The Town of Hilton Head has proposed an ordinance to settle a lawsuit filed by ArborNature, LLC, which has a separate solid waste management company that commercially grinds trees and other land debris. If approved, the ordinance would move the grinding operation to a 4-acre parcel of land on Summit Road (near the Town solid waste disposal center). This is not in the best interests of Port Royal residents, especially those who live near Dillon Road. This item will be on the agenda for the June 5, 2018 Town Council Meeting. We encourage Landowners to attend this meeting to show their opposition to moving this operation to a location so close to our community. BACKGROUND There has been an 8-year dispute between ArborNature and its neighbors at Indigo Run. ArborNature changed their business operations on Leg O’ Mutton Road from a nursery to a tree grinding facility. Besides the noise from the grinder itself, there is constant truck traffic moving in large logs, the beeping sound from bulldozers moving logs and mulch, as well as the loud thud that some people claim rattles their dishes and windows every time a log is dropped into the grinder. Tree grinding is currently exempt from the Town’s noise ordinance. After years of inaction by Town Council, and frustration that there was no town noise ordinance protection from tree grinding, the Indigo Run landowner association and a nearby business jointly filed a lawsuit against ArborNature, LLC trying to stop the ArborNature grinding operation in that location. In early 2017 Hilton Head Zoning found ArborNature in violation of the zoning for their current facility on Leg O’ Mutton Road. ArborNature appealed that finding and the Board of Zoning Appeal rejected the appeal. ArborNature then took legal action to appeal the ruling and the appeal went into mandatory mediation. The mediation resulted in a Settlement Agreement that Town Council voted to accept in July 2017. If enacted, the Settlement Agreement will resolve legal action against the Town by moving the operation to a new location on Summit Drive, close to Port Royal, and essentially only moving the problem from impacting one community to another. The Settlement Agreement cannot be enacted until it becomes an Ordinance, which requires public readings and a majority of Town Council votes at two Town Council meetings. The Settlement Agreement summary shows the concessions the Town is making to ArborNature. The Town of Hilton Head will: ● lease a 4-acre parcel to ArborNature for one year for $1 and ArborNature has the right to purchase that parcel for $300,000 ● pay ArborNature $10,000 from the Insurance Reserve fund ● waive adherence to minimum tree coverage ordinance allowing ArborNature to clearcut the 4-acre parcel ● rezone ArborNature's existing Leg O' Mutton property to alternatively be used for residential development at 8 units per acre ● permit tree grinding operations continuously from 8 am to 6 pm Monday through Friday (50 hours per week) Page 2 Portroyalplantation.net

ATTEND THE JUNE 5TH TOWN COUNCIL MEETING MAKE YOUR VOICE KNOWN
A Task Force was convened by the Port Royal Plantation Landowners Board to study the impact of this settlement on our community. The Task Force has completed a detailed analysis and recommends opposing the Proposed Settlement Agreement for the following reasons: ● The Proposed Settlement merely moves a known problem from one location, where nearby residents and businesses have been complaining about the problems from tree grinding and heavy vehicle traffic for the past 8 years, to another area that also has residences and businesses nearby. ● Tree grinding is currently exempt from the Town's noise ordinance. This settlement does nothing to provide a mechanism for residents to obtain relief from excessive noise, nor does it require any noise abatement on site. ● The Tree Coverage Ordinance Exemption conflicts with overall island environmental goals and sets a precedent for other businesses to request additional exemptions. Mayor Bennett and Town Council will be voting on this Settlement Agreement at the Town Council meeting June 5, 2018. There will be an opportunity for public comment before the vote. WHAT CAN YOU DO TO STOP THE PROPOSED SETTLEMENT? 1. Contact Mayor Bennett and Town Council Members with your objections (find contact information below) 2. Make sure your neighbors are informed and take similar action. 3. Attend the June 5, 2018 Town Council meeting to show your support. Please arrive early to ensure you get a seat in the Council chamber. This meeting is expected to start at 5 pm but the time will not be confirmed until the Agenda is published by the Town on June 1. BOARD OF DIRECTORS CALL FOR APPLICANTS Jerry Knight, 2019 Nominating Committee Chair Applications for the Board of Directors are now being accepted. We are looking for Landowners who want to have an active role and voice in an exciting time for our community. We have made significant progress in the last few years and look to carry that momentum forward. If you have ever thought about participating in the process, this would be a great time to get involved. As a Board member, you will be actively involved guiding our community into the future. And, if you have observed neighbors, golf or tennis players, committee members or friends that would be good candidates for the Board, encourage them to fill out an application. Give them your support and encourage their participation. Applicants will be interviewed by the Nominating Committee during July. Candidates for the four open positions will be selected by the Committee and presented to Landowners for vote by ballot or proxy at the November 28th Annual Meeting. Now is the time to submit your application, and/or encourage someone you think would make a good Board member to do so. Come join the effort and help us continue to move forward. PR I hope everyone enjoyed Memorial Day at the new bath house and pool area. Over the past four and a half months, contractors and staff worked hard to meet the goal of opening phase one for Memorial Day Weekend. Though it was a bit stressful up to opening day, we’re glad to have the pool area ready for Landowners and their guests. We are happy to announce that the beach walk from the parking lot to the boardwalk is open and the showers on the beach side are functioning once again. As you enjoy the pool, deck, bath house and beach walk, please remember to be safe and respectful of the rules and procedures. It is important for you to bring your amenity card (white card with Port Royal logo) to visit the pool. Security will be checking cards for admittance until the card reader is operational. If you were issued an amenity card and cannot find it, or misplaced it, there is a $15.00 fee for a replacement card. Please visit the pass office at the Administration Office during normal operating hours to get your replacement. For a full set of pool rules, please visit the website or click (HERE). In accordance with DHEC regulations, the pool will close at sunset (no swimming). The deck area will remain open until 9:00 pm. and the restrooms will be locked at 11:00 pm. Also, for the safety of everyone, and due to the narrow path and boardwalk, please walk your bike from the parking lot to the beach. Construction continues at the Beach House and, while we finish final punch list items at the pools and bath house, there may be times when the area is temporarily closed for Landowner use.Please remember, the area is still an active construction zone and parking may be limited at times. There may be heavy equipment and deliveries that could restrict parking. If parking is not available in the front lots, there is usually plenty of parking in the back lot near the playground. Please be respectful of the fenced area and do not enter the construction zone at any time. While the contractors are mindful of cleaning as they go, please be cautious when walking and driving through the area as there could be nails, screws and other construction material in the parking area. I would like to extend a big thank you to the Maintenance Staff - Scott Kunkle, Curtis White and Josh Holiday - for all their hard work on the landscaping. We invite everyone to enjoy and respect your new bath house and kiddie pool, and we wish you a wonderful summer.

Summer Fun, Summer Safety Leisure Paths Please use the leisure paths when exercising, riding bikes or walking dogs. We have had several reports of dangerous situations when Landowners choose to do these activities in the roadway. We want everyone to remain safe while enjoying the Plantation and its amenities. Bicycle Safety As summer (with summer visitors) approaches, we always see an influx of bicycles. As a friendly reminder, all bicycles ridden by a Landowner or their guests in our Community are required to have a decal or a temporary tag. Security has recently stopped individuals without tags and they were guests of a Landowner. To prevent this inconvenience, make sure that you and your guest’s bikes are appropriately identified. Landowners may affix a decal that can be picked up at the Pass Office, and temporary paper tags for guests can be picked up at either the Gate or the Pass Office.

Mosquito Control Now that warmer weather is here, many people are spending more time outside. With the nicer weather, unfortunately, comes more mosquitos. Here are some steps that you can take to reduce mosquito populations. ● Find and remove any puddles of water or standing water around your home to reduce breeding sites. This includes turning over or removing flower pots and other containers that collect water. ● Clean fountains and add some chorine or bleach periodically to maintain clean water and wipe out your bird bath every few days. Mosquito eggs can get stuck to the bottom and survive dry periods. ● Keep your roof gutters clean to allow rain water to flow freely.
The Association has a contract with L&L Mosquito Control Services to spray the entire property. They are here each week on Tuesday or Wednesday evenings throughout the summer, between the hours of 8:00 and 10:00 pm to spray, weather permitting. They drive down the streets and apply a mist or fog with their vehicle. The mist is not harmful to humans or animals, but they do ask that if you see the truck go down the road, wait until the fog dissipates before walking into the area. It will be gone within a couple of minutes. Our Staff dispenses “mosquito biscuits” or “mosquito dunks” in areas where there is standing water in common areas like the Arboretum, Steam Gun, Fort Walker Park, and Fort Sherman. These kill mosquito larvae for up to 150 days per treatment and will not harm pets, birds, fish, or wildlife. If anyone has any questions on the mosquito spraying, they can contact me or Lawrence at L&L Mosquito Control at (843) 384-8617.
Friends of the Arboretum An initial five bluebird boxes were constructed by Howard Arden and Gary Higgins, with installation by Howard, Lou Befano, and John Boullosa. Bird box sponsorship donations have been provided by: Howard Arden, John Boullosa, Col R. John & Diana Cully, and the Port Royal Club USTA (70 & over) S.C. State Championship team, Dave Partington, Captain. Congratulations to the Tennis Team, and thanks to all for the labors of love. These fine quality solid cedar houses received immediate inspection by a bluebird, who obviously recognizes the value of living in Port Royal. Birdhouse sponsorships may be made as donation of whatever amount you may wish to give, with the funds directly supporting the horticultural and wildlife refurbishment of the Arboretum. Our azaleas have been pruned and weeded by Kathy Tiso, Sissy Haskell, and Allen High. It was a heavy labor job that will show great results next spring. We will have brilliantly blooming azaleas next to the new cluster of Beauty Berry bushes. The new bluebird residents will be feeding off the berries quite soon. Port Royal Plantation Staff has planted eight new bald cypress trees beside the interior path. They will complete the path and install bridges as wood chips become available. We are very privileged to have men who venture bravely into those wetlands. It’s very, very difficult work. A wetlands/woodlands biologist has been consulted to provide a long-term biological and horticulture recovery plan. More “sponsorship” opportunities will be considered after that plan is completed. PR Beach Chair Storage Update The Board has voted to change the rule on storage of beach chairs on the beach paths. Following the update of PRP Rules & Procedures, we heard from a number of Landowners that one of the rules seemed to be more restrictive than necessary. So the Board revisited the rule that prohibited Landowners from storing beach chairs closer to the beach rather than having to carry them from home down a long beach path. Those Landowners who had for years been leaving their chairs close to the beach have told us how much the rule change has affected their ability to enjoy the beach. About thirty percent of our Landowners live in reasonable walking distance to the beach and many use the beach paths. The majority of PRP Landowners who go to the beach are accessing it from the Beach Club, or the parking spaces near the Steam Gun and Fort Walker. And the new Beach House is slated to have storage spaces for beach items (chairs, umbrellas, etc.). The Board has approved changing the rule on storage of beach chairs to allow Landowners to store their personal beach chairs on the edge of paths that have enough room so as to not obstruct the path or be deemed unsightly by neighbors. If “policing” within the neighborhood proves unsuccessful, Maintenance Staff will be asked to recommend and design a storage structure, and present to the Board for approval, the recommended structure(s) and its/their associated cost. The rule will now read: C- PROPERTY MAINTENANCE AND UPKEEP 2. BEACH PATH AND WALKOVERS – Beach paths shall be kept natural. Private property, such as umbrellas, beach toys, boats, etc. shall not be stored on such paths. A limited number of beach chairs may be stored on the Association side of the dunes, not visible from the beach. No such storage is permitted on Port Royal beach paths #8 (Beach House), #19 (Steam Gun), and #21 (Fort Walker). Chairs stored must be in good repair/usable, out of the walking path to the beach, and be marked with the name and/or phone number of the owner. Storage is permitted between March and October only. Any item left in a broken or disrepair state may be removed and disposed of by the maintenance team. The Association is not responsible for lost, broken or damaged items. While we can’t make every Landowner happy with every decision, your board was elected to make decisions that we feel are best for our community. The primary role of Board Members is governance, and in Port Royal Plantation, your board takes seriously the fact that we represent 973 Landowners. Our goal is to govern the organization in a responsible way, and to make good use of the resources available so that Landowners can enjoy a safe, secure and pleasant community. We hope that, in the spirit of community, Landowners will follow the guidelines, respect their neighbors, and enjoy our beautiful oceanfront community.
