This mock trial is designed to simulate a trial based on real errors that arose under errors-and-omissions liability for insurance agents. During this seminar, the presented facts will be from an actual claim that went to trial with a rendered verdict. The participants will observe what transpired during the trial, and they will learn about the issues that came to light and how they affected the eventual outcome. Those in attendance will participate—some by playing roles in the litigation and the remainder by acting as the jury—and will provide their own thoughts and observations on the verdict slip. This educational session will end with an overview of E&O liability, including an examination of what the agent could’ve done differently to avoid this lawsuit, and common causes of E&O claims against insurance agents. Guidance also will be given to help agents if they are faced with an E&O claim or lawsuit.

Understanding your client’s exposures to buildings under construction or renovation, and matching those exposures to the proper coverages, endorsements and products can be tricky and confusing—especially in New York. Simply put, builders risk policies are nonstandard, which means someone must read them, analyze the coverages, limitations and exclusions to be sure they meet your client’s needs and contractual responsibilities. This class will walk you through the maze of coverage differences and discuss the following topics: when a builders risk policy starts and automatically terminates; what’s covered property and what’s not; insuring to completed value–coinsurance and change orders; how to handle existing structures and renovations properly; who is an insured; occupancy prior to completion; and hard versus soft costs. Cyber liability attacks continue to occur at almost lightning speed, and they have become much more complex and sophisticated. Do insurance producers who sell this coverage truly feel prepared to assess an insured’s risk and to provide the correct coverage remedy adequately? Finally, here is a cyber security class that digs deeper—concentrating on all the aspects, details and nuances of this often-mysterious coverage. To date, many of the cyber security classes only touched on the basics, but they didn’t provide the in-depth knowledge and tools insurance producers need to understand this coverage fully and offer it to insureds confidently.
