Gazette Premier moves on VBS Mutual Bank scandal

As Platinum Gazette started to roll off the press on Thursday morning, the Fetakgomo Tubatse Local Municipal Council was set to hold a special council meeting in order to suspend senior officials following the Venda Building Society (VBS) Mutual Bank scandal. On Wednesday Premier Chupu Mathabatha briefed the media in Polokwane about the issue, saying: ”Even before the ‘Great Bank Heist’ report by Advocate Terry Motau, the Provincial Government had initiated a Forensic Report through its Treasury Department. The final report should be available at the end of this month and will give us necessary direction with regard to further steps on this Venda Building Society (VBS), saga. As you may know our initial report shows that 10 municipalities invested about 1,2 billion of rands in the VBS, and these are Polokwane, Makhuduthamaga, Elias Motsoaledi, Makhado, Ephraim Mogale, Collins Chabane, Vhembe District, Greater-Giyani, Lepelle-Nkumpi and Fetakgomo Tubatse. Of the 10 above-mentioned municipalities, investments for 3 municipalities namely Polokwane, Makhuduthamaga and Elias Motsoaledi matured and both investments and interest paid to the municipalities. Elias Motsoaledi is still owed a certain amount. As a Province we decided that remedial actions be taken against officials who may have acted outside the bounds and powers of the laws including the Municipal Finance Management Act and the Public Finance Management Act (PFMA)Forensic report. We have even pre-empted actions and report from our So far remedial actions taken include; • Vhembe District Municipality: Municipal Manager Mr Reuben Rambado and CFO Mr Muchave have been suspended. • Fetakgomo Tubatse Local Municipality: to take decision to suspend Municipal Manager Busani Patience and CFO Frank Maredi at a special council sitting tomorrow. • Ephraim Mogale Local Municipality: Intention to suspend soon. We will ensure that basic service provision continues unabated at local level. Recovery plans are being developed and implemented to ensure services are not compromised. I have also instructed the MEC for Coghsta , Mr Jerry Ndou to present in the next EXCO, Municipalities that should be put under administration because of their inability to provide necessary services. We therefore urge our communities to raise their concerns through legal and constitutional means. We are committed as a Provincial Government to provide a clear and concise information on what is being done to address the VBS matter”. Meanwile, the SAMWU strike at the Fetakgomo Tubatse Municipality continues, although the union welcomed the imminent suspension when the newspaper asked for the comment of members just before going to press. “Yes, we welcome the provincial government’s action on the VBS matter. Although it is linked to our placement and amalgamation issues, we still don’t experience relief around those problems”.

Let the safety lights shine bright at ECM S

amancor Eastern Chrome Mines (ECM) kicked off their “Shine your light on safety” campaign this week. The year is at that time where we are entering the so-called ‘silly’ season. Traditionally people cannot wait for the December Christmas holiday and this often leads to unnecessary accidents and incidents due to a lack of concentration and letting small safety issues pass. These can have an impact on the total safety of employees at the mines. ECM encourages employees to work safely, use the ‘Red Stop Cards’ and use the right to withdraw from an unsafe environment. They are also encouraged to be a ‘brother’s keeper’ and take the lead to address any safety related issues as soon as they are observed. The campaign will stretch until March 2019. The launch this week took place at Tweefontein Mine and Lannex Mine. Next week it will move to Doornbosch, Chrome Section and Shared Services. A special industrial theatre crew brought a safety message that underlined the need to ‘Shine your light on safety’. Characters in the play explained very relatable situa-

tions employees have to deal with every day. It was also explained that safety and production could never be separated. Production is needed for business survival and job security, but safety is key in achieving the production for everyone’s benefit. Employees enjoyed participating in the question and answer sessions where great prizes were up for grabs. They danced and were eager to lead and light the way with safety at their various sites. SHEQ Manager, Murendeni Ngobeli encouraged them to take responsibility for their own safety so everyone can return home safely at the end of the day. Achieving zero harm every day.

Be careful on these roads The Police in Ohrigstad appeal to motorists driving on the R555 between Ohrigstad and Burgersfort and the R36 between Ohrigstad and Hoedspruit to be extra vigilant to avoid possible harassment and hi-jacking. The warning follows an incident which happened on Saturday 2018-11-03 when a man traveling alone in a white Nissan NP200 noticed a suspicious white BMW with no registration numbers following him and driving very close to him next to the railway crossing at Longsight Ohrigstad on the R555. The victim continued to drive until he joined the R36 at the Ohrigstad-Hoedspruit. The vehicle followed him until they accosted him and forced him off the road. Four men camouflaged with balaclavas held the man at gunpoint, tied his hands with a rope and blindfoled him. The robbers took the victim’s wallet, blindfolded him and dumped him near Kgautswana (Rietfontein). After preliminary investigation the victim’s vehicle was found burned in the mountains at Kgautswana. Anglo American Platinum (Amplats) said on Thursday last week that it had completed the acquisition of both Glencore Operations South Africa’s 40.2 percent interest and Kagiso Platinum Ventures 9.8 percent interest in the Mototolo joint venture (JV) for a total consideration of R267.9 million. This means that Mototolo will became a wholly-owned operation of Amplats with effect from last week. The Mototolo mine is a large platinum mine located in Burgersfort, Limpopo. Mototolo represents one of the largest platinum reserves in South Africa, having estimated reserves of 5.5 million ounces of platinum and it produces around 57,000 ounces of platinum per year. The Mototolo JV was operated as a 50/50 joint venture between Anglo American Platinum and a partnership between Glencore (39%) and Kagiso Tiso Holdings Proprietary Limited (“KTH”) (11%). Amplats paid Glencore an upfront purchase consideration of R0.9 billion and a deferred consideration will be settled monthly over a six-year period and will be determined based on the rand platinum group metals prices over the Mototolo JV life of mine to 2024. A total purchase consideration of R267 million was paid to Kagiso, with no further deferred consideration being payable. Chris Griffith, chief executive of Amplats, said the transaction will unlock significant value and extend the life-of-mine by more than 30 years. “The acquisition of the Glencore and Kagiso interests in the Mototolo JV results in Anglo American Platinum wholly-owning a mechanised, low-cost, high quality resource, creating another major PGM hub for the company,” Griffith said. “The transaction unlocks significant optionality for the company in its adjacent wholly-owned Der Brochen resource, and will increase the life-of-mine to over 30-years creating material value for Anglo American Platinum.”

Competition Amendment Bill passed Economic Development Minister Ebrahim Patel says the Competition Amendment Bill is “transformative in character” as it will promote the participation of small enterprises in the economy, while aiming to dismantle cartels. The Minister said this when the National Assembly held a debate on the second reading of the Bill in the National Assembly recently. “If we are to grow the economy much faster and we are to bring in fresh investment, and if we are to support small business development, we must take measures to deal with the structural problems of the economy. This includes high levels of economic concentration that acts as a restriction for new entrants, new investors and new firms,” he said. After a vote, the Competition Amendment Bill was passed and referred to the National Council of Provinces for concurrence after 194 Members of Parliament (MPs) voted for, with 83 voting against the amendment. There were no abstentions. The Bill introduces several measures aimed at tackling anti-competitive behaviour from bigger firms. Outlining some of the benefits of the Bill, the Patel said: The Bill gives small businesses a special status as actions by dominant firms will now be subject to more scrutiny on practices like discriminatory pricing, which have been found to be damaging to smaller players; Consumers and customers will have better protection from excessive pricing by dominant firms, with the law set to put in place clear criteria that the courts can apply to determine if the price is excessive; Small suppliers will now have remedies against abusive buyer power from dominant firms when unfair pricing and trading conditions are imposed on them; Workers ownership of shares in companies will be promoted through a criteria on expanded ownership during mergers; Citizens will know that government will protect the country’s national security interests when a foreign acquiring firm wants to buy a South African firm in security sensitive areas; Large businesses will know that penalties are much tougher for breaking the law but they will also have a lot more flexible regime in place to get exemptions to enable them to collaborate with each other to help expand South African production, grow the country’s export markets and developing new technologies to create jobs; New investors will know that the market is open, that new players can know that monopolies are now being dismantled and that economic concentration is being addressed so that the country becomes more innovation-driven, more dynamic and more inclusive.

The National Student Financial Aid Scheme (NSFAS) has called on all learners, who have not yet applied for 2019 financial aid, to submit their online applications before the closing date. Applications will close officially on 30 November 2018. NSFAS Administrator Randall Carolissen said since the application cycle opened, the scheme has received 191 887 applications. This is more than double the applications in October 2017, when only 90 000 applications had been received. Applications opened on 1 September 2018 to eligible students wishing to further their studies in 2019 on an approved course at any public university or Technical and Vocational Education and Training (TVET) college in South Africa. Students are encouraged to submit online applications or visit their nearest National Youth Development Agency (NYDA) centres before the closing date. Carolissen emphasised that there will be no extended window period for the 2019 applications, therefore “NSFAS will not accept any late applications after the 30 November 2018 deadline”. An important messages for applicants were also given: Do not change your cell phone number or email address used for the application. These will be used by NSFAS to communicate the result of your application to you. Applicants who wish to inquire about their application status, or contest funding decisions can do so by calling the NSFAS contact centre toll free number 0860 007 327. Students who are funded by NSFAS for the first time are required to sign the NSFAS bursary agreement form. The proposed development will be an extension of the approved Mine Works Programme which triggers an amendment on the existing approved EMPR and WUL to include the Chrome Section mining extension on Portions of Winterveld 293 KT and Doornbosch 294 KT farms. To maximise operational efficiency, ECM intends to further exploit the Chromite ore at Chrome Section operation on the Farms Doornbosch 294 KT and Winterveld 293 KT. Chrome Section operation project remains critical to the ECM’s long-term sustainable growth as it plans to add 90kt per month over a period of 30 years through the Underground Operations. Furthermore ECM intends to apply for an amendment of the Environmental Authorisation and the Water Use Licence for operations on Portions Winterveld 293 KT and Doornbosch 294 KT Farms. ECM has appointed Segope Consulting as the Independent Environmental Assessment Practitioner to undertake the environmental authorisation and associated stakeholder engagement process. An integrated process will be followed to meet the requirements of the National Environmental Management Act, 1998 (Act No. 107 of 1998) (NEMA), National Water Act (Act No. 36 of 1998) (NWA) and Mineral Resources and Petroleum Act (Act No. 28 of 2002) (MPRDA). Duties (including but not limited to): • Coordinate and control outbound logistics between Dwarsrivier Chrome Mine and the Ports (Richards Bay, Maputo and Durban) • Review procedures as and when required • Generate certificate of analysis and submit for approval for every order • Prepare weekly and monthly reports, including Contractor and Material Reports • Ensure dispatched product is within customer’s specification • Reconcile and verify that information regarding stock levels captured on the MES system is accurate and records are kept for legal compliance • Ensure the stock quantity of material at the station before loading the wagons • Ensure timeous turnaround of truck arrival, loading and deliveries • Over-inspect all loading points off-site • Monitor stock condition and prioritise order dispatches • Plan and coordinate stock ports • Oversee contractors to ensure the required loading and cleaning standard is adhered to at the Port • Monitor dedicated transporter through agreement based on penalty clauses • Investigate and introduce corrective measures on deviations • Ensure that all material is cleared on the ground and reconcile before the batch of material is transported to the station • Investigate deviations and implement corrective measures • Monitor the railing of the wagons to the Port and visit hot theft spots • Arrange weighing of the wagons before and after the offloading • Reconcile and investigate the differences • Ensure all material offloaded from the wagons are on the stockpile identified • Ensure proper stockpile management in Port • Ensure all wagons are offloaded and cleared out of the Port • Implement harbour visit report that will involve the shipping companies’ normally acting as clearing and forwarding companies • Ensure nomination of vessel is clearly communicated to all relevant parties • Ensure that product meets the required quality specification, free of any foreign material and contamination while on stockpile at the Port • Ensure correct loading of vessel is done from the correct stockpile at the Port • Reconcile stock at the Port to be done on completion and immediately the relevant department at the Port should there be any deviations • Physically monitor stock at the Port • Ensure the proper communication of truck list released from the mine • Report trucks with mechanical failures immediately and recovery process to be put in place • Ensure all trucks released from the mine report to the Port timeously • Ensure all trucks arriving at the Port are already listed with the Port and trucks to report to the staging area on arrival • Ensure all road trucks entering the harbour are weighed on static approved weighbridge • Ensure trucks are fitted with seal tags with unique numbering and company based • Ensure seals are not tempered with before arriving at the Port • Ensure trucks are escorted to the stockpile in the Port • Ensure quality and foreign material on the stockpile • Assist with customer complaints investigations. Selection will take place according to the Dwarsrivier Chrome Mine Recruitment Operating Procedure. A strong consideration will be the individual’s fit with the Dwarsrivier Chrome Mine Values. The successful candidate will be appointed on the Dwarsrivier Chrome Mine Conditions of Employment, which includes being certified medically fit as per the Mine Health and Safety Act, 29/1996. LWUA responds to complaints Lebalelo Water User Association (LWUA) responded to issues raised by community and Working Committee members of seven communities (communities of Sehunyane, Shakung, Ga-Masete, Malokela, Pataneng, Modubeng and Phala) surrounding the LWUA operations. Some background to these allegations made by the group last week, was also provided. “During May/June this year some of the community members stopped LWUA to operate claiming that LWUA operates illegally and also claiming that they (communities) are members of LWUA and they want their dividends for the past 16 years. LWUA arranged a meeting with the Premier’s office, DWS, community leaders and LWUA on 13 June to discuss their grievances. The outcome of this meeting was that a working group was established which would report back to the meeting. Furthermore LWUA has carried out a strategic review and is currently in the process of formulating and rolling out the projects that were identified to support its new strategy. The objective of the new strategy is to improve lives through water. The strategy is widely supported” said Mr Bertus Bierman CEO of LWUA this week. He offered to further engage with the newspaper with regards to the strategy. “The Premier of the Limpopo Province send the MEC to represent him at a meeting on 13 June where the same claims were made. The working group had a 3 month mandate to discuss the issues referred to at that meeting. This working group’s mandate has lapse, yet LWUA is still engaging. I belief that the complainant must use all the recourse he thinks may be able to

assist him. The most effective recourse will be to ask the court to make a ruling as was explained to the complainant so many times”. Part of the complaints to the newspaper last week was frustration about an alleged unwillingness from LWUA and Sekhukhune District Municipality (SDM) to engage with the group. According to Bierman the meeting scheduled for last week was cancelled well beforehand, but “Mr Moela responded various times pushing for the meeting to continue whilst the invite was defect.” (The newspaper has seen e-mails to this effect). In addition SDM forwarded a SMS at 6h00 on the day of the meeting confirming that the meeting is cancelled. “There is a dispute between communities about the representation and it may be conducive to confirm with all the communities mentioned above. LWUA was informed that some Traditional Leaders met with the Tubatse Municipality to complain about the specific persons” said Bierman added. One of the major complaints raised with the newspaper was that although the communities are situated next to the river, they do not receive water from it and according to them, LWUA is responsible for this and not coming to the party. Bierman however explained: “Lebalelo Water User Association is established in terms of the National Water Act with a mandate to provide raw water to its members (Industrial members – mines and ordinary members – DWS). The Sekhukhune District Municipality (SDM) is the Water Service Authority in terms of the Water Services Act and responsible to treat and distribute water from the LWUA pipeline to the communities. This was explained at each

meeting and the SDM has also confirmed it at the previous meeting”. In an attempt to further try and to provide constructive support LWUA has previously appointed a company to determine the cost of a potable water scheme “with the understanding that it can then provide SDM with the information and negotiate with SDM to consider this as a project. The SDM has decided not to continue with the project and therefore nothing further happened. SDM is the only Authority that has a mandate to decide on potable water projects”. Last week Mr Willy Mosoma from SDM also responded to the newspaper confirming that these communities are however receiving water through a borehole system and that they are not aware of any water supply problems. The group that met with the newspaper last week complained that the security from Lebalelo cut their fences meant to protect the crops they are trying to grow from animals roaming the area. To this Bierman explained the following: “The farmers are putting up fences over the servitude areas where our pipeline traverses. Some of the people from some of the communities over the past years continuously damaged the LWUA infrastructure and therefore the security vehicles need to use these roads. LWUA is committed to find an amicable solution for this and is investigating options to work with the farmers. Our newly appointed Social Development Manager Mr Solly Manyaka will engage with the farmers. This specific issue has come to our attention this week as the farmers has now started to erect their fences to protect their future crops”.

Servitude areas are protected by law and no building or activities are legally allowed to happen on these areas. LWUA is operating according to a water use license issued by the Department of Water and Sanitation (DWS) for a period as determined by DWS. Part of the complaints last week were that the group is unhappy that they were not included in the last review of the license in 2008. “All licenses has a 5 year review option should the DWS wishes to do so but it is not compulsory. This is entirely in the hands and discretion of the DWS. The date of 2008 is also incorrect as the license was issued in 2004 and amended in 2007 when LWUA funded the raising of the Flag Boshielo Dam. DWS may consult with parties if they so require and it is the DWS’s prerogative” Bierman said. Community concerns about things like the LWUA constitution and the signing of it had been raised at various meetings. “This issue was mentioned many times by the complainant and was clearly answered by the MEC and the DWS. If Government was convinced that the procedures were not followed or were incomplete, they would have acted to either rectify or acted against the it. As explained to the complainant that he/they are welcome to engage in a legal action to prove to a court that all other views are wrong and only their interpretation of the law is correct” Bierman added. Frustrations from the group that the traditional authority is being undermined was also addressed. “I can’t comment on the internal traditional leader conflicts that spill over to relationships with LWUA. I engage with communities but some prefer not to participate”.

Fun and development of the youth at soccer tournament On Saturday 3 November 2018, Central United F.C. hosted a Football and Netball tournament at the Samancor Eastern Chrome Mangabane Sports field. Participating soccer teams were Central United from Montrose, Tubatse Masters from Burgersfort, Mmashadi Masters from Jane Furse and United FC Legends from Witbank. On the netball side it was Modikwa netball team, Coromandel Rock Stars from Lydenburg and Driekop Sun Shines. Part of the event was to show-case the under 15 football talent with an aim of selecting the few talented young stars who will be sent for trials with professional academies in December. The results on both sporting codes were as follows: Football: 1st Semi-final: Tubatse Masters 1 – 3 Mmashadi Masters; 2nd Semi-final: Central United FC 1 – 2 United FC Masters; Talent display: Central U/15

Some of the Modikwa runners at the Old Mutual Soweto Marathon - Mokaila Lawrence Tjia, Capri Maluleke, Jeffrey Nkuna, Violet Mabitla and Albert Tsosago all participated in the race. They were part of 11 Modikwa runners completing the race.

Alfred Tlaka qualified for Comrades with this race. Rudolph Mokgomola, Sonia Makua and Innocent Ngobeni were some of the other Modikwa runners at the race.
