key component within our playbook right now is the ongoing assessment of vendor relationships and business services. With 8

cost drivers challenging operations across the board, we have a duty to help our members find new ways to save money. We take this responsibility seriously and know our role is important as margins tighten in a growing regulatory environment on the West Coast.

2017 LEGISLATIVE SESSION ENDS, NEW LAWS TO ADDRESS
O
regon Restaurant & Lodging Association (ORLA) is the hospitality industry’s watchdog and advocate on issues and legislation affecting our industry. On the local, statewide and national levels, ORLA provides a strong voice for our industry. In the face of challenging political dynamics, you can count on ORLA, in partnership with AHLA and AAHOA, to fight for your business and continued growth in Oregon’s second largest private sector industry.
STATEWIDE LEVEL The Oregon Legislature officially adjourned on July 7, 2017. The following represents the final status of key bills and issues we were working on which have direct impacts on the hospitality industry. TOURISM HB 2744: Amends definition of “tourismrelated facility” to include improvements to real property that have substantial purpose of supporting, promoting or accommodating tourism or tourist activities. ORLA opposed this bill. This bill would change the definition and allow lodging taxes to be used for benches, light posts and hanging baskets. Because Oregon tourism is so strong and the efforts to market and promote the state have been so successful, ORLA believes we should continue to respect and uphold the law passed in 2003 defining the percentages of lodging tax revenue dedicated to promotion, marketing and facilities. Result: This bill was not passed out of committee and is dead. HB 2768: Expands definition of “tourism promotion” for purposes of local transient lodging tax revenue expenditures. ORLA opposed this bill. This bill would have allowed cities, counties and other 10

municipalities to use lodging taxes for purposes other than what has traditionally been defined as tourism related including beautification projects and sidewalks. Result: This bill was not passed out of committee and is dead. HB 2064: Directs Legislative Revenue Officer to report to interim committees of Legislative Assembly related to revenue on changes to law recommended by transient lodging tax work group. This bill had several amendments introduced, many of them attempting to alter the definition of tourism facilities or tourism promotion to include hanging flower baskets, benches or sidewalks. ORLA opposed this bill. Result: This bill was not passed out of committee and is dead. HB 3101A: Facility Fees; Prohibits hotels or inns from charging facility fees in addition to price of guest room rental unless facility fees are disclosed prior to guest room reservation or rental. ORLA was neutral on this bill after amendments were made. This bill was amended so that facility fees were not prohibited but lodging operators must disclose any facility fees to guests prior to their room reservation or rental. Result: It passed the House 56-0 with four excused and the Senate 24-2 with four excused. The Governor signed the bill into law on June 6, 2017. What this bill means to you: Lodging properties will need to disclose upfront any facility fees at the time that a guest reserves or rents a guest room, whichever is sooner.
PAY EQUITY HB 2005: Provides definitions relating to comparable work for purposes of pay equity provisions. Adds additional remedies for pay equity and wage-related violations that include right to jury trial and right to compensatory and punitive damages. ORLA initially opposed this bill. This is a bill that was going to pass this session no matter what efforts were made to kill it. ORLA joined others in amending the bill to make it better overall for our industry and other businesses. Result: The bill was passed in both chambers and signed by the Governor. It takes effect January 1, 2024. What this bill means to you: Oregon has had a pay equity law on the books for decades. This bill expanded what compensation employees could seek from just compensatory (back wages for example) to include punitive (pain and suffering for example). It added Veterans as a protected class. The bill also provides an affirmative defense for a pay equity analysis, meaning if, as an employer, civil action is brought against you and you have conducted an analysis of your pay practices within the last three years relevant to the employee’s position in question, damages may be reduced or disallowed. It allows for a pay differential between employees based on bona fide factors related to the position in question and based on certain criteria. Finally, this bill prohibits employers from asking about the salary history of job applicants but does not prevent an employer from requesting from a prospective employee written authorization to confirm prior compensation after the employer makes an offer of employment including an amount of compensation.
RESTRICTIVE SCHEDULING SB 828 and HB 2193: Requires employer to pay employee if employee is scheduled or called in to work but, due to employer, does not work entire shift. ORLA initially opposed this bill due to its restrictive and punitive nature and because research shows when Oregon employees are asked, three out of four do not want the government interfering with their work schedules. This bill became one of the top priorities for the unions once it was clear Paid Family Leave would not pass this session. Result: SB 828 passed both the Oregon House and Senate and is on the Governor’s desk awaiting her signature. HB 2193 was not passed out of Committee and died. This bill (SB 828) only applies to retail, foodservice and hospitality industries. There have been numerous amendments and revisions to this bill including reducing the predictability pay from four hours to one hour, increasing the number of employees from 100 to 500 for the purposes of inclusion in the law, eliminating the private right of action except in the case of retaliation by an employer and including a permanent statewide preemption on local scheduling ordinances. What this bill means to you: If you have fewer than 500 employees globally, this bill will not apply to you. If you have over 500 employees, this bill will apply to you as a retail, foodservice or hospitality establishment based on specific NAISC codes. Franchises are not included in the employee count unless that specific franchisee has over 500 employees. As an employer, you will need to provide a written schedule for at least seven days in advance for the first three years. In 2020, you will need to provide a written schedule
for fourteen days in advance. If you change an employee’s schedule within either the seven day or fourteen day period, you will need to compensate them one additional hour of pay. New employees will be given a good faith estimate of their work schedule at the time of hire. Unless requested or consented, employees will need at least ten hours between shifts or employers will need to pay 1½ times the normal rate of pay for any hours worked within the ten hour rest period. If this bill applies to you, there is still relief in the form of the voluntary on-call list which provides employees the opportunity to voluntarily add themselves to a list which employers can use to call employees and fill shifts when needed.
NATIONAL LEVEL TAX REFORM On a recent trip to Washington D.C., lodging members and staff from ORLA met with our Oregon Congressional delegation to discuss tax reform. We reminded them that many of the owners in our industry are pass-throughs: S Corporations, LLCs and Partnerships, and requested they keep that in mind while reviewing tax reform. While it will be important to reform the tax code for C Corporations, we also need them to consider pass-through entities when reforming the code. ORLA Encourages Congress to Strengthen the ADA, Stop Frivolous “Drive-By” Lawsuits
O
n a recent trip to Washington, D.C., ORLA staff and members met with the Oregon Congressional delegation to discuss several key lodging issues. Among those was the topic of “drive-by” lawsuits, an attempt by serial plaintiffs and attorneys to exploit small business owners for settlement money rather than go to court over issues related to the Americans with Disabilities Act (ADA).
that would give small business owners time to address an ADA violation before any legal proceedings can move forward.
ISSUE BACKGROUND The number of lawsuits filed under the ADA targeting property owners and businesses has grown by more than 63 percent in just one year. Further, in the past two years, the total number of lawsuits has grown to close to 10,000 nationwide.[1]
KEY MESSAGES • The hotel industry has always been committed to ensuring persons with disabilities are protected under the Americans with Disabilities Act (ADA) while staying at hotels across the country, since the inception of the law more than 25 years ago.
These so called “drive-by” lawsuits do not seek to increase access or eliminate barriers to enjoying the property or accommodations; rather, the actions often vaguely describe an overly technical or potential infraction and demand thousands of dollars to settle the case. Frequently, the settlement demand is only slightly lower than the amount the business owner would have to pay his own attorney to defend him in legal proceedings. This practice has become a cottage industry for bad actors to exploit small business owners as the same serial plaintiffs and attorneys have filed dozens even hundreds of these suits anticipating payouts, while never intending to stay at the targeted hotel. The ADA Education and Reform Act of 2015 would provide a “notice and cure” provision

New Retirement Savings Plan State Run Retirement Savings Plan for Employees Requires Large Employers to Register Soon.
J
uly 2017 marked the official launch of the OregonSaves pilot program, a state-run retirement program for employees of businesses who do not currently offer a retirement savings plan. For our members and others in the hospitality industry, we wanted to make sure you were aware of upcoming deadlines. Background In 2015, the Oregon Legislative Assembly enacted legislation, which created the Oregon Retirement Savings Board. House Bill 2960 tasked the Board with the establishment and oversight of a state-run retirement savings program providing employees with a flexible opportunity to save through payroll deductions and the ease of getting started with automatic enrollment and annual contribution escalation. The program, called OregonSaves, is overseen by the Board and is administered by the Board’s contracted plan service provider. The program will begin with a pilot in July 2017 with employers who expressed interest in participating and then roll out to employers statewide in phases, starting with the largest employers in January 2018. Website The new public website for OregonSaves is now live at Oregonsaves.com. The website includes general information about the program as well as specific information for savers at Saver.oregonsaves.com and for employers at Employer.oregonsaves.com. First pilot program The eleven employers selected for the first pilot program have now successfully completed the registration process for OregonSaves. Pilot employers get early access to the program, 14

Second pilot program Dozens of employers are scheduled to join the second pilot program. Registration for the second pilot will begin in August. Payroll deductions for those who participate will begin in October. The second pilot will help test the automation of the program for a wide variety of employers in terms of size and ways of doing business, helping prepare for the statewide launch. Roll out schedule OregonSaves is scheduled to roll out in phases starting with larger employers. The registration deadlines for employers are as follows: a. An employer employing 100 or more employees: November 15, 2017 b. An employer employing 50 to 99 employees: May 15, 2018 c. An employer employing 20 to 49 employees: December 15, 2018 d. An employer employing 10 to 19 employees: May 15, 2019 e. An employer employing 5 to 9 employees: November 15, 2019 f. An employer employing 4 or fewer employees: May 15, 2020 Employers with a deadline of November 15, 2017 received notices about the program from the State starting in July. In October, they will receive another notice with instructions about how to either register with the program or certify their exemption from it. They will have until November 15, 2017 to complete the registration or certification process. Payroll deductions for employees of those businesses that register by the deadline will begin in January 2018. Rules The first stage of the rulemaking process is complete for OregonSaves. The first set of rules can be found at Oregon.gov/retire/Pages/Rules.aspx. A second stage of rulemaking starting in June will consider technical matters that are not in the first set of rules, such as the process for joint employment circumstances. SAVINGS PLAN FAQ’s Is there a mandatory employer contribution? No, OregonSaves does not allow employer contributions. Is there a penalty for remitting payroll deductions late or not at all? Yes, failure to timely remit deductions violates Oregon law, including wage and hour requirements. The State may impose penalties for deduction violations. Can employees who participate in my qualified retirement plan also participate in the State's program? Not at this time. However, the State is considering how to provide this option for employees while keeping things simple for employers. Do family members who work for my business count as employees? Yes, if they are considered employees for tax purposes. Do I need to facilitate the program if I only have one or a couple of employees? Yes, all employers, no matter how many employees they have, need to facilitate the State's program for their employees if they don't offer a qualified retirement plan. Please note that very small employers will not be required to facilitate until the year 2020, and that OregonSaves is working with employers to consider how facilitation can be made as simple as possible. If a business owner or shareholder is also an employee of the business, are they eligible to participate? Yes, they can participate if they are considered employees for tax purposes. If I have employees in multiple states, including Oregon, do I just facilitate the State's program for those employees in Oregon? Yes, you would only need to facilitate the program for employees with income in Oregon. If I only offer my qualified retirement plan to some employees but not all, do I have to offer the State's program as well? No, if you offer a qualified retirement plan as defined in the OregonSaves statutes to any of your employees, you will file a certificate of exemption and you will not need to facilitate the State's program. Is it mandatory that employers facilitate the State's program if they don't offer a qualified retirement plan? Yes, any business with employees in Oregon that doesn’t offer a qualified retirement plan will need to facilitate the State’s program for its employees. Oregon is in the process of considering appropriate enforcement actions should such actions be needed to enforce the mandate.

Advocacy Done In Cooperation With Local, State And Federal Groups Achieve Better Results
G
overnment advocacy can, at times, feel like screaming over the sound of a hundred tumbling dryers. No matter how loud your voice is, no one seems to hear you. But what if there were thousands of other people in that laundry room, all talking at the same time? It would be much easier for your message to reach its intended audience.
That’s why ORLA works in tandem with national organizations whenever possible to advance policy priorities. “Anytime you partner with other people who have the same interests as you, you’re more apt to make a difference,” says director of government affairs Greg Astley. “Partnering with our national friends means we bring more to the table when we’re able to sit down and talk to folks at the state and national level.”

The lodging industry has a number of pressing concerns right now, including how to deal with online booking scams and drive by lawsuits. Now more than ever, it’s important to leverage partnerships to achieve progress on issues. National associations have a clear advantage when it comes to advocating for federal issues. “We’re a DC-based organization, so one of our strengths is the proximity and relationship we have with Congress and the administration,” says Troy Flanagan, vice president of state and local government affairs for the American Hotel & Lodging Association (AHLA), the nation’s largest organization representing the hotel industry. But associations can’t do their work without member support. “The best advocates we have don’t work in Washington, D.C.,” says Chirag K. Shah, vice president for government affairs at the Asian American Hotel Owners Association (AAHOA), the world’s largest association of hotel owners. “They live in the home districts and get to know their legislators. The people who are most important to these legislators are the people who vote for them.” “Since I’m a staff member of an organization, I’m seen as a hired gun,” says Astley. “Our members are the ones who are living the issue we’re talking about. I can share stories, but I’m not the one

who has to look that customer in the eye and say, ‘I’m sorry, we don’t have a room for you because you got scammed online.’ When our members see their members of Congress they can speak from direct experience. It does make a difference when you share those personal stories.” Flanagan agrees. “Those voices, and putting a face on what are often abstract issues, has been very effective in getting members of Congress to support legislation,” he reports. AAOHA and AHLA are currently working to pass legislation on two important issues: drive by lawsuits and online booking scams. The latter are scams run by individuals who set up websites and fraudulently sell rooms that don’t exist or are priced incorrectly. When the customer arrives at the hotel, the room they’ve been promised isn’t there. The Stop Online Booking Scams Act (introduced as H.B.2495 and S-1164) would help end this practice. “We’re working very hard to gather more co-sponsors so those bills can get committee hearings and move through the process,” Flanagan says. Individual hotel owners can be instrumental in getting their elected officials to add their names to the bills. Drive by lawsuits occur when an unscrupulous plaintiff works with an equally unethical attorney to send a letter stating that the hotel is in violation of the law (typically the Americans with Disabilities Act). They demand a relatively small amount of compensation, which owners often pay because it’s less expensive than fighting the issue in court. H.R.620, supported by AAOHA and AHLA, would take several steps to combat this practice. Associations work with hotel owners year-round to advance these issues, but once a year they make a concerted effort to bring people together to advance these issues in Washington. At a joint fly-in, lodging industry stakeholders from around the country come to Washington for a two-day conference. On the first day AAOHA and AHLA bring attendees up to speed on the issues they’re working on. “On the following day, we go to Capitol Hill as a group and present to our various members of Congress,” Shah says. The teams include industry representatives at every level, from executives at the world’s largest hotel chains to state associations to independent owners and their employees. This broad
representation gives members of Congress an idea of what the whole industry looks like, and shows the broad range of support for legislative priorities.
These examples illustrate that one person’s voice, when combined with others from around the state and country, really can make a difference.
Resources available through national associations can flow down to state and local advocacy efforts as well. AHLA and AAHOA sent representatives to ORLA’s Taste Oregon/Day at the Capitol, where they were able to share ideas and best practices with legislators during meetings.
Shah once worked for a member of Congress and saw this play out every day. “We would base our decisions on how many voices we were hearing from back home, whether it was letters or phone calls or conversations at town halls or parades,” he says. “If it was important enough for a person to write a letter from home, it was important enough for us to pay attention to it.”

They can help us model ourselves after things that are working and be cautious of things that are not working.”

And don’t worry that you have to memorize a million statistics or become a speaker on par with Abraham Lincoln to be effective. “Ours is the greatest story to tell in the lodging industry,” Shah says. It’s a story of entrepreneurship and the American dream realized, of hard-working people who create jobs and provide outstanding customer service and become leaders in their communities.

the labor shortage in the hospitality industry. Among all age groups surveyed, Millennials were the least satisfied with their job and the least likely to stay employed in the hospitality industry with 55 percent reporting that they would leave the hospitality industry within the next five years. In contrast, approximately 72 percent of respondents in older age brackets reported they plan to continue to work in the industry. However, there is no indication that this phenomenon only pertains to the hospitality industry as a 2016 Gallup poll found that across all industries “21 percent of Millennials report changing jobs within the last year, which is more than three times the number of non-millennials”.
Hospitality Labor Shortage OSU-Cascades Takes a Closer Look at the Hospitality Industry’s Challenges in Hiring a Workforce.
A
strong hospitality industry is fundamental to both Oregon’s and our nation’s economic prosperity. Tourism in Oregon is a $10.8 billion industry (Travel Oregon 2016) employing nearly 16 million workers nationally (U.S. Bureau of Labor Statistics 2017). And yet, it is estimated that there are close to 15,000 job openings in Oregon’s hospitality industry alone. According to Deloitte Center for Industry Insights’ report 2017 Travel and Hospitality Industry Outlook, the hospitality industry is entering an era of growth with global business travel spending hitting a record-breaking $1.2 trillion in 2015, up five percent from the previous year. While hotels, airlines, and other travel segments are particularly vulnerable to the ebbs and flows of economic conditions, the U.S. leisure travel market saw its fourth straight year of five percent growth in 2015, reaching $341 billion. Even stronger growth is projected for 2017, pushing the 32

combined travel and hospitality market closer to $381 billion by the end of 2017. Despite this favorable outlook, the industry will likely face some familiar, yet significant, challenges. Not least among these is talent, as a labor shortage weighs heavily begging the question why there is a labor shortage in the hospitality industry in the first place? And, what are some possible solutions to this labor shortage? Authors of the current research embarked on a labor shortage study seeking to answer these pressing questions. An online survey was conducted from February 20, 2017, to April 10, 2017, utilizing employees who currently work in the hospitality industry as a sample population. In the end, 163 employees responded from 55 hospitality companies across the country. Millennials in the Hospitality Industry Survey findings indicate that Millennials (age 18-29) are the primary reason for
Millennials See Benefits Differently The current study also asked respondents about the importance of specific employee compensation benefits and found that Millennials value a dynamic workplace culture and promotional opportunities above all other benefits. Although, benefits such as salary and employee healthcare were also deemed important. One industry executive explained, “Talent availability seems tight, it’s becoming increasingly challenging to retain talent, and salary expectations seem to be rising steadily, especially from the younger generations." Millennials Want Fast Upward Mobility and Task Variety The current study found Millennials want career development in their job with 64 percent of respondents viewing leadership and management skills as the most important skill to attain their five-year goal. This finding is supported by the previously referenced Gallup poll, which also concluded that Millennials “are not pursuing job satisfaction; they are pursuing development.” The same poll also concluded that Millennials have “little patience for upward mobility.” In other words, Millennials view their current job as a means to reaching their ultimate career aspirations, and when they no longer feel that they are developing, they look for new employment opportunities.
The current survey also found that 74 percent of Millennial respondents, who were least likely to stay in the hospitality industry over the next five years, valued task variety in their job. However, many entry-level jobs in the hospitality industry, like housekeeping, front desk, servers, etc. are routine in nature and likely contributing to Millennial job dissatisfaction. Future Forward The big question facing the industry remains whether Millennial workplace preferences are merely a fad or instead, a long-term workforce trend. During qualitative interviews that accompanied the current study, more professionals in the Oregon area stated they believe this is a long-term trend. Meanwhile, across the country, journalists would have to agree as in articles such as, “Myth of the Millennials or Trend of the Modern Employee” that argues future generations will be more like Millennials than like previous generations. This perception is particularly worrisome for the hospitality industry. Like all service-oriented organizations, the company is only as good as the people they employ; if the industry is unable to meet its staffing needs with engaged and quality team members then service quality levels, operational effectiveness, and growth opportunities will be severely impacted. In the coming years, the labor challenge is only likely to become more difficult to address. Increased competition and more informed customers with higher service expectations will only increase the need for engaged and high-quality staff. If the hospitality industry is unable to acquire and retain the necessary talent, then the industry is at a tipping point and must address these challenges now to succeed long-term.
and corresponding solutions will vary as well. However, at a high level, each organization needs to ask itself some basic questions: 1. How severe is our labor shortage and how are we doing relative to our competitors from a labor perspective? 2. Is our Human Resources Department a competitive advantage? If not, can it be? 3. How can we align our company culture with the modern workforce? 4. Have we leveraged technology enough to augment service and reduce routine tasks for our employees? Although responses to the questions above will vary, it is likely a two-prong approach is needed to succeed. First, hospitality companies must turn their Human Resources initiatives into a competitive advantage by building a dynamic workplace environment and culture that is aligned with the values of the modern workforce. This includes reevaluating existing hiring practices, the promotion process, career development, and workplace culture. However, to create a sustainable, longterm competitive advantage, hospitality organizations must also address the routine nature of many entry-level staff jobs that are the hardest to fill. As a result, companies will need to take advantage of lower cost technology and automate routine job tasks. The airline industry has fully embraced this concept and is already deploying automation technology across its operations. To implement this strategy at the operational level within the hospitality industry, an organization will need to ask this basic question before it posts each new job: Do we need another hire or can this job be automated through technology? Leashing Up Your Pet Policy Taking a Proactive Approach to Pets on Premises

ncreasingly, pets are viewed as part of a family, and as a result, it is important for your facility to address your position as it relates to pets on premises. Establishing a pet policy is a good start to proactive risk management.
COMPLAINT/INCIDENT PROCEDURES • Investigate, document, and report all incidents. • Train staff on how to handle the complaints and incidents.

Make written copies of the policies available to your guests and make sure all employees are trained on the policies. If you allow pets at your facility, having a clear expectation of the care and control of the animal will help to keep all guests staying at your property safer and comfortable. HAPPENINGS FROM AROUND THE INDUSTRY TRAVEL OREGON APPROVES STRATEGIC PLAN
RETIREMENT SAVINGS PLAN REGISTRATION DEADLINE
The biennial strategic plan for Travel Oregon was developed with extensive involvement from Oregon's travel and tourism industry, community leaders, members of the Tourism Commission, the Travel Oregon team and others. Input, derived from an industrywide survey, more than two dozen town halls, a public hearing and other meetings held throughout the state, was combined with current industry research on global and domestic trends and forecasts. The plan was designed to give partners a substantive look at the strategic priorities that will guide Travel Oregon for the next two years and provides context for Travel Oregon's strategic imperatives, initiatives and measures. OregonSaves, the new state-run retirement program for employees of businesses who do not currently offer a retirement savings plan, officially launched in July. Employers with 100 or more employees should have received their first notice from the State end of July, and have until November 15, 2017 to register with the program. The program will roll out for smaller businesses through 2020, with the next employer group (50 to 99 employees) required to register by May 15, 2018. Payroll deductions for employees of those businesses will begin in January 2018. Employers must collect and remit the payroll withholdings each pay period to the State. This will create additional paperwork for employers to deal with staff. The program is funded into IRA’s and does not allow employer contributions. Visit OregonSaves.com for details.
FIGHTING SEX TRAFFICKING IN OREGON Guardian Group’s Jeff Keith testified alongside Jason Brandt, President & CEO of ORLA, in support of three separate anti sex trafficking bills, eventually passed by the House in Salem last month. The goal of these House Bills was to have stricter penalties for pursuing illegal acts such as purchasing sex, and in many cases from minors. There are now nearly 40 companies within the hospitality, property management, cleaning and security industries who have purchased the Guardian Seal Training, which equips hotel personnel with the proper tools and understanding of this crime to enable them, and other hoteliers across the nation, to disrupt it.
