Casey Leads Fight for $45B in Opioid Crisis

O ADDRESS a number of critical shortcomings of the nation’s approach to combating the opioid epidemic, including the Trump Administration’s unwillingness to make a long-term investment in the fight, U.S. Sen. Bob Casey (DPa.), joined by colleagues Ed Markey (D-Mass.), Dianne Feinstein (D-Cal.), Bob Menendez (D-N.J.), Sherrod Brown (D-Ohio), Amy Klobuchar (D-Minn.), Jeanne Shaheen (D-N.H.), Al Franken (D-Minn.), Tammy Baldwin (D-Wisc.), Martin Heinrich (D-N.M.), Angus King (I-Me.), Tim Kaine (D-Va.), Elizabeth Warren (D-Mass.), Maggie Hassan (D-N.H.) and Kamala Harris (D-Cal.), introduced the “Combating the Opioid Epidemic Act.” This legislation would invest $45 billion for prevention, detection, surveillance and treatment of opioids. This is the same number proposed by Senate Republicans earlier this summer. “This epidemic knows no bounds. Whether impacting children, parents, or grandparents, the opioid crisis continues to grow in its intensity and its harm,” said Casey. “In order to effective-

ly address the problem, we must continue to commit resources to our states and our local communities. In my recent travels across Pennsylvania, to communities both large and small, one of the most common concerns in fighting the opioid crisis is the need for more support for local resources. This legislation incorporates bipartisan, commonsense principles to make sure we’re providing assistance where it is most needed.” This legislation would authorize and appropriate $4,5 billion for substance-abuse programs for the individual states for each of fiscal years 2018 through 2027. It would add this funding to the Account for the State Response to the Opioid Abuse Crisis, which was created by the 21st Century Cures Act as it passed the Senate with 94 votes. The measure would expand the use of funding already allowed under 21st Century Cures, so that states may also use this money for detection, surveillance and treatment of co-occurring infections, as well as for surveillance, data collection and reporting on the number of opioid over-

term cash-flow purposes. To meet our legal standard of a ‘prudent’ investment of taxpayer funds, a balanced budget plan should be in place to secure such loans, and we have repeatedly called for action to that end. “On Oct. 4, Gov. Wolf announced he would take responsibility for balancing the budget, relying solely on his executive authority, and presented Treasury with details of his plan to do so. Recognizing that the executive has extensive tools to achieve balance, includ-

ing the ability to put funds into budgetary reserve, Treasury approved a five business-day borrowing on October 12th on the basis of that plan. Since then, that borrowing has been repaid. “As I said then, however, the appropriate resolution has always been for the General Assembly to adopt a revenue package to fund the enacted budget. So I was pleased to see the General Assembly, on a bipartisan basis, complete its work of passing a 2017/18 budget earlier this week.

Under the bill, the National Institutes of Health would be responsible for distributing this money. The bill would provide stable, long-term funding – a total of $45 billion over 10 years – to the states and over five years to research

efforts. This is similar to the stable, long-term investment that Senate Republicans proposed as a response to the opioid emergency. It would not replace coverage for treatment under Medicaid or the treatment requirements for private insurance in the Affordable Care Act. Both of these remain critical for combating the opioid-abuse epidemic. This legislation has been endorsed by numerous professional groups,

among them the American Psychiatric Association, American Society of Addiction Medicine, Coalition to Stop Opioid Overdose, International Nurses Society on Addictions, National Association of Clinical Nurse Specialists, National Association of County & City Health Officials, National Association of Social Workers, National Council for Behavioral Health, Treatment Communities of America and Young People in Recovery.

Torsella Says Borrowing Is Now a Go

ENNSYLVANIA Treasurer Joe Torsella released a statement following the authorization of a $1.8 billion line of credit from Treasury’s Short Term Investment Pool to the Commonwealth’s General Fund to be paid back on or before April 2, 2018 at a variable interest rate equal to the SiFMA Swap Index Yield. Torsella stated: “For the past several years, Treasury has made loans from its investment funds to the General Fund for short-

“Under these circumstances, Treasury is able to renew its cash-flow lending to the General Fund. I have therefore approved, effective today, a line of credit to the General Fund not to exceed $1.8 billion and to be repaid in full on or before April 2, 2018. The administration has drawn an initial $100 million on this line today. “In light of the unusual events surrounding this year’s budget, we have written new provisions in this line of credit to secure

Treasury’s investment, and to provide alternatives if circumstances change. “Building on the criteria we have articulated this year, in the weeks ahead Treasury will be comprehensively reviewing this lending program, and will establish and communicate appropriate guidelines and standards for all future lending by Treasury to the General Fund. Several departments allowed improper disbursements of petty cash through unallowable expenditures. The Parks & Recreation Department disbursed $1,426 of petty cash on food and refreshments for meetings and training sessions attended only by city employees. The Office of the Managing Director disbursed $866 for employee travel expenditures exceeding the limit on three separate occasions. Employee travel over $100 cannot be reimbursed by petty cash. The Office of Homeless Services disbursed petty cash for monthly services from ADT Security, even though payments for a recurring service should be through a direct purchase

agreement or a contract with a vendor. The Department of Public Health disbursed petty-cash funds for services from Comcast, which should have been purchased through the Office of Information Technology’s agreement. In releasing last year’s department audit, Butkovitz called on the Finance Office to implement training for all city departments. At that time, the Mayor’s Office indicated it was working with departments to ensure compliance with proper procedures for handling petty cash. “Our latest audit indicates there is still much work that needs to be done when it comes to training departments to properly managing petty-cash accounts,” said Butkovitz.

ITY CONTROLLER Alan Butkovitz’s annual audit of all city agencies found 70% of departments mismanaged their petty cash accounts. Of the 42 total agencies, 29 were found with at least one petty-cash issue. These accounts, which totaled $1.5 million in expenditures for Fiscal Year 2016, provide departments with sufficient cash for minor expenditures such as postage, subscriptions, licensing fees and many other items under $500. “Petty cash is an efficient tool for departments to make small reimbursements for business needs as they arise,” said the controller. “When controls are not in place, the entire amount of funds is placed at risk.”

EMBERS of the Philadelphia Delegation in Harrisburg hailed the passage of legislation that will enable the swift closure of nuisance “stop-and-gos” in neighborhoods where they are magnets for disorder. State Rep. Jason Dawkins (D-Kensington) stood proudly with fellow members of the delegation at the State Capitol to celebrate passage of legislation that would make it easier for the State to crack down on stop-and-gos. He said those businesses have been posing a threat to Philadelphia communities for a number of years. “We as a delegation, working with our city elected officials, were able to draft crucial language to allow us the tools to start cracking down on nuisance bars and stopand-gos,” Dawkins said. Included in the Fiscal Code bill (HB 674), the legislation would allow the Pennsylvania Liquor Control Board to suspend a license immediately if it finds a licensee does not meet a requirement under the Liquor Code for seating, square footage, food or health. The bill also would give local government entities the power to make recommendations to the LCB to investigate establishments believed to be failing to meet code requirements. “Stop-and-gos have been a danger for far too long, specifically putting our children at risk,” Dawkins explained. “These businesses will finally be held account-

able for their actions.” State Sen. Vincent Hughes (D-W. Phila.) called the measure “an excellent, aggressive step forward that will improve enforcement, help neighborhoods combat crime and improve quality of life.” The Fiscal Code now goes to the governor’s desk for his signature.

Senate Committee Targets Harassment At the request of State Sen. Lawrence Farnese (DS. Phila.), the State Senate Democratic Policy Committee held a public roundtable discussion yesterday in City Hall on strategies for preventing street harassment. The committee is chaired by State Sen. Lisa Boscola (D-Northampton). The discussion was co-chaired by Boscola, Farnese and State Sen. Judy Schwank (D-Berks), who chairs the Senate Women’s Health Caucus. Philadelphia participants included Amber Hikes, executive director, City Office of LGBT Affairs; Dr. Nina Ahmad, PhD, deputy mayor for public engagement; Nuala Cabral, communications manager, Temple University Community Collaborative; Kayla Watkins, Temple University student; Jovida Hill, executive director, Philadelphia Commission for Women; and Noelle Marconi, member of the legislative policy & advocacy committee for the Philadelphia Commission.

Cruz: October for Indigenous Peoples The State House of Representatives unanimously adopted a resolution designating October as Indigenous Peoples’ Month, according to lead sponsor state Rep. Bullock, Costa Cheer Lunch-shaming Ban State Rep. Donna Bullock (D-N. Phila.) and State Senate Democratic Leader Jay Costa (D-Allegheny) announced the passage of a school-lunch shaming ban they worked collaboratively on since May. The provision is included in the 2017-18 School Code (HB 178), which went to Gov. Tom Wolf’s desk last week. Brought on by reports of “school-lunch shaming” in the spring, Costa introduced a co-sponsorship memo for a bill that would ban this behavior from school administrators, and Bullock introduced a companion bill (HB 1403) days later. There had been cases of students being denied a meal, forced to do chores at school, or wear a special wristband indicating that they were receiving a free or reduced lunch. In June, Bullock and Costa joined forces. Bullock said, “In Pennsylvania, one in six children struggle with hunger.

School is often the one place they receive an affordable, nutritious meal. I am glad that with this legislation, we can put the cruel practice of lunch shaming behind us and focus on more productive initiatives, such as ‘Breakfast after the Bell,’ which expands access to school nutrition.”

Cephas Joins Labor For Roundtable State Rep. Morgan Cephas (D-W. Phila.) went on PhillyLabor Radio for a roundtable discussion with local labor leaders to discuss her efforts to protect workers’ rights in Pennsylvania. She also discussed her efforts to stop anti-labor legislation and how she is working to increase workforce development opportunities throughout the commonwealth. Cephas was joined by Jim Gardler, CWA Local 13000 President Jim Gardler, Fred Wright, AFSCME District Council 47 President Fred Wright, Ironworkers 401 Business Manager Kevin Boyle and City Deputy Labor Commissioner Rich Lazer. Cephas said, “I sit on the Labor & Industry, Gaming Oversight, and Liquor Control Committees in the House, and I have witnessed some of my colleagues intentionally create bad policies that would weaken our unions and devastate working families. I have opposed countless anti-labor proposals and will continue to do so.”

Cephas spoke out against anti-labor budget proposals such as increasing the State Hotel Tax rate by 5%, ending the longtime salestax exemption for commercial storage and increasing liquor privatization. She also discussed legislative proposals that would harm working families in Pennsylvania, such as HB 55, which would amend Pennsylvania’s constitution to make the commonwealth a Right-to-Work state. The bill currently sits in the House Labor and Industry Committee, where Cephas vows to vote against it.

Bass Takes Aim At Bad CUAs City Council passed a resolution introduced by Councilwoman Cindy Bass (8th Dist.) to hold hearings on the results of a startling report about Community Umbrella Agencies by the Philadelphia Department of Human Services, which revealed several under-performing agencies. CUAs were created to manage child-welfare cases and improve services for children under DHS care and their families. Last month, DHS released an “Improving Outcomes for Children” scorecard to evaluate the performance and quality of 10 CUAs in several areas including safety, supervision and financial stability. The report found seven out of 10 CUAs received ‘Ds’ and the rest received ‘Cs,’ with several receiving ‘Fs’ in specific areas.

“I want to ask DHS to go back to the drawing board based on the information they issued to us,” said the councilwoman.

Boyle, Murt Tout Hate-Crime Bill Joined by Democrats and Republicans from the Senate and House, State Reps. Kevin J. Boyle (D-Northeast) and Tom Murt (R-Northeast) called upon the General Assembly during a Capitol news conference to pass legislation to strengthen the hate crimes law in Pennsylvania. HB 505, co-sponsored by Boyle and Murt, would amend current state law to expand the offense of ethnic intimidation to include malicious intention against the actual or perceived ancestry, mental or physical disability, sexual orientation, gender or gender identity of another person or a group of people. State Sens. Lawrence Farnese (D-S. Phila.) and Anthony Williams (D-W. Phila.) also have legislation (SB 96) regarding hate crimes. Boyle said under HB 505, a crime motivated by hatred toward these protected classes would be graded one degree higher than already specified in law. “Pennsylvania’s lack of protections against hate crimes for LGBT communities and persons with disabilities is a national embarrassment. We remain the only state in the Northeast to not enshrine protections against hate crimes for these groups into law,” Boyle said. “I have introduced this bill for two consecutive sessions to add these protections but it has never been brought to a vote. Our legislature is failing its duty to protect the citizens of this commonwealth, and ignoring the constitutional rights of the physically and intellectually disabled, and the LGBT communities.”

For Superior Court, Judge Emil Giordano has an impressive rack of 24 groups, including many labor unions; Judge Jeffrey Moulton is backed by 18 diverse bodies; Judge Carolyn Nichols follows closely with 14; while Judge Maria McLaughlin enjoys the support of a jaw-dropping 42. This assures us of two things: she is reputable and she is industrious. Endorsements don’t fall from trees. We cannot recall such a quiet election in which there were no incumbents at the head of the ticket. It’s obvious Democratic candidates for district attorney and city controller have the edge, given the 7:1 voter-registration edge they have over Republicans. But turnout will be low, so enthusiasm will be key – as we saw with Larry Krasner’s surprise win in the spring primary. Since then, Krasner’s strategy has been to keep

While it would be unusual to see a controller with such explicit ties to an administration, Rhynhart has made it clear through position papers, interviews and debates that she is her own person – and enough voters took notice that she performed the herculean taskn of unseating a longtime incumbent in Alan Butkovitz. Rhynhart, at least, has been out and about more than Krasner. That’s a good sign she cares. Republican Mike Tomlinson is a diligent activist with financial expertise. But with limited funds, it is hard for

his mouth shut and mend as many party fences as possible behind the scenes. That has left his GOP opponent, Beth Grossman, shadowboxing much of the time as she tries to stir up issues. But her main issue may be enthusiasm for public safety. While Krasner ran the table with most endorsements, Grossman locked in most public-safety groups. These are typically important in DA races, where the voting public usually wants toughness before compassion. The tough crowd was split in the Democratic primary and many stayed home. The general election offers them a different choice. Will they rise to the occasion? Will Krasner’s base stay home asleep? We’ll soon see. The city controller race has not caught fire with any base in the electorate. That’s a pity, because nobody knows the whole city government like the controller. The office is – and should be – independent of the mayor, whose huge admin-

There are four vacancies on Superior Court. Judge Geoffrey Moulton (D), who was appointed to the court last year, must run for office now. He has more than 20 years of respected practice in the Delaware Valley. Philadelphia Common Pleas Judges Maria McLaughlin (D) and Carolyn Nichols (D) are sharp, trusted by their peers and very accessible to their fellow city-dwellers. Judge Emil Giordano (R) hails from

Bethlehem but he is down here all the time and reflects the general culture of Southeastern Pennsylvania. There are two vacancies on Commonwealth Court. Philadelphia Common Pleas Court Judge Ellen Ceisler (D) has precisely the chops for the complex cases involving local and state governments that Commonwealth Court must adjudicate. Judge Christine Fizzano Cannon (R) has deep roots in Delaware County’s political life and knows her community, which is intimately related to Philadelphia, very well. Three Supreme Court justices are on the ballot, but none are from this part of the state.

Democrats, Republicans, Greens, Independents and everyone in between will be making their way to the polls on Tuesday to vote for a new district attorney, a whole bunch of new judges, a new City Controller and other offices. Heck, New Jersey even gets to pick a new governor, just in time for Robert Mueller to subpoena the old one thanks to his presiden-

time I wrote this column was just before the 2016 presidential election. Unless you were under a rock on Monday, you know that Paul Manafort, the former campaign manager for President Donald Trump, and one of his associates, were indicted by Special Prosecutor Robert Mueller on a variety of charges, including money laundering and conspiracy against the United States. Depending on whom you ask, this shows either that our democracy was hacked by Russian operatives or that somehow operatives connected to Democratic presidential candidate had conspired with Mueller to bring down the president and that the special prosecutor must be fired. And let’s not forget that Trump and company are looking to spend federal dollars on another investigation of Clinton; probably because misery loves company. (Cont. Page 17)

running for lieutenant governor. Fetterman has taken numerous shots at GOV. TOM WOLF for not being progressive enough. He has attacked him on fracking, the shale tax and a failure to get a tax increase. He did get less than 19% in his statewide race against KATIE McGINTY and JOE SESTAK. His campaign likely would be about the need for an independent lieutenant governor who is more progressive than the Governor and would cause Tom Wolf a ton of headaches. In the meantime, the crowded lieutenant governor field favors MIKE STACK, who has Philadelphia as his intimate friend and is supported by essentially everybody across the whole state. Who will run against MARTINA WHITE for state Rep. in her Northeast Philly district? Two Democrats have given it a try already, but is there a fresh face? Previous candidates include

BRIAN NELMS, MATT DARRAGH and SARA DelRICCI. All were hard-working candidates, but the district is borderline rightwing, and White hasn’t done anything devastatingly bad. She also has some key labor supporters that help her with finance. It’s hard to beat an incumbent. STATE SEN. STEWART GREENLEAF and STATE REP. TOM MURT hosted a Pathways to Pardons workshop in Huntingdon Valley. The two Republicans are part of a growing trend of folks who want to be about second chances and being smart on crime. A side effect of the opioid crisis is the number of people left with criminal records. If the answer to drug addiction is recovery, people need to be able to achieve a pardon. Otherwise, they’ll be trapped in the cycle of failure and rejection. Second chances are not only good for ex-offenders but (Cont. Page 17)

HE NATIONAL Republican Congressional Committee put out its “On the Radar” list for promising 2018 Republican candidates. These are individuals running for open seats or opposing an incumbent Democrat. On the list is former REVENUE SECRETARY DAN MEUSER, who is running to replace CONGRESSMAN LOU BARLETTA in the 11th Congressional District. Also on this list is former investment banker and investment advisor JOHN

list, the candidates had to prove they can raise significant funds and have the skills to campaign effectively. As Meuser and Chrin are both wealthy men with good connections, fundraising should not be a problem. Last week CONGRESSMAN ROBERT BRADY’S (D-Phila.) political strategists KEN SMUKLER and DONALD “D.A.” JONES pled not guilty and promised to vigorously defend themselves (in other words, they have no intention at this time to turn on Brady to obtain get-out-ofjail-free cards). Smukler and Jones are facing federal felony charges that they had conspired to hide a $90,000 payment from Brady’s campaign to induce a primary challenger to drop out of the race. After the hearing, their lawyers did not deny that both men helped channel money to Brady’s 2012 primary opponent, FORMER (Cont. Page 17)

NRCC CHAIRMAN STEVE STIVERS, commenting on the list, said, “These 31 candidates are formidable competitors against the liberal agenda of NANCY PELOSI and the left.” Making the list does not mean the NRCC will donate to these candidates prior to their respective primaries, as the NRCC does not get involved in competitive open primaries. Meuser is expected to have a number of opponents in the primary, possibly including STATE REP. STEPHEN BLOOM (R-Cumberland), businessman ANDREW LEWIS and former Trump delegate to RNC ANDREW SHECKTOR. Judge Moore has already pled guilty to not reporting the $90,000 campaign contribution. Smukler does not deny facilitating the donation, but contends his actions were legal. However, a Moore staffer who set up a consulting firm just to take this contribution claims she was instructed to do so by Smukler. known of the two defendants. He is a former municipal attorney-turned-political advisor. In addition to working for Brady, he managed MARJORIE MARGOLIES’ successful bid for the U.S. House in 1992 and her failed bid to retake that seat in 2014. He was one of the many communications advisers who worked for former Pennsylvania ATTORNEY GENERAL KATHLEEN KANE during her downward spiral. His failure with the messaging for Kane was probably not due to his skills, but rather to the deadly story that the best public-relations man could not spin. BETH GROSSMAN’S campaign to be our next district attorney appears to picking up steam. I think it’s beginning to register what might happen to this city if her opponent LARRY KRASNER wins. These fears are increasingly being heard from not just the average people

who are registered Democrats, but party people. On a local Sunday-morning talk show, former City of Philadelphia MANAGING DIRECTOR RICHARD NEGRÍN leveled a few muted criticisms of Grossman, but then savaged Krasner. I understand Negrín lost to Krasner in the primary, but usually entrenched politicos like Negrín dial down their criticism of other Democrats in a general election. I think there is genuine fear that the DA’s office would be in disarray for a long period of time under Krasner, as the office would be headed by someone more concerned with a political agenda than prosecuting crime. This may be good news for criminals, but not for victims. I am concerned that the police, fearing the DA’s office will not support them, may become less diligent. If you think this cannot happen – just take a look at Baltimore.

(Cont. From page 9) But you know what could have prevented this and much of what else we’ve been dealing with in terms of the Trump administration? Voting. Voting could have prevented this. In Philadelphia, we have some serious, criminal

justice-related decisions to make. We pick a new controller who will oversee the budget, and will hopefully do more than hold press conferences and issue reports that hurt more than help. But only 20% of us – and that’s a generous estimate – are expected to go to the polls. Considering the issues at hand, that’s not nearly enough.

So a whole lot of people 17 are about to be really unhappy with the results. But it doesn’t have to be that way. You can do your research, study the candidates, and cast your ballot. Your vote only counts if you use it. Considering we have a whole lot of people who would rather you didn’t do that, you might want to surprise them. T HE P UB L I C R E CO R D

GOP Injunction On LCB Filed

Shortly before Gov. Tom Wolf signed the Republican House-driven revenue budget, an injunction request was filed in Commonwealth Court on Monday to try to stop his plan to monetize future earnings of the Pennsylvania Liquor Control Board to raise $1.25 billion to help fund this year’s state budget. It’s a move that bears watching. While the legislative ins and outs of Wolf’s proposal are not yet fully known, the Republicans’ move aims to throttle any effort to use liquor sales as a way to increase revenue for Pennsylvania governments. When a government is short on income, but enjoys a monopoly to sell booze, that’s a powerful revenue-generator. But state Republicans don’t like generating any new revenue; borrowing is the best way to fund a government, they insist. Yet borrowing today requires more revenue tomorrow to pay off yesterday’s debts. Where will that revenue come from – even more borrowing? This is not a business plan; this is a Ponzi scheme. Honest leaders on Capitol Hill should bite the bullet next year, if not this year, and deploy the LCB craftily to fund the programs they vote for.

It seems you get ADJUDICATED by the media, then a judge, in federal cases. Maybe the writer wants to be important (?)... Meanwhile, sensing a weak Brady moment, a person slithering in the shadows made phone calls to POLS to take the Party Chair post. To no avail. He cannot stand being out of the limelight. Tommy CARLUCCI, education advocate, is running for State Rep. Kevin Haggerty’s seat as a Democrat in Lackawanna County.

If you know all four seasons: almost winter, winter, still winter and road construction, you live in Iowa. If you have more hours on your snow blower than miles on your car, you live in Iowa. If you find 10 degrees “a little chilly”, you live in Iowa. If you understand these jokes, and forward them to all your Iowa friends and others, you actually have lived in Iowa.
