Silverwoods’ native vegetation saga By Fiona Blick Silverwoods developers are “deeply disappointed” in comments made by Moira Shire councillor Garry Jones, after an emotion charged meeting on September 20. Moira Shire Council is seeking an enforcement order against the developers of Silverwoods after it was alleged 19 established native trees were removed without planning approval. Ralph Robinson, managing director of the Silverwoods developers, said the company removed the trees on the understanding approval had already been granted by the Moira Shire. “On the advice of our town planner, who consulted with Moira Shire employees specifically on this matter, we went ahead with our development and removed the trees,” Mr Robinson said. “After we had removed the trees we donated them to the Department of Primary Industries for re-snagging purposes along the Murray River. It was then Council decided we should have applied for a separate licence.” Mr Robinson said the Council then approached the Department of Sus-
tainability and Environment, who have recommended an extra 3,800 trees be planted to make up for the 19 that have been removed. “This is on top of the 11,000 trees we have already planted in the Silverwoods development area,” Mr Robinson said. “We are very happy to comply with this requirement; we are not arguing this point. There will be a total approaching half a million plantings of native flora at the completion of the project and in the grand scheme of this development 3,800 extra trees is not a great amount. However, the sticking point seems to be the DSE are not happy with us replanting in the areas the trees were originally situated; they want us to plant at different locations far removed from the Silverwoods site. We are not arguing about the penalty, we just believe we should keep the trees on site.” Councillor Garry Jones said Moira Shire Council is bound to go through with legal prosecution as the DSE have very rigid requirements and it was with “great pleasure” he will vote in favour of the recommendation. “The developers cannot accept the second part of the motion to
provide appropriate offsets consistent with Victoria’s Native Vegetation Framework,” Cr Jones said. “The 19 trees were removed, even though negotiations were ongoing. The developers were fined and they did pay that fine, however Council is under statute obligations and we are bound to go through with legal prosecution if the Silverwoods developers do not comply with DSE regulations.” Mr Robinson said he was deeply disappointed to hear Cr Jones state publically it would give him pleasure to vote in favour of the recommendation. “I believe it was an unnecessary comment, it just does not help this situation at all,” Mr Robinson said. Councillor Brian Keenan wondered if a little more discussion on the matter would have produced a different result. “I know I will be accused of being a tree destroyer, but I can’t see how we can have one rule to serve everyone,” Cr Keenan said. “Perhaps a little more negotiation on this deal would have resulted in a better outcome.”
