This mock trial is designed to simulate a trial based on real errors that arose under errors-and-omissions liability for insurance agents. During this seminar, the presented facts will be from an actual claim that went to trial with a rendered verdict. The participants will observe what transpired during the trial, and they will learn about the issues that came to light and how they affected the eventual outcome. Those in attendance will participate—some by playing roles in the litigation and the remainder by acting as the jury—and will provide their own thoughts and observations on the verdict slip. This educational session will end with an overview of E&O liability, including an examination of what the agent could’ve done differently to avoid this lawsuit, and common causes of E&O claims against insurance agents. Guidance also will be given to help agents if they are faced with an E&O claim or lawsuit.

Understanding your client’s exposures to buildings under construction or renovation, and matching those exposures to the proper coverages, endorsements and products can be tricky and confusing—especially in New York. Simply put, builders risk policies are nonstandard, which means someone must read them, analyze the coverages, limitations and exclusions to be sure they meet your client’s needs and contractual responsibilities.
