OWHATAN – Local law enforcement recently took part in a special town hall meeting to educate Powhatan citizens about their rights when it comes to selfdefense and gun laws. Supervisor Larry Nordvig and Powhatan Citizens Alliance founder Don Silberbauer hosted a Home Defense Briefing Town Hall on Sunday, Aug. 9 that about 75 people attended at the Village Building. Nordvig said they decided to focus on home and personal defense “because we live in unsettled times; we live in even dangerous times.” “I don’t have to point too far; I can point to downtown Richmond. We number along with over 30 cities now in America that have experienced some sort of rioting, looting, vandalism, statue pulling, … actual murders,” he said. Durham gave a presentation on the new gun laws that went into effect in Virginia on July 1, 2020. (See information Page 5A) The town hall meeting, which lasted three hours, covered a wide range of information. Because attendance had to be capped due to COVID-19 restrictions, the meeting was filmed so people could access it and learn about their rights. Local runner carries memory of fallen soldiers mile by mile By Laura McFarland Editor
POWHATAN – When Donna Schultz-Shagena is out running around Powhatan, the large American flag she often carries tends to make her stand out. But more than a simple show of patriotism, running has become a vehicle for Schultz-Shagena to honor those whose sacrifices she feels are worthy of recognition. A few years ago, the experienced long distance runner began carrying the names and images of fallen American military personnel with her as she trained and competed in races both locally and elsewhere. When she laces up her running shoes, she is not just running for the sake of it; carrying their photographs and information is about remembering them and their sacrifice for their country, she said. “This country is built on what our military veterans have done. Where
would we be without them? They have sacrificed years of their life and their families have sacrificed,” she said. But more than just a name and photograph, Schultz-Shagena tries to research each fallen hero to learn more about who they were as a person. She has carried the images of military personnel killed in World War II and the Korean War as well as in Iraq and Afghanistan. At the end of last year, she sent the large flag she had carried in races throughout 2019 to the family of a Korean War soldier who was missing in action but whose remains had recently been identified. She had carried that particular flag for more than 700 miles in races she completed. Powhatan County Public Library has reopened to the public, but due to COVID-19related safety measures, it will be open for limited hours and occupancy, from 10 a.m. to 4 p.m. Monday to Thursday and from 10 a.m. to 4 p.m. on Saturdays. Powhatan County Public Schools has found five locations to park school buses that will give Wi-Fi access to students who need it. In 1996, a spirited group of Powhatan volunteers held the first Relay For Life of Powhatan. They worked together to raise money for the American Cancer Society. Some were cancer survivors or cancer patients, and many others were friends or loved ones of people who had suffered with cancer. Organizers are trying to reach the volunteers from that 1996 Relay to show their appreciation for the great event that they founded and passed down. The Powhatan Convenience Center is now allowing a modified schedule for disposal of “free loads,” which are small amounts of construction and demolition waste generated at a residence. They may be disposed of at no cost, no more than once per month, provided such waste is limited to the amount contained in one level pickup truck load without supplemental sides. Convenience center employees will track monthly free loads by documenting the vehicle, license plate, and a description of the individual. At this time the convenience center will also resume metal recycling and oil/antifreeze/paint collection but will NOT accept any fee-based materials such as tires, appliances or materials in excess of the monthly free load. Commercial businesses are NOT permitted to use the convenience center. Free loads will only be allowed Tuesday to Friday subject to available capacity. Any resident attempting to dispose of free load material on Saturday or Sunday will be turned away.

BUSINESS BRIEFS Powhatan promotes business assistance grant program Powhatan County Economic Development recently announced the Powhatan Business Assistance Grant program. The grant program is funded using the Federal CARES Act funding, which the Powhatan Board of Supervisors have allocated $517,404.60 to assist small businesses in Powhatan. The funding is intended to cover COVID-19 related costs and will be administered through the Powhatan Economic Development Authority by Community Investment Collaborative (CIC). The program is separated into two categories: 1) funding up to $25,000 for businesses with 10-25 employees and $500,000-$2.5 million in revenue per calendar year 2019 and 2) up to $10,000 for businesses with nine or less employees and less than $500,000 in revenue per calendar year 2019. All businesses must be able to show at least a 25 percent revenue reduction from 2019 to 2020. Applications will open on Aug. 24, 2020, and will close on Sept. 7, 2020. Applicants are required to visit the CIC website and complete the interest form to be automatically informed of the opening of applications. CRIME BRIEF Powhatan man charged with soliciting a minor waives hearing A Powhatan man who worked as a local substitute teacher and was charged in June with soliciting a minor in North Carolina waived his right to a preliminary hearing on Wednesday, Aug. 12. On June 5, Erik Logan Hockaday, 24, was served with three felony warrants for using a communication device for solicitation of a minor less than 15 years of age (a Class 5 felony) and one count of possession of child pornography (a Class 6 felony). He has been held in Piedmont Regional Jail since being taken into custody. Hockaday, who was a substitute teacher at Powhatan High School at the time of his arrest, is accused of being involved in an inappropriate online relationship with a 14-year-old North Carolina boy, according to a release from the

Royall so the commonwealth’s attorney’s office, sheriff’s office, and Virginia State Police could lay out evidence to determine whether the prosecution has enough evidence to support proceeding to a trial. However, at the start of the hearing, defense attorney Steve Goodwin made a motion for a closed hearing to exclude press coverage, which he said could prejudice a potential jury pool against his client. When Royall denied the motion for a closed hearing, Hockaday waived his right for a preliminary hearing. The case will now go to a grand jury in October for another probable cause hearing, which will be a closed hearing.

School board bans wearing, displaying Confederate flag By Laura McFarland Editor
POWAHTAN – The Powhatan County School Board voted unanimously last week to ban wearing or displaying the Confederate flag on school grounds in a fairly low-key decision. During the board’s meeting on Tuesday, Aug. 11, the members updated both the division’s Student Rights and Responsibilities document and school board policies relating to the prohibition against harassment and retaliation to reflect this change. The division already prohibited “clothing with language or images that are discriminatory, obscene, relating to alcohol, tobacco, drugs, sex, profanity, obscenity, vulgarity, violence, that is demeaning any group or individual, or that promotes conduct contrary to the Powhatan County Public Schools guide to Student Rights and Responsibilities.” New language was added to include “clothing with language or images of Confederate flags, swastikas, KKK references, or any other images that might reasonably be considered intimidating to others such that it may cause a disruption to the learning environment.” The board said little about the decision during open meeting. They had invited their attorney to discuss their options in a closed session that took up a sizeable chunk at the first part of the meeting. Kim Hymel, who represents District 5, was the only school board member who spoke before the vote. She said she wanted to support students who requested to have the flag banned in schools, feeling that “they are letting us know that they want a safe learning environment, which they don’t feel they have right now.” “We are in the business of teaching students, and if we can’t have a safe learning environment for them then we are not doing justice for them,” she said. If we are truly an inclusive community, we will figure out a way for people of those diverse viewpoints to get along in the same environment.” Cole said he was happy with the school board’s vote but wanted to caution people that “the work is not done.” Other business handled by the school board included: The board decided in a 2-3 vote against entering into an electric school bus agreement with Dominion Energy Virginia. PCPS learned in January that it had been chosen by Dominion as one of the winners in its grant program to receive two electric buses. Under the terms of the grant, the school division would pay $119,743 each for two 77-passenger electric school buses, which would normally cost about $350,000. This price includes $9,230 for mandated seatbelts and $10,873 for air conditioning. Normally, the school division pays $94,073 for each 65-passenger diesel bus. Staff maintained through data it collected and two school board members agreed – Cole and Valarie Ayers, District 3 – that although there was more of an upfront cost with the electric school buses, a price comparison of purchase and estimated operating costs represented a savings of $66,205 per bus. However, Hymel and Susan Smith, District 2, argued strongly against the purchase, saying the school division had no set need for electric school buses. Most importantly, they said, the county just finished a budget process in which they admitted they had no idea what the new school year would look like or cost, so they needed to be frugal with their money. Although he didn’t offer an opinion on the issue, chairman Joe Walters, District 1, joined Hymel and Smith in voting against approving the electric school bus agreement.

Powhatan High School’s Diverse Hands at Work student group sent a letter to Dr. Eric Jones, superintendent, asking that the division ban the Confederate flag from being displayed anywhere or worn by anyone on PCPS property. That request has been supported at the last several meetings since the issue was raised during the public comment period, and it was again last week. Of the 14 emails that were sent to Jones ahead of the meeting and partially read during the public comment period, all 14 of them asked for the flag to be banned. In various ways, those supporting the ban argued that allowing the flag to be worn or display on school grounds for anything except educational purposes promotes an “unsafe, unwelcoming, intimidating, and racist school climate.” They talked about it being a “serious distraction in the learning environment,” pointed to its use as an intimidation tool beginning in the 1930s and its continued use by organizations such as the KKK and neoNazis, and argued that it goes against the division’s Core Beliefs of “commitment to equity and inclusiveness in our schools.” After the vote on the Student Rights and Responsibilities, the board also adopted two updated policies that had language added similar to the first document. At the end of the meeting, Rick Cole, District 1, said all of the board members received numerous emails about the Confederate flag with people both in support of and against banning its presence in schools. Cole reminded people that “tolerance is a two-way street,” saying everybody deserves to have their own viewpoint. “Passing this ban is one step in the right direction but it is a multi-step process – one that will not end with what we did tonight,” Cole said. He went on to add that the school division tries to promote an inclusive community, and “that inclusivity includes people who

Cerullo started by pointing out some of the laws Virginia does not have that other states do have: a Stand Your Ground Law, a Duty to Retreat Law, or a Castle Doctrine Law. Instead, in cases of violent crimes, the state relies on Common Law, also known as a judge-made law, for when people can and cannot use deadly force. This means it is left to law enforcement, commonwealth’s attorneys, judges, and/or ultimately a jury to determine if someone’s actions were justified force or excusable force. “That means there is no get out of jail free card. You can do everything 100 percent right, you can follow the law as best as you know it, as best as anyone knows it, and a prosecutor or a police officer or a jury
or a grand jury can still bring charges against you. And it is up to you to then defend yourself in court and prove that you were within the law. ‌ There is no statute that says in this situation you cannot charge somebody,� Cerullo said. In Virginia, there are two distinct situations where deadly force is used: justified use of force and excusable use of force. should find them not guilty, Cerullo said. With excusable use of force, the defendant was to some degree at fault in provoking or bringing on the fight or difficulty. However, the person retreated as far as they safely could under the circumstances in a good faith attempt to abandon the fight; reasonably feared, under the circumstances as they appeared to them, that they were in imminent danger of bodily harm, and used no more force, under the circumstances as they appeared to them, than was reasonably necessary to protect themselves from the perceived harm. If a person met that burden of proof in a trial, a jury should find them not guilty, Cerullo said. However, Cerullo also talked about the With Fault Exception. In this case, the person who used deadly force and is with fault, meaning they instigated the fight in some way, does not have to retreat and attempt to abandon the fight if he is in his own home. The conditions about reasonably fearing that they were in imminent danger of bodily harm and using no more force than is reasonably necessary to protect themselves still apply. Cerullo said that the Virginia Supreme Court solidified the With Fault Exception with a 2016 case, Com v. Hines. When talking about defending the home, Hines applies if someone is on his curtilage, which is part of the property immediately surrounding a house or dwelling, including any closely associated buildings and structures, Nunnally said. “Don’t think about what you use so much yourself; think about what would be readily apparent to somebody else. That is why when we come on your property as law enforcement, you have more rights on your curtilage than you do on your entire property,� he said.
To outline these definitions, Cerullo walked the audience through three cases, two of which were actual incidents in Powhatan County. One involved a homicide where the man who used deadly force was not indicted because both the witness statements and the evidence supported that he used justified use of force. Another case described a case in which the defendant pleaded guilty to shooting at another driver in a road rage incident, and his actions did not meet the threshold of self-defense.
Use of force Cerullo made several points about self-defense and what people need to understand regarding their rights. „ There is never any justification or scenario where words alone would justify the use of deadly force. „ A person may never ever use deadly force to protect property alone – he or she must be protecting themselves or someone else. Under Virginia law, animals are considered personal property. Because of many questions related to scenarios involving a criminal stealing property or harming an animal, Durham told the audience to ask themselves whether the crime could carry a death penalty before they pull out their gun and use it. „ In order to use deadly force under either scenario, a person has to reasonably believe his or her life is in danger. Being afraid is not enough. Their fear must be reasonable under the circumstances. Additionally, the force used must be reasonable in proportion to the threat against them. Durham pointed out that not every scenario is immediately clear, so someone needs to identify their target before they shoot. What if a neighbor comes over and enters your
home, which is not locked, because they couldn’t reach you on the phone, she asked. What if the person kicking in your door is a firefighter trying to save your life? “You want to make sure what you are shooting at,� she said.
Open carry vs. concealed carry Virginia is an open carry state, meaning people may carry a firearm anywhere they are not otherwise prohibited from doing so, as long as it's open to the public and identifiable as a firearm – no permit or license required. If people have been issued a permit by the Circuit Court of the jurisdiction in which they reside, they may carry a firearm concealed on their person anywhere they are not otherwise prohibited from carrying a firearm. Some of the places covered by statute under otherwise prohibited include: courthouse; all airport property; a federal facility (including the post office); a bar or restaurant if you consume alcohol and have a CCP; anywhere if you are have a CCP and are under the influence; school property, except a CCP holder in a car in the parking lot or if the weapon is in a closed container and unloaded; a child day care center (new as of July 1); and a place of worship “without a good and sufficient reason.� Cerullo also pointed to a new law where a locality can ban firearms in certain locations and events with clear signage. However, the board of supervisors talked about their intention at a recent meeting not to pass such an ordinance. Regarding private businesses that ban firearms on their property, that is not a Second Amendment violation or a violation of the law, Cerullo said. New laws Most of the discussion regarding new laws was a presentation by Durham, including answering questions about particular examples. The most discussion regarding the new laws surrounded the Emergency/ Substantial Risk Orders (ESRO/SRO), also known as the “Red Flag Law.� An SRO is civil in nature and is similar to a protective order but dealing specifically with firearms, Durham said. The red flag laws have been a highly controversial topic, Nunnally said. Citizens’ mental health is important and needs to be addressed, but he is more concerned about helping a person going through those struggles than he is about whether he or she owns a firearm. “I do not believe, nor do I support, the red flag laws as they were passed. This county I doubt would utilize this at all because I cannot think of an instance where the red flag law would apply to you and you not also need mental health care,� Nunnally said.

New gun laws as of July 1, 2020 18.2-208.2:5-Background checks for all transfers of firearms not just federal firearms license (FFL) sales – if sold or transferred for anything of value; up to three days to run. 18.2-308.5:1 – Bump stocks banned. 18.2-308.2:2 – One gun a month unless law enforcement officer or concealed carry permit (CCP) holder and private sales. 18.2-56.2 – increased penalties from Class 3 to Class 1 misdemeanor for allowing minors access to firearms. 18.2-287.5 – 48 hours to report lost or stolen firearms to law enforcement from the time it is noticed missing with a $250 fine for failure to do so. Civil penalty only. 18.2-308.1:6 – Creates the Virginia Voluntary Do Not Sell Firearms List that prohibits the possession, transportation, and sale of firearms to any person who voluntarily registers herself or himself to be enrolled into the list. Police must conduct an investigation and establish probable cause to believe that the person poses a risk of injury to self or others in the near future by possession of guns. Emergency Substantial Risk Order (ESRO) – Petition is reviewed by magistrate or judge and it lasts 14 days. Substantial Risk Order (SRO) – Circuit court reviews within 14 days to decide if the court should issue an SRO to prohibit the person from buying or possessing a gun for up to six months upon a finding. Requires clear and convincing evidence that the person poses a risk of injury to self or others in the near future by possessing guns. People who are subject to an ESRO or SRO must surrender any firearms and their CCP and are disqualified from getting a CCP and may not work for a firearms dealer. Virginia State Police will be required to keep and maintain a digital system for keeping track of people subject to E/SROs. It only authorizes police to ask you to voluntarily turn your weapons over. It does not grant author-

Allows Virginia localities to ban guns in public buildings, parks and other areas, including recreation and community centers. Also applies to streets where events or rallies requiring permits are taking place. Must have clear signage banning weapons. Powhatan does not have such an ordinance. State funds available for farm land improvements Contributed Report Have you been pondering ways to improve the natural resources on your farm? Are your livestock drinking from a stream? Is there erosion occurring from your crop field? Are you interested in a winter cover on a crop field? Would you like to convert a crop field into permanent grass? The Monacan Soil and Water Conservation District office (MSWCD) has funds through the Virginia General Assembly for these types of best management practices (BMPs) and more on your farm. The program that offers these funds is called the Virginia Agricultural Cost Share Program (VACS). Monacan administers the VACS program for Goochland and Powhatan Counties. The practices within the program are designed to reduce agricultural pollution to the Chesapeake Bay. There are 47 SWCDs that cover the counties of Virginia. Visit vaswcd.org for more information about them. There are eligibility requirements for the VACS program. Agricultural land is defined as “land being used in a BONA FIDE program of agricultural management and engaged in the production of agricultural,
horticultural or forest products for market.” The real estate must consist of a minimum of 5 contiguous acres and have verifiable gross receipts in excess of $1,000 per year from the production or sale of agricultural, horticultural or forest products produced on the applicant’s agricultural land for each of the past five years. Monacan provided funding for the following this past fiscal year: a poultry waste control and composter facility; over 3,000 acres of cover crops; 160 acres of permanent grass; 5,500 acres of nutrient management; and over 9 miles of streambank excluded from 658 cattle creating 48 acres of 35-foot riparian (creek) buffers. Looking more closely at the results, at the elementary and high school levels, the split stays roughly the same, with 81 percent choosing hybrid and 19 percent opting to attend virtually, he said. Powhatan Middle School is expected to have 76 percent of students in hybrid and 23 percent in virtual. Since the school board approved the models, division staff has been working on further developing what they will look like, Jones said. With the virtual model, the school division has had several areas it is continuing to develop to best facilitate the enhanced online option: creating a balance of real-time instruction versus learning they do separate from the class and teacher; meeting the needs of families who need more structure as well as those seeking flexibility; defining the structure of the day to make sure there is consistency among teachers in both models, and fleshing out what Wednesdays will look like as far as support, teacher office hours, and small group interaction. With the hybrid model, parents were notified last week if their children would attend school in the Monday/Tuesday (AA) or Thursday/Friday (BB) schedules. The division allowed families to request which schedule they would like and was able to accommodate those needs, Jones said. Wednesdays on hybrid will mirror the virtual model, offering work that can be completed on their own, opportunities for teacher office hours, and small group activities where necessary. Jones touched on a variety of other topics in his presentation on the return to school.

When possible, she contacts the families of the fallen to let them know their loved one is being remembered. If they are interested, she also sends them a package with the image of their loved one that she carried and any materials related to the race. Included in that package is always pennies that have had crosses stamped out of them by Cross Penny Ministries in Texas, which she carries in the races and on training runs, leaving them everywhere she goes. “I have found all but two families of all the people I have run for, so they know I am doing this for them and that someone is honoring their (loved one’s) memory,” she said. The runner had carried Nouv’s photo before. Although she never met the servicewoman, Nouv holds a special place in her heart because her parents were the first family of a fallen soldier she honored that SchultzShagena met in person. Judy Reynal, Nouv’s mother, said she met Schultz-Shagena in Virginia Beach after the first time she ran in her daughter’s memory. Reynal said it was wonderful to learn that several years after her daughter’s death, her sacrifice was still being remembered. “Sometimes you think they died in vain and are just another statistic. Then you see someone like Donna, who does what she does and goes to the point of finding out about the families. It is not just a name. She finds out about the person,” said Reynal of Yorktown. Nouv joined the U.S. Army to better herself and her future prospects for her two children, who are teen-

agers now. She planned to continue her education after her service with the army’s help. Nouv’s deployment was supposed to end in September 2013. She was one of three soldiers in her unit killed during deployment, her mother said. More recently, SchultzShagena also started adding living heroes to the list of people she carries on her runs, including Powhatan deputies. “Once it became clear there were not going to be any races held until later in the year. I thought I am going to run anyway – why not run for heroes that are still here and we can tell them thank you and they are appreciated,” she said. As with so many aspects of life in 2020, COVID-19 has vitally changed the course of the runner’s year. Used to participating in about 20 races a year, 2020 saw her completing her last in-person event in February. But even though the virtual races don’t have the same energy as traveling and completing live races, SchultzShagena said she never once thought about it deterring her from running. “It is my therapy. I always feel so much better after I run. I have never regretted going out for a run. It just becomes part of your life. I feel bad if I don’t run,” she said.
The division’s health plan is a fluid document that will continually be updated as more information is known, Jones said. One of the most frequently asked questions staff members have received have pertained to what happens if a person is suspected of COVID-19 and is being tested. PCPS’s health plan says that people who were in close contact of a person who tested positive for COVID-19 should be tested. The health department defines close contact as being within less than 6 feet of the person who tested positive for at least 10 to 15 minutes and having direct contact with infectious secretions of a COVID-19 case (e.g., being coughed on) while not wearing recommended personal protective equipment. The school division has been asked repeatedly who is required to wear a mask. All adults and students will be required to wear face coverings in accordance with county guidance, Jones said. Students who choose not to wear masks will be given a disciplinary infraction if they willfully don’t wear a mask. If they don’t have a mask, the school will provide them with one. “We expect our students to wear masks. The only way this works is if people are following our protocols,” Jones said. “So if people aren’t wearing masks and it happens more than once, they will be moved to Pathway I and be a virtual student if they can’t wear a mask in our schools and follow the rules. It is just like any other disciplinary infraction.” Dr. Lynn Clayton-Prince, director of special education, said the division will be working with the youngest students on wearing masks and is asking families to begin practicing with them before the school year begins. The division has acquired a small number of test kits that could be used for staff members in cases where exposure is suspected, Clay-

ton-Prince said. In the case of people needing to be quarantined, for students the division has been given some flexibility on attendance from the state. For educators, PCPS will follow the updated Emergency Family and Medical Leave Expansion Act regarding time off because of the need to quarantine.
Transportation School buses are an important component in planning to reduce risk, Jones said. The biggest change caused by transportation is reducing the elementary schools’ hours by 10 minutes to allow for more cleaning turnaround time between elementary and secondary school bus runs. Buses will be disinfected weekly instead of the recommended 10 days. While staff levels for buses are

currently sufficient, the division did lose three drivers to resignations and two to retirements, Jones said. The school division is putting out buses with signage for recruitment purposes at the edges of the county. Drivers will call parents to verify ridership status. Drivers will receive training on SafeSchools, Health & Safety Resources for School Transportation, and updates from the trainers that include reviewing routes, cleaning protocols, and pre and post checks, he added. Wearing a mask will be required on buses, he said.
School food service Meals will be eaten in classrooms to maintain social distancing with some small groups in commons areas as needed, Jones said. The division has bought some equipment such as carts to help deliver meals to classrooms. Meals will be available for virtual days and virtual learners, but, as with hybrid students, meal charges are in effect unless a student is eligible for free or reduced meals. “That is something that is important for the board and the community to be aware of,” Jones said. “The waiver that we received when schools were closed that allowed us to serve lunches basically to anybody is expired. Once we reopen schools, we will only be able to provide lunches to Powhatan students and we will only be able to provide free and reduced lunches to those who qualify for free and reduced lunches.” Sodexo, which contracts to handle PCPS’s food services, has trained its employees on COVID-19 safety measures and employees will sign policy and acknowledge training prior to working, Jones said. An additional precaution taken this year is to only allow food service employees to work in one school, he said. Therefore, if there is an exposure in a kitchen or cafeteria it would only impact one school.
Childcare with staff Jones announced last week that the school division had received a $500,000 donation from local couple Bob and Karla Curtis, with $120,000 of that amount designated for childcare for staff with schoolage children. The division has identified 45 students in prekindergarten through third grade and 45 students in fourth through seven grades who need a safe place to go while their parents are working. For the first three weeks of the school year, the students will be housed at each elemen-

Staffing The school division worked hard to make sure it is meeting the needs of employees to the best of its ability, Jones said. Staff members were asked if they were comfortable coming back to school, and 43 employees raised issues. Their issues related to returning to in-person instruction either because they have a medical issue or disability; an immediate family member has a medical issue or disability, or they had general concerns about returning to school. The human resources department has been in touch with those employees to determine if they need to teach in the virtual model or if there are accommodations the division can make to allay their fears about returning to the classroom, Jones continued. Types of accommodations for qualifying employees may include: more breaks for hand-washing; rerouting traffic pattern; additional or enhanced PPE; erecting a barrier in the classroom, eliminating marginal duties; reassignment to a different position; modification of work schedules; having them become a virtual instructor/teleworker, or granting a leave of absence. For non-qualifying employees, HR is working with the employees and school to determine what supports, if any, the division can provide based on division needs, Jones said. “I have talked to several employees and the conversations I have had have been very positive. Once we talked to people and talked about what measures can be put in place they feel better,” Jones said. “I think we are in a good spot in terms of our employees and where they are. We are still working with a few – probably less than five – to finalize what those accommodations are.” After answering questions about the accommodations being made for staff, Jones said that to his knowledge, no teacher has resigned specifically because the division couldn’t accommodate their needs. However, he acknowledged that not every teacher is 100 percent happy, because sometimes the division had to “balance the needs of those individuals against the needs of the school and our master schedule at that school and the rest of the teachers there.” Policies and protocols for substitute teachers are still being developed, he said.
Facilities Because maintaining clean schools will be such an integral part of making the hybrid model work, staff members are looking closely at the facilities, said Dr. Jason Tibbs, director of facilities. The school division is implementing many safe guards, including: increasing custodial staff training on COVID-19 precautions; increasing the frequency of cleaning areas with a high level of humans touching the surroundings; implementing an accountability system throughout all buildings; adjusting custodial staff hours to have more on hand during the day; regular bathroom closures throughout the day to clean, disinfect, and sanitize, and seeking to hire one additional custodian per building and two custodial technicians. The schools also will provide personal protective equipment (PPE) such as adult and child size masks; hand sanitizing stations at the entrances and hallways as well as in each classroom and on buses; disinfectant spray and wipes in each classroom, and paper towels. Great American road trip still captivates By Laura McFarland Editor
R
ecently, I agreed to let a friend plan a road trip in West Virginia. She needed something to keep her from going crazy in the early months of the pandemic, and I will admit that I was hankering for something to look forward to as well. My friend Erin has strong ties to the state, both because she has family there and she simply loves what the state has to offer. So I pretty much let her be in charge of planning our adventure. We knew from the beginning that we needed to be smart about this trip. We chose places to stay where we could adequately social distance, including a campground and a few days with her family, and sites to see that were generally either outdoors or had good safety measures in place. And of course we brought along the necessary PPE to help keep ourselves and others safe. I went into the West Virginia trip with an open mind; there were no preconceived notions about the state or its residents. And while I know the state as it is now is different than what I might normally experience when COVID-19 hasn’t turned our world upside down, I feel like I still gained insight into the place and its people. This isn’t a travelogue, but I will beg our readers’ indulgence to share a few of the experiences, because they were not only places I would highly recommend for anyone to visit someday but demonstrated how our exploration of other people and places can help us discover more about ourselves.
This road trip was a great mix of scheduled and unscheduled stops. As a person who tends to make lists will do, toward the end of the trip, I tried to think about my favorite moments. After all, when you go on a trip, “What was your favorite part?” is a standard question when you return. Because the experiences were so wonderful and diverse, I had to categorize them. My favorite manmade structure was visiting the New River Gorge Bridge. I had seen many photos of this bridge and was more than a little excited to see it. In addition to being a great engineering feat, set against the beauty of the tree-covered mountains and the New River, which runs below it, it is simply a breathtaking sight. While the visitors center was closed, I was still able to learn some fun facts about the bridge from the tourist signs. The height of the bridge is 876 feet. That is high enough for the Statue of Liberty to stand underneath it twice atop the Washington Monument with 20 feet to spare. Because we made the trip down the mountain to see it from below, I also can appreciate what opening that bridge meant for travel, cutting what is purported to have been a 45-minute trip from one mountain top to another down to 45 seconds. The most impressive natural site for me was Sandstone Falls, a portion of the New River that sees a line of waterfalls with 10- to 15-foot drops across the expanse of the river, which is 1,500 feet wide at that point. A series of boardwalks gives a lovely view of the waterfalls from a distance, meaning it is accessible to even those with mobility issues. But if you want to get off the beaten path and explore, you can make your way closer

The city has had a Civilian Police Review Board since 1990 - 30 years. Not exactly your white supremacist bastion. This is precisely the environment and government that the demonstrators and rioters have demanded. After over a half billion dollars damage to Minneapolis the residents must ask themselves, "Does this model work? Why hasn't this model of government protected our homes and businesses and prevented this disruption and destruction?” “Did the leaders of the state and city do their job or did they simply allow the destruction of their city?” “Did the police chief do his job?” “Why don't Americans express their anger with the rapid escalating violent crime wave?” “How about the skyrocketing drug overdoses?” Virginians, does all this sound familiar? Resident examines what has sparked recent social disruption Dear Editor, What has sparked all this conversation about the Confederacy and its flag as well as massive social disruption causing billions of dollars in damage? Ostensibly, it was the alleged criminal action by four police officers in Minneapolis. I say alleged because I am not a judge, the prosecutor, or on the jury that will handle this case. Our Constitution guarantees all of us the right to a fair trial. Unfortunately, many have forgotten this. They have tried, convicted and executed the defendants. It is unlikely that the defendants will receive a fair trial anywhere in this country. Here’s the background taken from what I believe are reliable sources. 1. George Floyd was a career criminal who was convicted of eight crimes between 1997 and 2005. He served five years in prison for an armed home invasion over drugs and money. He was apprehended for passing a counterfeit bill - a big problem in the neighborhood. 2. Floyd also has been reported to have had COVID-19 in April. 3. Minnesota is one of the most liberal states in the country. It was settled by hardworking, law abiding and God-fearing Scandinavians and Germans. They were not slave holders. They adopted the liberal Scandinavian model of government with extremely high taxes and vast social programs. 4. Minnesota is a staunchly democratic state, having voted democratic in all of the presidential elections since 1932. Its governor, two female U.S. Senators, most of its Congressmen, and the mayor of Minneapolis are members of the Democratic-FarmerLabor (DFL) Party. Twelve of the 13

The best unexpected stop hands down was the war memorial in Parsons. The memorial commemorates veterans of every war since War World I. Erin and I had stopped at a gas station across the street, and, when I saw the memorial, I had to take a look. From the stones with the names of veterans to the engraved plaques dedicated to the different wars, it was all so powerful. At one point, I was taking a picture of a reflective stone bench with the Pledge of Allegiance written on it and could see the reflection of the American flag waving above me. The moment gave me chills. The most profound moment came when we visited the Trans-Allegheny Lunatic Asylum. I let Erin know up front that I wasn’t interested in a paranormal tour or hearing about the criminally insane ward of the facility – the basic first floor tour of the structure would be more than enough. I don’t pretend to know everything, but I had enough knowledge about how mental illness was treated in the past that I guessed the standard introduction to regular treatment would be horrifying enough. Of course, it wasn’t talk of inhumane medical treatments that most got under my skin, although that was pretty terrible. What struck me the hardest was a catchall diagnosis called “domestic troubles,” which allowed a male relative to commit a female relative to an insane asylum for just about any reason under the sun. This law would make permanent a federal excise tax (FET) cut that was enacted in 2017 and affects beer, wine, distilled spirits, and cider makers. Without congressional passage of this legislation, the current tax cut would expire on Dec. 31, 2020, and craft distillers in Virginia would face a 400 percent tax increase in 2021, which would hinder the local industry’s recovery from the COVID-19 crisis, said Amy Ciarametaro, executive director of the Virginia Distillers Association. Ciarametaro pointed out that the industry has grown so rapidly that more than 80 percent of distilleries nationwide were not in business before the temporary tax reform was put in place. “There is this enormity of uncertainty for so much of the industry that doesn’t even know what the former rate was like. You couple that with the environment with COVID and onsite operations being scaled down significantly, it is a recipe
for disaster,” she said. Michelle Davenport, who co-owns Three Crosses with her husband John, said the state of Virginia currently taxes her business 54 percent on every bottle they sell. The federal excise tax reform in place now taxes the business at $2.70 a proof gallon. If it is allowed to expire at the end of the year, that will jump to $13.50 a proof gallon. To put it in perspective, Davenport said Three Crosses has made 3,021 proof gallons since it opened in August 2018. At the current rate of $2.70, the federal tax bill would be $8,156. If the tax rate was increased to $13.50, the tax bill on the same amount would be $40,483. “This would be on top of the state 54 percent tax per bottle. So, essentially it would put us out of business,” she said. “What it basically boils down to, is that if it lapsed back to $13.50, it is going to crush the craft distiller industry.” Distillers would be looking at an increase of about $3 to $4 per bottle if the tax reform is not renewed, and then they would have to build it into their pricing structure, Ciarametaro said. That means they have to ask themselves if they would pass the cost onto the consumer and

As far as making the tax cut permanent, Spanberger said she thinks it will be a matter of timing. Negotiations related to the next COVID-19 package have been painfully delayed and ineffective so far, which does have an impact on other pieces of legislation that might be taken up. “Notably there are more than 300 co-sponsors in the House of Representatives, so if this bill were to get a vote, it would pass easily. One of the components of this that I don’t have as much purview into is what happens on the Senate side,” she said. The best chance for the bill might be to put it into a package along with a variety of other bills related to economic growth that also appeal to other legislators’ economic priorities, but she added she can’t begin to predict the Senate’s actions. There is just no way you can operate a business that way,” Davenport said. She added that she and her husband are very worried that “because of one tax reform lapse we could lose it all. It is extremely scary.”

POWHATAN – Andrew Shiflett set the tone in Thursday’s championship game when he smashed the pitch into left field for a lead-off double. He and his teammates unleashed four runs on five hits in that first half-inning alone, and the Legends continued to pull away to defeat the Yard Goats 11-1 in six innings and become the 2020 Powhatan Little League Seniors tournament champions. “It was amazing,” Shiflett said. “It was so fun.” The Legends’ lockdown pitching matched the team’s fiery hitting. Shiflett threw three no-hit innings to secure the win in the championship round; he faced five over the minimum, walked six batters and struck out six. His fastball and curveball were working for him, and he also had the help of his changeup. At the
plate, he batted 2 for 3 with a double and an RBI and scored two runs. His teammate Will Karanian in the fourth inning smashed a bases-clearing double to the right-center fence to further balloon his Legends’ lead. Karanian overall batted 3 for 4 with three doubles and five RBI and scored one run. Luke Burkhart, who threw a no-hitter in the Legends’ previous tournament game against the Outlaws, batted 2 for 3 with a double that he smacked past the third baseman’s glove. He also scored both of his runs in Thursday’s game while sliding. Burkhart in the fifth inning beat the play at the plate after racing home on a wild pitch to score his team’s 10th run and put the Legends in position to win the game in the next half-frame via the 10-run mercy rule. Due to this year’s COVID-10 pandemic, a longtime Labor Day weekend staple, the Powhatan Village Run, will now be held at a later date. In a social media post early last week, race organizers shared the following: “After much thought (and some gnashing of teeth), we have decided to postpone this fall’s Powhatan Village Run. Our race has always been about having fun and promoting fitness, both in short supply as we deal with the impact of COVID-19. However, we are not comfortable with the potential risk to our runners and volunteers in spreading the virus by going forward at this time.” Race organizer Rick Cole said it was a really difficult decision to postpone this year’s Powhatan Village Run. “The race was first held in 1981 and has been held every year on Labor Day weekend since 1989,” Cole said. “We have a lot of runners who have been accustomed to running with us each fall and a number of volunteers who keep the date open to help year after year. There will be a vote to decide if the VCC fall teams, including BSH football, quarterbacked last year by Trevor Parker, will flip their seasons from the fall to the spring.
Blessed Sacrament Huguenot could still begin its athletic year as soon as this fall. But if it does, the order in which it holds its seasons will be different. A vote is slated to be held during a Sept. 9 meeting to decide whether or not the Virginia Colonial Conference, which
includes BSH, will flip fall sports to the spring, and spring sports to the fall. If the VCC flips the seasons, that means BSH would play baseball, softball, co-ed soccer and girls tennis this fall, and football, cheer and volleyball would compete in the spring. Even if the seasons aren’t flipped, the VCC will not play fall sports, including football, this fall. And if the flip doesn’t occur, then the conference is expected to look towards a condensed-season model that is similar to what the Virginia High School League has implemented for this coming year. VHSL’s winter sports will be held
Dec. 14 – Feb. 20 (with the first contest date to be held Dec. 28), fall sports will be moved to Feb. 15 – May 1 (March 1) and spring sports will be held April 12 – June 26 (April 26). The Tidewater Conference of Independent Schools, a private school conference that includes The Steward School in Richmond, is going to a condensed-season model, in which its winter sports will be held Nov. 18 – Jan. 30 (first play date on Dec. 8), fall sports Feb. 1 – March 27 (Feb. 16) and spring sports March 29 – May 22 (April 13). If BSH plays its spring sports this fall, it would only play VCC opponents.

Not a single matchup that Post 201 played was decided by more than three runs. “I think it was good baseball, some of the best baseball that’s probably been played at the Legion level in a long time, said Post 201 baseball head coach Eric Mead, who added: “I think this allowed not only the players who had lost either their high school season or lost their college season an opportunity to find some normalcy in their life – I’m hoping that we did the same thing for the community, gave the community a little bit of normalcy as well.”

This fall season will have a new feeling to it By Nick Vandeloecht Sports Editor As the fight to lower COVID-19 case numbers in the United States continues, the Virginia High School League has made both a safe and smart decision to postpone the start of the 2020-2021 athletic calendar to December. But with that decision comes another void. There will be no VHSL-sanctioned sports this fall. Powhatan High School’s fall teams will have to wait until February to begin their seasons, and none of the school’s student-athletes will be able to represent the school until – or rather, if – winter sports return in December.
Athletic competition, however, will not stop outright. A vote is scheduled for Sept. 9 to determine whether the Virginia Colonial Conference, which includes Powhatan’s Blessed Sacrament Huguenot, will switch its spring sports to the fall. We also anticipate that youth leagues and clubs will continue to compete, with PYAA Fastpitch Softball and Powhatan Fury FC already announcing their plans to play this coming autumn. While it’s tough to see Powhatan High School’s teams having to wait nine months in total before possibly getting another shot at competition, it is good to know that the athletic fields in Powhatan – and nearby – will not be silent for an-
other season. That said, to ensure we bring live coverage, we expect the Powhatan Today’s sports section to include a few new players. We look forward to covering Powhatan’s club teams and youth leagues, and also to highlighting the achievements of Powhatan County athletes who will play this fall for both club teams and private schools in the Richmond area. The Richmond Kickers’ season is also back underway, and with Powhatan County residents having played for their youth programs, we will provide stories and updates on the pro soccer team as well. Our coverage of NASCAR’s four-
race weekend at Richmond Raceway will be featured in the Powhatan Today, and we expect to preview and recap the action featuring all three national touring series, including the Cup’s playoff race at 7:30 p.m. on Saturday, Sept. 12. The team’s defensive backs coach, Matt MacPherson, was on the other end. MacPherson delivered the news that Northwestern, along with the rest of the Big Ten, had canceled its fall football season. The Big Ten on Tuesday became the first Power Five conference to halt fall athletics because of the coronavirus pandemic. Later that afternoon, the Pac-12 followed suit by stopping its fall sports schedule. The Big 12 has voted to press forward. Williams, a 2020 graduate of Colle-
giate and resident of Powhatan County, is one of at least seven scholarship football players from the Richmond area impacted by the conference’s decision. “It’s obviously really disappointing,” Williams said. But hurdles to playing in 2020 kept materializing. Twenty-eight Rutgers players reportedly tested positive, one tested positive at Northwestern, and an Indiana player reportedly endured a possible heart complication because of his positive test. “I don’t think it would have worked in general,” Williams said. “I think this is definitely the right decision. If we’re playing football, a close-contact sport, the virus is going to be able to spread.” Williams applauded the efforts that Northwestern’s staff went to in order to keep players healthy. Players were tested twice a week. They wore masks at every practice, and
they were often broken into smaller groups for workouts. Northwestern, Williams said, did what it needed to do to allow for a season to happen. Many questions remain, including whether the season can be played in the spring and, if there is no season at all, whether players will retain a year of eligibility. Northwestern is hoping for a spring season, Williams said. As for Williams himself, he plans to go home for a few weeks and return to campus in early September. The team won’t practice soon, and classes don’t start until Sept. 9. He expects to have one in-person class; the rest will be online. He’s considering majoring in communications. For the first time in his life, Williams will be a student without being an athlete. “It’s definitely going to be a weird change of pace,” he said.
RICHMOND – Water flowed along the side like a slow and steady river as remnants remained from Saturday’s heavy rains prior to the Kickers’ evening match with FC Tucson. But if the water hadn’t been there, it would’ve been difficult to guess the total rainfall by the state of City Stadium’s field itself. The bright green playing surface hardly looked wet, and the Kickers never seemed to lose a step in their second consecutive home game as they fended off a late surge from Tucson to win 2-1 in a match in which the gametime precipitation never escalated past a light drizzle. Still, head coach Darren Sawatzky saw room for improvement in his team. “Our press is still not where it needs to be. I think we’re probably lacking . . . the type of player that does that. Some guys are filling in and doing a good job,” Sawatzky said. “But I think what we’re doing really well is at the mid-block area. Just past the half-line, we pounced on things and we get behind teams pretty quickly.” The Kickers grabbed the lead on a set piece when Ivan Magalhães headed teammate Mutaya Mwape’s kick into the back of the net for his first goal seven minutes into the game. “Pretty much every day we have a little bit of set piece practice, so we’re always running different set pieces,” Magalhães said, adding: “I’ve got a good connection with MuMu (Mwape), I know where he likes to hit the ball.” “When he’s on the ball, he’s very, very, very dangerous for us,” Sawatzky said of Mwape. “Hopefully we find him a goal soon so that the floodgates open up.” After Tucson’s goalie Carlos Merancio somehow saved a hard shot by Luke Pavone, Emiliano Terzaghi footed through the Kickers’ second goal before the end of the first half. Terzaghi remains the Kickers’ leading scorer with three goals this season. “He’s an Argentine professional soccer player. Some of our guys are learning to be pros . . . he’s an established professional, he understands what it takes,” Sawatzky said of Terzaghi. “I can’t say see KICKERS, pg. 3B

Sports Editor POWHATAN – The Yard Goats on Monday punched their ticket to Powhatan Little League’s Seniors championship round after they routed the Outlaws 14-1 in six innings last Monday. Thomas Whitley got the win on the mound, striking out nine and allowing one hit and one run in four innings pitched, and he pulled his team out of a bases-loaded jam in the bottom of the second inning with the game still scoreless. He also helped his case at the plate in the third when he cleared the bases on a double that he smashed all the way to the right-center fence, then advanced to third base on the Outlaws’ throw home. His big at-bat gave the Yard Goats a 3-0 lead, which they ballooned from there. Whitley’s teammate Eric Hilbert in the top of the fourth slammed a basesclearing double all the way to the cen-
ter field wall. Hilbert also golfed an RBI single deep into right field in the sixth inning and finished the game with four RBI and two runs scored. Also in the sixth, Tyler Holland smacked a two-run double into right field, and Kayden Rogers helped two runs come home with the help of an error at second base. Two tagouts in the same play secured the game for the Yard Goats in the bottom of the frame via the 10-run mercy rule. For the Outlaws, Elijah Bodie in the fourth inning took a 3-2, two-out walk with the bases loaded to plate Connor Yates, who also had a big hit in the second inning when he doubled deep into the left field corner. Three Outlaws players, Bodie, Yates and Jacob DeHart, are aging out of the program. The Yard Goats ultimately took runner-up to the Legends in the tournament following a 11-1, six-inning loss in the championship game.

NOTICE OF PUBLIC HEARING POWHATAN COUNTY PLANNING COMMISSION Notice is hereby given, pursuant to § 15.2-2204 of the Code of Virginia, that the Planning Commission of Powhatan County will conduct a public hearing on Tuesday, September 1, 2020, at 6:00 PM in the Powhatan County Village Building Auditorium, 3910 Old Buckingham Road, to consider the following request: Case #20-03-CUP: Powhatan Solar II, LLC (District #3: Bethesda/Lees Landing) requests a conditional use permit (CUP) to permit a solar energy farm within the Agricultural-10 (A-10) zoning district per Sec. 83-162 of the Zoning Ordinance of the County of Powhatan. The use is proposed to be located on Tax Map Parcels #27-14, 27-14A, and 26-104, which are located at the northern end of State Route 626 (Brauer Road) and along the south side of State Route 615 (Three Bridge Road) west of State Route 1330 (Mill Mount Parkway). The subject properties consist of 927.38 acres. The maximum project area subject to this request is 200 acres. The 2019 Long-Range Comprehensive Plan designates the subject properties as Rural Residential and Natural Conservation on the Countywide Future Land Use Map. Notice is hereby given that the Powhatan County Board of Supervisors will conduct public hearings on Monday, August 24, 2020 at 6:30 PM in the Powhatan County Village Building Auditorium (3910 Old Buckingham Road) regarding the “following matters. Ordinance #O-2020-04 (Case #19-06-REZC): Markel Eagle Partners, LLC (District #1: Subletts/Manakin/Flat Rock) requests the rezoning of Tax Map Parcels #42-55A, 42-55B, 42-57G, 42-72 and a portion of Tax Map Parcel #42-55 from Agricultural-10 (A-10) and General Commercial (C) with proffered conditions (Case #06-14-REZC) to Commerce Center (CC) with proffered conditions and Village Residential Planned Development (VR-PD) with proffered conditions and amendment of the zoning district map of approximately 43.15 acres of land with frontage along the north side of U.S. Route 60 (Anderson Highway) at its intersection with State Route 1101 (Holly Hills Road) and along the south side of State Route 675 (Page Road) at its intersection with State Route 1110 (Old Powhatan Estates), including 1680 Anderson Highway and 1647 Page Road.
