High water ends batteau festival early By Laura McFarland News Editor
POWHATAN – The 31st annual James River Batteau Festival ended early for most of the participants, including two Powhatan-based boats, when rising water levels on the James River over the weekend caused them to pull out a day ahead of schedule. The majority of the 20 boats that started the eight-day festival on Saturday, June 18 in Lynchburg ended what is
being described as a nearly perfect week on the river in Cartersville. Normally, Cartersville Landing in Cumberland County is the last overnight stop before the final day of the festival, which sees the batteau floating to Maiden’s Landing in Powhatan.

OWHATAN – At the ripe old age of 10, Alex Campbell has already been making a name for himself in Virginia legislative circles.

In the last few years, Alex Campbell of Powhatan has become an advocate for regulation of restraint and seclusion. He received a national award and has worked with legislators on creating laws in Virginia.
In the last few years alone, he has come to know state senators and representatives as he advocates for mandating regulations on the use of restraint and seclusion in Virginia’s schools and has been recognized
with a national award for his work. In July, Alex, the son of Sean and Kelly Campbell of Powhatan, will head to Washington, D.C. to talk to U.S. senators and congressmen on see ADVOCATE page 6A
POWHATAN – The Powhatan Lions Club awarded its first Lions of Virginia Foundation Virginia Distinguished Humanitarian Recognition during its 2016 Charter Night. The event held on Wednesday, June 22 at the County Seat Restaurant is an evening where the club bestows its annual awards and installs the new members for the coming year. The club celebrated its 40th anniversary this year. During the awards portion of the evening, outgoing president Jim Washburn announced club member Robert Butler as the first recipient of the humanitarian award for the Powhatan chapter. Butler, who has been a Lion for 19 years, was recognized for starting the vision screening at the schools and continuing to work with the program; working with social services to provide free eye exams and eyeglasses; collecting used eyeglasses for the club, and organizing road clean-ups with the Virginia Department of Transportation. He also was secretary of the club for a number of years, runs the 50-50 raffle every meeting and maintains the sign-up sheet at the meeting. Upon receiving the award, Butler simply recited a Lions Club anthem, which included saying, “Lions Clubs are service clubs, our work is never done; we give our all to make the world better for everyone.” Butler later said that he wasn’t aware he would be receiving the award but as Washburn continued to list the attributes of the recipient, he thought “that sounds like what I’m doing.” see LIONS page 10A

Summer reading kicks off at library

The Powhatan County Public Library kicked off its summer reading program on June 9 with an Olympicsthemed program. Children listened to a story, created crafts and played games.
Contributed Report The Powhatan County Public Library kicked off its 2016 Summer Reading Program “Read for the Win!” with an Olympic-themed event the evening of Thursday, June 9 at the library. Hosted in conjunction with the Powhatan County Public Schools (as part of the school’s annual “Passport to Summer Reading”) the event featured a book giveaway as well as a variety of craft and activity stations throughout the library. To start the festivities the winner of the 1964 Caldecott Medal, “Where the Wild Things Are” by Maurice Sendak, was read to participants by library board member Karen Bradbury. Nearly 100 adults and children attended the event. The library invites children and teens to complete online registration for the “Read for the Win!” program via a link on the library’s website www.powhatanlibrary.net. Readers can use the online component of the program to track summer reading progress and

on overnight or chanced the high waters on Saturday, the crews of the Lady’s Slipper and Fine Creek Mill, both based in Powhatan County, said they choose to err on the side of caution and not risk themselves or their boats on the high river. They both pulled their boats out of the water on Friday night. Water traveling downriver from West Virginia, where devastating flooding rain had killed at least 24 people with more missing, is causing the large jump. Ned Nelson of Powhatan, the captain of the Fine Creek Mill, said he made the decision to pull his boat out on Friday morning, when he heard predictions about how high the James River was going to rise by that night. “At that time we thought we would have water in the parking lot in Carters-
ville. It came close to that. We had water up to the banks. It was an easy decision to make,” he said. The crew of the Lady’s Slipper took a vote on Friday evening to decide what the group would do. It wasn’t unanimous, but the majority thought it wisest not to risk going back on the water that night or the next day, said Gail Timberlake, a crew member who was also captain this year. “That was a hard decision because eight days is even not enough sometimes, but it wasn’t hard if you were thinking with wisdom because safety is the most important thing,” she said. The safety of the crew was of the utmost importance, she said, but they also took into consideration that the Lady’s Slipper crew was using a borrowed boat. The Margaret Stevens, which debuted in the 2015 festival, didn’t have a crew this year so its owner, Mike Harris, al-

The boat crews that made the decision to go on either overnight or on the last day of the festival were still relatively safe since the long riverboats were designed to not only withstand but use water conditions like these, Nelson said. Still, he said it was the right decision to get out of the water. “We enjoyed every moment we stayed on the river, but if it had to end, it had to end. There was no point in trying to make a big deal of it. If it was over, it was over. You don’t mess with Mother Nature,” Nelson said.

MAYO SILVEY JR. Mayo “Skip” Singleton Silvey Jr. of Midlothian and Irvington, formerly of Powhatan, died at his home on Thursday, June 23, 2016. Skip, also affectionately known as “Papa” to his grandchildren, was born on April 2, 1937. He is survived by his wife of 58 years, Sally Montgomery Silvey; his daughter, Jean Silvey Enroughty and her husband, Wayne Enroughty; his daughter, Cabell Silvey Cunningham and her husband, Edward Cunningham; his grandchildren, Lucy Block Rimington and her husband, Caulin Rimington, Michele Block Norrington and her husband, Brett Norrington, David Silvey Block, Patrick O’Brien Cunningham, Catherine MacRae Cunningham, and Eileen Mayo Cunningham; and his greatgranddaughter, Hadley Jean Rimington. Skip graduated from Fork Union Military Academy and the University of Richmond School of Business with a degree in accounting. Skip worked for AMF companies in many capacities for 37 years and retired as CFO of AMF Reece in 2001. Working for AMF, Skip traveled the world and cherished sharing the stories and treasures of his travel with his family. Since 1968, Skip was a member of the Fine Creek Men’s Club. He was an avid fisherman, hunter, and active member of the Middlesex Shooting Sports Club and Rappahannock Pistol and Rifle Club. At his river house on Carter’s Creek, Skip took pride in the oysters he raised by his dock and enjoyed sharing them with all of his family and friends. A memorial service was held at 4:30 p.m. on Sunday, June 26 at St. Luke’s Episcopal Church at 2245 Huguenot Trail, Powhatan. A reception followed at Willow Oaks Country Club at 6228 Forest Hill Ave., Richmond. In lieu of flowers, contributions may be made to the St. Luke’s Heritage Endowment Fund.

Enforcement The evening started with an introduction to the documentary by two of the guest panelists, Adam Lee, special agent in charge of the Richmond Division of the FBI, and Gregory Cherundolo, assistant special agent in charge of the Richmond Division of the DEA. Although the two agencies have long had a rivalry, they have worked on a few documentaries like “Chasing the Dragon� to raise awareness of pressing issues of emerging threats that they think the public needs to be keenly aware of, Lee said. Cherundolo agreed it is a great thing that the two agencies are partnering but said it is also good that community members like those present are getting involved as well. “We are the enforcement arm of what this epidemic is doing to our country. We are not the educators. We are not the treatment people. But we are looking at this as a whole government approach,� he said. In addition to law enforcement, it is important to reach out to doctors and pharmacists about what is being prescribed and how much of it, treatment facilities and community outreach avenues to have more people working to solve the problem. In his 25-year career, Cherundolo said this is his third epidemic – crack, meth and now opioids – and the last is the “worst one by far.� “We are of the opinion that this is the beginning of it; we are not in the middle of it and we are not at the end of it. That is why we’ve got to bring every-
body together, so it is important to do things like this,� he said to the gathered crowd. Capitol Hill about restraint and seclusion and the need to make sure schools are funded adequately so students with special needs can be educated properly. From July 10 to 12, Campbell said his son was invited to participate in the Council for Exceptional Children’s legislative summit. After meeting with policy analysts to learn how to better talk to legislators, he will have the opportunity to speak with congressmen and senators. Then in August, Alex will attend a banquet in Williamsburg where he will receive the 2016 Catalyst for Change Award by The Arc of Virginia, which promotes and protects the human rights of people with intellectual and developmental disabilities, Campbell said. Meanwhile, Alex is taking all the attention in stride. “I feel proud of myself but it feels kind of rude to sit there and brag about yourself,” said Alex, a rising sixth-grader at Pocahontas Middle School. A personal history The issues of restraint and seclusion of children are close to Alex’s heart because of his own experiences. In 2011, during first grade, Alex – a talkative, inquisitive child on the autism spectrum – was dealt with by the principal of his school at the time by subjecting the little boy to multiple instances of restraint and seclusion. His principal would force him into a converted closet and slide the teacher’s desk across the door, blocking Alex from leaving the closet, he said. The school, which the family does not identify, did not notify Alex’s parents and he didn’t tell them at first either. “Most of the time I was confused because he wouldn’t tell me why I was going in there,” Alex said. His parents did find out a few
months into the school year and were shocked on many levels, Sean Campbell said. They were surprised to find that there were no state laws prohibiting these discipline methods. They were also surprised by what behavior by Alex was garnering him this treatment, including running around, standing on chairs, tearing paper, and hanging on a door. They could be disruptive behaviors, but didn’t present imminent danger, which is the only reason Campbell said he believed seclusion and restraint would be necessary. “We went and talked to the people. We were told there was nothing that could be done because there were no laws, there were no policies, there were no regulations,” he said. A counselor later had Alex create a little booklet with drawings to express his feelings on what had happened, and it ended up being a catalyst for Alex becoming a voice for other children who have been affected by seclusion and restraint.
Finding his voice In 2013, Campbell took a class on partnering in policymaking that was designed for adults who either have disabilities or are parents of a child with disabilities. He shared his son’s story with someone from The Arc of Virginia, which promotes and protects the human rights of people with intellectual and developmental disabilities. That started the ball rolling. Alex worked with the Arc and the disAbility Law Center of Virginia to create a bill in 2014 to direct the Commission on Youth to study the lack of protections in Virginia and report their findings back to the Virginia General Assembly. In October 2014, Alex testified to the Commission on Youth on the issues of seclusion and restraint. Inspired by Alex’s story, Sen. Barbara A. Favola, D-31, and Del. Richard Bell, R-20, drafted two separate bills for the 2015 session of the Virginia General Assembly— Senate Bill 782 and House Bill 1443—that would require the Virginia State Board of Education to adopt formal regulations on restraint and seclusion in schools. Both bills were signed in March 2015 by Gov. Terry McAuliffe. “Seclusion and restraint may be a tool but it does not address the cause. The children who were repeatedly subjected to seclusion and restraint were really children suffering from some other issue,” Favola said. “The seclusion and restraint is not addressing the cause. It is stopping the behavior for a moment. Or is it really stopping it? It is just removing it.” Favola said that upon meeting Alex during his time testifying to the Commission on Youth, she was impressed with the “remarkable young man” and his conviction about the issues under discussion. “Alex believes very strongly that he was a good person, he was
trying his best, he wanted to be a good student, he wanted to fit in and be liked,” she said. “He felt like the way he was treated made him so sad and hurt him at a very deep level. He had that sense that it wasn’t just. It wasn’t right.” Favola was so impressed with Alex during the whole process and in follow-up visits that she was one of the people who recommended him for the national Yes I Can Award. His father and one of his teachers at Charterhouse School, which he was attending at the time, also recommended him. The Council for Exceptional Children (CEC) gives the awards each year to young people, ages 9 to 20, who are making incredible contributions to their communities as artists, scholars, advocates, technology experts and successful students and employees. “The recipients of the Yes I Can Awards are courageous and hardworking young people who are supported by families, friends and professionals who believe in them,” said Alexander T. Graham, CEC executive director. Alex, who was one of 12 recipients, received one of two awards given for self-advocacy. He was honored at the Yes I Can awards ceremony on April 15 at the CEC’s 2016 Convention and Expo in St. Louis. Favola said she nominated Alex for the Yes I Can award because of his courage and tenacity. “He really stuck with the legislative process and he made a difference. I was very proud of him,” she said. “Rather than feeling sorry for himself, he really stepped up and said, ‘I am a good person and I am going to make the world better.’ I was really impressed by him and what motivated him.” Alex attended the event with his parents and little brother, Jack, and they made a vacation out of the experience. During the conference, Campbell said he was surprised at how much attention Alex received, both during and outside of event activities. “When we were there people would stop him on the street and ask for selfies and asked for autographs. All of the winners had their pictures plastered all over the conference center. They had about 4,000 attendees from across the nation,” Campbell said. Alex simply said he was “excited and surprised and proud of myself.” As a result of the award, Alex was chosen by the United Methodist Family Services as its Featured Champion and pictured on the front of its Spring 2016 newsletter. This spring, he also transitioned back to public school, moving from Charterhouse School to Pocahontas Middle School. Campbell said all of the teachers and administrators at PMS have been fantastic with his son. Campbell said he and his wife are excited for Alex and have watched him grow and find his voice through all of these experiences.

treatment consultant with the Richmond Behavioral Health Authority, and Keith Cartwright, a behavioral health wellness consultant with the Virginia Department of Behavioral Health and Developmental Services. Oehl called addiction a brain disease and talked about the need to treat a whole person instead of relegating them to the label of addict. She said that in 2009, Virginia had 19 opioid treatment programs. “Sadly, we have just licensed the 35th opiate treatment program and we are not meeting the demand,” she said. She also talked about Naloxone, a medication used to block the effects of opioids that is often used in overdose cases. Cartwright reiterated that addiction isn’t just a law enforcement or medical program but an issue for the whole community. He also addressed the topic of parents who are friendly with the issue of teens experimenting with alcohol or marijuana and the idea that it could lead to more risky behavior. “I tell folks all the time that every young person who goes out and drinks and smokes marijuana isn’t going to do something more illicit. But I will also tell you this – in 25 years, I have worked with an awful lot of young people who have done something more illicit and almost every single one of them had experimented with alcohol or marijuana,” he said. He encouraged parents and grandparents to talk with the young people in their lives about drugs and the risks. After the panel introduced itself, it took questions from the audience that ranged on topics from how the United States is dealing with drug dealers in Latin America to the need to have more of a medical focus on the opioid addiction problem. Two women’s pain shows human side of epidemic By Laura McFarland News Editor
T
hey were two women who met because of their shared love and affection for a young woman who died before her time. I met with Katrina King and Diane Webster last week about an hour before the start of a free screening of “Chasing the Dragon: The Life of an Opiate Addict,” a documentary created by the FBI and DEA to raise awareness of opioid and prescription drug abuse, held at Powhatan High School. When the film ended, Katrina, who was featured in the documentary, sat on a panel alongside law enforcement personnel and professionals who deal with the issues of drug addiction from the medical side. Katrina said she has been clean from her opioid drug addiction for almost five years. It was a drug addiction that led to her being incarcerated and was the precursor for a similar addiction that ended the life of her 20-year-old daughter, Kirstyn. Diane’s son was engaged to Kirstyn before she died. In the time she knew Kirstyn, Diane said she came to love the young girl and she still tears up when she
talks about realizing too late that Kirstyn was an addict. Now she is friends with Kirstyn’s mom and came to support her as she spoke on the panel. Organizer Cindy Harris facilitated a meeting with Katrina before the documentary screening to see if it might offer a different dimension to my coverage of the event. Wow, was she right. As we sat in the high school’s main hallway and talked before the event started, what stood out was the fact that, at the beginning of her story, Katrina would have fit right into Powhatan County. She was a mother of two teenagers with a husband and a successful job that paid more than $130,000 a year. She was injured in an accident in her home and took some pain pills that a co-worker offered. She couldn’t have known at that moment that her inconspicuous introduction to those prescription drugs would one day lead to a habit where she was taking a total of 40 pills just to get through the day and not get sick or experience withdrawal symptoms. As a story of drug addiction, it was always obvious that Katrina’s story was going to be disturbing. But for someone who, very fortunately, has not been directly touched in my personal life by drug addiction, it is still always astound-
ing and horrifying to hear about the lengths addicts will go to so they can achieve their next fix and the fact that the pull of the drug is so strong that those who have been clean for months and even years can still be sucked back in so quickly. Katrina used drugs for several years and her addiction had reached massive levels before she was arrested, while her daughter was only addicted for a few months when she overdosed. Katrina, who was allowed to attend her daughter’s funeral while incarcerated, said most of Kirstyn’s friends were high at the funeral and admitted that she even took a few pills to help her get through it. It is inconceivable to fathom standing at the funeral of someone you love – a daughter, a friend – and being high on drugs you know killed her, but that is how strong the pull of these drugs are for an addict. Hopefully readers have seen some of the stories and notices the Powhatan Today has done about the series of events being planned locally to raise awareness of how the opioid addiction relates to Powhatan County. The purpose was to help people be vigilant to prevent more tragedies like the one that happened to Katrina’s family as a result of drug ad-
diction. Because you have to realize that so many cases of addiction started with the user believing it could never happen to them. And, yet, people who take prescription painkillers can become addicted with just one prescription, according to the Centers for Disease Control, as cited in “Chasing the Dragon.” The 2014 National Survey on Drug Use and Health (NSDUH) found an estimated 1.4 million people in the United States abused a prescription painkiller for the first time that year, according to information from the documentary. Or how about the fact that more than 10 million people 12 years old and older in the United States reported nonmedical use of prescription opiates in 2014, according to the NSDUH. And if you think it isn’t a problem in Powhatan County, talk to Sheriff Brad Nunnally. He was on the panel along with representatives from the FBI and DEA, and I am sure he would be willing to disabuse people of the notion that the drug problem facing the United States right now has nothing to do with Powhatan. L E T T E R S TO T H E E D I TO R Saying no is hard but still the right choice for Powhatan Dear Editor, Conserve: to keep in a safe or sound state; to avoid wasteful or destructive use of. No: used to express the negative of an alternative. To many people, these words reflect negativity; yet depending on the context they impart common sense and logic. Most people would agree these words are appropriate and make sense. However, if we say, “let’s hold-off buying the car right now and conserve our money,” or “we should conserve our resources as the future looks uncertain,” a different reaction can be seen. To conserve seems to have a benign purpose that everyone can rally behind but to “hold off” conveys an unwillingness to risk resources and conveys a negative. Why is it so hard to say NO? For one, most people don’t like to hurt other people’s feelings. This is especially true with family, close friends or co-workers. No is negative while yes is the path of least resistance. I have seen signs in supermarkets identifying a checkout line as candy free. This is because many parents cannot deal with telling their children they cannot have a candy bar. As all of us who are or were a parent fully realize, children will push back in a variety of ways when you say no and it tends to make you feel like you’re the worst parent ever created. When this happens, try and remember “tough love.” In fact, many alleged “experts” have written magazine articles and entire books dealing with the fact that the generation we refer to as “millennials” are so accustomed to “instant gratification” that they have no concept of anything resembling a work ethic and instead just think everything should be given to them. Reportedly, many of these young Americans are embracing the openly socialistic views of one of our presidential candidates. Many of them simply do not understand that there is no such thing as a free lunch. As Maggie Thatcher said, roughly translated, “The problem with socialism is that sooner or later, you run out of other people’s money.” That is currently what is happening right here in River City (aka Powhatan). Why am I focusing on the word NO? Here in Powhatan, as in the federal government,
saying no to more spending, higher taxes, etc., frequently unfairly brands the person(s) as anti-something: anti-education, anti-immigration, anti-progress, anti-growth, anti-love of country, etc. In fact, just the opposite is true. Lately, in response to pleas from numerous citizens to reign in the out of control spending, increased assessments and increased taxes, our board of supervisors has been waxing poetic and prolific on platitudes such as: we love Powhatan, we want what is best for the children and the community, we are looking toward the future. For whatever reason, they simply have a hard time saying no. These statements would suggest, and many have in fact declared, that anyone who opposes higher taxes is anti-Powhatan or anti-children. Mr. Tucker has even accused citizens of lying and having our facts wrong. Interesting comment from a person who last fall made public statements in this newspaper that Republicans were lying about the then county debt of $120 milion and that it was really only slightly over $81 million. The same untruth was stated orally and in writing by the current chairman, who had to modify his statement in the same newspaper article in which he was quoted when challenged by the editor of this paper. I have news for you, the debt will soon be in excess of $200 million. That’s right $200 million. That is not a typo. In many things, moderation is the key to success. Trying to stuff five years of projects into one year is irresponsible and doesn’t reflect a conservative approach. Why? Because there is no guarantee that the money to pay for them will be available. The 2017 Capital Improvement Plan (CIP) relies heavily on future revenue increases and unless some commercial development magically appears or there is a huge spike in sales tax revenues, property owners will be looking at another tax hike sooner rather than later. And to once again remind you, both Mr. Tucker and Mr. Melton campaigned on lowering your tax rate. Businesses will not flock to Powhatan and support the 400 percent increase in sales tax contained in some of the projections as long as we have one of the highest tax rates in Virginia. And Mr. Tucker, that is true whether or not you try and compare a county such as Powhatan with townships and cities. But it is even more true when you compare apples to apples (counties to counties). An important argument about high tax rates that you never hear supervisors or school board members talk about, is the impact higher taxes have on prop-

erty owners on the bottom rungs of the economic and income ladders. Many live on land that has been in their family for years or even generations, and they are struggling to pay Powhatan tax rates. I’ll bet some of these folks are visiting the wonderful new Powhatan Food Pantry. Shouldn’t we be trying to get these folks out of “poverty” and not enabling the status quo? People who have recently made public statements that they do not have a problem paying the increased rates are apathetic to these people and should consider those people who are less fortunate and who cannot afford to pay these continuing high rates. I suppose it makes the “giver” feel good to provide for the poor instead of dealing with the cause of the problem, which, in part, is reducing their economic burden (i.e. lower taxes). As with federal taxes, if you don’t think you’re paying enough taxes, write a check. I’ll bet Faye Barton, county treasurer, will accept it without any arm-twisting. And when the board supervisors pull out prepared statements and again spout motherhood about why we need to spend more money, remember what author and news personality Ann Coulter said: “When liberals tell you this is complicated, hang on to your wallet.” I will close with a famous quote from a famous First Lady, Nancy Reagan: “Just say no.” Dave Bailey Powhatan County
Parents grateful for fire and rescue workers’ efforts Dear Editor, Did you know we have angels living in Powhatan? On March 8, our son had a serious ATV accident and had to be airlifted to MCV. He suffered a traumatic brain injury and spent almost a month in the hospital. He couldn’t talk clearly, walk, eat or breathe on his own. As a result of this, we endured a life changing experience. Because of the Powhatan Fire and Rescue Squad, we are grateful and blessed every day with his presence. Due to their immediate care, he is almost back to being a “normal” adolescent. New laws to take effect July 1 Contributed Report (Editor’s note: The following was submitted by Ramon E. “Trip” Chalkley III, commonwealth’s attorney for Hanover County.) As always, on July 1, 2016, certain new laws or amendments to existing statutes will take effect in the commonwealth. Due to the veto session in the General Assembly, not all of these changes have been received. What is set forth in the following is a summary of new legislation taken from a synopsis furnished by the Virginia Association of Commonwealth’s Attorneys. However, this article does not discuss all new legislation. The following are new or changes to Virginia law that take effect on July 1: A district court may order that a dog that has killed only poultry be microchipped and be confined securely, or transferred to another owner. Previously, the dog would have to be destroyed or sent to another state. Civil immunity is provided to first responders who forcibly enter a vehicle to save a companion animal from serious bodily injury or death. This applies to damage to the vehicle or the animal but does not apply if gross negligence or willful or wanton misconduct is present. All wild birds and wild animals may be hunted with a slingshot, except deer, bear, elk, and turkey. It is illegal to intentionally release a hunting dog(s) on the land of another, posted pursuant to §18.2-134.1, without permission. A first offense is punishable by a fine; a second offense within three years is a Class 1 misdemeanor, punishable by a fine of up to $2,500 and/or incarceration of up to 12 months. Dogs simply being on the land is not sufficient evidence to prove intent. Local governments may pass ordinances to address the hunting of coyotes with a firearm larger than .22 rimfire. Asset forfeiture law was changed to state that interest in seized property may not be waived until information has been filed. Roadside waivers that occur when law enforcement seeks a waiver of the right to property by the owner on the side of the road has been eliminated. The burden of proof placed upon the commonwealth in forfeiture hearings has been raised from a “preponderance of the evidence” to “clear and convincing evidence.” The definition of “abused or neglected child” was expanded to include children who have been trafficked. A Class 4 felony (two to 10 years) was created for the abuse and neglect of a child when there is serious injury or death of a child under the care of an unlicensed daycare provider. Failure of the provider to secure the license constitutes a willful act or omission. A child victim evidentiary hearsay exception was created that permits a hearsay exception for an outcry of abuse by a child under a certain age to be admissible for substantive purposes. The hearsay statement is admissible in trial for enumerated felony offenses against children under the age of 13. Certain misdemeanor sex offenses against a minor had the statute of limitations extended to one year after the victim turns 18 to initiate a prosecution. Pimping a minor and aggravated malicious wounding by an adult upon a child were added to the sex offender registry. Also, an offender’s current work address and/or college/university were added to the registry online information. A homeowners’ association may request and receive from the Virginia State Police notice of the registration of offenders whose registered address is in the same or contiguous zip code. A juvenile intake officer may issue a capias (process for arrest) for an adult under age 21 for a crime committed before he or she was 18. The maximum jail sentence is increased to up to 12 months for each offense with a 36 month cap. A deferred finding for domestic simple assault is permitted when the victim is a family or household member. Previously, this was permitted only for a charge of domestic assault and battery. A “no contact” order in an emergency protective order includes not being in the “physical presence” of the abused person, family or household members. Physical presence includes intentionally making direct visual contact or unreasonably being within 100 feet of the petitioner’s home or work. The requirement that a bodily injury be “serious” to charge a felony of assault and battery resulting in injury while under a protective order has been removed. In a stalking prosecution, actual notice to the stalker that the victim desires no contact provides prima facie evidence of intent to place the victim in fear of injury to the victim or the victim’s family. This notice may be provided by anyone, can be written or oral,
and the protective order may act as notice. A second offense of stalking within five years is a felony (previously it was a third offense) and does not require the same victim be involved. Any defendant in a domestic assault case under a deferred disposition must be ordered into a treatment program. A new Class 6 felony (up to five years in prison) was enacted for anyone possessing a firearm while under a permanent protective order for domestic abuse. The individual has 24 hours after service of the order to remove the firearm(s). This applies to any permanent protective order, even if issued before July 1, 2016. A Class 6 felony was enacted to apply to any person under a protective order who violates the order while knowingly armed with a deadly weapon, not just merely possessing the weapon. Virginia residents are permitted to purchase firearms with just one government issued photo ID showing residency in Virginia. Armed forces members may use a Department of Defense ID and a copy of permanent duty orders assigning them to a post in Virginia or a copy of their Leave and Earnings statement. Certain individuals previously adjudicated at age 14 or older of a crime that would be a felony if committed by an adult may possess firearms and secure a concealed weapon permit if they have completed a two-year term of enlistment in the military and have been honorably discharged. Virginia will recognize concealed carry permits of all other states if the holder is 21 years of age, the issuing state has a 24/7 verification process, the holder carries a government issued photo ID and the holder has not had a Virginia concealed carry permit revoked. It is now a Class 1 misdemeanor to fraudulently represent oneself as a former or current member of the Armed Services to obtain services (e.g., to gain a free haircut or discount admission into an event). It is a Class 4 misdemeanor to fit a dog with a vest, etc., in order to represent the dog as a service dog with the intent to fraudulently gain public access for the dog. The minimum age for marriage was raised to 18 unless emancipated by court order. For motorcycles, the maximum number of lights allowable to provide forward illumination is increased from four to five. DMV shall issue permits to vehicles transporting a watercraft when the total outside width is between 102 and 108 inches. No locality may regulate the use of privately owned, unmanned aircraft (drones) within its boundaries. This expires on July 1, 2019. A motor vehicle driver’s viewing of a moving image (TV, video) is now restricted by requiring that the equipment is factory installed and that the equipment has an interlock device that disables the image when performing a “driving task” as set forth in the statute. There is a civil penalty of $100 for smoking in a vehicle with a child under 8 years. A minor may give consent to the taking of a Physical Evidence Recovery Kit if the parent or guardian refuses consent to the PERK. Procedures are set forth for the handling of PERKs. Injuring, destroying, etc., of firefighting equipment or an EMS vehicle with intent to prevent its use is a Class 1 misdemeanor. If the victim is under age 18, subpoenas, search warrants or orders for electronic communication service records will have a nondisclosure provision directing the service provider not disclose said issuance to the subscriber. Existing law was amended to allow law enforcement to get emergency real-time data from an out-of-state provider. Previously, the statute only applied to an in-state provider. Also, the need for the provider to believe there was a danger was eliminated. An affidavit from the custodian of records of electronic communications eliminates the requirement that the custodian appear in court to verify the records are true, complete, and prepared in the course of business. This does not replace proof as to who authored the communication or what it means. New legislation permits a summons to be mailed for unlawfully passing a stopped school bus when the locality uses a videomonitoring system. A method is provided for the accused to rebut the presumption that the registered owner was the driver by filing an affidavit with specified information. Drivers must now wait to it is a reasonably safe to open a door on the side adjacent to traffic or face a fine of up to $50. This does not apply to passengers.

Contributed Report “It’s So Hard To Say Goodbye To Yesterday,” a popular tune by the recording artists Boyz II Men was playing as the original Powhatan High School Steppers With Class members reunited in the Powhatan Junior High School gymnasium on Saturday, June 4. After 23 years, 13 of the 15 original steppers were in attendance with their families and friends for what was described as “the best reunion ever,” said Dale Goodman, former co-sponsor of the step team. When it was announced publically that the doors of Powhatan Junior High School, formerly the old Powhatan High School, would be closing its doors, Mary Ann Howell and Goodman decided that there was no time to waste. What better way to say goodbye to this building than to bring the original step team members back to where it all began in the PJHS gymnasium some 23 years ago. With the approval of Dr. Eric Jones, superintendent, and Jason Tibbs, PJHS Principal, a reunion was held. Draping the tables in the gymnasium were countless news articles published long ago by the Powhatan Today and the Richmond Times-Dispatch of the Step Team’s awards and accomplishments. Some of the former step team members’ performance attires were on display. Standing tall were 10 trophies released to Goodman by the present Powhatan High School.
At the very last minute, Howell and Goodman decided to distribute the trophies to any former step team members who would be willing to give a personal rendition of one of their past performances. Surprisingly enough, the 10 trophies were awarded within one hour’s time, Goodman said. The former high spirited steppers, most of them in their mid- 30s, had no problem showing off their unforgotten talents in front of a well-attended audience. The highlight of the reunion was a surprise visit from Steve Ellerbe, the steppers’ former coach/sponsor of Fayetteville, North Carolina. There were many tears of laughter and hugs of joy spread throughout the entire gathering. A video was shown of the step team’s past performances at the Apollo in New York with host Steve Harvey, a halftime performance at the Washington Bullets’ game in Washington, D.C., and the ultimate pre-game performance show at the Super Bowl XXX1 in New Orleans that gave them national fame. The reunion ended with a special farewell to the building of PJHS followed by a reception held in the school’s cafeteria. were as close to perfect as it is possible to achieve. Joy Daniel of Powhatan, a crew member on the Lady’s Slipper, said the water level, weather, and people on the first seven days were all perfect. “There were few struggles, and when there were, everyone helped. If there is an issue, people come to help each other,” she said. Daniel has participated in all 31 years of the festival in different ways, starting when she was 9 years old, and said she wouldn’t dream of missing it. She said she was incredibly thankful to Harris for lending his batteau to the crew of the Lady’s Slipper so that missing the festival wasn’t an issue. “The river is my soul. I love the peacefulness and the slow, river time. People ask what time it is, but it’s ‘rivah’ time. There is no time schedule. You just do it on your own time,” she said. Timberlake echoed Daniel’s appreciation for the week, saying the water level was wonderful and the teamwork on the boat was awesome. It made getting used to how the Margaret Stevens handles in the water even easier, she said. Nelson said he appreciated how good his crew and the company of other participants were this year and that the water levels made it easier for them all to enjoy each other and the float. “Good water levels mean we are not working our butts off. We have time to look around and enjoy what the river has to offer- the river, the scenery, the flowers. We had time to enjoy our time together. It just makes for a very enjoyable time on the river,” he said. He added that his crew is already talking and planning for next year’s festival. Powhatan Little League’s 12-yearold All Stars were down a pair of runs in the second game of the District 5 tournament at Tuckahoe Little League on Saturday. But, that wasn’t the case for long. Powhatan’s bats came alive in the bottom of the first inning for double-
digit runs in a 14-4 win over Chesterfield’s All-Stars. “We feel great,” Powhatan All-Stars coach Jay Heckel said. “It was nice to watch the boys to contribute as a team, hit the ball, and win.” The win kept Powhatan alive in the double-elimination tournament after they fell to Tuckahoe on Friday. Powhatan’s win eliminated Chesterfield. Powhatan’s Connor Yates was on
the mound for the all stars and struck out three batters, but two talks and an RBI single gave Chesterfield the early 2-0 edge. Yates led off the bottom of the explosive inning for Powhatan and reached base with a single. Andrew Shiflett knocked Yates in with a single to cut the deficit to 2-1. But, that was just the beginning of the runs in the inning.
The next five batters for Powhatan would reach base, starting with Connor Nickerson and Carl Hess reaching on errors by the shortstop. Shiflett would score to make it 2-2. Some nights, bats go cold in the situations when they’re needed. Other nights, the opposing pitcher is just dealing. There was a little bit of both at Powhatan High School on June 25 when Post 201 hosted Post 361 and fell 3-2. While West End’s Patrick Hulihan was extremely effective, striking out 11 Post 201 batters from the third inning on alone, Powhatan was un-
able to get runners moving when they were able to get to Hulihan. “We’re still struggling with the bats,” Post 201 coach Eric Mead said. “We’re hitting the ball hard. We just can’t put them together. This is three games to where we’ve waited until the latter part of the game to start hitting. We have got to start hitting earlier.” In the bottom of the third inning, Justin Bales had a lead-off single, but three straight outs ended the frame. West End got to starter
Reilly Dickerson for a run early on, and added another in the top of the fourth. Josh Duimstra reached on line drive that was almost caught by Joe Cutchins at second, and then stole a base. Ryan Grubbs brought him home with a single to make it 2-0. ANAKINSABOT – Powhatan’s Elizabeth Carter didn’t expect to win anything when she readied herself for the Bryan Trophy competition at the Deep Run Horse Show at the Deep Run Hunt Club Saturday morning. She just wanted to get through the jumping course and other tests
without any grave mistakes. Carter need not have worried. The rising freshman at Blessed Sacrament Huguenot and her mount, Andiamo, left the award ceremony with award ribbons and she sported a huge smile after claiming a fourth-place finish – the best of any local competitor – in the prestigious competition. The competition consisted of three phases – a jumping course, followed
by two sets of horsemanship exercises. The 14year-old had to maneuver Andiamo over a series of 3-foot, 3-inch obstacles during the jumping portion. “I had never jumped that high before, so it was a lot of fun going there,” Carter said. “I was just hoping to go in and get around the course and have fun. I wasn’t expecting to get a good ribbon or anything.” Carter confessed to

To be able to go up and compete against them, and put a decent game up, they had a lot to be proud of. No reason to be upset. We’re a young team. We had a number of kids that were nine-years-old and younger and other teams were older. It was all of their first time playing all stars. They just had a lot to be proud of. They pitched well and played good defense.”

While a strikeout followed that walk, Logan Allen came to the plate and belted a single to the fence, scoring Bales and Cutchins to cut the lead to 3-2. “That’s what we’re looking for out of our leaders,” Mead said. “We had some opportunities in the last inning where we had some of our seniors up there that are going off to play some college baseball that needed to get it done, but we haven’t gotten it done. That’s what I’m looking for from our leaders is to step up in those tight spots. We just need to get it done earli-
er.” Brian Fitch couldn’t continue the scoring when he came to bat with the tying run 90 feet away, as he struck out. The bottom of the ninth was a one-twothree inning, crippling any hopes of the comeback win. Post 201 ended its three-game skid on Sunday with a 7-3 win over Post 284P. The game was the first of nine games over the span of 11 days for the team. Mead said that that stretch will test the team, especially from the pitching perspective. “You almost have to pitch by committee,” he said. “We’re going to have to make sure our arms stay strong.”
