ACCEPTANCE OF ORDERS

The customer agrees to the following terms by ordering from Pan American Nursery Products Inc. TERMS - New accounts are requested to make full payment 14 days in advance of shipment for a minimum of one season, or until credit has been approved by our credit department. Established accounts are payable 30 days from invoice date. A service charge of 1.5% per month will be payable for all overdue accounts. A charge of $35.00 will be assessed on all returned cheques. ORDERING - Orders should be placed well in advance to reserve quantities and ensure on time delivery. Orders are acknowledged subject to crops’ growing conditions and are accepted without liability for non-performance. Order cancellations are subject to a 50% re-stocking fee on custom orders and 20% re-stocking fee on regular orders. MINIMUM ORDER: $1000.00. Administration fee of $100.00 on orders under $1000.00. PRICES - All prices are subject to change without notice. Volume discounts only apply to accounts paid within 30 days. All prices (listed on the order forms) are F.O.B. our warehouses (Surrey - BC, Millgrove - ON and Niagara-on-the-Lake - ON) and are subject to change without notice. SHIPPING - We will use our best judgement (normally pooled with other deliveries in your area) when shipping, unless special arrangements have been made. CLAIMS - Claims regarding quality of stock must be reported to our office within 14 days (30 days for dormant stock) of receiving product. All returns must be approved in advance by contacting our customer service department within 14 days of receiving product. Because we have no control over the environment in which your product is stored after leaving our premises, we will not accept any returns for damaged, frozen, or overgrown merchandise. You may file a claim with the carrier and notify our office to render any possible assistance. LIABILITY - Pan American Nursery Products Inc. will in no way be liable for any amount greater than the amount paid for said nursery stock.
