Legal Matters with Howlett Clarke Absolute have teamed up with Brighton’s oldest law firm QualitySolicitors Howlett Clarke to bring you a monthly insight into the latest legal issues, with top tips and advice.

Tribunal fees have a place but should not be a barrier to justice. The introduction of employment tribunal fees this summer have proved highly controversial and divisive, with the trade union Unison claiming the new system will allow unscrupulous employers to “ride roughshod” over workers’ rights. For the first time in more than 50 years, people wanting to bring a claim must now pay a fee. Under the new rules, it will cost £160 or £250 to lodge a claim, with a further charge of either £230 or £950 if the case goes ahead. Fees must be paid online at the point of issuing. There are two new categories of claims. Type A is for basic claims such as unpaid wages and unpaid holiday where an award may be low. Type B is for more complex claims including unfair dismissal and discrimination where an award could be far higher. From my perspective as an employment law specialist, the fee structure does have some advantages, mainly that it will help act as a disincentive to poor quality clams brought by staff in the hope of an easy win, with nothing to lose. Such claims can cause long periods of uncertainty and stress for employers who may be in the right. As stated by Justice Minister Helen Grant, is it fair that the taxpayer should foot the entire £74m annual bill for people to escalate workplace disputes to a tribunal? She said: “We want people, where they can afford to do so, to pay a contribution.”

Although a fee remission system will be put in place, it will be limited and only offered to those who have earned less than £15,000 in the last 12 months. On balance, I believe the new fee structure has a place in the modernday workplace and for many employers represents a welcome and sensible piece of legislation. In places, it is poorly thought out, not only for workers who may be put off making a claim, but also for employers who would rather settle smaller

fees. This is a view shared by Unison who in July were granted permission to seek a judicial review of the new fees. Time will tell if a review is successful and whether the fee

It’s really not good enough for our historic city! So here’s my latest big idea. Fill in the arches along Madeira Drive. They are dingy spaces (and rather smelly after a typical Brighton weekend!) Turn them in to fantastic restaurants, cafes, galleries, shops and bars, using the upper level as terraces, all with great sea views. Then build a world class hotel and spa on the Black Rock site. It would attract people from all over the UK and abroad. Taking the 22

T

HE American Express Community Stadium is a magnificent edifice which emerged out of the rolling South Downs just south of the A27. It is the city’s major sporting citadel. The Seagulls play their home games there. It means more than 20,000 can make their way to make their way there when each one is staged. And even when Oscar Garcia’s boys are not performing, the club help ensure the stadium is used for other purposes to help turnover and the community. There are lots of people involved to ensure the stadium which club owner and chairman Tony Bloom bought, maintains its status in Brighton and Hove. There are rather less over at the city’s racetrack overlooking the sea. And it could be argued those in the employ of the Race Hill site have a tougher job than their footballing counterparts in certain respects. For start, Albion is a passion, often exceeding the borders of obsession, for many of Brighton and Hove’s sports fans. Many stuck with them over the ‘homeless’ years and got involved in the fight for a permanent home. Brighton Racecourse might have a core of obsessives who pore the fixture list each year to plan their holidays around, but that core is far less in number than the one which represents the Albion.

And the general state of horse racing does not help matters. The industry has been going through a rough patch. Too many fixtures, too few horses and punters and too little prize money has led to two-horse races in front of a handful. The days when entries for a race were so large they had to be split into two have been a bygone memory for many. So inventiveness, energy and teamwork has been needed to increase Brighton’s attractiveness. A need to strengthen bonds in the city and spread the net wider, to lure in more racegoers. Not just geographically, but demographically. Put on entertainment beyond the racing, for instance. Pop bands, charity promotions. It needs a bright, personable leader to recognise what is needed and then go out and fulfil those needs. Stuart Dorn is such a person. The Brighton general manager, an Albion fan as it happens, has made a fist of the task and, it seems, judging from the successful three-day Festival in August, the track seems to be on an upward curve. Dorn took on the challenge

t has certainly been a busy month of sport since my last column. From Andy Murray winning Wimbledon in such a dramatic and comprehensive fashion in the scorching heat ending over 70 years of wait for a British winner to Chris Froome making it back to back wins for British riders in the Tour de France in the 100th anniversary of the race and with England beating Australia in the Ashes, there has been a lot to celebrate in British sport at the moment. July also marked the one year anniversary of the London Olympic and Paralympic games, with all the brilliant memories and moments that brings to mind. As well as being a great sporting occasion, the Games marked an opportunity to showcase Britain to the world and to ensure a lasting legacy. That is why I read with great interest the recent Visit Britain report which landed on my desk this month, outlining the impact of the 2012 Games on the image of Britain and inbound tourism. The early signs are very good. Britain welcomed 31.1 million overseas visitors and the amount of money spent by these visitors grew by 4%, reaching a record ÂŁ18.6 billion for the UK economy. As well as perceptions of British Sport improving, so did perceptions of our culture, natural beauty and the welcome. Perhaps most encouragingly, the report suggests that the Games delivered not just for London, but for all of Britain, with three quarters of people saying they wanted to see more of Britain than London alone. It is great news that as well as the Olympic and Paralympic Games being such a success from a sporting stand point, the country is continuing to benefit from the impact of hosting the games in other ways as well, with Tourism making an important contribution to the economy of Brighton Kemptown and Peacehaven. Again credit must go to everyone involved with the Games, and in particular the volunteer “games makersâ€? who helped make the occasion so special. I am always conscious that up and down the country, at every level of sport, it is the volunteers giving their time so generously which allows so many events to take place. It is important we never forget the important contributions these selfless individuals make.

The Festival is a rare opportunity for creatives, entertainers and geeks to combine forces and create an assortment of events promising something for everyone. Visitors can choose from cutting edge art installations, literature and comedy nights to highbrow digital and creative conferences, 48-hour hackathons, live music performances, plus everything in between. With so many events covering such a broad range of interests, planning your festival itinerary is no easy task.
