FINANCES ARE PUBLIC IN DIVORCE PROCEEDINGS In divorce proceedings, there is no general right to keep a spouse’s finances private and protected from the public, decided the BC Court of Appeal in a recent case. As part of a court application to reduce his family support obligations, Mr M had filed affidavits giving details of his financial situation. His ex-wife passed along edited copies of those affidavits to a former business associate of Mr M’s who was involved in a bitter dispute with Mr. M and had publicly accused him of misconduct. She hoped the associate could help her figure out Mr M’s income. Mr M was reluctant to file a Form 89 financial statement, as required under the Child Support Guidelines, because he was afraid that potential employers in the economic downturn wouldn’t hire him if they knew of his true financial picture. He wanted the court file sealed as well as an order preventing his ex-wife from divulging his financial information to others. “It is clear that an open court is the policy of the law,” wrote Justice Chiasson on behalf of the BC Court of Appeal. “In matrimonial proceedings, as in other court proceedings, public access is the norm.” However, in recognition of the “sensitivities of matrimonial proceedings,” the court noted there are rules which limit that access. Not everyone can search a divorce or family law court file – only the spouses, their lawyers and people authorized by them. Also, anyone who has access to the Form 89 must keep the information confidential and not disclose it to others except for the purposes of valuing an asset, determining the spouse’s income

or introducing evidence in court. And the court can order that the Form 89 and applicable income documents be sealed or closed if public disclosure would be a hardship on the person who filed the financial information. In this case, however, the Court of Appeal refused to order an injunction restraining Mrs M from disclosing the information in the Form 89 Mr M had yet to file. The confidentiality rule “identifies with some specificity the material to which confidentiality applies,” said Justice Chiasson. “It is an exception to the general open court policy of the law. I would not stretch the plain meaning of the words in the rule to include an affidavit that provides an overall picture of the deponent’s financial circumstances.” Further, there was “insufficient evidence to support a finding” that Mrs M was likely to break the confidentiality rules, added the court. As well, the court commented on Mr M’s claim that disclosure of his financial information would prejudice his chances of obtaining work. It didn’t agree that this claim was “sufficient to establish hardship” under the rules and justify the sealing of his financial documents. In general, however, in most family court cases, your file is usually only viewed by the parties named in the action and their respective counsel. Still, this case does underscore that it’s important in divorce and family law matters to retain a lawyer who is fully knowledgeable and experienced in family law. If a case is particularly sensitive, especially where children are involved, your lawyer may be able to have your file sealed or obtain a nondisclosure order.

Shaping Our Future Together

Residents are being encouraged to mark the date of the Columbia Basin Symposium Shaping our Future Together: Take Action, Build Partnerships, Strengthen Communities on their calendars. The symposium takes place in Revelstoke from October 22 to October 24. The event seeks to engage key leaders and residents active in their communities to collectively look toward the future of the Columbia Basin, while also discussing and addressing some of today’s key issues. “An important role for CBT is bringing residents together at events like the symposium to celebrate our accomplishments and help the region work towards solutions to shared challenges,” said Garry Merkel, CBT Board Chair. “It is an opportunity for Basin residents to connect with one another to create momentum in the Basin for further local engagement and action, as well as develop a sense of interconnectedness within the region.” Helping to build our views about the future will be keynote speaker David Beurle. Beurle is the Founder and Managing Director of Innovative Leadership, a company that specializes in helping communities, regions and organizations plan and prepare for their future and that pioneered the development and application of The Futures Game, a tool to support critical decision making and good leadership. Building on attendees’ knowledge of current opportunities and challenges in their community, Beurle will provide an opportunity for people to explore key drivers shaping the future of their community and region.

This will be a catalyst for thinking about what actions people need to start taking today to put us in a position to deal with tomorrow’s challenges, including things that can be addressed on a regional basis and those that are more community specific. The symposium will include several facilitated sessions covering topics such as economic development, alternate energy, community engagement and building resilient organizations. These sessions will be supported by “expert” speakers from both within and outside the Basin, as well as community champions, tools and best practices. There will also be an opportunity to connect with CBT Board and staff, and learn more about the work CBT is doing in the region. In addition, an evening of cultural entertainment featuring local and Basin talent will be open to the public on Saturday evening. A draft program agenda is available online. Symposium registration will open in early September and space is limited. The symposium is free of charge. Castlegar Celebrates National Aborginal Days

Castlegar’s National Aboriginal Days was a huge success. This annual event was hosted on Monday, June 21 at the Pass Creek Park. Even the threat of rain didn’t dampen the spirit of sharing and celebration. The sun came out and stayed all day. Many families and residents from across the basin came to check out the many displays and join the festivities. At the opening ceremony, blessings were given over the gathering by prominent elder, Barbara Pistak. The 2010 Castlegar National Aboriginal Days was an opportunity to come together and share a First Nations cultural experience while promoting an awareness, understanding and acceptance of First Nations people. All attending were treated to a traditional dinner of salmon, bannock and much more. Lower Columbia All First Nations organized crafts for kids and gifts, games, tepee storytelling, song, dance and drumming. Lower Columbia All First Nations would like to take this opportunity to thank all the sponsors, volunteers and organizers who donated their time to make this event such a success.

But the only reconnaissance James does these days is over which spot has the most sun and which toy makes the most pleasing jingle when he bats it around. Free Workshop On Invasive Plants

The Land Conservancy of BC (TLC), in partnership with the Central Kootenay Invasive Plant Committee and Columbia Basin Trust, invites residents to the Invasive Investigation Workshop on invasive weeds at Fort Shepherd Conservancy Area on Wednesday, July 14 from 6 pm to 7:30 pm. The workshop is part of the West Kootenay Community Field School – a series of free naturefocused events that TLC will host throughout the summer. Participants will meet at the orange bridge in Trail at 6 pm and Jen Vogel from the Central Kootenay Invasive Plant Committee will lead a tour of the Fort Shepherd Conservancy Area. Participants will learn to identify invasive weeds, be aware of their impact on native plants, and understand practical ways to limit the spread of exotic species. The workshop is partially funded through Columbia Basin Trust. Open Fire Restriction Within The Southeast Fire Centre

Effective at noon July 5, 2010 all medium and largesized open fires are prohibited within the Southeast Fire Centre’s jurisdiction to help prevent human-caused wildfires and protect public safety. Specifically this prohibits: • Burning waste, slash or other material, whether piled or unpiled, that is larger than 0.5 metres in height or 0.5 metres in width. • More than two piles of waste, slash or other burning, whether piled or unpiled, that are of any size. • Stubble or grass burning over any area. • Fireworks of any size or description. • Burning barrels. The ban doesn’t apply to cooking stoves that use gas, propane or briquettes, or to open fires, including campfires, that are a half-metre by a half-metre or smaller. Please ensure campfires aren’t lit or kept burning during windy conditions, that adequate tools, water and people are on hand to contain a fire and that it is fully extinguished before leaving the area. This ban covers all BC Parks, Crown and private lands, but doesn’t apply within the boundaries of local governments that have forest fire prevention bylaws and are serviced by a fire department. Please check with civic authorities for any restrictions. The Southeast Fire Centre is currently experiencing dry conditions and elevated fire hazard. Human-caused wildfires continue to draw resources away from unpreventable wildfires caused by lightning. Anyone contravening an open fire ban may be issued a ticket for $345, or, if convicted in court, be fined up to $100,000 and sentenced to one year in jail. If the contravention causes or contributes to a wildfire, the person may be subject to a penalty of up to $10,000 and be ordered to pay all fire fighting and associated costs. This ban will be in place until the public is otherwise notified. The Southeast Fire Centre encompasses the area extending from the US Border in the south to Mica Dam in the north and from the Okanagan Highlands or Monashee Mountains in the west to the BC/Alberta Border in the east. This includes all of the Arrow-Boundary, Kootenay Lake, Rocky Mountain and Columbia Forest Districts.
