This Limited Warranty covers products purchased after 1 March 2022. 2.1. Australian Designer Faucets, Inc. (“ADF”), a wholly-owned subsidiary of Phoenix Industries Pty Ltd (“Phoenix”), an entity domiciled in Australia, provides the following limited warranty for all Phoenix products (“Products”) purchased in the United States from an authorized reseller or distributor of ADF (“Reseller”) for use in residential or commercial installations in the United States. For the avoidance of doubt, Products purchased: (a) outside the United States from other sources, including grey, parallel or direct imports; (b) within the United States from an entity other than a Reseller; or (c) within the United States and exported for use outside of the United States, are not covered by this Limited Warranty. Because neither Phoenix nor ADF can control the quality of products sold by unauthorised sellers, ADF reserves the right to reject warranty claims from purchasers for products purchased from any unauthorised seller, including unauthorised internet sales. 2.2. This Limited Warranty covers Products and applies to defects which have arisen solely from faulty materials or workmanship. For the avoidance of doubt, defects in Products as a result of defects other than solely faulty materials or workmanship, including without limitation the following are not covered by this Limited Warranty: (a) abuse, misuse, neglect, mishandling, excessive stress or strain; (b) excessive water pressure or temperature (which do not comply with the recommended usage below); (c) outside use of the Product, including but not limited to installation on an external wall or surface; (d) repairs or alterations (other than by an accredited and licensed technician); and (e) attachments of accessories of any kind (other than approved Phoenix attachments that are correctly installed). 2.3. For the purpose of this Limited Warranty, a Product is a product which: (a) was manufactured by or on behalf of Phoenix; (b) bears a trademark owned by Phoenix or ADF; (c) was sold by an authorized Reseller; and (d) was purchased in the United States. 2.4. This Limited Warranty commences on the date of purchase and will continue for the relevant periods set out in the warranty period tables in Section 3 below. 2.5. It is the installer/Purchaser’s responsibility to ensure: (a) the Product is not damaged prior to installation; (b) the Product contains all components; and (c) required maintenance is performed on the Product. 2.6. The Limited Warranty: (a) extends only to the Purchaser of the Product, and it does not extend to any subsequent or other owner or transferee of the Product; and (b) is a parts only warranty, and the warranty covers only the repair of the defective part or the provision of a spare part to replace the defective part and does not include the removal of the defective part or the installation of the repaired or replaced part. 2.7. For the avoidance of doubt, the Limited Warranty provided herein is not a parts and labor warranty, and the warranty does not cover the installation of any replacement or repaired parts provided under a successful warranty claim. Without limitation, any removal, alteration, repair or change to a connecting surface or any indirect or consequential building works are also expressly excluded and not covered by this warranty. 2.8. In this Limited Warranty, special order, custom or discontinued items may be replaced by a reasonable alternative product and/or finish should a valid warranty claim occur. 3. Warranty Periods and Details 3.1. Residential ADF warrants that the below Products, which are purchased for use in residential homes, will be free from defects in materials and workmanship for the periods specified below. All warranties are in respect of parts only, and any warranty in respect of labor is expressly excluded. Conditions apply to special order, custom or discontinued items, refer to section 2.8.

1 Excludes damage to ceramic disc cartridges from pieces of copper tube, plastic tube, sand, dirt, or thread tape etc. 2 In order to claim on Filtered Kitchen Faucet filters & housing, receipts must be presented to verify filter cartridges have been replaced as specified (every 6 months). 3 Chrome finish covered under standard replacement product or parts warranty. 4 Excludes Drains and ‘tea staining’, refer to care instructions available at www.australiandesignerfaucets.com/ faq-category/cleaning-and-care/ 3.2. Commercial ADF warrants that the below Products, which are purchased for use other than in a residential home (e.g. hotels, aged care facilities, hospitals, schools, factories, motels), will be free from defects in materials and workmanship for the periods specified below. All warranties are in respect of parts only, and any warranty in respect of labor is expressly excluded. Conditions apply to special order, custom or discontinued items, refer to section 2.8.

4. Warranty Exclusions To the maximum extent permitted by applicable law, this Limited Warranty will not apply and neither Phoenix nor ADF will be liable for any Loss or damage, whether to the Product itself, surrounding surfaces including walls, fixtures, furniture or any other Consequential Loss caused by a defect in the Product where: (a) the Purchaser is unable to provide proof of purchase or equivalent documentation which confirms that the relevant Product was purchased from an ADF authorized Reseller; (b) the relevant Product is not a product which was manufactured by Phoenix and imported by ADF with the intention of being supplied in the United States;
