THE GUIDING LIGHT BURNING IN THE WEST "COMMON LAW" This Survival Guide called "Common Law" was formulated with the intention of giving all students pursuing Law a head start, by equipping them with the necessary armour and knowledge to achieve success in all aspects of University life.

This garnered knowledge, along with the intention, allows us to reminiscence on a quote that goes, "True knowledge is like a small torch in a dark forest. It doesn't show everything at once... but gives enough light for the next step to be safe." Swami Vivekananda. This quote undeviatingly portrays the aim of this guide, which is devoted to giving students that next step and ultimately is the small torch to help along the way. It may not have all the answers, but it is that needed leap towards a safer more comfortable University life.

This is also the main reason why the guide is called "Common Law" mostly because it is needed as a form of student custom, practice and is at large material that all readers can utilise. The name "Common Law” as mentioned is a play on one of the first courses introduced to students doing Law called "Law and Legal Systems" like this course this guide should be something that all students encounter and are familiar with as a pilot towards a prosperous University experience.

THE LAW SOCIETY MISSION STATEMENT The Mission of the Law Society is to achieve the highest standards in the deliverance of legal education to the students of the Law Faculty at the University of the West Indies, Cave Hill Campus.

The Law Society will foster social interaction and Stakeholder Partnerships which will assist in the smooth advancement into Law School and the Legal Profession.

The Law Society has at its forefront the well being of the students, the creation of a wholesome experience during the completion of LLB programs and the increased accessibility to resources to ensure that degrees attained will be of utmost excellence.

PRESIDENT'S ADDRESS PIERRE K. COOKE JR.

Dear Law Students, It is my honour to address you as the President of the Cave Hill Law Society for the year 20212022. For the last seven years, I have dedicated my time and energy to youth development and using my voice for youth representation. I've had opportunities to represent the Caribbean as far as Dubai and it has all been very rewarding.

However, this is by far my proudest role and I am happy to be working with you and for you.

This year, the Law Society is committed to the development of Law, Life and Legacy. We are working to ensure that your mental health and wellness is protected in the midst of everything else happening in the world. The last two years have been challenging for us all and we are all hoping for a better and brighter future. Crucial to that goal is a degree in good standing. To this end, we will be providing you with tips and tools to make it through your degree.

The study and practice of law is characterised by a tradition of camaraderie amongst legal scholars. We have a culture of passing notes, thoughts and support to ensure the law is upheld and developed at appropriate junctures. I believe this spirit has to be nurtured and fostered at this stage of our career so that we can move on, wherever we go, with a standard of excellence and compassion for the wellbeing of others.

MEET THE ACADEMIC STAFF Prof. Eddy Ventose

DEAN Professor Ventose was promoted to Professor of Law in 2012, at 35 years of age, making him the youngest person promoted to a personal professorship in the history of the University of the West Indies.

Professor Ventose is an Attorney-at-Law and a Solicitor of the Supreme Court of England and Wales, having trained at Slaughter and May, one of the most prestigious law firms in London.

Mrs. Nicole Foster

DEPUTY DEAN Public International Law II, International Human Rights Law, International Trade Law Mrs. Foster is a public international law lawyer and former diplomat specialising in the area of WTO law.

Prof. Alina Kaczorowska-Ireland

Public International Law I, Competition Law Alina Kaczorowaska-Ireland serves as the Deputy Dean for the faculty’s Postgraduate and Research sector. She is the leading writer on EU Law and Public International Law for Routledge of London and New York. She has published eighteen books, and

renowned

EDUCATIONAL TIPS

The Law Library

The Law Library provides reference services and legal information, both in print and electronic formats, primarily to students and staff; but also to

governmental departments and members of the legal profession. It

is renowned as the best Law Library in the Commonwealth Caribbean.

Printing Services Once a student is registered at the University, they are automatically given a printing account. To enable printing from any computer lab on campus the student must go to the issue desk, present their valid UWI ID card, and put a minimum of $5.00 on their account. This can be done either at the Law Library, the Campus Bursary, or the Main Library. The Library also provides photocopying services at a cost of 25 cents per exposure. All users are expected to locate and copy their own material. Copying done by a person who is neither student nor staff of the University is charged at 40 cents per exposure.

Damaged books Unauthorized removal, minor damage or defacement of Law Library materials renders a user liable to a fine not exceeding Bds $25.00, at the discretion of the Law Librarian. The reader must pay the cost of replacing a lost or seriously damaged book or other item, in addition to any fine which the reader may have incurred before reporting the loss or damage.

Borrowing Books If a student fails to return material borrowed for reading room use to the Issue Desk by the end of the day on which it is borrowed, a fine of $5 for that day and $10 for each day that the book has not been returned to the Issue Desk must be paid.

Fines Overnight Reserve Items $1.00 per hour or part thereof for each book that is returned after 10:00 am.

Open Shelf $1.00 per day for each book that is returned after the alotted period for borrowing.

Micro Labs

There are seven microcomputer labs. All the labs have internet access and 24 hour accessibility. These labs cater to all students and all rules must be followed. (May vary due to Covid-19)

The micro labs

are more convenient to use when you want a more

relaxed space to study, if you need to print or if you need to use a computer.

They

are

especially

useful

if

you

are

experiencing

problems with your laptop or prefer to not carry it. However, it is important to remember your ID and password to gain access to these computers. If there are any issues within the lab there is always a student assistant to aid you.

GREAT APPS

One great app which you can download is Moodle. It an open source, free to download, flexible user-friendly eLearning platform.

It eases the hassle of having to go through the web in order to access your coursework. After copying the e-learning link to the app you will be able to acquire all your lecture notes, recordings, and

additional

readings

as

well

as

submit

your

assignments.

Moodle can be downloaded via goggle play store as well as Apple Store.

This app is great for keeping track of your assignments, assessments and homework and is available on multiple platforms. Its layout is simple but aesthetically pleasing. As a due date for an assignment gets closer, it goes from green (when there’s a fair amount of time left) to orange ( when the deadline is drawing near) to red( the deadline is very close). The degree of importance of the assignment can be assigned as well as alerts set at different time periods to remind you of the assignment. This app is the organized and the want-to be organized student’s best friend!

Keeping It One Hunna Law students on what they wish they knew before starting their L.L.B

When coming to the Law Faculty, I wish someone told me a method to study. While all persons may study differently, I believe that study styles can still be grouped into categories and be shared. It would have helped for sudden changes in mental health and the atmosphere.

Reach out! The L.L.B program at the UWI Cave Hill

difficult

campus offers. No one can do it on her/his own. Don’t be afraid to reach out to students who have preceded you for guidance; whether it be academic or personal!

For starters, I do wish I knew how much reading being a law student encompassed. The reading was endless. Do not undermine yourself because of what another student is doing.

It is clichéd but having good time management skills and socialising within the faculty are immeasurable. Allocate adequate time for study, assignment completion and revision to ensure good grades. Engage and develop good relationships with your fellow law students as you will need each other for the next three years and beyond.

Group work, some hate it and others love it but regardless always be a good group member!

Know and understand your learning style. Don't depend on lectures to give you everything. If you want to know more about a topic, do your own research. Persistence is Key: be prepared to throw your hands at an issue or subject matter multiple times before you get it right. Often times you don't grasp most things in the first listen/learn.

Upon matriculation to UWI, I thought I had identified my learning style, however that was far from true. I presumed that group studies were beneficial because I could bounce ideas and have discussions with my friends and classmates. Though that helped, learning by myself was really my method to success. What is the Law Society?

The Law Society collectively refers to all students pursuing an LLB or part thereof. This is not to be confused with the Law Society's executive which is the Faculty of Law’s student government.

2. What is the grading scheme?

N.B. This grading scheme is applicable to the university at large.

3. If I am sick, do I have to redo a course?

In the event you are sick or are unable to write your final exam, you

qualify to sit the supplemental exam as opposed to redoing

the course. The Board of Examiners may exercise their discretion and allow students to sit supplemental exams if the circumstance have merit. However, the Faculty has a strict policy as it relates to supplemental

exams,

and

will

usually

only

grant

a

request

for

supplemental exams where

a 3rd year student has failed a course.

The

7. What happens if I fail a subject but I don't qualify for a supplemental?

If you fail a subject, you will have to redo the course in order to graduate. You may opt to do it in the successive academic year, or you may wait until your final academic year to redo the course. The course will be taken in addition to the other subjects you are required to do for that academic year.

E.g. If

you fail Law and Legal Systems in Semester 1 of first year, you

are able to do it in Semester 1 of second year or Semester 1 of third year. You are required to redo the subject and obtain a passing grade in order to receive your LLB.

8. Do I have to pay to redo the subject?

You are required to pay to redo a subject.

9. How can I query my exam mark?

In order to discuss your examination paper with your lecturer, an Application for Discussion must be made to the Examinations Section at Student Affairs. There is also the option of paying to have your examination paper remarked. See 'Student Resources' on the Faculty of

10. How do I make a complaint about a lecturer or a problem I have encountered in the faculty?

We recommend reporting the issue to your year representative. They will advise you on how the issue can be remedied. In the event they are not properly equipped to address the issue, it will be addressed at the Joint Consultive Committee (JCC) meeting. Here the Faculty's staff representatives meet with the Law Society executive on student matters and issues. If a solution cannot be provided thereafter, then this committee will reconvene and present the issue to the academic board

meeting

where

academic

administration of the university.

11. Am I able to contact the deputy Dean and other faculty officials without going through the Law Society?

You are free to contact faculty officials if you are experiencing any issues,

or

have

any

questions

or

concerns.

lecturers and tutors directly if it is to notify them about your absence or any related matter that requires their attention. If your concern is academic

12. Do I get an exemption for any of my foundational courses?

Exemptions from foundational courses may be determined by the faculty, or course director, of the relevant course. In determination of whether

to

grant

an

exemption,

the

faculty

is

guided

by

the

following considerations:

student with a prior degree in History, which includes a number of courses focusing on Caribbean history;

Apart from printing and copying, you do not have to pay to use the Law Library or any of the e-resources such as LexisNexis, Westlaw, or Carilaw. To log into these resources you are required to use your Student ID and passcode.
