Eminent domain change remains a hot topic Many insist change to state constitution would protect property owners By Emily Darrell Staff Writer
Eminent domain – the seizing of private land by a government for public use, with compensation to the landowner – is an area of government and law that even lawyers and politicians will tell you is often complex, generally complicated, and always controversial.
On Nov. 6 Virginians will get the chance to vote on an amendment to the state constitution that will make changes to eminent domain law. Virginia, like many other states, was spurred to review its eminent domain legislation in 2005, when a U.S. Supreme Court decision – Kelo v. City of New London – made national headlines. In the case, a homeowner named Susanne Kelo sued her Connecticut city – a city that had been in economic decline for decades – after it seized her home to make way for a Pfizer chemical plant on the grounds that the plant would stimu-
late the local economy and provide jobs, thus serving the greater good. Ultimately, the Pfizer project fell through, Kelo and her neighbors were forced from their homes for nothing, and the Supreme Court’s decision was widely unpopular with both liberals and conservatives, being viewed as a gross abuse of governmental power. In 2007, Virginia passed a law to ensure that what happened to Ms. Kelo would not happen to any of its own citizens. The definition of “public use” was more narrowly defined than it had been previously, and it was declared that
“property can only be taken when the public interest dominates the private gain and the primary purpose is not private financial gain, private benefit, an increase in tax base or revenues, or an increase in employment” with the exception of utilities and railroads. Still, many state legislators – Attorney General Ken Cuccinelli and Del. Robert Bell, R-Albemarle, chief among them –felt this bill did not go far enough. A soft opening, it was not. There was cheering and chanting, speeches and prayer, a live rendition of the national anthem. There were even some tears. And all this before 8 a.m. But, then again, a Walmart Supercenter doesn’t open in Pow-
hatan County every day. For the most part, the 148,368square-foot store that opened Friday morning isn’t wildly different from the 3,000 or so other Walmart Supercenters across the nation. (In case you didn’t know, a Supercenter differs from a plain old Walmart by dint of having, along with all the other departments, a full-service supermarket.) It has a hair salon, a Subway, a vision center, and a pharmacy. The produce aisles overflow with fruits and vegetables from around the world –from plantains and tomatillos to beets and pomegran-
ate seeds. The “As Seen on TV” shelf, up front near the cash registers, taunts buyers with products such as “Hot Booties” – i.e. microwaveable slippers – and Pillow Pets Dream Lights, “the nightlight that turns your room into a starry sky.” Not that there weren’t some splashes of local color. In the clothing department, Powhatan Indians t-shirts and sweatshirts were prominently displayed. In the Toy Shoppe machine near the entrance – the game where, for 50 cents, you can take a stab and
Italy has given the world high fashion, priceless art and fabulous food. And now, it seems, she has given Powhatan at least 35 new employment opportunities. Those opportunities will come courtesy of Weightpack, Inc., which announced last Thursday that it will invest $2.6 million to move its headquarters operation from Italy and expand its Powhatan County production facility. “The decision to move our corporate headquarters from Italy to Virginia reflects our belief that the United States has and will continue its leadership role in the high technology field throughout the world,” said Weightpack CEO Gianguido Corniani. Weightpack, Inc., a packaging machinery company that designs and builds complete lines for the filling and capping of liquid product containers, has locations in Brazil, Mexico and Argentina in addition to the facility located on Route 60 just past Academy Road. COMMUNITY BRIEFS Festival of the Grape drew at least 8,000 to Village The weather could not have been better and the wine was flowing Oct. 20, making Powhatan’s 10th Festival of the Grape one of the most successful yet. According to Powhatan Chamber of Commerce executive director Tina Bustos, the event drew over 8,000 people to Powhatan’s Courthouse Village. Those in attendance enjoyed several new wineries this year, as well as music, food and crafts. Bustos reported that there were no major issues during the event and gave much of the credit for the seamlessness of the day to the Chamber’s events coordinator Iris Woodson. “Iris’s attention to detail is incredible,” said Bustos. “She always has her clipboard and knows exactly who is supposed to be where and what they are doing.” While the Chamber does not have firm numbers on the amount of money raised by the Festival of the Grape this year, Bustos said they expect to have that information to share soon. She also said the Chamber will be able to tell where festival-goers were coming from this year, since the new ticketing system they used was able to track that information.
Deadline for Clean Business Award nominees today The Powhatan Anti-Litter Council is currently accepting community nominations for the Clean Business Award. Criteria for selection includes: litter free grounds and parking; ownership commitment to recycling efforts; visible and well maintained signage; attractive and well kept building(s) ; well maintained landscape; and a clear support of community environmental efforts. Businesses must be in operation at their current location in Powhatan for a minimum of one year to be eligible. Council members suggest that residents take a look at local businesses that encourage clean and attractive operations by complementing these business owners and employees on the value of pleasing surroundings. Recent Clean Business Award recipients include Yardworks, PIE Technologies, Garland’s Training Facility, the Mill at Fine Creek, Central Virginia Bank, and Chadwick and Son’s Orchids. The 2012 recipient will be honored during the Powhatan Board of Supervisor’s meeting in December. Lonesome Dove Equestrian Center hits a major milestone By Emily Darrell Staff Writer

Bowman ,40, has been in rehab at McGuire Hospital, after suffering a broken blood vessel in his head that led to a massive stroke last March. Bowman was honored as being the thousandth rider Lonesome Dove has seen since opening their stables more than four years ago. Lonesome Dove is a privately-funded not-for-profit organization that provides therapeutic horseback writing for disabled veterans. Clint Arrington, the founding director of Lonesome Dove, is thrilled at how his program has grown over the years. Sherry Newark, one of the organization’s volunteers and as she describes herself “Clint’s better half,” says that she’s been very pleased to get a few “walk-ins” of late – i.e. veteran’s who see Lonesome Dove’s sign or hear about it through word of mouth and come in without the push of a therapist or doctor. “In the last two years so many people have been coming out,” Newark said happily.

Touches like these are one of the ways Walmart seems out to prove, as store manger Laura Francisco said at the ribbon cutting ceremony: “Now that we’re here we are part of the community.”
On the Thursday evening prior to the grand opening, Walmart and the Walmart Foundation presented $8,000 in grants to local organizations, including $1,000 to the Powhatan Rescue Squad and $1,000 to Backpacks of Love. The Walmart will also provide approximately 300 jobs and an estimated $600,000-plus dollars in annual tax revenue to Powhatan County. Several members of the Board of Supervisors, Interim County Administrator Elmer Hodge, and Commissioner of the
Revenue Jamie Timberlake were all present at the grand opening, seeming visibly excited by the new store. Resident Donald Silberbauer, who along with his wife, Mickey, and several dozen others, was out front before 7:30 a.m., waiting for the doors to open. Silberbauer had been for several years a vocal advocate of bringing Walmart to Powhatan. Now that it’s here he says: “It’s the biggest thing to happen in Powhatan in many years. At least from an economic standpoint, it is.”

Change: Some say law change is essentially ‘a done deal’ with flying colors in the House (83-14) and more narrowly in the Senate (2216), with the majority of “nays” coming from Democrats. Public approval is the last step needed for the amendment to be officially added to the state constitution. Sen. John Watkins, RPowhatan, is one of the few Republicans to oppose the bill, and has been among the more vocal critics of the so-called eminent domain amendment. In a document sent by email to Powhatan Today (a statement that was also run as an editorial in The Roanoke Times earlier this month), Watkins stated that “the impacts of the changes that have been proposed are virtually unknown” and that “most of the amendment was put together at the last minute in 2011 and subsequently amended on the floor of the Senate before it passed.” Watkins goes on to state that: “There are three elements to this amendment that give me grave concern.” The first, Watkins states, is a requirement that governments compensate individuals or corporations for lost profits. “I am unsure, as a businessman, how you adequately justify what your profits, particularly future profits, will be [. . . ] who pays for those profits? To the best of my knowledge, the taxpayers will wind up paying for those lost profits.” Secondly, Watkins takes issue with the clause that prohibits land acquisition in a for profit setting. This, he states, “eliminates the use of public/private partnerships [. . .] for the development of infrastructure. Examples would be the Metro in northern Virginia, or Route 895 in central Virginia.” “Each of these changes,” he goes on, “I believe
will lead to bigger government and more costly government as a result of increased payments for property acquisitions. This, in turn, will probably push development into more rural and more undeveloped areas in order to reduce costs.” Thirdly, Watkins opposes the clause that declares property ownership a “fundamental right” – a designation given to no other right in Virginia. However, proponents of the amendment, such as its co-sponsor, Del. Bell, believe the bill to be much simpler – as they see it, the amendment is simply a way of strengthening personal property rights. On his website, Bell states that the bill will “place private property protections in the Virginia State Constitution. These rights would include many of those in the 2007 law, and would additionally require that the government adequately compensate the property owner.” At a news conference held in Norfolk in September, Cuccinelli stated: “A property rights amendment to Virginia’s constitution is the ultimate protection Virginians need, and voters will finally have a property rights amendment to vote on in the November ballot. Hopefully, then –finally – we can put this dreaded and abominable era of government taking private property from one landowner and giving it to another behind us.” Various groups, including the Va. Farm Bureau, have come out officially endorsing the amendment. (See: A8). The Virginia Municipal League (VML), a nonprofit association city, town, and county governments, originally opposed the amendment and lobbied to have some of its language changed. (Flynn said he believes it will have an 80 percent pass rate.) Like Watkins, Flynn feels the amendment is far more complex than it first appears and believes that its passage could be lead to a deluge of unin-
tended consequences. He also believes that the wording on the ballot, which does not contain the full text of the amendment, is deceptively simple. “It’s like asking,” Flynn said in a telephone interview, “’Should the constitution of Virginia be amended in favor of mom-and-pop and apple pie or in favor of communism?’”

Following his passion, local artist earns big-time notice
P
owhatan resident Dick Pitini, a native of Southwest Virginia, has been drawn to photography since he was a kid. However, years of working long, demanding hours in the corporate world, while also raising a family, didn’t give him much time to indulge his passion. Since retiring several years ago, Pitini, 67, has rekindled his love affair with the camera, pursuing it, he says, with a single-minded, obsessive focus. His diligence has paid off. Pitini’s photograph, “Moving On” was recently selected as one of 91 winners – out of more than 100,000 entries – in Canon’s ‘Project Imagina10n,” a contest dreamed up by Hollywood director Ron Howard. A panel of judges picked up to 10 winner photographs in 10 different “storytelling” themes and five celebrity directors, including Jaime Foxx and Eva Longoria, will select one photo from each category and make a film based around the images. Pitini recently sat down with PT reporter Emily Darrell to discuss his winning picture.

So, tell me about your winning shot. Well, I was in New Orleans at a workshop called “Momentum Project New Orleans,” where I was producing a documentary film for a not-for-profit group called Canine Companions for Independence. There was a disabled lady who’d had a stroke living outside New Orleans that had one of the service dogs; I was down there to document her situation. One afternoon I had some time and I took a walk up through the French Quarter. There’s a thing in photography that Cartier-Bresson, who’s kind of the father of photography says: “You need to try to capture the decisive moment.” And that’s sort of what happened here. A lot of people say “Oh, Dick, you got so lucky to take that shot.” Well, luck might have had a little something to do with it, but not much. Because you can’t get lucky if you’re not ready. You need to be aware when you’re in the presence of a photograph. And, of course, in the French Quarter that’s around every corner. So you’ve got to kind of stay ready – meaning you’ve got the camera, it’s there, it’s on, it’s set. So when you see something you don’t have to think about the camera. You just instinctively capture it. I don’t go around of shooting thousands of frames. A lot of people do that with digital cameras. I’m more of a target shooter.

It was a lonely street, there wasn’t much traffic going on and this little fella [was there] on his little motorized scooter. If you look at it closely he’s got a big beard, he’s barefoot, he’s got some kind of like a skirt-thing on. He’s kind of an unusual char-

Sometimes they do, and sometimes they don’t. I mean, I anybody my age, you grew up in company’s growth had a person not long ago tell me film photography. And I think that’s Do you shoot much here in Powhatan? There’s not a whole lot of opportunity for street photography . . . You know, that’s sort of limited. Although, I’ve got some very interesting shots [from around here.] I did a little series I was kind of calling “Rural America.� There’s a fascinating little Mennonite store over here called Countryside Shop, out in Amelia. I went in there one day, and the ladies were real nice, and I got some beautiful shots of them just in their store. But when I’m doing street stuff, I typically go into the Fan or somewhere like that. I’m fortunate enough that we do a fair amount of travel. So we go to a lot of different cities, and I’m always fascinated to get out and sort of see what’s going on there.
Of all the photos that you’ve taken, do you have one that’s your absolute favorite?

In looking through the photos on your website, it seems like you have Who are some of your somewhat of a preference for favorite photographers? black and white photos over You know, Henri Carter-Bresson, color. Am I off-base here, or is who I mentioned before is kind of this the case? the father of documentary photography and certainly one of my favorites. Elliot Erwitt had a beautiful kind of sense of humor about his work. Craig Semetko – I have a book by him over here [gestures to his coffee table.] I took a course from Craig down in Miami. He’s an exVegas Strip comedian turned photographer, and he’s just fabulous to work with. Mary Ellen Mark, I’ve taken classes with her . . .There’s so many people out there, and I think it pays to study their work. But I try not to get too hung up in that. It’s like any kind of art, if you’re trying to copy somebody’s work, that’s not the way to go. I think you want to kind of look at the work and try to understand it. But then you have to sort of develop your own eye and shoot things your own way.
I don’t. I have a lot that I really love. You know anytime you’re doing one of these contests, it forces you to start thinking like that “Now, what do I want to enter?� Sometimes you’re trying to think, “Well, what do I like the best?� But more often than not your probably honestly trying to say, “What do I think they might like the best?� That’s hard. If I’m trying to do a gallery show or something, I just go with what I So do you only shoot digital like and hope that somebody else or do you shoot film as well?
You know that’s always an interesting question. I think it depends. Everything I shoot is originally in color. I shoot a file type called RAW, which means you’re capturing all the data. And then I decide when I look at it. Sometimes when I take an image I’ll know whether it’s a color image or a black-and-white image. But often, it’s not until I start processing it and start looking at it. Then I covert to black and white if I think it looks better. Now, that particular image, didn’t look very good to me in color at all. It was only when I converted it to black and white that it kind of popped at me. There’s another saying in photography that goes: “If you want to capture the color of a man’s suit, shoot him in color. If you want to capture the color of his soul, shoot in black and white.� Whatever that means. [Laughs.]

Election season can take real toll on us By Roslyn Ryan Editor
Have you found yourself feeling withdrawn lately, or crankier than usual? Have you been snapping at people, or having trouble concentrating? If so, you may be suffering from Election Season Burnout. Election Season Burnout, or ESB, has become a very real problem in the U.S. Spiking every four years, as the Presidential campaigns enter their final weeks, ESB makes glassy-eyed zombies out of formerly engaged citizens and ushers in apathy where there was once a sense of civic duty. Wondering if you may have been affected? Take this simple quiz. The best way to describe the 2012 Presidential campaign is: A. A chance to get to know two qualified candidates, hear spirited debate and gear up to make a decision that will greatly impact the future of your country. B. An opportunity to join likeminded people in stumping for your particular candidate. C. Comparable to a Quentin Tarantino movie: too brutal, too confusing, and you just wish it would end already. During the three recent debates between the two candidates, you … A. Watched intently, making a mental note each time a candidate made a point you agreed with. B. Recorded all three, then invited all your most politically astute friends over for a debate marathon. C. Wished one of the participants would throw an actual punch – that would be the only thing that would make the debates worth watching. The way you will decide how to cast your vote is: A. By carefully examining the issues, reading up on the candidates’ individual positions, and, ultimately, trusting your gut. B. By figuring out which candidate’s values most closely resemble your own. C. By flipping a coin. If you answered “C” to any of the above questions, you may be at risk for ESB – in fact, you may be burned out already. The one thing to remember is this: it’s not your fault. With the steady stream of negative ads, political posturing and bombastic rhetoric that we have been bombarded with this year, it’s a wonder the vast majority of us have not already thrown up our hands. Fortunately, there is a cure for ESB. It starts with turning off the television. Take a walk, clear your head, avoid anyone foaming at the mouth or screaming that the end is near. Keep the television off, or at least avoid political ads. Read more, think more, worry less, and – together – we can eradicate ESB for good.

Either Vice President Biden is totally neglecting his role as Vice President or is a habitual liar. In either case, his performance as Vice President is totally unacceptable. Libya is a very volatile country and has contributed more foreign fighters to the war in Afghanistan than any other, and most of these terrorist recruits originated from the Benghazi area. The revolt against Colonel Gadhafi was led from Benghazi and the city continues to be a

September 11, 2012, and apparent cover up by the Obama Administration arose; V.P. Biden said administration responses were based on intelligence reports and attributed the attack to protesters. There were no protest demonstrations near the U.S. Consulate on Sept. 11, 2012 and Congressional hearings revealed that the State Department had real time access to information from Benghazi and our intelligence organizations knew immediately that it had been a well-planned terrorist attack. The White House was informed of the attack within 24 hours and yet President Obama, Vice President Biden, and the entire Obama Administration followed the scripted version that this was a rouge protest that developed in response to a film. This dishonest response continued for two weeks and Vice President Biden

With the upcoming presidential election, people are battling over topics from taxes to terrorism. But maybe we need to take a look at the big picture for just a second, not the specific issues facing our country. No matter who comes out on top on November 6th, there are a few principles I’d like our next president to keep in mind.
Do the right thing, even if it’s hard This one’s a biggie. Even if we’ve had to grit our teeth to pull through in the past, America has always made it. To solve our debt crisis, we’ll need to just bite the bullet, and make some major budget cuts. And to set the proper example for many of the developing and rebelling countries across the globe, we need to stick to our principles now more than ever. If the country succeeds in the long run, even if we have to go through a few hardships to get there, that’s a
lot better than living easy shortterm, but floundering later.
Accept that you can’t please everyone A ton of presidents have tried to make everyone happy, apologizing to the groups they didn’t please, and attempting to be everything to everyone. That’s just not possible. Whether you’re pleasing people because you think it works best to have everyone be happy, or because you’re looking for a shot at reelection, it’s not the way to be a leader. Recognize that you really can’t make everyone satisfied, so make decisions about what’s best for the country, and stand by those choices.
Serve the country, not yourself The president really needs to keep the country’s best interests in heart, even if that means sacrificing his reelection. Which is more important, the future of the United States of America, or an extra four years on the job?

Is there a war on women? By Jason Moore Contributing columnist
I have a question for all women. Do you really believe that the Republican Party or its candidates are conducting a “war on women?” Let us talk about the three issues that Democrats use as their basis for the war on women. The first issue is equal pay. Democrats claim women make less for doing the same amount of work as men. Democrats claim a woman will make $0.77 for every $1 a man makes. The Census Bureau, the federal agency that generated the data upon which the Democrats stake their claim, has disavowed the Democrats’ claim. The Census Bureau stated that the numbers ($0.77 to $1) do not measure equal pay for equal work. The exact quote: “We do not have a way of measuring equal pay for equal work. We try to compare the earnings of full-time year round work between men and women.” The data is a rough comparison of all men’s wages to all women’s wages without regard to type of employment or hours worked. The biggest two factors in how or why a person is compensated for their time are: the number of hours worked and the type of job they work. American service members killed in the 11 year long war in Afghanistan have been killed since 2009, and violence is spreading throughout the Middle East. So far the most deadly year of the war was 2010 when 499 Americans and 212 coalition service members were killed. Attacks are not only increasing in Iraq, Libya, Afghanistan, and other countries in the region but they are also more organized and destructive. For example, a terrorist attack on Camp Bastion/Camp Leatherneck in Afghanistan managed to breach a well-fortified compound and killed two Americans and destroyed 6 Harrier jets and three refueling stations worth approximately $200 million. Eight other soldiers and one civilian were also wounded. By infiltrating Afghan forces and killing coalition forces, terrorists have almost destroyed the effectiveness of the Afghan training program which is vital if American forces are to withdraw in 2014. But Vice President Biden and the Obama Administration refuse to recognize the true force of terrorism since it would expose the total failure of this administration’s foreign policies. So even if you forgive Vice President Biden for being overbearing, he made numerous statements that were totally false. An effective Vice President should have known the correct answer to all these questions so Vice President Biden is either not performing his duties in a competent manner or he is totally dishonest. In either case, he is not worthy of serving as Vice President of the United States, and should not be reelected in 2012.

This was a major attack on an American diplomatic mission, and four Americans were killed. Every responsible member of our government must be knowledge of these attacks, and the American public deserves a truthful explanation of what occurred. So Vice President Biden knew, or should have known, that it was a terrorist attack by the next day, Sept. 12. Yet he lied, or was grossly negligent in his duties as Vice President not to inform himself of the facts by Oct. 11, 2012. His response concerning the Affordable Care Act’s impact on religious organizations was also blatantly false. He claimed that the Obama Affordable Care Act would not force religious organizations to provide abortions, or other birth control materials to their employees or patients that are against their religious beliefs. This is blatantly false and has been challenged by the Council of Catholic Bishops and other religious groups that filed a legal challenge to the Act based on religious freedoms guaranteed by the First Amendment of the Constitution He also made the ridiculous boast that Al Qaida is in re- Billy H. Dear Editor, It can be argued that, historically, Powhatan is Republican country – as a few yard signs opine. But since when did checking the box for the GOP become a necessity, not a choice? I ask this in response to last week’s thievery of my Aunt and grandparents’ President Obama yard signs. To be fair, my Aunt’s Tim Kaine sign was left unscathed (insert your own inference there). While juvenile, and not to mention illegal, the confiscation of the yard signs is not at issue. What is at issue is choice. Powhatan may, in fact, be Republican country, but other (Democratic, Green, Libertarian, Independent) names are listed on the ballot for us to prove that to be factual. Yard signs are replaceable – we have more – and our choice will be made Nov. 6 regardless of whether a yard sign sits at the edge of our property. From now until that point, is it too much to ask that we may remain civil, or at the minimum, respectful of our differences in opinion/yard ornamentation? We can all attest to Powhatan’s welcoming nature – with the influx of new residents from other localities. I suggest that we be similarly welcoming of others’ political viewpoints and choices. As Election Day nears, I ask that we first decide to keep thoughtfulness in mind. And, as always, stay classy Powhatan. Trae Harris Powhatan

If tried and failed, well, there were (and are) a lot more opportunities left. You see, that’s the thing about opportunities: there’s infinity of them. They don’t run out. They don’t cost anything. And we need the president to create and sustain those opportunities. You should get every chance you want, and you should shoot for every one of them.
Support those who can’t For some people – those with disabilities, the very young, the very old – those opportunities can be harder to find. That is when the government needs to step in. These people are at a disadvantage, and we may need to intentionally create opportunities for them, even if that’s federallyprovided income.
Take the long view The president shouldn’t just be looking at his term – he should be looking out for future generations, too. The president needs to be fiscally responsible, ensure that there are plenty of jobs for the future, keep an eye on the environment, and keep our military strong. He needs to lead the country into the future, and you can’t do this by just fixing today’s problems.
Play nice I think the international community is a lot like a kindergarten playground – there are the bullies and the leaders, the troublemakers and the peacemakers. Kids – and countries – have to choose when to stick up for their friends. America’s not one to
back down, and we need to keep it that way. Though we need to let our allies stick up for themselves, we should always be there to help if they need it. And for those “new kids” on the play set, we need to be

I’m not saying the job of the president is easy – it’s probably one of the most challenging jobs in the world. But I am asking our next president – whoever it may be – to keep in mind what their office and our country is all about. The next president means more to us than just reducing illegal immigration or research alternative energy; he matters because he’s the leader of the world’s most powerful – and in my mind, the world’s best – nation. He’s shaping the future. We need to know what to look for in a president, and it’s not just their political party or their platform, but their ideals, their principles, their beliefs. The leader of the United States matters, because now and forever, America is the land of opportunity, where all men – and women – are created equal, with the rights to life, liberty, and the pursuit of happiness. n Nov. 6, Virginians will have the opportunity to vote on an amendment to Virginia’s constitution to permanently protect your private property rights. Hopefully, that vote will be a resounding “Yes.”

City of New London, Conn. decision, ruled that the U.S. Constitution allowed one person’s property to be taken by the government and then sold or given to someone else who promised to use it to generate more jobs and taxes. The changes would go into effect Jan. 1, 2013. By voting “Yes,” you will be making sure that:

While the proposed amendment received bipartisan support in two consecutive sessions of the General Assembly, the ultimate decision will be made by you, Virginia’s voters. Opponents of the amendment have said Virginia’s constitution already provides protection against eminent domain abuse, but we don’t believe it currently goes far enough. The amendment would tighten the state’s definition of public use, which at the moment is left to the discretion of the General Assembly. Man will serve two and a half years for eluding, assaulting police officer A Richmond man, Jason Edward Woods, was sentenced in Powhatan Circuit Court last week to two and a half years in the penitentiary for eluding and assaulting a police officer and driving under the influence. Woods was arrested in May of 2011, after he led a Powhatan Sheriff’s deputy on a high speed chase that began at the intersection of Trenholm Road and Route 60 in western Powhatan County and continued westward into Cumberland. The chase ended after Woods, who had
turned his car around in Cumberland and headed back east, intentionally struck a Powhatan police cruiser with his own vehicle, then got out and laid in the road, telling the officer that he was drunk. Woods’ defense attorney, Terry Royall, argued that her client was “a broken man,” one with a history of substance abuse and mental health issues, but no record of violence, and should therefore only be sentenced to a year and a half – the midpoint of the sentencing guidelines. Commonwealth’s Attorney Bob Beasley pointed to Woods’ lengthy criminal history – a grand larceny conviction in Ohio in 1993, auto theft conviction in 1995 in the same state, a 2009
conviction in Henrico for reckless driving and vandalism – and the life-threatening nature of a car chase that saw speeds in excess of 100 miles per hour. “Judge, this man put in jeopardy the life of every single person on Route 60 that evening,” Beasley said as he argued for Woods to be sentenced to the high point of the guidelines. “Actually, my gut tells me that’s a little low,” Beasley said of the two-and-a-half year sentence. In addition to his prison time, Woods has also been ordered to pay restitution of the Powhatan Sheriff’s Office in the amount of $1,431 for the damage he caused to the police vehicle. – Emily Darrell

therefore, are not factored in to the $0.77 for every $1.00 claim that Democrats are making. Women and men work differing number of hours mostly because of childcare. Women work few hours and sometimes take lower paying jobs or jobs with less travel, because of their children. I have worked as guardian ad litem representing children in custody cases for over a decade in eight different counties, and no matter the income level or race, women tend to do most of the parenting. Women spend more time caring for their children, and therefore, work fewer hours or take jobs that require less travel than men. Women also take more time off to have children. They also tend to help more with elderly or ailing relatives than men. All of which diverts time from their ability to make money. Accounting for very logical and long standing work patterns for men and women and understanding how the Census data was computed, you understand why there is a difference between the compensation level of men and women when comparing full-time year round work. The difference is based on hours worked and the types of jobs compared. The data is not a true comparison of equal work and equal pay. This does not mean that some employers do not treat men and women differently, but a claim of universal disparity cannot be staked on the Census data. The lie about equal pay and equal work, however, will continue, because it is a great wedge issue. The second issue is health care and more specifically contraceptive care. Obama wants health insurance companies to charge men and women the same amount for the same coverage and wants insurance companies to pay for birth control. There is a logical reason healthcare policies are not priced the same. Men and women have different medical needs. The price of a healthcare policy is based on a person’s current needs, future needs and the estimated cost of covering those needs. I am fat, and much more likely to die of a heart attack walking up a flight of stairs than a healthy woman of the same age. Knowing that I am more likely to have problems with sleep apnea, diabetes or high blood pressure should an insurance provider charge me the same for the exact same policy as they would a healthy woman. The answer is no. The inverse is also true. Women have a different set of medical needs than men, and the differing set of needs is the basis for the difference in cost. Milton Freidman would call this the free market system. If I, as an unhealthy man with a likelihood of having health problems, am charged the same rate as a healthy woman who is less likely to have health problems, for the same policy, then the woman is subsidizing my healthcare and she will pay more for the policy than if I paid my fair share. Milton Friedman would call this socialism. Regarding contraceptive care, there is a legitimate reason for employers not to cover the cost of contraceptive care. Religion! I believe the government cannot force religious organizations to provide contraceptive care when such activity violates the dictates of their church. The Supreme Court will hear cases on this matter within the next two years, and we will have a more definitive answer then. The First Amendment’s protect of Freedom of Religion, however, should be upheld. Democrats’ biggest gun in their claim about a War on women is abortion rights. They frame the issue as a woman’s choice to control her body. Well there is an alternative view to abortion, and that view believes that there is a second life involved in the process. A life which deserves a voice and to live. This view is a principled position not designed to denigrate or subjugate women, but based on the protection of life. Most Americans believe abortion should be safe, but limited. Roughly 20% of Americans believe in abortion on demand, which is the Democratic Party’s platform position. Roughly 25% of Americans believe in an absolute ban on abortion, which is the Republican Party’s platform position. The other 55% of Americans believe abortion should be legal with reasonable restrictions. The issue for the 55% majority is what constitutes a reasonable restriction. These numbers are from a Gallup Poll and the PBS show Need to Know. Based on the Gallup numbers, most Americans have a nuanced view of abortion, and these nuanced views could resolve a great deal of the acrimony over abortion rights. The problem is some people see any limits on abortion as a step towards relegating all women to the kitchen barefoot and pregnant, and others see any allowance, even for rape, incest or the health of the mother, as heresy. Because of the 20% to 25% absolutists on each side of the abortion issue, abortion will continue to be a wedge issue used to drive up base turnout. Opposition to abortion, however, is not an attempt to control women. Opposition to abortion is a principled support of life.

RC was again driving when Drewicz separated Chris Zoller from the ball on the right side-line, scooped up the fumble, made one cut and cruised into the
end zone. Undaunted, the Celtics stated their next series on their ten and moved out of the shadow of their own goal- post,; moving even further down-field on a gutsy fourth and one at the 22. Sam Newlin’s sack forced a punt which Drewicz ran up to gather in at the 44 and streaked down the right sideline for his second score of the quarter. The BSH defense began to adjust to the gadgets plays of the Celtics and held them without a first down on their next two possessions. Taking over at mid-field BSH moved to the 35 where, from a fullhouse “pistol” set, Bendele took the direct snap and when straight up the middle, cut to the right and raced 35 yards unmolested. Rock bottom. They say you’ll know when you hit it. It wasn’t announced over the P.A. system. It wasn’t shouted down from the opposing bleachers. But none of those things would have been necessary, anyway - it was already evidenced in the face of every Indians’ coach, player and fan. There is one good thing about
hitting the bottle of the barrel, though: the only way to go is up. Powhatan hit rock bottom last Friday evening, losing a game in which they were undeniably overmatched by a faster, more physical Monticello Mustangs squad. The Indians rushed for 106 yards on 23 carries, 55 of which came in the second half, but were never able to keep the game even moderately close. T.J. Tillery and Jhalil Mosley combined for 270 yards of offense and four touchdowns as Monticello rolled to an effortless 42-13 victory. It’s Monticello’s first victory over the Indians since 2007.

Knights: Drewicz led Knights Indians: PHS finishes regular season this Friday at home their 30 to the BSH 20, aided by a hit-out-of bounds by David Prince, his second such transgression in two games. With 42 seconds left in the half Drewicz’s attempt to deflect the pass missed by inches as the Celtics big tight end, Nick Nester, gathered in Pat Cotter’s delivery in the back corner of the end-zone. The two squads traded interceptions (Drewicz and Nester) and the half ended 21-7 BSH. Succumbing to the lack of focus Fritts would address post-game; BSH fell asleep on the second half kick-off and the Celtics fell on their on-sides attempt at the BSH 48. Someone on the Knight’s recovery team was called for unsportsmanlike-like conduct, advancing the ball to the BSH 33. RC advanced to the BSH seven where Bendele, Drewicz and Ethan Johnson choked down the drive. Sam Welsh was true on a 25 yard fieldgoal to trim the lead to 2110. Aided by a 23 yard rumble from Johnson, the Knights advanced to the RC 42, where Bendele completed his only pass of the contest. Drewicz was so open down the right sideline that he had to wait on the delivery and still negotiated 42 yards untouched. Roanoke Catholic took over on their 20 and, with
the help of a fake punthook and ladder, moved the ball to the BSH 46. A sack by Will Moore and big hits by Moore and Sam Newlin forced the Celtics into a passing down and Drewicz ended the threat with his second interception. Taking over at their 45, BSH converted a fourth and three, were aided by a pass interference call and moved into the final quarter with Savarie scoring on a nine yard plunge. Savarie, “running hard and with new confidence,“ according to his coach, had the best game of his career, piling up 72 yards and taking the pressure to carry the running load off of Johnson and Prince. At 34-10, Fritts swept his bench clean on both sides of the ball while, understandably, Roanoke Catholic kept its starters in. The result was the emergence of a possible future impact player for the Knights. 5’11’, 168 pound sophomore Chandler Emberling scampered around the Celtics right side for an eight yard score and then made three tackles on defense, two of those catching the Celtic’s speedy Nick Fittz from behind as the second and third teamers held the visitors scoreless. He tossed two more before night’s end, finishing 0-7 with three interceptions before being pulled in favor of senior Wes Garrett. Garrett hadn’t seen playing time since the first half of the Fork Union game, which took place all the way back on September 14. oe Cahn first ate moist, tender garbage-can turkey — a bird that’s been cooked under a large metal trash can surrounded by charcoal — in the vast outfields of Richmond International Raceway. He’s sampled beefy, saucy meatballs while standing in a parking lot at a Carolina Panthers game in Charlotte, N.C., and he tasted some of the best jambalaya he’s ever had in Nashville before a Tennessee Titans game. Cahn, the self-proclaimed “Commissioner of Tailgating,” travels all over the country each week to college and pro football games, NASCAR and steeplechase races – even the occasional Jimmy Buffett concert – on a quest to participate in what he calls “the last great American neighborhood.” “What tailgating has really become is the new community,” Cahn said last week as he made his way southwest toward Texas for Sunday’s NFL game between the Houston Texans and the Tennessee Titans. He was in Blacksburg the previous Saturday for the Virginia Tech game, from which he traveled to a football game at the University of Tennessee at Chattanooga and then on to Nashville the next day for the Tennessee Titans’ game against the Detroit Lions. That’s a lot of miles. But for every mile Cahn travels, he’s got triple that number of friends. And he’s eaten a lot of good food along the way. Tailgating is “the original social network,” he said. Standing around in a parking lot sharing a meal, people aren’t lost in cyberspace or flipping through channels while vegetating alone on their couch. To Cahn, a former cooking-school owner in New Orleans, the Super Bowl isn’t the NFL’s season finale, but a large bowl of gumbo.

Any day of the week, the New Orleans native would make a pit stop for boiled shrimp and those big bowls of spicy jambalaya, the latter being one of his game-day staples. He’s been tailgating for a long time, and if there’s one thing he’s learned about a successful day at the stadium or the race, he said, it’s simplicity. Keep your food simple, and try to do as much ahead of time as possible. “A lot of people are getting more and more elaborate” with what they serve at tailgate parties, Cahn said. “Martha Stewart and Emeril (Lagasse) aren’t coming to your tailgate. The simpler you have it, the more time you have with your friends.” Thick slices of buttery, garlicky grilled toast accompany everything from brats to beef ribs. It’s easy to prepare and can serve as a great way to sop leftover chicken wing sauce off your plates. Cahn said he loves grilled bratwurst, but rather than eating them in hot dog buns, he rolls them in tortillas and slices them into bite-sized pieces. He serves them with a variety of mustards – mild to spicy – for dipping. Rather than boring bowls of potato chips, set out roasted chili-lime pecans. Tossed in a mixture of olive oil, lime juice and spices, such as paprika and chili powder, they’re crunchy and full of flavor. It wouldn’t be a true tailgate party without at least one dip. Try a warm one made with hot or mild sausage, pinto beans and chopped spinach folded into a creamy sauce of garlic, cream cheese, a little beer and Parmesan cheese. Serve it with corn chips or sliced red bell peppers. Outside the stadium, Cahn said, “we bond, we break bread [and] we make these relationships that last a lifetime just because we parked next to someone in a parking lot.”

Goal orientation allows Students to earn certificates & medals. Classes meet once a week on Tuesdays for 8 weeks.
