Dear Capital One Bank Manager Jake Tezcan:

I write this letter on behalf of the recent harassing treatment of my elderly mother while banking at this facility. She has had an account with this bank for several years with no problems and seeks to continue such. The recent below documented back to back errors with her savings account compels the writing of this letter. My name is Miriam Snyder. I am her daughter, care taker and power of attorney. Additionally, she has signed this letter seeking correction of the inflicted errors on her account. 2

Foremost, she will not be harassed into closing her account before it is clear who is ordering these repetitious errors in her account and why. Last week an affidavit was written documenting the loss of her check by the bank. No reason or apology was given for this internal organized bank lost check. She did not complain. This week her regular bi-monthly Workers Compensation check for $250.00 was miraculously deposited in the wrong account. All of her other Workmen Compensation checks for the same amount have been deposited in her savings account # 5800166103, by the bank. Miraculously her February 3, 2012 check was deposited in the wrong account, her checking account. This is gross incompetence, deliberate negligence, or pure harassment. These new back to back errors are unacceptable and need to stop. If the Bankâ&#x20AC;&#x2122;s new manager does not want her to have her checks mailed to and deposited in this bank, then the proper thing is to write my mother. Weekly bank harassment and elder abuse will not be tolerated. We do not manage the bank and weekly errors with her money are not acceptable. It is a form of harassment, is not appreciated, and must be stopped. My elderly mother will not be forced to jump from bank to bank every time management changes or internal hit men are put in place to harass targeted customers, particularly, senior citizens. We are informing all parties, in this letter, of the correct account her Workers compensation check has been and must continue to be deposited in. We do not look forward to weekly bank problems. Please regulate these problems or let us know in writing what the new agenda is. It is my prayer that the previous manager was not terminated because of not acting like a hit man and inflicting banking problems in my motherâ&#x20AC;&#x2122;s account.

Re: Allstate Cognitive Test Scam Letter, Taking of Senior Citizens Blood for Unknown Purposes and Attached Bank Stamped Stop Debit Payment Letter Dear Mr. Williams: I am saddened with the third party enjoinment that caused the decline of the insurance policy for my mother that we discussed. For the record, please note I find it deceptive to schedule a blood test and slip in an unplanned and non-agreed upon alleged cognitive test. What happened to my mother is not right. The Examiner had coffee with us, the TV was running, and we were not paying attention to the alleged cognitive test. I would not say that was a test because it was not given like a test and the environment was not conducive for an unscheduled memory test. After the blood test, we entertained the Examiner. In the midst of entertaining, specifically drinking coffee, watching TV, and talking casually, a few memory questions were thrown at my elderly mother. This was not a cognitive test; it was a set up for failure. The environment was deliberately not conducive for effective memory testing. Additionally, my mother’s bank is charging her an additional 35 dollar fee for stopping the Allstate scheduled future debits. My mother was exploited and I resent this. She came out a loser every which way despite doing everything she was told to do to get Allstate coverage. Attached you will find her hand delivered letter to the bank stopping future debits. She submitted this in addition to filling out the bank’s debit stop form. We were not billed the debit fee stop bill yet, when we are billed, we seek reimbursement. 16

Finally, please let the top of Allstate Insurance know that a scam is going on with respect to the cognitive test for the elderly. Customers should be told about such before the exam. The proper testing environment needs to be put in place. This means the Examiner must make sure the environment is in a test mode, meaning all TVâ&#x20AC;&#x2122;s, radioâ&#x20AC;&#x2122;s, and any other distractors turned off. The Examiner did not do such for my mother. My mother was set up for failure and we resent this. It feels like all that was wanted was her blood and that is what they got, while my mother got nothing but harassment and scammed. It feels like a form of elder abuse. This is not a good feeling. I believe you should have told me about the cognitive test. No one told us about this test and this slipped in unconscionable contracted test is being used to deny my mother coverage after she paid. This is sickening! We were told that a blood test was all that was needed to finalize her coverage. We feel deceived, used, and scammed. Please stop these practices that harm the elderly. Notify elderly people about the cognitive test in advance and mandate examiners to put in place a cognitive test environment. I seek the reimbursement of the stop debit fee as we have done nothing to breach the pre-contract. Consequently, we should not suffer anymore ramifications for deceptive business practices. I will submit the stop debit payment when it is deducted. On behalf of all senior citizens and advocates for senior citizens, please do all you can do to stop unscheduled cognitive test decline scams. Demand notification to senior citizens of this test. Demand that Examiners create a quiet cognitive test ready environment. My mother passed the blood test but was denied coverage based on the unscheduled and improperly given cognitive test. This is a form of deceptive practices and unconscionable contracting. My motherâ&#x20AC;&#x2122;s blood was taken for unknown purposes. This is dangerous. Foremost, I am a senior citizen who respects, appreciates, and needs Access- A- Ride. In addition, I am disabled. I would never violate Access-A-Ride services to the level to warrant suspension as I am a responsible and appreciative customer. For the record please note I have never had a NO Show. My daughter who handles all of my Access-Ride schedulingâ&#x20AC;&#x2122;s makes all calls in front of me. We find it inconsiderate and inappropriate to simply not show and would never do such. If I was not going on a scheduled trip, a cancellation call is made. This is a priority. Please note my history. I am not one for NO Shows. With respect to the alleged trips of November 2011, I contest all of the No Shows as exemplified in my Daughters attached affidavit and attestation. The November 2, 2011 No Show allegation is untrue as stated in the attached affidavit. The November 15, 2011, No Show allegation is in accurate. I witnessed my daughter boarding the Access- A- Ride vehicle on November 15, 2011, offering the driver the fee and explaining to the driver that the wheelchair guest was going to be hospitalized. My daughter explained to the driver that an emergency had occurred. The driver refused the fee and said she would report the emergency. In addition, it was explained to the driver that due to the emergency the later trip for November 15, 2011, would need to be cancelled.

In summary, I have no record of the alleged November 2, 2011 NO SHOW and I did not receive a receipt for my trip that day. The 2 trips of November 15, 2011 were cancelled because of the wheelchair guest hospitalization that we could not predict. However, we met with the driver and explained the emergency. I ask that the late cancellations from 11/19/11 to 11/29/11 be excused due to circumstances beyond my control embedded in medical emergencies related to the hospitalization and killing of my daughter November 21, 2011. Please note November 21, 2011 I knew I was staying in the hospital and witnessed my daughter calling and cancelling the scheduled Access-A-Ride, 3 hours before the scheduled pick up time. Please note I have two daughters. My daughter was killed November 21, 2011 and every event that occurred after such date was not planned. We were unprepared for this and this atrocity caused much confusion. I have attached a copy of her death certificate to verify the medical emergencies and death, illustrating, circumstances beyond our control. 11/19/11 to 11/21/11 I could not leave the hospital and did not know my daughter would be killed. 11/21/11 I do recall my daughter calling Access-A-Ride 3 hours before the scheduled trip. This was the day my daughter was killed and we planned to stay in the hospital overnight. Consequently, she called in front of me 3 hours in advance. Please note my travel history. I have no history of no shows and few late cancellations, only emergencies. Nothing I have done warrants suspension or the threat of such. I am saddened with this. I feel targeted and set up. To this end, I am asking for the methods of verifying and or validating the time of cancellation calls. I believe this loophole for human error is being used to harm and abuse me. In closing, Access-Ride is an exemplary and needed service for the disabled and elderly. I am both and greatly need and appreciate the service. I did nothing to warrant suspension or the threat of such. The few late cancellations incurred were due to the noted medical emergencies and death. Please note because I believe someone is using Access-A â&#x20AC;&#x201C;Ride to target me, please note my husband died the month of May 2011 and that was the only other time a few late cancellations were made. January 24, 2011 Evevtte Ennis, Director of Appeals AAR Suspension Appeals Board New York City 130 Livingston Street Brooklyn, NY 11201 AFFIDAVIT IN SUPPORT OF THE ACCESS-A-RIDE APPEAL OF MAZARINE SNYDER I Miriam Snyder am the PCA and scheduler for my mother, Mazarine Levy Snyderâ&#x20AC;&#x2122;s Access-A-Ride services. I make all of her appointments and I do such carefully and responsibly, as this disability service is much needed in the community. As stated in her appeal affidavit, the alleged violations are erroneous, malicious, exploitative, and excessive. My elderly motherâ&#x20AC;&#x2122;s other daughter was killed November 2011 and the Access-A-Ride internal programmers knew such. Trips were scheduled to and from the hospital and funeral home. It is malicious and insensitive for the attached November 2011 alleged Access-A-Ride excessive, erroneous and unwarranted violation allegations, particularly during the murder of a loved one. The November 2, 2011 alleged violation needs to be investigated because my records show that this was the trip where the driver harassed my mother as noted in her affidavit. The two trips for November 15, 2011 were not No Shows. The first trip of November 15, 2011, I met with the driver, offered the fee, and explained that our wheelchair guest had a medical emergency that effectuated hospitalization. The later trip for November 15, 2011 may have been cancelled improperly. I asked the driver to cancel it because of the medical emergency. The medical emergency caused much havoc and we were faced with a non-expected hospitalization.

The 11/19/11 to 11/29/11 trips were cancelled. I cancelled three hours in advance for most trips. In the midst of the medical emergencies and killing of my sister the timing may have been off two or three times, not 5, and this happened due to the emergency medical circumstances noted in my mother’s affidavit. I can attest to the fact that I did cancel 3 hours in advance on 11/21/11 because this was the day my sister was killed and my mother and I were planning on sleeping in the hospital, prior to her death. We, my mother and I, have no history of NO SHOWS. This has never happened in our entire history with Access-A-ride. We have no history of unwarranted late cancellations. Death is an ugly situation and because of such, the above incidents occurred. Access-ARide records are inaccurate and the alleged violations are excessive. Most of the cancellations are made 3 hours prior to the scheduled visit. I pray my mother is not being harassed. I say this because I am saddened with the retaliatory inaccuracies in the attached letter threatening an unwarranted suspension. I say retaliatory, because November 11, 2011 I was compelled to file a complaint regarding Access-A –Ride –Workers deliberately creating a hostile environment. Three Access-A –Ride –Worker harassment incidents happened in the month of November 2011, in the midst of the murder of my sister. It was as if someone was paying AccessA-Ride workers to harass my mother to deter us from visiting my sister before she was killed. The incident that compelled me to call 311 regarding Access-A –Ride –Workers was the refusal of a scheduler to schedule a 9pm or after pick up. November 11, 2011, the scheduler refused to schedule a 9pm or after pick up without reason or cause, simple harassment. The scheduler said the only pick up time for my mother was 8pm. We could not understand why a scheduler would do this, particularly while we were arriving at the location after 7pm. It was as if someone directed the workers to harass us regarding a needed pick up time after 9 pm. The scheduler refused to schedule a 9pm or later pick up and I, in good conscience and on behalf of other elderly and disabled people, I filed a 311 complaint regarding this harassment. The scheduler violated Access-A –Ride’s very own policies to harass my mother and we want to know why? Specifically, the scheduler abused my mother by telling her that she could not get an after 9 pm pick up, and said such, maliciously, arrogantly, and without cause or reason. It was as if someone ordered this harassment to minimize my mother’s time to visit her sickly daughter. Please note after filing the complaint with 311, an Access-A –Ride –supervisor was called in and corrected the problem via scheduling an after 9pm trip as requested. Please note this had never happened previously. This was covert elder abuse and if my mother did not have an advocate she would have been forced not to see her daughter because of this scheduler’s harassment agenda. Again, this was unusual, most schedulers and drivers have been outstanding. In addition to the above incident, November 2, 2011, a hostile driver picked us up at the Beach Street location noted and brought us to my mother’s home address in Astoria. This driver was on a mission to harass my mother. He refused to drive next to the location where there was access for the vehicle. He wanted my elderly mother, with her walker to walk across the street to the Access-ARide vehicle, when he was able to pull up next to the facility. There was no need for her to walk across the street in the snow. In addition he was rude, rough, and scandalous. He argued all the way to her house. 29

I did not file a complaint regarding this driver, because this was unusual. Most drivers are very nice and professional. Since it was so unusual, it was let go. But, when the above noted scheduler told us, we could not get a pick up time after 9pm, I knew someone ordered harassment, because these incidences should not have happened. I believe someone ordered the above noted harassment incidents so my mother would not visit her daughter as much as she did. In addition, I believe someone added falsified Access-A â&#x20AC;&#x201C; Ride â&#x20AC;&#x201C; records to maliciously create a reason to threaten needed services. Someone is trying to harm my elderly mother and I ask that Access-A-Ride not be included. Please see the reference section. Usually this harassment is ordered from the top and is implemented internally. My mother has done nothing to warrant the suspension threat, particularly with the above facts at hand and with a dead daughter that was killed during the alleged violations time frame. I pray that my mother will not have to tape every Access-A-Ride discussion to stop this harassment. I pray my elderly mother will not have to remind each driver to give her a receipt and hide the receipts so if this happens again she can have proof of her trip. I pray that the falsification of Access-A-Ride records to target my mother will be exposed. I pray that other elderly people are not being harassed and targeted like this. I pray that Access-A-Ride will not be used to further victimize my elderly mother regarding the death of her daughter. The timing, medical emergencies and the death of my sister exemplify extenuating circumstances. My elderly mother has suffered greatly behind the November 21, 2011 killing of her daughter and the Access-A-Ride Flashback with inaccurate and penalizing records further injures and harms my elderly mother. An Access-A-Ride suspension would be a disregard of justice, care for the elderly and an additional inflicted travesty on my mother. My mother would be penalized for alleged excessive violations and circumstances regarding the murder of her daughter. In closing, for the above reasons we seek justice in the appeal and an investigation into the harassment inflicted on my elderly mother by the above linked Access-A-Ride workers.
