s you are reading this magazine we are beginning a new year. As the MPMCA Board looks forward to what the New Year will bring, I would like to take this time to extend my sincere appreciation to the efforts by our Board members throughout this past year, as they helped guide our organization. This is also an excellent opportunity to express our collective pride in the work of our staff, Executive Director Cynthia Maher and her assistant Sharon. This has been an extremely busy year, particularly as it regards the legislature. Numerous amounts of legislation have been introduced this year, particularly as it regards licensing and the construction bureau. At the forefront of the negotiations on these bills has been our Lobbyist Cynthia Maher. Working with other Construction Association Executives they were able to have changes made to the legislation for the protection of our industry.
Brunett. Mike’s commitment to the industry, to our Association and the Greater Michigan PMC was wellknown. That untiring commitment was especially evident in his career with the John E. Green Company where he was family and will be missed. Mike Brunett was a unique individual who improved the industry through his years of service. With his commitment, dedication and participation our industry has benefited greatly. Mike received the prestigious MPMCA Contractor of the Year Award in 2004. He served on PMC’s Board of Directors for the past 25 years and retired as Chairman of the Board. Having worked with Mike as a member of our PMC Association, we thank Mike for the countless hours he gave to the industry that provides a livelihood for all of us. Mike, we are honored to have had you as part of our lives. You will be missed!

Christmas Dinner Past Presidents’ Annual
Eight Past Presidents and spouses gathered together for their annual Christmas Dinner at the Soaring Eagle Isabella’s restaurant on Thursday, December 1, 2016.

The Past Presidents have been doing this annually since the early 1990’s, beginning at the Huron Valley Hunt club, moving after several years there to Heritage House Restaurant in Chesaning until they closed their doors. They then tried Bavarian Inn in Frankenmuth one year (they were jammed into a very small room). This prompted them to move the event to The Embers in Mount Pleasant for a couple years. They ended up closing and then the Past President’s moved to the Soaring Eagle, which seems to be a great fit for the group. The dinner and the once-a-year get together was thoroughly enjoyed by the group and they look forward to next year and hopefully to see several faces they haven’t seen in a little while.

Is Voluntary Attendance During FMLA Allowed? QUESTION: We have an employee on FMLA who is required to have an updated CPR certification for licensure purposes. As an employer, we outsource CPR vendors who come into our clinics to recertify employees. This employee is on maternity leave and fully released to return to work with no restrictions, however the employee is on her last weeks of child bonding. The employee wishes to come in to one of our clinics to recertify CPR. Should we allow the employee to take the CPR course even though the employee is on FMLA? Would we be violating the employee rights even though it’s the employee who wishes to attend the CPR course? RESPONSE: If the employer agrees to it, we are not aware of any law that would prevent the employer from allowing the subject employee to voluntarily return to work for the CPR certification course prior to the conclusion of her Family and Medical Leave Act (FMLA) leave. It is up to the employer to decide whether to require that she conclude her FMLA leave as of that time or resume the leave when the CPR training ends. Employees who are eligible for FMLA leave and who seek to use it in connection with bonding with a newborn or newly-adopted child or a child placed in foster care can take as much leave, up to 12 weeks, as they so choose (assuming they have not previously utilized any FMLA leave in the same 12-month period). Leave must be provided continuously when it is taken for this purpose, but employers are not required to provide leave on an intermittent or reduced schedule basis for this reason unless the employer agrees to do so. Thus, if the subject employee is presently on continuous FMLA leave to bond with a newborn baby and is medically cleared to return to work, then if she would like to return to work to participate in the CPR class, we are not aware of any law prohibiting her from doing so. If she wishes to resume whatever remaining FMLA she may have after the course completes, she can do so only if the employer agrees, because this arguably would be in the nature of intermittent leave under the Act (see page 52 at https://www.dol.gov/whd/fmla/employerguide.pdf ). If the employer agrees to the arrangement, it should be cognizant of the precedent it is setting, as others may want – and expect – a similar accommodation in the future. (We assume from the inquiry this is the first situation of its kind. If it is not, the employer should follow its past practices to avoid discrimination and retaliation concerns here.) JOHN KOONTZ SEMINARS The WMMCA sponsored two seminars on October 4, 2016 presented by John Koontz. John conducted a Planning Skills for Foreman workshop in the morning followed by a Productivity Improvement for Mechanical Projects workshop in the afternoon. Participants of both seminars took away practical tips of the trade. The use of Local 174’s assembly hall for the training was greatly appreciated. John is scheduled to return April 11, 2017 when he will be teaching two courses: The Foreman’s Role in Project Documentation and Essential Management Skills for the Project Foreman. MICHIGAN SERVICE & MAINTENANCE OVERSIGHT COMMITTEE UPDATE The Michigan Service & Maintenance Agreement Oversight Committee met in Lansing, October 13. Topics discussed included: Michigan Schedule A, training, recruitment, Flint status update, retirement of Gary Young UA International Representative. Russ Borst, Hurst Mechanical, is the WMMCA contractor representative. His time and energy spent on this committee is appreciated. MEMBERSHIP AND LABOR MANAGEMENT MEETINGS Membership meetings were held in September and November. Topics covered in these meetings include committee reports, updates from affiliated associations including the MCAA, MPMCA, and NCPWB, Local 174 activity and more. These meetings are a great networking opportunity. The Local 174 Management of Jeff Wilkerson, Bob Barnett, Jason Finch and Chris Pelton met with contractors for a Labor Management meeting to discuss work opportunities, substance abuse testing, apprenticeship, a new job classification and more. These meetings offer an open dialog between labor and management. [ 30 ]
