THE CHANGING SEASONS
As the brightness of Summer fades and the nights begin to draw in, we start to steel ourselves for the long Cape Winter. The change of season into Autumn somehow feels more like a year-end than the traditional mid-summer New Year does. In the middle of our summer reveries we are rudely awoken to gather our thoughts and plans together to return to work and start a new year when our minds are really not in the mood for that. Summers feel light and frivolous, Autumn feels mellower and more serious – a much better time to start a new year I think! Thoughts of food also turn from braais to lekker dik potjies, from salads to soups and meringues to malvas. It's a time when your favourite red wine just tastes better than before and your cola seems to lose its fizz. With the rash of holidays in April, many people will likely be on the roads, and with the weather getting wetter, it's probably a good time to check the tyres on your car and replace the wipers if they're a bit tired. We wish you a safe and Happy Easter and a joyous Passover. Enjoy the issue!

Love them or hate them, Egyptian Geese are a natural part of our birdlife! They are indigenous to South Africa (in other words, they occur here naturally) and occur throughout Africa, although they are now rare in Egypt where they were once revered. There is no doubt that their numbers are increasing as they adapt well to man's artificial lawns and lakes — some escapees are even rapidly colonising the UK and Europe! The males and females look alike but can be told apart by call: the female often leads with her loud honking while the male makes a hissing sound. They are not actually true geese but are really a species of large duck known as a shelduck.

If we consider our last 20 sales under Sole Mandate the difference between listing and selling prices has reduced to 91% and the average time taken to sell a property has dropped to 36 days. This is considerably less than the 119 days two years ago. There is a stock shortage although we do note that in the past week a few more homes have come on the market. This is probably in line with the fact that there has been an increase in interest rates as I

predicted in my February article, with the possibility that there could be another 5 basis point increase just around the corner. The biggest demand for homes is still in the R1.8 to R2.5 million range and homes correctly priced can sell within 14 days of coming on the market. It is interesting to note that there has been some movement above the R4 million mark. We are currently negotiating two sales of property with asking prices above R4.5 million. We will continue to caution that the market is very sensitive to interest rates with buyer affordability levels under pressure and another interest rate increase could definitely put a damper on selling prices. This is already evident in the number of homes that we are renting at rentals never achieved in Pinelands before.

Sport at Pinelands High School continues to thrive with the cricketers enjoying a particularly successful season. Under the leadership of Andre Marais, Head of Sport, Kyle Prince, Director of Cricket and the First XI coaches Rushdi Jappie and Barry Maart both former Pinelands High School pupils, the 1st team has flourished, building on the strong foundation left by John Young who coached at Pinelands for nearly 15 years. “Our first aim is to be the best coeducational cricket school, and then to be one of the best cricket schools in the Western Cape,” said Marais.
Recent results, including two victories over Bishops and a draw against Rondebosch, the number one cricketing school in the country, bode well and coach Jappie believes that a culture of hard work and consistent performances is the key. Some of the boys are expected to push on to higher honours in provincial and national teams. Captain Cheslyn Clark, with 92 caps, will be hoping to impress the selectors as will vice-captain Joel Clothier, an off-spinning all rounder, and Nathaneal Adams, with over 50 wickets last year. RAISING AWARENESS ON WORLD DOWN SYNDROME DAY 21 March 2014 marked the 9th anniversary of World Down Syndrome Day (WDSD) which aims to create awareness of the rights of people with Down syndrome. The theme for this year is See the Ability. Text from Lisa Harrison and Rose - Anne Reynolds, Pinelands North Primary School. At Pinelands North Primary School, we believe that everyone is different and special. The school acknowledged WDSD by tying blue and yellow ribbons around the trees. The children made their mark for Down syndrome by painting their hands with yellow and blue paint and placing them on a map of Africa. We also wore bright, colourful stripy socks to school. It was a great success.
WHAT IS DOWN SYNDROME?
Down syndrome is a lifelong genetic condition, it is not an illness or a disease. Any child with Down syndrome, is a child first and can be supported at a mainstream school if their specific needs are assessed and the school is willing to work with the child and family in a way that enables the child to continue to grow and progress. Each child with Down syndrome is different

They may mature slower than their peers or have varying degrees of learning difficulties, but each individual is unique. At present PNPS has one grade 2 pupil Erica Brink, a Pinelands resident, who has Down syndrome. Erica has a facilitator, Lisa Harrison who comes to school with her everyday and helps her with her dayto-day classroom activities. She does her classwork enthusiastically, which has been adapted for her specific needs. As Erica is a visual learner, she learns mainly through pictures and visual representations of concepts and content. Erica's teacher and her facilitator adapt the work that she is doing to meet her specific needs.
Erica is a part of every aspect of our school life. She is an active, involved member of her Grade 2 classroom and participates fully in the extra-mural activities offered at the school. She has a group of friends and spends break times playing with them without her facilitator. At PNPS we ‘see the ability’ in each child rather than the disability they might struggle with. We are trying to help create an inclusive society where everyone can feel embraced. Children with Down syndrome have the same needs as any other children – they need to be loved, cared for, made to feel special and included.

JMI CELEBRATES 2013 SOCCER SEASON Batandwa Ntsebeza the under 17 coach for the JMI Cape Town Football Club (incorporating JMI Soccer Academy) reports back on their achievements in the last soccer season, when the club trained over 150 Cape Town players, and one talented young Tanzanian. The club is now preparing for its fourth season as a club hoping to produce players that will make Pinelands, and South Africa, proud. The highlight of the 2013 season was for the Under 19's who were crowned league champions of the CTTFA Colt B Division and earned promotion to the Colt A Division,
FUTSAL (5-A-SIDE FOOTBALL) GROWS CHAMPION FOOTBALL PLAYERS Batandwa Ntsebeza is investigating the possibility of providing a safe place for children to play football, modelled on the popular 5-a-side football or Futsal. Two opposing teams field 5 players each, a
where, on a weekly basis they will compete with the best U19s in Cape Town, such as Ajax Cape Town, Vasco, and ASD. So, as the saying goes, "in order to be the best, you have to play against the best”. There was also much excitement when three players from the Under–19 side were invited to the PSL’s Bidvest Wits training camp in the 2013 June holidays at Stellenbosch University. The Under 17 team made it to the prestigious Coca Cola Cup, where 250 teams including Santos FC, and Milano United compete, but were knocked out by Ajax Cape Town. Other achievements include the Cape Town–Tygerberg Football Association’s Fairplay Award for the second year in a row; the First Team was crowned
league champions of the CTTFA 2nd and gained promotion to the 1st Division. They are aiming to get into Premier Soccer League (PSL) soon and show them how we do it here in Pinelands. The Under 15 side reached the semi-finals of the Avendale Cup; the Under 13A side won the league and cup double, both CTTFA 1st Division and League Knockout Cup champions; the Under 13B side won the double, both CTTFA 4th Division and League Knockout Cup champions; the Under 11A side made the final of the annual Rygersdal Tournament; the Under 11B side made it into the winners section of the prestigious Wynberg St Johns Tournament. Initially developed as an indoor form of football, it can be adapted to the outdoors where the game is played on an enclosed artificial grass pitch keeping the game flowing and action packed. The pitch is smaller and so are the goal-posts. This form of football is very economical, safe, simple and fun to play which makes it attractive for children. It provides the equivalent of street football where so many football greats developed a festive style for the game. It is no coincidence that the top football
playing nations in the world have invested in the creation of 5-a-side or Futsal courts, where youngsters can play from morning until sunset. Top clubs in Europe such as Barcelona, Bayen Munich and Ajax Amsterdam teach their players the basics of football on 5-a-side-courts from as early as 6 years old. If SA football is to live up to the promise of the mid 90’s when we were a rising force in world football, the creation of 5-a-side courts in neighbourhoods will be key so that youngsters can get out and play more often.

The four cyclists, Chris Nuttall, Donovan Will, Jack Thonissen and Martin Odendaal are all Pinelands High School old–boys, and will be supported by friends Christine Thonissen, who also went to Pinelands High, Leigh Charlton, and Donovan’s parents Nancy and Tony Will, all of whom are Pinelands residents. They are setting out to test and inspire themselves, to explore lesser known parts of South Africa, and to raise funds and awareness for early childhood development in the Cape Town townships. The Riding The Forgotten Highway team has partnered with Ikamva Labuntu, an NGO that specializes in development projects helping pre–schools in under–developed centers, as well as orphans, vulnerable children, youth and senior citizens. CANNONS CREEK ANNUAL FAMILY FUN RUN
Now in its sixth year, the Cannons Creek annual Fun Run sported 720 people, mostly from the Pinelands Community. The race, started in 2009 to commemorate the High School’s 10th anniversary, and is open to all in the community. Participants run or walk 2km, 6km or 8km, starting and finishing at the school in Nursery Way. There were prizes for all categories and medals for all who had pre-registered. It was a fun-filled family event, with many parents running
with their children and enjoying boerewors rolls and other refreshments on sale after the race. Great fun was had by all!

When holidays are upon us the question arises, “What do we do with our children?” In order for you not to hear the old ‘I am bored’ story, sit down with your children and work out the holiday ‘programme’.
MAKE A LIST
You may list the items that you are happy to do with them but be careful with regard to outings to formal commercial activities as the cost for these can add up really quickly. Think of things that you or your husband (individually and together) are happy to do and keep this list as a back-up.
CHILDREN'S ACTIVITIES ON PINTEREST
Sit all your children down individually and ask them what they would like to do. This way one child does not influence his/her siblings. They may not just say art activities, they need to say exactly what activity they would like to do. If they are struggling with this then it may be a good idea to purchase an activity book from the local discount book seller. You will use this over and over and the ideas that people come up with now compared to when we were young are amazing! Alternatively, join “Pinterest” and search for ‘children’s activities’. There are hundreds of ideas to be found.
CONSIDER AGE DIFFERENCES AND COST
Ask each child to prioritise the list starting with their favourite activity. As Christmas is a long holiday they will need lots of activities. Remember to keep some of the best ideas for the last week. Do your homework and work out the cost beforehand. Then sit down with all the children to work out the practicality of combining the activities. It is a tad more difficult when one has a large age difference. One needs to get clever to sort them all out but it is possible.

Engage with another parent who is in the same position and activities can then be shared. Don’t forget to have play dates. It is so important for us to include this as during the term our children are far too busy with all their sporting, outside activities and homework and they do not get enough time to play.

Once you have established all the outings and activities, decide which ones are good for inside, as one can never be too sure about the rain! Don’t draw up a firm plan as it does need to be weather dependent. Mind you, a picnic in the lounge on cushions can also be fun!
BONDING WITH YOUR CHILDREN
Every night before the children go to bed, look at the list and decide which one will be done the next day, so that they can look forward to their chosen activity. The most important thing about the holidays is that you can connect with your child on such a different level. Get to know them as individuals, each with their different tastes, dislikes and likes.
DISCIPLINE IS STILL IMPORTANT
Also remember, that if they are not well behaved, the next day’s reward of activity is not there. What you are doing for them is special – a treat and they must not see it as their right. Enjoy the break, and enjoy engaging with your child – a precious gift in itself.

There are those that believe that the human body has not had enough time to evolve genetically, to be able to cope with the diet that has become commonplace since the introduction of agriculture and farming, bringing with it the cultivation of grains, and the refining of many foods including sugar. The feeling is that we are still only capable of dealing with the type of food eaten by the cavemen – hence the name paleo, from paleolithic, an era which ended about 15 000years ago when modern day agriculture was born.

THE EXPERIENCE OF TIM NOAKES
Bravely backtracking on his previous advice on carbohydrate rich diets, Tim Noakes has found great success in the Paleo diet. He explains how he constantly felt unfit no matter how much he exercised. He couldn't lose weight and felt fuzzy headed, till he cut down his carbohydrates to 50g per day and ate as much as he wanted of the meats, vegetables, and "free" snacks – avocado pear, biltong, macadamia nuts and almonds, allowed in the Paleo diet. His weight has dropped, his fitness levels have increased and mentally he feels wonderful. This diet is easier to turn into a way of life because there is no calorie counting – one can eat to satisfaction – as long as it is the right foods.

Whether or not one believes the genetic basis of the Paleo diet, it is quite plain to see the effects of refined sugars on our society, with the rise in obesity, and the incidence of sugar related psychological conditions.

INFINITY CULINARY TRAINING
Happy Sudents at ICT after receiving their sponsored uniforms. Infinity Culinary Chefs (ICT) is a small NGO based in Pinelands, and has been running for four years. Their aim is to find employment for their graduates trained up to commi chef level by ICT. There are three courses a year, for which the students are fully sponsored. The courses run for three months, concentrating on the basics in the kitchen: food theory, health and safety in the kitchen, knife skills and preparation to name a few. There are life skills lessons every day, as well as the opportunity for counselling to all of our students, who come from disadvantaged backgrounds, and often from extremely difficult family situations. The life skills and counselling prepares them for the working world. ICT also offers business skills training to prepare them for the professional world. Over the first two months the students

are placed at establishments one day of the weekend to gain experience in the kitchen. Currently the students are placed at Blowfish Restaurant, a number of Knead Bakeries and The Vineyard Hotel. For the last month of their course the students are placed in apprenticeships for the entire month, yet are still under ICT supervision. Once the students graduate, ICT finds them placements within the hospitality industry. The current rate of employment stands at 80%, with graduates working at places such as Hudson's, Carne, Savoy Cabbage, Knead, Blowfish, The Table Bay Hotel, Maersk Lines, The Power and The Glory and various others. They have received great feedback about their graduates, and have made sure that the graduates enter the industry with minds that are open to further training.

THE "NOW" GENERATION AN APP FOR INSTANT GRATIFICATION?
As humans, we are hard-wired to think of delayed gratification as withholding or denying pleasure. Enter a generation of people obsessed with immediate gratification, and it could well be that patience and persistence are becoming dying art forms. Search as one might (even Siri will agree), there is undoubtedly no app for delayed gratification. In the world of long-term investing where compound interest is magically able to expound its asset base, there is simply no room for the whims of instant gratification.
ALWAYS IN A HURRY?
Fast food, instant messaging, online chat rooms, meals-in-a-bottle, cyber doctors and instant loan approvals are all part of our new vernacular which seems not to include the word “wait”. Results from a recent retail study show that the “close door” buttons in mall lifts are wearing down quicker than any other button. Why? Because waiting for the doors to close automatically is a visceral test of our already-worn-thin patience.
HAPPINESS AND IMPULSE CONTROL
As if BBM, Viagra and Netflix aren’t instant enough, this generation is intent on finding the enigmatic “happy” pill – that secret ingredient that will provide 100% sheer, unadulterated joy in and of the moment. With a new movement of “mindfulness” gaining momentum worldwide, thousands of happiness-seekers are embracing this ancient Buddhist practice to help focus their awareness on the present – which may or may not include learning the fine art of impulse control.
THE MARSHMALLOW TEST
Stanford University’s “marshmallow test” is well-documented and supported by subsequent research into the benefits of delaying pleasure. In a nutshell, the “marshmallow test” was conducted by psychologist, Walter Mischel, in the 1960's and 1970's where a group of children were offered one small reward (in the form of one marshmallow) provided immediately, or two small rewards (two marshmallows) if

they waited for a period of fifteen minutes. In follow-up studies, the researchers found that children who were able to wait longer for the two marshmallows tended to have better life outcomes, including fewer behavioural problems, higher academic achievements, higher incomes and a lesser propensity towards addictions than the group of children who could not delay gratification.
ECONOMIC WEALTH & IMPULSE CONTROL
Speaking right to the very heart of retirement funding, the key difference between those people who have adequate retirement funding and those who have failed to invest for their retirement, is that the well-invested are content to deny themselves smaller immediate pleasures in return for a greater, guaranteed reward at a pre-determined time in the future. Ditto for those who are laden with consumer debt versus the happily debt-free.
VISUALISE THE FUTURE
Further insights into the “marshmallow” test revealed that those children who were able to delay gratification did so not by focusing on what they couldn’t have in the moment, but on what they could have later on. And this really is the essence of financial planning. By mentally stimulating and visualising the future (for example, your child’s education, your retirement years, your overseas vacation), one is able to reach a state of contentedly forgoing fleeting semi-pleasures, safe in the knowledge and filled with anticipation of a far greater, more meaningful recompense.

PINELANDERS As Jade glides elegantly across the ice it is hard to believe that she began her life as a premature baby weighing 610g. A third generation Pinelander, Jade is preparing for the International Ice Skating Union World Development Programme for pairs in Berlin, a course for ice skaters who have reached skills level five.
JADE CARELS PREMATURE BIRTH
Jade's mother, Carol developed preeclampsia in her 26th week of pregnancy, and was rushed to hospital, unconscious. Jade was born after an emergency caesarian, which turned out to be a life saving event for both mother and daughter. Weighing only 610g Jade could fit, top to toe, into her father's hand. Her own hand was only as big as her dad's finger nail. She had to spend three and a half months in an incubator so that her tiny body could grow and develop to enable her to survive on independently.
TWO KILOGRAMS AT ONE YEAR OLD
Jade's proud Mom remembers the events: "During her stay in hospital she had two blood transfusions and surgery and we were told that it would be touch and go for a while. She reached 2kgs in weight just after her first birthday and has managed to blossom since then. We were told that Jade could have lots of problems but so far she only has a few learning disabilities from the oxygen treatment at birth and some minor skeletal problems which we have learned to manage."

SWIMMING, WATERPOLO AND ICE SKATING
"Our paediatrician advised us to encourage Jade to achieve on the sports field as all children need to achieve in one area in their lives. Initially she had to deal with co– ordination problems and we persevered and encouraged her as much as we could. She is a great swimmer and waterpolo player but due to problems with her ears we have had to drop these sports. Jade's perseverance with ice skating has helped her not only in her physical development but also in her mental development as well as many other life skills."
PARIS - A FAVOURITE PLACE TO VISIT
Up until two years ago Jade still struggled with fine motor skills such as threading beads. One would never think it when you see her and Johann practicing the "death spiral" on the ice rink. The training course in Berlin is in April and Jade can add this city to her list of travel destinations, one of them being Paris – which she says she would love to revisit.
EACH BIRTHDAY A HAPPY MILESTONE
Jade has just celebrated her 15th birthday and is in Grade 8 at Cannons Creek High School. She is still a very small and slight teenager and even though she is one of the oldest in her class she is still one of
the smallest. Daily milestones are still a challenge, but Jade is a happy girl who loves her animals and friends and has achieved more than her family could have ever thought possible.
AIMING TO BE AN ICE SKATING COACH
Jade has managed to overcome the struggles brought about by a premature birth, and can look forward to a bright future, where she hopes to train as an ice skating coach.
GRATEFUL THANKS
Jade and her family acknowledge the advice and help from the schools along the way, La Gratitude where she attended preschool; Vista Nova who tested her and advised that she attend a model C school with small classes, and Cannons Creek independent school where she started primary school and is now in Grade 8. Jade's Mom Carol, would like to thank her parents, and all those who have been instrumental in getting Jade to where she is today: "After her birth, news spread that she was fighting for her life and a real miracle child and she was prayed for by many Pinelands residents as well as many others I still have not met or am aware of. I would like to encourage others in my situation to take heart and never give up."

Congratulations to Pinelander Toks Viviers for successfully completing the Ice Mile Swim (1.6km) in the Antarctic on the 2nd March. Six founder members of the Ice Swimming Association boarded the Ocean Diamond in Ushuaia, Tierra del Fuego, 'hitching a ride' with the Quark Antarctic Tour group – to complete their goal of swimming a mile in the icy waters of the Antarctic circle. The tourist images of towering icebergs floating on glassy calm waters was not the picture that faced them for their challenge.
UNDERWATER HOCKEY PLAYER
Toks has lived in Pinelands for 20 years having come to the Cape with his family from Bloemfontein. He has always been a keen swimmer and was awarded his national colours for underwater hockey. Naturally Toks did his national service with the Navy Diving School at Simonstown, and also spent time with the Navy in Durban.
REGULAR CAMPS BAY
It is not surprising that someone so involved with cold water swimming does a regular Sunday swim in Camps Bay, with an occasional stretch to Robben Island. The Ice Swimmers practice here as often as they can – Toks believes that constant training is the answer to success in their cold swims, helping them to recover more quickly from the dangerously low body temperatures.
USHUAIA TO THE ANTARCTIC PENINSULA
The group of swimmers, consisting of Toks Viviers, Ram Barkai, Andrew Chin, Kieron Palframan, Gavin Pike and Ryan Stamrood sailed from Ushuaia for the 11 day Antarctic trip. As the Ocean Diamond negotiated Drake's passage and proceeded along the west coast of the Antarctic Peninsula, the team prepared for their first opportunity to swim inside the Antarctic Circle as soon

as the ship crossed the 66th latitude. The weather was against them though with rough seas and winds that prevented the ship from laying anchor. No pleading or persuasion could budge the captain's decision not to allow the swim in the treacherous seas. The next day was the same and the disappointed team had to accept that their swim would not happen as far south as they had anticipated.
SWIMMING AT LAST!
Sailing north again they reached Neko Harbour where the first three swimmers plunged into the icy –1oC waters to attempt the one mile swim. The tough conditions resulted in only one swimmer completing the distance. Later the same day at Paradise Harbour Toks Viviers and the remaining swimmers took their turn in the freezing water, wearing only their speedo swimming trunks, silicone caps and goggles. Our very own Pinelander Toks Viviers was successful and completed his ice mile in 25 minutes and 30 seconds. “From Pinelands to Antarctica” said frozen Toks.
HOW WOULD YOU DESCRIBE THE SWIM?
"There is the initial shock of hitting the cold water and head pains that last for seven to eight minutes. Then you just have to concentrate on moving – keep swimming to get to your destination, remembering that there is a medical safety time limit of 35 minutes in the sub zero water. The support team follows in a zodiac as well as a kayak, monitoring the swimmer's progress."

HOW DO YOU MANAGE THE FREEZING COLD?
"There may be a genetic component but I feel that with training anyone would be able to master a cold water swim – it is just a matter of getting your body used to the change in temperature. I don't have any special meals, but it is logical that one couldn't be too thin for example, because one's body temperature would drop too quickly. It is a mental challenge as much as a physical challenge, and this is probably why we work well as a team, having done a number of cold water challenges together. "
HIGHLIGHTS OF THE TRIP
"Finishing the swim! This was certainly not a holiday experience. The days of waiting for the swim to happen were purgatory. We couldn't relax and enjoy our surroundings while we waited for the opportunity to swim. Just after we finished we saw an Orca whale, and during the tour we saw many Leopard seals both of which can be dangerous to sea swimmers."

Few of us will ever have the opportunity to travel as far south as the Antarctic circle, and experience the huge ice bergs, glaciers, and sea life in this remote part of the world. Quark Expeditions organised trips cater for tourists keen to experience a "polar plunge" – an icy dip into the ocean, or a climb on an Antarctic ice wall. Experienced paddlers can take a kayak trip into the ocean areas that are not accessible by ship, and float between the ice bergs while playful and inquisitive penguins and seals swim close by. There are a number of Leopard seals that have a reputation for being dangerous, and of course one has to keep an eye open for whales, humpback and orca. Land trips include camping on the ice, mountaineering and cross country skiing. From Cooking from the heart Makes 12 small scones 250 ml (1 cup) wholewheat flour 250 ml (1 cup) cake flour 15 ml (1 tbsp) baking powder 1 egg, beaten 250 ml (1 cup) plain yoghurt 60 ml (¼ cup) sunflower oil 1. Preheat the oven to 180 °C. 2. Lightly grease a baking tray and dust with a little cake flour. 3. Mix the flours and baking powder in a mixing bowl. 4. Beat egg, yoghurt and oil together. 5. Stir egg mixture into the flour until it just forms a soft dough. 6. Gently press dough out onto a lightly floured surface to about 2 cm thick. Take care not to handle the dough too much. 7. Cut out scones using a small cookie cutter or water glass. Dip the cutter or glass in extra flour if necessary. Place scones on baking tray. The left-over dough can be pressed together and cut into more scones. 8. Bake for 15–20 minutes or until golden brown and cooked.
Tip
A pinch of cayenne pepper or paprika can be sprinkled on top for a savoury scone.

PROPERTY DEFECTS AND THE VOETSTOOTS CLAUSE Years after the inception of the Consumer Protection Act (CPA), there remains a misconception that the CPA did away with the voetstoots clause. When buying any goods, there is an implied warranty that they are free from any defects. However, second-hand goods are likely to have defects, from normal wear-and-tear. In such cases, the parties contract out of this implied warranty by including a voetstoots clause in the agreement of sale. There are two types of defects – latent and patent. • Latent defects are not immediately obvious (eg. a leaking roof ). • Patent defects are apparent upon a reasonable inspection (eg. missing tiles). A voetstoots clause protects a seller from liability for patent defects as a purchaser has a duty to inspect the property before concluding the agreement of sale. However, the seller will only be exempt from liability for latent defects if he was not aware of the defects at the time the sale was concluded. If the seller was aware of defects and concealed it from the purchaser, then the seller could be held liable. Sellers often make cosmetic improvements to increase the selling price. This is acceptable, unless done to conceal a problem (eg. painting over damp or filling cracks without correcting the cause thereof ). The CPA will only apply to the sale of property if the seller is selling the property in the ordinary course of his business and if the purchaser qualifies as a consumer to whom the CPA is applicable. Generally, the CPA will not apply to the sale |of property in |private April 2014 the muse 21 sale transactions. Under section 55 of the CPA, a consumer has a right to receive goods that
are free from defects. If the agreement of sale is subject to the CPA, the seller cannot rely on a voetstoots clause to avoid being held liable for any defects in the property, regardless of whether the seller was aware of the defects or not. So, if the purchaser is a consumer in terms of the CPA and he buys a property from a seller who is selling the property in the ordinary course of the seller’s business (eg. a developer), then the seller will not be able to benefit from the voetstoots clause. The parties can, however, still avoid the implied warranty and sell the property as it is, provided that they describe the property in detail and the purchaser expressly accepts it in such a condition. Defects are often a bone of contention between parties to the sale of a property. To avoid such disputes, parties should clarify the condition of the property prior to concluding an agreement of sale.
