“God Grant me the serenity to accept the things I cannot change, the courage to change the things I can and the wisdom to know the difference.” Widely attributed to 20th century American professor, seminarian and philosopher Reinhold Niebuhr, who used it in sermons in the early 1930’s. The short first verse of the Serenity prayer became more widely known after being brought to the attention of Alcoholics Anonymous in 1941 by an early member. Courage, wisdom and serenity are admirable traits in our culture. We have long tried to choose leaders we think have courage and wisdom. Niebuhr was a favorite of President Obama’s. He shaped the first year of his presidency after Niebuhr’s philosophies. A 2010 CNN Politics article reports “In a 2007 interview, Obama explained to David Brooks, a New York Times columnist, what he learns from Niebuhr. He called Niebuhr his "favorite philosopher," Brooks wrote. "I take away," Brooks quoted Obama as saying, "the compelling idea that there's serious evil in the world and hardship and pain; and we should be humble and modest in our belief that we can eliminate those things. We shouldn't use that as an excuse for cynicism and inaction. I take away ... the sense that we have to make these efforts knowing they are hard, and not swinging from naive idealism to bitter realism." Other scholars say Obama's efforts to balance idealism with realism can be seen in his Nobel Peace Prize acceptance speech in Oslo, Norway, in December. Obama, a student of the civil rights movement, declared that he was a "living, testimony to the moral force of nonviolence. Yet force is necessary at times.” "A nonviolent movement could not have halted Hitler's armies," he said. "Negotiations cannot convince al Qaeda's leaders to lay down their arms." It is hard to believe November is here already. We know we are not the only ones anxious to see the national election over. Nor are we the only ones who wonder how the “best democratic political system in the world” in a country of 325,000,000 people (www.census.gov/popclock) cannot present a presidential candidate or two that the voters would actually be proud and excited to vote for. However that works out, the local election season is just beginning and it promises to be an interesting few months on the barrier islands. There are matters to deal with on the barrier islands. More in upcoming issues. In this issue, we are excited to introduce you to the NEW MadFish, which has propelled itself to the top of local epicurean’s favorite places. It still looks like a diner outside, but get inside and try the food. We also welcome Mastry’s, St. Pete Beach’s first Brewery, now open on Blind Pass Rd., and Thirsty Pelican Tours which takes tourists and locals on Brewery tours. We also welcome the Tampa Bay Ferry service which are beginning to provide rides with nine stops from Madeira Beach’s Rec. Ctr. south to the dock behind MiddleGrounds in Treasure Island, including a stop at Publix in Madeira Beach, Hubbard’s Marina at John’s Pass and Native Lands at the Jungle Tavern on Park Street near 22nd Ave. N among others. Departures are at 10 and 1, 4 and 7 from both the north and south ends. It must be the month for ferries, as the Cross Bay Ferry also premieres, connecting Downtown Tampa at the convention center to Downtown St. Pete’s Pier approach on the Vinoy Basin, beside the St. Petersburg Museum of History, for $10 each way. LETTERS Treasure Island is slowly being strangled by the inability to redevelop its ageing tourism properties. Many of the properties are in dire need of updating, and their condition drags down other better properties by forcing them to compete, while dragging down the community as a whole. Just a paint job is not going to fix the problems facing the Island’s commercial zone. These worn-out and outdated tourist dwellings need to be replaced with modern tourism units with amenities desired by today’s travelers, who have higher standards and expectations. Under current regulations, that is impossible. Sadly, if nothing is done, these once profitable mid-century properties will become blighted, derelict ghosts of the past. There are 6 referendum questions on the November 8th ballot, dealing with redevelopment within a small, defined area, and incorporate a Planned Development Zoning District. Perhaps the most important ones pertain to height and density. The City is asking for 24 more feet of height, which would increase a tourism structure from 5 to 7 floors, and adjustments related to density in the PD Zone. The charm of a community does not lie in the height of its structures. It is dependent on the warmth and caring attitudes of residents, the quality and success of its businesses, the feeling of trust and reliability in local government and the sense that everyone wants to help make the community the best it can be. The charm of Treasure Island is best maintained by improving and upgrading

those 40, 50 and 60 year old properties. There is nothing charming about old and decaying buildings. Without these changes, the operation of the city will fall on the shoulders of its residents by way of increased property taxes, and\or there will be diminishing services. No one wants to see Treasure Island turn into a Clearwater Beach. The request in the PD Zone is simple; 24 feet of height, and an increase in density, not through the entire City, but in a small, clearly defined commercial area. This inability to redevelop has led to a noticeably negative effect on tax revenues. In 2015, Treasure Island ranked LOWEST in evaluation increases of all beach communities. The values of redeveloped properties will lead to an increase in property tax collections. Redevelopment will also increase the other tourist taxes, and the benefit of direct spending on food, retail and other businesses, as well as creating job opportunities in the community. Tourism provides diversity, vibrancy, job opportunities, more profit for our existing businesses, and the benefits the tourist dollar provides throughout the cities and counties are tremendous. Each household in Florida would be taxed an additional $1,535 annually to replace the tourism taxes to the state and local governments. The iconic Casino has been a symbol of Gulfport for decades. Originally the southwestern terminus of the St. Petersburg Trolley Service at what was for a time known as Disston City, ferries took beachgoers to Merry Pier in Pass-A-Grille and steamships connected to Tampa and to numerous distant ports. We will cut off registration at 120 which is about all that we can put up in our boats at BCYC. It is the biggest and most complete regatta in the southern region of BSA. We offer racing on Sunfish and 16 ft. sloops and we hold 14 maritime skill events to challenge the teams and test their boating knowledge and skills. www.sailbcyc.org/ Gulfport Community Support Grants The Gulfport Merchants Association (GMA) has announced a call for applicants for its 2017 community support grant program. “This is a great day for Pinellas County, but an even greater day for the residents of Pinellas County” who will use the service, U.S. Rep. David Jolly said in announcing the award. Jolly, a Republican who represents Florida’s 13th Congressional District, said the grant was an example of bipartisan collaboration. KUDOS TO US: A recent Brookings analysis identified Tampa Bay as one of 16 "American Middleweight" metros that make up a global mix of 123 large cities. The Washington, D.C., think tank sorted them into seven categories based on such competitive factors as their tradable economic clusters, innovation, talent and infrastructure connectivity. FORECLOSURE REGISTRY APPROVED: In an effort to minimize the impact of foreclosed properties that may not be properly maintained, the Pinellas County Board of Commissioners recently approved an ordinance requiring the registration,

inspection and maintenance of foreclosed homes. The ordinance, which goes into effect Jan. 1, 2017, applies to properties in unincorporated Pinellas County that have been foreclosed on or are entering foreclosure. It requires that they be registered with the county and periodically inspected by the registrant to ensure they are being maintained. The registry will include the name and address of the mortgagee, the registered agent or the property manager’s contact information. This will allow county staff to easily identify a point of contact responsible for maintenance issues on a foreclosed home. The goal of the registry is to reduce the need for recurring code enforcement actions against foreclosed properties, avoid detracting from the character of existing neighborhoods and ultimately, return these properties to the market in viable condition. Once the ordinance goes into effect, the mortgagee will have 30 days to register the property. Failure to register could result in a fine and code enforcement actions may be taken on properties that do not address maintenance issues. Chef Oliver and sister Ella bought "MadFish" about 18 months ago and they have transformed the shiny diner into an elegant dining destination. Most often you enter a restaurant expecting the inside décor to match the outside. Not so at MadFish, a cozy-looking streamlined diner located at 5200 Gulf Boulevard about three blocks south of the TradeWinds Resort on St. Pete Beach. The inside décor is beautifully appointed, with gleaming wood booths, a shiny tin ceiling,

FEATURYE STOR Remembering the SPB Aquatarium STORY by STEVE TRAIMAN

T

If you lived on St. Pete Beach from 1964 to 1977 you should have fond memories of one of the country’s leading marine attractions.

The Aquatarium was built by Marine Attractions Inc. on 17 acres on what was then St. Petersburg Beach, between 64th and 66th avenues, right on the Gulf of Mexico. It was built somewhat on the plan of the Miami Seaquarium, with a signature 160-foot-tall golden geodesic dome. The Aquatarium opened in 1964, with its main attraction being shows featuring trained porpoises, sea lions, and pilot whales. Shows were staged under the dome, which sheltered the audience from the sun as they were seated around the world's largest circular marine tank 100 feet in diameter and 25 feet deep, containing 1.244 million gallons of seawater. The Aquatarium shows were billed as "The World's Greatest Marine Show," or "World's Largest Marine Attraction," and starred a dolphin named "Floppy." She was famed for her 25-foot leaps into the air, leading to her characterization as "the worldchampion high-jumping dolphin."

A Zoological Garden was added several years after the opening, with Bob Campbell as director and it became a favorite visitor site on its own very quickly. In 1968 Frank Cannova, a local hotel owner, bought the Aquatarium for $2 million, just in time to watch tourism in the area decline as Walt Disney World opened and the gasoline shortages of the 1970's hit. An attempt was made to rebrand the Aquatarium as "Shark World" in the mid-seventies following the release of the blockbuster movie “Jaws” in 1975, but that was little help. After city zoning officials refused to approve the construction of a waterslide at the park, it closed at the end of the 1977 summer season and was eventually torn down to make way for what is now the Silver Sands Beach & Racquet Club condominiums.

Grady Marlowe's collection boat was equipped with an ingenious ‘ice tongs’ device on a long pole which allowed deep water Dolphins (spotted) to be captured safely.”

Many Local Memories A number of local, long-time residents and civic activists have more direct memories of the Aquatarium. Julian Fant, former Treasure Island Mayor and general manager of the first Treasure Island Chamber of Commerce, had lived in St. Augustine where he had been involved with its Marineland attraction (see Paradise News, March 2016 issue).

Julian first visited Marineland at age 7 with his Dad, and recalls riding with other neighborhood kids about six miles to a salt water lagoon near our homes to watch the secretive training of the first dolphins to enter Marineland's daily shows. He recalls,“Marineland was also the scene of a feature movie, ‘Revenge of the Creature’, In which I had a romantic ‘lover's lane’ scene and it was the debut of a young man who played a lab technician … his name was Clint Eastwood. “In my native St. Augustine Carl Selph and I became good friends. We were both members of the Jaycees, which had its annual awards banquets at Marineland's restaurant. Carl became GM, and I was a broadcaster with the local radio station, WFOY.” “After moving to Treasure Island and when I resigned as TI Chamber manager, I was visited at my office by none other than Carl and Cliff Ball, a son of the Aquatarium's founder. They hired me as PR director to help launch the attraction in the early 60s. I was successful in placing a number of feature articles, as well as having an attractive

Aquatarium officials gave their approval, and I was elected at the age of 33, in 1965 and the rest, as they say, ‘is history’.” Laura Campbell and her husband Bob are long-time residents. She has operated the Poodle Palace in the same location since the 1970’s at 6660 Gulf Blvd. Bob was in charge of the Zoo, which the Aquatarium added several years after the opening, and it became a favorite visitor site on its own. He has many good memories of the zoo, and is very proud of the time he spent with the marine and other animals that were a big hit at the Aquatarium. Mike Cannova, the son of Aquatarium owner Frank Cannova, is also a long-time resident of St. Pete Beach. He remembers when his dad bought the attraction, and the many happy hours he spent at the Gulffront location. For Julian Fant, his memories of both the St. Augustine Marineland and the SPB Aquatarium are still very special pieces of his long-time service to his communities. Thanksgiving Feasts Made Easy By Nanette Wiser In our family, we like to run the Turkey Trot on Thanksgiving morning or volunteer to help feed those in need. Giving back is the reason for the season and a good way to say thank you to our community. For those with little time to prepare or hosting visitors, why not create a feast with the help of local restaurants, grocers, liquor stores and specialty shops. Pick up olives and cheeses at Earth Fare, centerpieces at Lou’s Florist and desserts from Sweet IRB. Every good hostess has a secret posse, and here’s a curated guide to some of our secrets. • Start a tabletop memory cloth. Set the holiday table with a white cotton cloth and jars of fabric markers. Then encourage guests to create personal place settings before the meal, signing their names, drawing pictures or writing messages to enjoy every year. • Thanks with a twist. Have each person write something they’re thankful for on a slip of paper and sign their name on the other side. Wrap the slips in crescent-roll dough and bake. At the table ask everybody to share the message inside their rolls.

Closing Adventures by Tom Brodersen, Esq. Get Real about Property! Travels through Real Estate Law Every real estate transaction, and every closing, has a life (and personality) of its own. Many are relatively ordinary, and therefore easy, others are much more challenging. This week we closed a transaction that was one of the more challenging we’ve seen in a long time. As“personalities” go, I guess you could call it a Grinch! As the Sellers were nearing the end of a nasty divorce, communication was very painful. Last minute marital issues included various pieces of furniture and personal property, liability for closing costs and tax issues on the proceeds of the sale. There were problems with the lender, partly based on a disappointing appraisal (not at all unusual), but the valuation really didn’t seem to fit with the very desirable property

location and features, so I ended up talking at great length to the appraiser, after doing hours of analysis of the comps, etc. myself. All this was after driving all around the neighborhood of the property, as well as the comps. The home inspection led to questions that wound up involving an engineer. The issues weren’t actually important, but it sounded bad, so it was bad. Not surprisingly, we ended up negotiating with the engineers, too. All these issues led to delay after delay, therefore, amendment after amendment of the sales contract. Both Realtors had to accept reductions of their commissions, which is never any fun. During this time, the relationship between the Sellers and the listing broker broke down to the point that all communications had to go through me.

All told, the deal was declared all but dead about a dozen times (but never by me!) We just kept calmly working at solving the various problems and challenges, and though it looked dubious right up to the end, we finally did get it successfully closed, to everyone’s delight. Most of what we did to hold this deal together were things a title company would never do, and, in fact, is not licensed to do. The bottom line is, you do get more when you close through a real estate lawyer, and, contrary to many, real estate lawyers are NOT deal killers! I must say, the showing agent was a trooper throughout, and helped (and encouraged) me all along. So was Barbara Trawinski, our in-house licensed title agent/closer. There’s a lot to be said for a great team. The best thing you can say, though, is probably that WE GOT THE JOB DONE!

Brandon Kuntz and buddy Joey Willet were also fishing the north Jetty of Johns Pass this week using live white bait. Brandon caught a beautiful speckled trout and Joey caught a big mackerel too. The white bait is thick inside the pass and the trout, snook and mackerel are still tearing up the bait in the pass and on the beaches. Kingfish are now on the beaches as well. Justin Winkelman, from Seminole, caught a nice nearly 30lb king from the Reddington long pier using a lady fish for bait. Justin also caught a monster black drum using live shrimp. Near shore- Mackerel and kingfish will be the headline of the near shore fishery while they are doing their fall run by our area. This past weekend’s Wild West kingfish tournament by Angler armory was very successful with the big kingfish weighing in at nearly 55lbs. we’re also getting big kingfish & mackerel trolling out during our 5 hour half days and flat lining during our deep sea fishing trips on the party boats and the private charter too! Hogfish are biting very well right now averaging nearly a half dozen or more on each trip. The grey snapper bite is steady. Having a cold front blowing in will make the water a little dirty and chillier so the fish will be a little picky. Offshore- The weather has been a little tough offshore due to the strong east breeze making the offshore waters a little bumpy and breezy. However, we were able to make it out to the 39 hour areas on the 12 hour extreme aboard the Flying HUB 2 and they caught some beautiful big red grouper, gag grouper, scamp, kingfish and vermillion snapper. plenty of keeper fish in

We have noticed that some of our local Boca Ciega Bay dolphins have headed down to the mouth of Tampa bay and were seeing them as a part of large pods spotted hunting mullet leaving Tampa bay while riding out to Egmont Key from Fort De Soto bay pier. Manatees are making their pilgrimage out of the area to northern springs and power plants to stay warm for the winter. Pinellas Barrier island real estate has very unique characteristics that differ significantly from mainland properties. Before selling, follow these simple steps. First, get your Pinellas property appraiser info from PCPAO.ORG and make sure it’s correct. Second, see what the internet thinks it’s worth. Zillow.com, Realtor.com Smarthomeprice.com, and trulia.com will give you an idea of what your property might sell for today. These estimates are often wrong but your potential buyers use these sites to help them make offers to you. Third, get opinions of value from 2 or 3 local agents who should provide this service for free. Make sure you chose an agent who represents you as your personal “fiduciary agent” rather than those who represent both seller and buyer as transaction agents. Fourth, compare marketing plans and pick an agent you trust or decide to sell yourself as a FSBO. “Make me move” on Zillow.com is a good place to start if you decide to begin the process yourself. I don’t generally

recommend this because most buyers deduct a standard real estate commission from their offer and you lose the negotiation power that good, trustworthy agents provide. Also, consider getting a current elevation survey so you can confirm flood insurance rates. This survey will cost about $150. Make sure your lot size is correct because waterfront lots in our beach towns are sold by the front foot. About 25% of the homes are built with the living area elevated and are worth considerably more than the 75% that are flood prone. You may be wiser to build a new house on your lot rather than sell the old one. Many banks will finance 100% of construction costs for a new home for you at low interest rates. In many of our beach communities short term rentals are allowed. You can get as much or more for a weekly rental as others get per month. Renting may be a better alternative than selling for some. Management rates run from 10-20% or you can do it yourself. Rental rates are increasing as more people prefer the flexibility of renting over home ownership. Finally, to avoid unpleasant surprises, be sure to thoroughly check out where you’re moving to.

Egmont Key Island has recovered quickly from the recent brush fire that occurred on the island thanks to a lightning bolt. This fire burned away much of the brush and the trunks of the trees on the island. However, the trees now have lush green tops and the cleared out brush areas have allowed visitors, to more easily spot the islands wildlife. The Bald Eagles are back in the area and we have a nesting pair on top of a local cell tower. You can spot these beautiful birds of prey from our dolphin watching nature cruise and eco tour at Hubbard’s Marina. Local pelicans are starting to show off their mating plumage again inside upper Boca Ciega Bay. These yellow heads are great to see again and marks the start of their fall nesting season. Sticker Shock, Year After Year…… by Tom Smith - GHD Construction Services, Inc. Although most real estate professionals tend to quote home values based strictly upon the living area square footage of a home, this is at best an “average” valuation that doesn’t take into consideration many factors in a home. Is a home elevated per FEMA requirements, how many bathrooms, age of the home and especially all the additional square footage of roofed area for porches, garages, veranda’s, etc.. These are all factors that have to be considered in order to obtain an accurate home value. With that in mind, how does an informed customer determine a realistic value for a particular home? Equally important, how does a prospective home buyer accurately determine the increased cost of a new home in Pinellas from last year, this year, or a possible future cost should they decide to wait 12-24 months to build their dream home? There are in fact statistics that we see in the Sunday newspapers stating inflationary costs, and these prove to be somewhat accurate based upon the “average” living area square footage. However, what is a realistic and true cost increase for a new home today? I’m glad you asked! Being the only

builder with a model home along the beaches in Pinellas, for the exact same home with the exact specifications, I am experiencing inflationary cost increases each quarter and the reasons for these uncontrollable additional costs vary. For instance, last year new building codes went into effect, mandating new construction items. Then, “creeping inflation” is the curse in our industry, as prices escalate based upon volume and supply and demand. Government has also been a culprit, as new impact fees get passed in certain municipalities raising costs sometimes thousands of dollars per home. Try as we do, these items are not controllable by contractors. What does this mean in dollars and cents? Doing everything I can to keep costs as low as possible for my customers, our model home has increased about 11% this past year. That’s great for those that already purchased at the lower price and are enjoying the 11% return on investment, much higher than they realize in their stock investment portfolio. It’s not so good for those that are seriously considering a new home, but did not pull the trigger last year. My best “guestimate” is that our industry will experience a 6% - 9% home cost increase in 2017.

Some folks are waiting for retirement which is understandable, yet many of my customers are buying at today’s price, realizing that when the home is complete, they are one year closer to their retirement years. I realize how difficult a decision is to invest (transfer) savings into a new home investment, but remember that a new home along the Pinellas beaches will most probably offer a much higher return than today’s stock investments. And…… you end up with a beautiful new energy efficient, hurricane resistant raised home for your family to enjoy for generations to come. Medicare late enrollment penalties General eligibility By Steve Reiser, CFP® Most eligible Medicare Beneficiaries meet enrollment date requirements in Part B and Part D by either a voluntary or involuntary benefit election based on one of these likely triggers: eligibility prior to 65 after receiving SSDI for 24 months, turning 65 (aging in described below) or at a later date because the individual had other credible coverage in place beyond 65. Two examples of credible coverage are Employer Group coverage and VA benefits. However, I routinely find that some Medicare Beneficiaries have subjected themselves to late enrollment penalties because of a gap in credible medical or prescription drug coverage. Important Dates Medicare Beneficiaries become eligible for Part A Hospital, Part B Medical and Part D Prescription Drug coverage on the first day of the birth month in which he/she turns 65. This is commonly referred to as your aging in date. In the event your birthday falls on the 1st, your eligibility starts on the 1st of the preceding month. Since Part A is normally free to those that have met the 40 quarter requirement, the effective date usually coincides with the 1st as described above. If drawing your social security at 65 or earlier, you can expect to receive a Medicare card showing automatic enrollment in Part B with the same effective date as Part A. The monthly cost of Part B is $121.80 for most retirees. Part B Penalty If you don't sign up for Part B when you're first eligible due to disability, aging in or termination of credible coverage, you'll have to pay a late enrollment penalty once enrolled in Part B. Your monthly premium for Part B may go up 10% for each full 12-month period that you could have had Part B, but didn't sign up for it. Also, you may have to wait until the General Enrollment Period (from January 1 to March 31) to enroll in Part B and coverage will start July 1st, of that year. Part D Penalty The cost of the late enrollment penalty depends on how long you went without Part D or creditable prescription drug coverage. Medicare Advantage plans typically include credible Part D drug coverage. The penalty is 1% for every month you were eligible but lacked enrollment. In 2016, the Part D penalty is calculated by multiplying 1% of the "national base beneficiary premium" ($34.10 in 2016) times the number of full, uncovered months you didn't have Part D or creditable coverage. The monthly premium is rounded to the nearest $.10 and added to your monthly Part D premium. As the national base beneficiary premium increases each year, your penalty amount may also increase each year. *Expires December 7, 2016

The “Veterans Day Fall Fly on TI” is slated this year for November 12th & 13th on Treasure Island Beach behind Thunderbird Beach Resort. The theme for the weekend… “Honor America’s Veterans”, featuring red, white & blue kites, banners and flags galore. This free, family-oriented event will feature general kite flying, kite games, stunt kite lessons & demos as well as a chance to honor Veterans by flying a kite.

There is no formal competition, however, new and experienced flyers are encouraged to bring out their best Red, White and Blue and share the freedom of kite flying by sharing kite knowledge and including the public. Each day there will be two different, 15 child kite making classes held at the Thunderbird Beach Resort. Sign children up for these classes on the beach upon your arrival at the Windworks Tent.

Kite festival will launch morning of Saturday, November 12th, and continue thru the weekend. After dark on Saturday, kite flyers are urged to add lights to their kites for a night fly.
