that Chilliwack residents should vote for five out of seven commissioners at the lake. But current Cultus Lake Park Board (CLPB) commissioner Sacha Peter says the simplicity of the petition overlooks a number of important things, not least of which is

that Cultus Lake Park is owned by the City of Chilliwack. “The City of Chilliwack is on the title of the land,” Peter told the Times. “If such a change were to be considered by the government, at a minimum this would need some sort of consultation with the City of

Chilliwack.” But there’s more. “Right now, the people of Chilliwack get to control, through the election, who gets to be on the board of the Cultus Lake Park Board. If there is a change of control [it] would trigger First Nations

high-risk sex offender has moved to the ChilliwackHope area, according to the Corrections Branch of the Ministry of Justice. For ty-six-year-old Graham Lackey is a high-risk, repeat sex offender with a significant criminal history, including: indecent exposure, possession of child pornography, uttering threats, theft under $5,000 and breach of probation. Lackey is five-foot-10 inches tall and weighs 179 pounds. He is described as Caucasian with brown hair and blue eyes. The last time Lackey—who has 37 convictions dating back to 1989, including 17 sex-related convictions and a dozen for violating sentencing conditions—was released, it took just 24 minutes See SEX OFFENDER, Page 4

Mom humbled by nomination

L

ocal Columbia Valley mom Susi Vander Wyk is one of 20 semi-finalists for Walmart’s Canada-wide 2013 Mom of the Year Award. The mother of three was nominated by her niece, Katrina Clow, and her story was picked from more 24,000 others for a chance to vie for a spot in the next round.Victory would earn her $10,000 for the charity of her choice (Families of SMA Canada) and another $10,000 to dispose of however she wants. No one deserves the award more than “Tante Susi,” according to Clow. “She’s simply one of the most amazing women I know,” she said in a nomination video posted on the award website. Like most moms, of course, Vander Wyk said she doesn’t exactly feel like a mom of the year. She said for her, the word “mom” comes with two other words appended: guilt and worry. “You feel like, ‘Am I doing the best I can? Am I doing it right? Could it have been better if I’d done something else?’” she told theTimes.

Those questions got a lot louder 14 years ago when her daughter Holli, her middle child, was diagnosed with Type 2 Spinal Muscular Atrophy (SMA) at age two. The number-one genetic killer of kids under two, SMA is a rare degenerative disease that affects the nerves’ ability to send messages from the brain to the muscles. As the disease progresses, unused muscles weaken, including those used for breathing. “When you get a diagnosis like spinal muscular atrophy, it rocks your world,” Vander Wyk said. Most children with Type 1 SMA don’t live past age two. Holli’s type has meant life in a power wheelchair, a 10-anda-half-hour spinal fusion surgery at age 12, a 42 per cent lung capacity and numerous other complications. Vander Wyk said she hid in a shell for about a year and a half after getting her daughter’s diagnosis. What finally broke her out of it was helping others, and she’s been doing that ever since. “There are things that my mom does for others that no one knows but my family,” Holli wrote in a Facebook

post on the Mom of the Year Award website. “She has been our school PAC president for several years, tutored kids with learning challenges, donated anonymously to underprivileged families at Christmas with gifts on door steps, donated to teen mom programs, sat up for many nights with parents of children who were dying at Canuck Place, helped my brother and I start a charity, taught us kids the meaning of compassion and giving . . .” Vander Wyk’s first move after coming out of her shell was to start EPIC, a local support group for parents of kids with disabilities. She also became deeply involved with Families of SMA Canada, an organization that raises funds for research and to support families of children with SMA. Besides her current twoyear term as president, she has organized an annual SMA family camp at Cultus Lake for 14 years that has drawn families from across Canada, the U.S., Asia and Europe. Families of SMA is a lifeline of hope and support for families like Vander Wyk’s, and it’s the chance to win that cause some much-needed money that has her excited about the

mom-of-the-year nomination, which otherwise left her mostly “shocked and humbled and embarrassed.” “Finding a cure for this disease is paramount. There are parents that don’t even know yet that their child has it, and there are parents that haven’t even conceived yet that will be going through this horrid pain. This needs to end.” She hasn’t yet decided what she would do with her own $10,000 if she made it to the final eight of the contest. Her first impulse was to donate it too, but when she thinks of all the time her husband Bruce and kids Dexter, Holli and Amy have volunteered alongside her, and how they carried SMA campers around on their backs, helped comfort siblings going through fear for their SMA brother or sister, or stayed at home while their mom was at the hospital comforting a fellow SMA parent, she tears up and is torn between giving the money away or using it for something like a family trip. “When I volunteer, my kids are in there too,” she said. ◗ Voting runs until Aug. 1. Now a Cultus Lake woman is standing trial this week in connection with the 2010 hit-and-run that broke a pedestrian’s legs and left chunks of his bone on the windshield of the car that struck him. Virginia Bast pleaded not guilty Monday to charges of dangerous driving causing bodily harm, impaired driving causing bodily harm and leaving the scene of the accident. Bast is alleged to have struck Victor Dyck on Feb. 6, 2010, near Cultus Lake Market. Both Bast and Dyck had just left the nearby Cultus Lake Pub—Bast in her car, Dyck on foot. Crown counsel Paul Blessin told the court that Bast hit Dyck, then continued driving. Blessin said she tried to turn onto Leavens Road to go home, but failed to negotiate the turn and crashed into a vehicle parked in the driveway of a home. The owners of the home found Bast in the car. Blessin said a blood alcohol test turned up a reading below the .08 legal limit. But he said Bast’s behaviour “seemed to indicate a greater degree of impairment.” Blessin admitted the charge of impaired driving will be more difficult for the Crown to prove than the other two counts. Blessin said traces of Dyck’s hair and bits of his bone were found on Bast’s windshield, thereby tying the car to the hit-and-run. The trial is expected to last four days, during which Dyck, along with several police officers are expected to testify.

Local sex offender faces 13 conditions

On March 17, 2013, the day he was released, Mounties watched Lackey get off a bus at 1:51 p.m. in Langley and walk to a pub with a friend. By 2:15 p.m., he was drinking a beer in violation of his probation. He was arrested and sentenced to a further five months behind bars. When asked to be more precise about where Lackey is living this time, BC Corrections spokesperson Marnie Mayhew couldn’t say. “The safety of the public is our primary consideration,” she said in an emailed statement. “That’s why we’ve issued this notification. Hope-Chilliwack has been identified as an area where this individual might be seen, and the public can report any breaches of his court-ordered conditions. I can assure you that he will be monitored closely by RCMP and is subject to 13 strict court-ordered conditions.” Those 13 conditions include: Lackey cannot possess weapons; he cannot consume drugs or

alcohol; he cannot have contact with anyone under 16, nor can he attend places where persons under the age of 16 might be; and he cannot possess or access personal computers or electronic devices capable of accessing the internet. Lackey was convicted in November 2011 of two charges of exposing himself to a person under the age of 16, and one charge of breaching an undertaking. The criminal offences took place in the Comox Valley, but after his prison term he announced he would live in Langley. the 470 residential leaseholders,” Peter said. “If you look at it in terms of dollars and cents, about 15 per cent of [park board] revenue comes from residential leaseholders.” Other revenue comes mainly from commercial leaseholders, Sunnyside Campground revenue and parking. Sue and Gary Lister created a petition to the provincial government with three requests: that the number of commissioners be reduced from seven to five; that the residents of Cultus Lake become the only ones to vote for CLPB members; and that “other sections” of the Cultus Lake Park Act be amended “as needed in consultation with its residents to bring the Act into the 21st century.” It’s this third and final request that also could be the kicker for the provincial representative for the lake, Chilliwack-Hope MLA Laurie Throness. “The third point is really catchall,” he told the Times. “What does that mean? I have no idea what that means.” Throness confirmed his support for the petition “in general terms,” and he agreed that he would present it to the Legislature and even follow up with a Private Member’s Bill on the subject. He does have, however, two questions he needs answered: firstly, he wants to know if there is in fact general consensus on the need for change (a petition on its own doesn’t affirm this) and, secondly, he wonders what the tax implications might be.

Throness supports petition ‘in general terms’ but has questions More than eight decades ago, the City of Chilliwack and the Corporation of the Township of Chilliwhack jointly presented a petition asking Victoria to create a governance structure at Cultus Lake Park. On April 13, 1932, the provincial government created the Cultus Lake Park Act, a piece of legislation that is past its prime, according to

park was as a campground for the residents of Chilliwack, Peter said the concession of two out of seven spots on the park board is enough. He also points out that five of the current members of the park board—Bob McRae, Owen Skonberg, Carlton Toews, Charlotte Hall and Larry Payeur—live or have homes at the lake. Only Peter and Malcolm Shanks do not live at the lake. “It’s not as if the residents are not represented on the board,” Peter said. “Conversely, one could make the argument that the people of Chilliwack do not have adequate representation on the board.” Peter emphasized that his “grave concern” was that if such a change were to even be considered, a “very costly” consultation process with Chilliwack and First Nations would be required. For years, a committee was devoted to studying changes to the governance at Cultus before the idea hit a brick wall. The options were: village status, amalgamation with Chilliwack or status quo. The city didn’t want the expense of amalgamation and the provincial government said “no” to village status. But crucially, either option would have triggered land claims by the Soowahlie band, and Peter said the same thing would happen if the petitioners’ changes were implemented.

w o ow n e r s o f b ra n d new motorcycles met under unpleasant circumstances on Yale Road West in Chilliwack Friday afternoon when a man riding a newly-purchased Suzuki DL650 sport bike T-boned the SUV of man who had just finished buying a Harley at Mountainview Harley-Davidson. The motorcyclist, who was launched onto the hood and windshield of the SUV, was taken to hospital with undetermined injuries. The two people in the SUV were unhurt. Wi t n e s s e s s a y h e w a s conscious and walking at the scene shortly after the collision. “He had apparently just bought [the motorcycle] f ro m Ya m a h a , w h i c h i s only a couple blocks up the road,” said one Mountainview employee. “This was his maiden voyage out.” She said the driver of the SUV had also just finished purchasing a new bike but wasn’t riding it because of

Matt Wright, the driver was nosing his black SUV out of the Mountainview parking lot past some vehicles parked on Yale Road West when he was struck by the eastbound motorcyclist.

“His vision was obstructed,” Wright said of the driver. “It was just bad timing.” For Const. Greg Dykstra, another officer at the scene, it’s a good reminder for drivers to be on the lookout for motorcyclists. “There are a lot of them on the road these days,” he said.

ne person is in hospital with serious injuries after being rescued by firefighters from his burning house Sunday morning. Fire crews responded to the blaze, in the 45000 block of Trethewey Ave., to find fire and smoke coming from a single-family house. Told someone was still in the home, firefighters found the front door locked. They proceeded to bash in the entrance. Inside, near the door, they found the 51year-old homeowner. He was removed from the house and, suffering from smoke inhalation and burns, airlifted to hospital. Twenty firefighters from two halls battled the fire for nearly three hours before it was fully extinguished. The home sustained serious damage. Assistant fire chief James MacDonald said the fire likely began in the kitchen. While a precise cause is not known, the blaze began in the vicinity of the stove, he said.

Five years in prison for ‘burnt-out’ bank robber BY TYLER OLSEN tolsen@chilliwacktimes.com

A

“burnt-out” Chilliwack man with a long history of crime is headed back to prison after pleading guilty to robbing a bank. James Turnbull was sentenced to five years in prison last Wednesday for robbing Prospera Credit Union on Nov. 18, 2011. A large man, Turnbull had already been designated as a prolific offender by Chilliwack RCMP prior to the robbery.

Turnbull entered the credit union wearing a hooded parka, but complied when he was asked to remove the hood, thereby exposing his distinctive full-skull tattoo, the court heard during a sentencing hearing in May. When he reached the teller, he passed a note that read: “I want $15,000 in 50s and 100s. Do not put a dye pack in or hell to pay. Think of your customers . . . someone is outside with a scanner. Do your job, no [one] will get hurt.” Turnbull left with just $400.

Mounties quickly identified a suspect and arrested Turnbull at his girlfriend’s home.

“Now it’s time for me to get up, man up and go back to being normal.” James Turnbull Crown counsel Brian Fell had asked for

a five-to-seven-year prison term. He cited a pre-sentence report that he said “shows someone who is entrenched into criminality at an early age and has never taken any steps to rehabilitate himself.” Turnbull’s lawyer, Suzanne Paterson, asked for just house arrest for the crime. She took issue with the report and called her client to the stand. There, Turnbull, said he was “burnt out” and done with crime. “Now it’s time for me to get up, man up and go back to being normal,” he said.

Unique summer movie I hate all these summer movies. They’re so samey, so repetitive, so much like last summer’s, and the summer before that. I’ve got a great idea for a summer movie, one that will shake up the tired clichés of the megaplex and really get people excited about film again. Ready? Here we go! So there’s this young boy, or maybe a young girl, I haven’t decided, and he (definitely he) grows up on a farm in Kansas with loving parents, until they’re horribly killed by aliens while she’s out hoeing the beet field. Our protagonist (eh, maybe it’s a girl) grows up in the alien-fighting underground, battling the sinister forces of the Sinistaar (that’s the aliens) with a rag-tag group of misfits, including his former high school pottery instructor, a cardcounter from Las Vegas, an autistic savant NBA player, and their pet sheep. They’re driven underground by the Sinistaar, where the mole people rescue them, but the mole people don’t want to fight the aliens, even though their giant digging machines and radar-targeted spud guns could change the course of the war. The protagonist (a guy?) saves a baby mole-person from a rampaging mutant carrot, and with the aid of a rousing speech, the mole people are at last convinced to help. They tunnel back to the surface and are greeted by Danny Devito

Be Our Guest (playing himself) who is now the leader of the resistance. The protagonist challenges the alien leader, Leedaar, to single combat, but Danny Devito knocks him out and takes his place. Amazingly, Danny Devito beats the aliens in a no-holds barred jai alai tournament for the fate of the world. This scene will need plenty of dramatic slo-mo. Sadly, the pet sheep is killed by an errant ball. The protagonist sheds a single tear. Danny Devito is declared president of Earth, and integrates the mole people into the economy, getting them jobs at Costco. Protagonist (a girl, I’m sure this time) heads home to Kansas to take up a quiet life of farming, when she’s suddenly run off the road by a mysterious cloaked figure in a beet truck. One by one, the beet-scented, masked figure begins killing her friends using methods that are certainly ironic, but only marginally practical. This culminates in the scene in which the guidance counsellor is ripped apart by two giant robots representing alternative career paths, in flower arranging

or forensic accounting. Finally the hero unmasks the beet-truck-driving serial killer, only to see the face of his (yes, it’s a guy) father! Then he pulls that mask off to reveal the vile metal countenance of a Sinistaar revengebot! Then he smashes that and finds it’s piloted by the son of the mutant carrot. Then he eats the carrot. Tired out from all of this, our hero attends a movie. It’s Hamlet, shown in its entirety, except that the play within the play has been replaced by a performance of Last Year at Marienbad, performed by six-year-olds, in Flemish, with no subtitles. The entire movie plays during this movie, complete with the sound of the theatre patrons near the protagonist, and the loud guy whose cellphone rings during the grave digger scene, and he has a long conversation with his friends about which steak house they want to meet at, while people try to shush him. Finally, the hero decides she wants to settle down, and she meets a nice guy but they have a misunderstanding about a canoe and a can of Nutella, and finally it’s all sorted out, but when they kiss she looks shocked, and pulls off his mask, and it’s a revengebot again, and she beats it to death with the hoe she was using in the beet field when her parents died. arbon is the stuff diamonds are made of, so you’d expect it to be expensive. But you may not be aware of just how much it has cost B.C. taxpayers. For instance, it has cost school districts across B.C. more than five and a half million dollars—that’s how much local-level education has pumped into the B.C. government’s Pacific Carbon Trust. And that’s just the beginning. The province’s universities have tossed another $4.5 million into the carbon kitty, and health authorities have boosted the carbon tax surplus by another $6 million. Yup. We said “surplus.” The Pacific Carbon Trust is sitting with a $30-million surplus, while school district trustees and administrators have been tasked with finding creative ways to cut education services to our children—while fitting in a budget item for money to be paid towards a questionable effort to reduce greenhouse gas emissions. Meanwhile, university students’ fees go up, and Fraser Health Authority hospital visitors dip into their pockets for parking fees (while the hospitals post cheery signs pointing out the importance of loved ones’ visits to patients’ health outcomes). We’re not opposed to efforts to reduce greenhouse gases. We recognize that climate change is real and something needs to be done. But this is not the way. Money collected from tax-funded government services—like health and education—goes to corporations that, in many cases, get paid to do what they were planning (or not planning) to do anyway. Or in the case of that surplus, the money just sits there. Meanwhile, government services are cut while their costs to taxpayers rise, and government funds go into a government fund to pay the corporations that caused the need for the fund. We trust new Environment Minister Mary Polak, ordered by Premier Christy Clark to look into the carbon tax surplus, won’t find it as confusing as we do.

Reconsider roundabout

Editor: In response to an article in the Chilliwack Times July 18: As a Sardis resident, frequent pedestrian, and taxpayer, I can’t refrain from adding my two cents worth (too bad pennies are worthless these days). The proposed designbuild project for a $2 million roundabout at Tyson and Keith Wilson appears to me as a gross waste of capital. Did this project go to public tender for open bidding, or was it an invited tender? Was there a pre-tender detailed cost estimate, tempered with enough expert scrutiny to justify the cost? If one was to observe this intersection from the sidewalk, it would be readily apparent that there are many factors to consider. I’m hoping that the grownups that care for our tax dollars have deliberated on: ◗ How will the substantial girth of a roundabout impact the UFV, RCMP, and private residences, in whose lap the asphalt lands. ◗ The probability of a snowy road in combination with inertia, launching a car into someone’s living room; ◗ The incredible obstacle this type of intersection poses to mobility compromised citizens, pedestrians, or cyclists; ◗ The amount of down time needed to re-route the utilities and the impact those inevitable outages would have on the UFV, DND and local residents; ◗ How much of this underground hydro requirement, is a “free” infrastructure upgrade for BC Hydro? Are they willing to: negotiate the fee; look at the current condition of existing poles; and factor in the long-term benefits of reduced maintenance costs? ◗ The negative impact on property values for those homeowners inheriting a curbside view of street racing delight. I’m hopeful that our elected officials would reconsider installing a more economical set of traffic lights, that remarkably, even incorporate a crosswalk to reign in the current vehicular homicide attempts on wayward pedestrians. Anyone who’s tried to cross Keith Wilson during that relentless rushhour traffic is familiar with near death experience. The occasional red light actually causes those hurried cage pilots to stop, and provides a few precious seconds necessary for people cross the road without fear of being run over. Let’s remember that we have an elementary school, senior’s activity centre, playground, ice rink, university, and public library within a block of the impact area. OK, traffic circles seem to be all the rage because of

But, I wonder if those statistics took in consideration: the prevalence of distracted texting drivers, safety ratings of modern cars, and the life expectance of a human trying to avoid a face plant on truck-osaurs. Better a church than a vacancy Editor: It was interesting to put two recent items together: from June 20, “City targets vacant lots,” then Ms. Coopman’s letter to the editor on July 16 “Church doesn’t belong there.” First item: There appears to be a problem with our downtown having too many abandoned buildings—this being an eyesore. Second item, if Ms. Coopman has her way, a derelict or abandoned building is better than, gasp, a church! I understand that there are those who see no useful purpose for a church (apparently it is worse if it is downtown), but there are those who see no useful purpose in a lot of things others like to see. Bike paths, cars, waterslides, casinos, doctor’s offices, acupuncturists, good banks, schools, big box stores. I’m sure you can make a list of useful/useless that is different from my list of useful/useless. As for me, I’m glad to see our downtown filled with activity and vitality. Wholesome and family-oriented enterprises (including churches) will not be driving “real business” away as Ms. Coopman claims, but rather drawing it to the area. Church brings people to core Editor: Faith-based gatherings fuel downtown revitalization. First Promontory Church, then Vineyard Community

Church relocates to the centre of the downtown core. Oh no, the sky is falling, the sky is falling! Churches setting up in a retail location, how dare they. For 40 years throughout this country most downtown cores have bled a slow death with the invention of the mall, with no sustainability plan, no silver bullet, that successfully revamps these areas rich with history, and culture, granted there are some cities who have had degrees of success, but there plans always include a fleet of armoured cars full of money to fix the problem. Two years ago, an incumbent councillor stated during municipal elections that we need to create a unique niche, to have any chance of reinventing the downtown area. Is this not a unique, but different way of finding a partial solution to this problem? Or at least get the ball rolling. It is my opinion that there has been a pleasant increase in traffic that visits restaurants, and coffee shops throughout the Wellington area. Whole families dressed in their Sunday best, meeting, chatting, and visiting venues, within this area. Economics 101. On the other six days of the week, minus their day of worship, we must consider that rooms, conferences halls of all sizes are sometimes rented on a first-come basis. For example: weddings, anniversaries, conferences, meetings, and they are used as training facilities. This process creates foot traffic, foot traffic increases sales. These faith-based organizations have entered these structures breathing life into buildings that are one step away from a wrecking ball. On July 20, Vineyard Community Church will be rented to a family event in which as I write this, people are arriving from all over North America, to attend. They will rent hotels, eat at restaurants, by groceries, gas, and last minute gifts. With an openminded approach to this process, we can look forward to the start of a successful, thriving downtown revitalization process. So I say a warm welcome, and thank you. They ended the regular season earlier this month by taking four out of a possible six points from Penticton and Kelowna and are now undefeated in eight games—their last loss a distant memory in late May. Before their games against the two Okanagan teams, Chilliwack already had four wins and 12 points, all against playoff contending teams: Victoria FC, the Mid Isle Highlanders and West Vancouver FC. Chilliwack hosted Penticton’s Pinnacles July 13, battling the visitors to a 1-1 draw. Kyle Rawlek had the lone goal for the locals.

Jock scraps Powerlifter wins Chilliwack’s Joanne Bunnin deadlifted more than 100 kilograms to claim top prize in powerlifting earlier this month at the 2013 Special Olympics BC Summer Games in Langley. Bunnin was one of several Chilliwack athletes at the games. In addition to powerlifters Lisa Newell, Janice Reid and Matt McKay, Special Olympics Chilliwack sent five bowlers, five swimmers and a soccer team. That soccer team claimed top prize in Division B.

It is with great sadness that the family of Harold Gudbranson announce his passing. Harold bid us farewell on Monday, July 15, 2013 at the Chilliwack Hospital after a long, brave battle with cancer. He was born in Spalding, Saskatchewan on September 17, 1934. a Harold is survived by his wife, Joyce; his children, Doug and Linda (Eric) and his grandsons, Thomas and Christopher; his step-children, Stanley (Trish), Allan (Tina) and John and three grandchildren and five greatgrandchildren. He is also survived by siblings, George (Ruby), Parksville, B.C., Eddie, Ruby, Elsie, Clara all of Ontario and Linda, of Chilliwack B.C. He is predeceased by his parents, Christian and Karen Gudbranson, and siblings Eileen, Olaug, Ruth and Stanley. He will be sadly missed by many nieces and nephews. a At the age of four, his family moved to Malartic, Quebec where he grew up playing hockey and fastball. A fine athlete, Harold enjoyed playing golf and as a young man had the opportunity to attend a Boston Bruins training camp. He started his mining career at Canadian Malartic Gold Mines and eventually moved to Rosita Mines, Nicaragua where he spent more than 15 years. In recent years, Harold and Joyce, spent many wonderful years with family and friends at Camper’s Paradise, their property in the U.S.A. a Special thanks to Dr. Fitzpatrick and Fran; the nurses and care aides at Chilliwack General Hospital; and Dr. Paul Galbraith and staff at the Abbotsford Cancer Clinic. a A memorial service will be held at Henderson’s Funeral Home, Chilliwack on July 27, 2013 at 2:00 PM. Laurie Kim Perkins passed away on July 13, 2013 at Cascade Hospice at age 52 years. She was born January 23, 1961 in Durban, South Africa. Laurie is survived by her husband Deon, two sons, Deon Glen and Carl; her parents, Glen and Angeline and her sister, Alison (Sandy) as well as nephews, Alexander, Ross and Malcolm, great nephew Maxwell and many dear friends. She was predeceased by her brother, Malcolm (January 11, 1971). Laurie qualified as MD in 1985 at the University of Stellenbosch, SA and subsequently practiced as physician in many different roles until 2003 when she immigrated with her family to Canada. She has been living and working in Burns Lake and for the last three years in Chilliwack. She gave her all to work and family. She a made this world a better place. a
