2015 BOARD ELECTION The 2015 Board Elections feature heavily in this edition of the Journal. An overview of this year’s poll is contained on page 6; the new Electronic Voting process is explained on page 5; and the biographies of the candidates nominating for office are contained on pages 6-9. All QJA members are encouraged to vote in this election. The polling period starts on 1 September and finishes on 16 October.

2014-2015 ANNUAL REPORTING This edition of the Journal contains (as an insert) the 2014-15 Financial Statements, Auditor’s Report and Directors’ Report as well as the President’s 2015-14 Annual Report (pages 3-5). The QJA Board is pleased to advise that operating result for the 2014-15 financial year was a surplus of $68,195.

PRESIDENT’S 2014-2015 ANNUAL REPORT Ladies and Gentlemen, The QJA is a company with a bright and exciting future and I am very proud to be part of the team presenting this report to you. The Directors’ Report and Financial Statements contained within this issue of the Journal and as published on our website summarise the achievements of the last financial year, but I would like to expand on a few points.

Financial The annual budget process is a core function of the Board and one that my fellow Directors, Business Manager, and I address each year with a sense of responsibility. From the outset we had a responsibility to again ensure the QJA retained the Members fees at the lowest level responsibly possible. At a time when funding from community grants is increasingly difficult to come by, the QJA has improved efficiencies and developed ways to deliver ongoing value for money. Delivering a sound financial result which makes us sustainable in the long term is one of our core priorities. I believe we must strive to achieve this outcome by delivering financial results that acknowledge the challenges, provide for the needs and expectations of our Membership and plan for the future. We must look at options to increase our bottom line without placing additional burdens on our Membership. Our budget for the 2014-2015 financial year forecast a small surplus at year-end and your Board is very pleased to report a moderate surplus has been achieved which has exceeded our original budget estimates. The effectiveness of the online training program coupled with a thorough and rigorous process of restraining costs, and seeking additional external sales opportunities for Merchandise and Training, has delivered an end of year result which assists with offsetting past year deficits. While our forecast position at the end of this year is encouraging we must not forget that over the past few years we have suffered deficits, or very small surpluses, while expending over $70,000 on approved Capital investments which were drawn down from our Retained Earnings. These Retained Earnings require replenishment and we need to accumulate funds for future capital expansions, plus we need to make provisions against future events that could seriously restrict our income and ensure we can continue to cover our operating costs.

Back office computer system upgrade In June 2013 a proposal was put to the Board which identified opportunities to improve the existing membership system and resolve some functionality shortcomings. Over the following 12 months a number of potential Membership systems were reviewed and costed, including updating the existing system. In December 2014 the Board approved the implementation of a new Membership system provided

by Coresoft, the total approved funding for this project being $19,572. In August 2014 the Board approved the implementation of a Student Management system to replace the existing system to ensure we could maintain our RTO compliance. Over the ensuing few months a number of suppliers were reviewed and then in December 2014, with the decision made to proceed with Coresoft as a Membership system, an opportunity was presented to the Board to add Coresoft’s Student Management module and deliver a fully integrated, single solution system. An additional $6,832 was approved for this solution, with total project funding approved of $26,404. A fixed price contract was signed in December 2014 and the project commenced. This new system will replace four current stand-alone systems plus numerous spreadsheets that have to be maintained. As well as financial savings through reduced licences, the savings in staff time will be considerable by providing a single point of reference for every Member and Student and remove duplication. The new system also introduces a number of significant new features that will enable greater Member engagement, better recording of Member interactions enabling our staff to track progress on requests and a Member Self-service facility so you can keep your contact details updated. With the planned rollout of electronic Journals the system will also record your communication preferences, and enable improved tracking of requests and orders. The ability to issue annual invoice renewals electronically and enable Members to pay these invoices online has already delivered significant benefits. The current online event management booking system, and the online merchandise shop will be upgraded and integrated into the new system. While it has been a challenging project (as it has increased short term workloads in the office due to the need to change our internal processes and the requirement to ensure thorough testing), I remain excited by the potential as I believe this will be a game-changer for the QJA business. Completion is scheduled for later this year.

Governance The QJA Board held an Extraordinary General Meeting on Monday 26 January 2015. The purpose of this meeting was to consider a proposed change to the QJA Constitution to allow the acceptance of member votes in either electronic or postal format. Under the existing wording of the Constitution, postal votes only are allowable. The meeting approved the changes and this year the introduction of electronic balloting will be used in the Board election process. Members will now be offered the option of voting online or by postal ballot. The advantage of voting online is it is immediate, it is secure, it is easier, the candidate details are there at your fingertips, no messing around with envelopes, and no special trips required to the post box. For the QJA, the cost savings are significant and the results are tallied automatically so less time for our staff having to count votes. ballot papers so that option will still be available, but we encourage all Members to take advantage of the online voting service. With the implementation of the new Membership system, an opportunity is now available to provide a subscription renewal based on joining date rather than an arbitrary end-of-financial year date. Following discussions with our honorary Lawyers – Hall Payne - the Board has approved and recommends a change to the company constitution which will need to be considered and voted on at this year’s AGM in November. Details were included in the 2015 Winter issue of the Journal and are posted on the website. The Board continues to review our governance documents and is currently updating the core Policies for the company.

Training QJA continues to provide pre-appointment training for JPs and C.Decs throughout Queensland. We have a number of competitors in the market, however as the peak professional body for honorary justices in Queensland, we are still the largest provider of pre-appointment training for new JPs and C.Decs. As a not-for-profit, surplus funds from the Training program are re-invested back into Branches, or into Membership development that supports the local community. Pre-appointment training for new JPs continues to expand with 1,306 students enrolled over the past twelve months. This includes 379 JP(Qual), and 265 C.Dec, students in our classroom courses. In April 2014, we offered the online C.Dec pre-appointment course, and the online JP(Qual) pre-appointment course was released in July 2014. Both have proven to be extremely popular with 388 JP(Qual), and 274 C.Dec, students enrolled over the past twelve months.

Australasian Council of Justices’ Associations The Australasian Council of Justices’ Associations (ACJA) provides a forum for Justice of the Peace associations within Australia and New Zealand for public discussion and debate of matters relating to Justices of the Peace. In October 2014 it was Queensland’s turn to host the annual conference. Queensland and notably the QJA continue to be held in high regard amongst the other jurisdictions due to our leadership in areas of governance and pre-appointment training. The success of this year’s ACJA conference was due to the outstanding efforts of Director John Carpendale who through his focus, dedication, and attention to detail delivered a remarkable timetable of events: from the welcome at the Banco court hosted by our patron Chief Justice Hon Tim Carmody, to the conference held in the Supreme Court building with guest speaker Damien Mealey, JP Branch Registrar. At the Conference Dinner on Saturday, delegates were treated to a presentation by Justice David Thomas, President of the Queensland Civil and Administrative Tribunal (QCAT). In his speech Justice Thomas outlined his satisfaction with the success achieved thus far in the ongoing QCAT trial of using JPs as small claims adjudicators. 4

Professional Development/Community The QJA State Conference, held this year at the Redlands Sporting Club, Wellington Point, was once again a very successful event, attracting more than 180 delegates. The 2014 Conference was also successful in attracting high profile representatives from Local Government, State Parliament, State Cabinet and the Judiciary. To open Conference proceedings, attendees were addressed by the Redland City Mayor, Cr Karen Williams, three local members of State Parliament (Dr Mark Robinson MLA, Mr Steve Davies MLA and Mr Peter Dowling MLA), State Attorney-General, the Hon. Jarrod Bleijie MLA and the Chief Justice of Queensland and QJA Patron, Hon. Tim Carmody. Refresher/workshops held over the past twelve or so months included: • Caboolture Branch in August 2014 • Brisbane North Branch in August 2014 • Warwick Branch in September 2014 • Logan Branch in September 2014 • Gold Coast Branch in February 2015 • Warwick Branch in February 2015 • Logan Branch in May 2015 • Mackay Branch in May 2015 • Western Suburbs Branch in May 2015 • Hornibrook Branch in May 2015 • Brisbane North Branch in June 2015 QJA continues to support local communities with the provision of over 50 public signing facilities as part of the “JPs in the Community” program where JPs and C.Decs volunteer in local shopping centres, libraries, community organisations and courthouses, including the public signing facility at our Head office which is increasing in volume. QJA has over 500 active volunteers in public signing facilities throughout Queensland.

International Women’s Day On 8th March 2015, QJA events were held in Brisbane, Bundaberg and Cairns to celebrate International Women’s Day. All functions were very successful.

Office Staff Over the past twelve months a number of staff changes have occurred in the office: Angela left us in July 2014 after 4 years as the Registrar for career opportunities overseas and we offer our thanks to Angela for her dedication as she moves on to a new career challenge. In July 2014, Wendy was appointed as the Business Manager/Registrar and Company Secretary. In August 2014, trainee Aaron completed his business training and was offered and accepted a full-time position within the QJA. Cindy began in our office in June 2014 on a casual basis and was later successful in her application for the Administration Officer position and was appointed to a full-time role in January 2015. Linda Evans continued her role to manage the training program but has however, just recently informed us that she too wished to move on to other career opportunities. A new member of the team is currently being recruited.

BOARD ELECTIONS Nominations for positions on the QJA Board of Directors were called for in the 2015 Winter edition of the Journal (which included nomination forms as an insert). Nominations closed on Friday 7 August 2015. As only Keith Revell nominated for the position of President, no ballot is necessary for this position. For the role of Vice-President (2 positions), there were three (3) nominations and for the role of Board Member (7 positions) there were ten (10) nominations (including the three candidates who also nominated for the role of VicePresident). Ballots are required to determine the successful candidates for the positions of Vice-President and Board Member. Voting begins from 1 September 2015 and the ballot closes at 5pm on Friday 16 October 2915. CANDIDATES’ PROFILES Bruce Lindsay Birtwell QCAH. BAppSc (Bio) GCert PubSecMgt. QMS Auditor. JP(Qual) Candidate for: Board Member Bruce is a father and grandfather, was born in Rockhampton and has worked and lived in various centres in Queensland such as Charleville, Roma, Ipswich, Bundaberg, Warwick and Mount Isa. He was appointed a Justice of Peace in October 1989 and upgrading to JP (Qual) in May 1990. He has been a QJA Member since January 1990, been involved in the Toowoomba Branch since 2011 and Branch Chairman and Coordinator of the Clifford Gardens Signing Centre since September 2014. Bruce is a Senior Biosecurity Officer with Biosecurity Queensland, Department of Agriculture and Fisheries, has inspector’s appointments under ten Acts administered by Biosecurity Queensland. He commenced as a Meat Inspector with the Department of Primary Industries in 1975 after completing a management traineeship with Thomas Borthwick & Sons in Brisbane after graduating with a Certificate in Animal Husbandry from Queensland Agricultural College, Gatton. He later completed as an 6

external student, a Bachelor degree in applied science (biology) and postgraduate course in animal welfare. Bruce completed a Graduate Certificate in Public Sector Management and has a sound knowledge in the areas of leadership in the knowledge era, strategic planning and managing for outcomes, people and work and included the themes of ethics, accountability, relationship management and enabled him to develop as a professional manager in the public sector administering programs, projects and supervision of staff to operating in the multivariate and constant changing work environment. His qualifications, knowledge and experience validate his abilities in corporate governance, financial management and strategic planning. Bruce’s experience as a trainer, auditor, workplace health and safety officer, member of safety committees, regulatory officer and active Departmental representative on Code of Conduct, Workforce Advisory and WH&S technical reference Group demonstrates his commitment to ethical behaviour, fairness, equity and governance issues.

John Carpendale JP(Qual) Candidate for: Board Member First appointed as a JP in 1978, John is Secretary of the QJA Brisbane North Branch, a position he has held since 2010. He has been a director on the QJA Board since November 2011, is currently the Editor of the QJA Journal and Registrar of the Australasian Council of Justices’ Associations (ACJA). His business background comprises 40 years in the financial services industry, including more than 20 years at executive level. After completing full-time work in 2005, John served on the boards of several financial services organisations (superannuation funds, credit unions and financial planning companies) before committing himself to volunteering and involvement with the QJA. His academic attainments include an Arts degree (UQ) and post-graduate diplomas in Applied Finance & Investment and Financial Planning (FINSIA). He is also a diploma graduate of the Australian Institute of Company Directors (AICD) and is an Accredited Investment Fiduciary. His professional memberships include the Association of Superannuation Funds of Australia (fellowship), the Financial Services Institute of Australasia (fellowship), AICD (graduate) and QJA. John is a strong advocate of continuous improvement and ongoing education. In this regard, he is heavily involved in developing and delivering professional development sessions for members of the QJA Brisbane North Branch. Since his appointment to the QJA Board, John has worked tirelessly with fellow directors to elevate the standard of services provided to members and to extend the influence and membership of the association. His vision for the QJA is that membership will universally be highly regarded and respected by all honorary justices. To achieve this, QJA must continue to develop and improve all of its services, functions and membership reach. John seeks your support for his re-election so he can drive this continuous improvement.

I like to nomatied myself to stand as the candidate for the upcoming election which will be conduction in 2015. As I’m nominated for Australia of the year award in 2012 for my work in public transportation. I also been nominated for pride of Australia medal 2011 for community spirit medal for my work in Justice. In 2002 I gained my Justice of the peace qualified and service the community of Ipswich as a JP- Qual. and involvement with the Lions and Apex clubs of Ipswich with my experience as a social media campaigner. My employment within the state government with the justice / correctives service department as a kitchen manager at Wacol in the western outreach rehabition camps or worc. Work within the education department as an international night tutor / teacher in the fields of tourism, justice and marketing. With my wife a singer we operated a music label under the name of SML Music which is based here and also in the Philippines and SML Sync which is based in Brisbane doing social media and part time model. In my spare time my interest in social media feeder, the Filipino community within the Ipswich and greater Brisbane, plane spotting, sound engineering production, travelling interstate and international and attending personal development & leadership seminars and workshops and modeling. I feel I will be asset to the QJA with my wealth of knowledge with the working for the state government and background in education and justice.

Carmelo Pasquale JP(Qual) Candidate for: Board Member My name is Carmelo Pasquale and I am nominating for a position on the Board of Directors. I have been on the current Board of Directors since January 2015. Even though I have only been in the position for 7 months, I find the role is giving me the opportunity to provide input into developing a better service for our members. As a director you will find me approachable, prepared to listen to our members and provide solutions within the board governance. I am also prepared to challenge decisions that may diminish the services given to our members. In July 2000 I obtained my qualifications as a Justice of the Peace Qualified and also joined the Queensland Justices Association. I have been employed with Ergon Energy since 1991 and hope to remain as an employee until my retirement in 5 years. My time in the electricity supply industry has given me the opportunity to obtain the following qualifications: Associate Diploma in Electrical Engineering in 1990, Advance Diploma in Business 2000 and Diploma in Project Management 2008.

Steve Lucas JP(Qual) Candidate for: Board Member

During my time at Ergon I have worked in the field as well as the roles of District and Area Manager. I currently work in the area of developing Safe Work Methods for our workers in the field.

I like to introduce myself I’m Steven Paul Lucas of North Booval, In 2002 I married to my wonderful wife Mildred Lucas and my talent son Ryan Lucas and currently in the process of immigration to Australia for the Philippines. It’s an honor to a member of Queensland Justice Association branch member of Ipswich and Freemason Queensland for the Brisbane central branch.

In 2009 I was asked to re-establish the Mackay Branch of the QJA. I have held the position of Chair for 6 years and have seen our branch meetings grow in numbers. Our Mackay Branch has also run 2 successful refresher days for our members. I have also been co-ordinating the “JP’s in the Community” at Caneland Central Mackay since it began in January 2013. David Read JP(Qual) Candidate for: Vice-President, or Board Member David John Read JP (Qual.) has been a justice for approximately 14 years and in this short time he has established the Bundaberg Branch where he is currently the serving chairman as well he has been on the board for the Australasian council of Justices, been nominated to sit on the JP Advisory Council. He has successfully run two state conferences and many workshops. Dave is hands on approach style of leader not just talk the talk he also likes to get in and lend a hand. Dave is also very vocal about if any member needs help at any time he is only a phone call away and that phone line is open 24/7 to anyone that needs assistance. Dave’s day time job is a real-estate agent /auctioneer so he naturally has grounding in marketing, branding and negotiating all of which both items fit in well when it comes to marketing the QJA brand. Dave also runs his own Auctioneering business which comes in handy for fundraisers for any branches that require the services of an auctioneer. Dave has sound knowledge of what JP’s need help with and as a practicing Justice of the peace Qual himself see a lot of warrants of all types and uses and even loads of the bread and butter type of documents to being called to court as a witness in various cases. So he can relate to any problems that may arise at any time. Dave has a firm grasp on all of the duties that are expected from the position of being a director and or a Vice president as he is currently a Vice President for the QJA with his experience as a board member for the past eight years. Dave enjoys being out amongst the members creating new contacts ,assisting in creating new branches and contact groups assisting these groups in the network system and thinking outside the square to make things happen. Dave is married to Debra also a JP (QuaI) and has two daughters wondering when he is going to slow down. They are informed that he is just getting wound up. After 22 years of marriage it makes for interesting conversation to who will be working on the signing centre the most.

Garth Stevens JP(Qual) Candidate for: Board Member Garth has been J.P. since 1977 upgrading to J.P. Qual. in 1997. Garth is an Executive Committee member of the Q.J.A. Western Suburbs Branch, a Mentoring Cttee Member of W.S.B. and an active member in the J.P.’s in the Community Programme. Garth has attended refresher courses, State Conferences, and J.A.G. Courses to keep informed and updated on issues relating to J.P. Duties and Responsibilities. Garth is a retired Primary School Principal bringing Administration and Inter-personal relationship skills to the Q.J.A. Director role if elected. He is married to Kay and father to four adult daughters. Hobbies include walking and photography both indulged last year walking the Camino in Spain. His current role is Civil Marriage Celebrant. As a Q.J.A. Director Garth would enhance the Vision and Mission of the Q.J.A. by being proactive in Q.J.A. Branches and actively involving Q.J.A. Members to ensure their issues are addressed. Promotion of the Role of J.P’s in the community through active involvement of J.P’s in refresher courses,

promoting education programmes via High School Legal Studies and encouraging Q.J.A. Speakers at Community Club Meetings would be advocated by Garth if elected to the Q.J.A Director Role.

Marian Vierveyzer JP(Qual) Candidate for: Vice-President, or Board Member Marian Vierveyzer has been a JP (Qual) since 2000 and immediately joined QJA Ipswich Branch. Since taking her oath she has held the position of Chair at Ipswich Branch and as a Director for the past 11 years. She volunteers at 2 Ipswich signing facilities and supports local initiatives to expand the service. Marian’s director portfolio focus is on Human Resources which encompasses the recruitment and support of the office staff. She leads the annual International Women’s Day event and promotes QJA at every opportunity, exploring new horizons for QJA such as the establishment of new branches through the South Western region. Her commitment to the aims and values of QJA and its Constitution allows her to support the board through its endeavours for continuous improvement and to give value to the membership. In her working life Marian works in the Construction industry as Work Health & Safety Specialist which also incorporates Environment, Quality, Training, Injury Management and Compliance. She is committed to empowering Justices with their own professional development and to lobby for the betterment of all honorary justices in Queensland. Marian is committed to membership growth and establishing a “club like” culture to instil pride in being a member of QJA and as a Director will work tirelessly to ensure the Board is professional in its leadership and advocacy.

Lance Watson JP(Qual) Candidate for: Board Member Lance has his family home in Gracemere and beginnings in Rockhampton, Central Queensland. In 1988 Whilst working as an Ambulance Officer in Queensland with the Qld Ambulance Service, (Qld Ambulance Transport Brigade QATB at that time) was appointed as a Justice of the Peace. Lance has had the privilege of forming a Magistrates Court with the local Court Registrar whilst working in Moranbah with the QAS. Originally a member of the Queensland Justice Association in 1989 for a few years, before taking a break, Lance rejoined in 2006. He has provided workshops and training assisting many to become Justice of the Peace (Qualified) and Commissioner for Declarations, throughout Central Queensland. Lance has travelled to run courses in Rockhampton, Mackay and Emerald and continues to provide support many of those JP’s who contact him on a regular basis either by phone or skype. Lance works as a Work Health & Safety Advisor, for the last 5 years Lance has been the current chair of the Queensland Justice Association - Rockhampton Branch and 15 years with


VOLUME 12 • NUMBER 3 • SPRING 2015 the Rockhampton Enterprise Centre Incorporated a Non-forProfit Small to Medium Business incubator associated with Business Enterprise Centres Australia, with the past 7 years as Chairman. Lance remains an advocate for the Justices of Peace throughout regional Queensland and looks forward to once again travelling with his wife Jenni, and QJA Team throughout Central and regional Queensland to provide support and information to isolated Queensland Justices.

Raymond Young OAM JP(Qual) Candidate for: Vice-President, or Board Member One of the highlights of Raymond’s vision and ongoing training was that he would organise a yearly Mock Court to show members what happens within the court procedure, with the assistance of the Magistrate Court Judge, solicitors, members of the police, and a member would be the accused and others would firm a jury. This also benefited the police recruits that were new to the area. This concluded with a tour of the Etna Creek Correctional Centre on the following weekend which continued with the training where the guilty accused was handed over to the prison officer who accepted the papers given to us by the Judge. In 1990 he was also involved in organising the Local State Association JP Satellite Seminar. This attracted over 60 JP members. After he resigned as Convenor he continued with his major project, “Educating the Role of a Justice of the Peace Training Seminar” by visiting Blackwater, Biloela and Mackay. After many years Raymond was finally recognised by State Council and received a travel subsidy for country visits. Raymond was elected as a member of the QJA Board in 2004. Since then he has been involved in reforming branches in Gladstone, Townsville, Mt. Isa, and Mackay. His monthly meeting was open to all JPs and non-members were always welcome. Meetings included professional development with different guest speakers such as the Magistrate Court Judge, solicitors, police and government departments (Land and Public Trustee and etc.). Twice a year seminars and refresher workshops were held. He introduced four social functions to increase membership with members bringing other JP’s who were not already connected to the

QJA. In 2005 he established Signing Facilities in shopping centres in Rockhampton and Yeppoon. He has always been prepared to travel far and wide to support the people and events of the QJA.

STATE CONFERENCE With only two months until the 22nd Annual State Conference, the Caboolture Branch Conference Sub-Committee is working feverishly to apply the finishing touches. Just to remind you, the conference is to be held at the excellent facilities of St Columban’s College at Caboolture on Saturday, 7th November 2015 with registrations starting at 8:30 am. The cost of $40 for members and $45 for non-members includes the full registration for the day, morning & afternoon tea and buffet lunch. The conference goodies bag alone makes attending worthwhile! The conference is the one major yearly opportunity for professional development and networking with your fellow JPs and C.Decs from throughout Queensland. The action packed agenda is all but complete and includes a wide cross section of speakers providing interesting and informative topics such as “Organised Crime in Queensland: its extent and nature, economic and social impacts”, “Resilience and Self Care”, as well as the key roles of the Public Guardian and the Public Trustee and important updates from JP Branch. We have secured a number of major sponsors including Morayfield Shopping Centre (see advertisement below) and Caboolture Sports Club as well as valuable support from Councillor Greg Chippendale (MBRC), Coles and Bunnings. These sponsorships help us to plan a vibrant day for all attendees. Negotiations are continuing with other potential sponsors. There will be transport provided from the Caboolture Train Station to St Columban’s or, if you are coming from further afield, there are a number of accommodation options available for delegates. NEWS IN BRIEF

REGISTRAR’S REFLECTIONS The Year that was Wow what a year. There has been a lot going on in my first year at QJA. My first day involved not just a board meeting but it was pay day and BAS was due. It set the tone for the 11 months to follow. Since that first day, I had to deal with the end of year financial accounts, a National Conference, State Conference, the AGM, we were changing bank accounts, hiring a new staff member and looking at new software, thinking about moving the office. That is not to mention the rollout of the Online JP Qual course that has been a big success. It happened to be launched the Friday before I started the following Monday. That was the first six months. The next six months since January have included implementing new software, reorganising the office with new furniture, membership renewals and lots of visits to branches and workshops. I was surprised by how dynamic the QJA was and is. There are many challenges facing us as we move toward our centenary. We need to be thinking about our member collective in different ways to what we have traditionally. Only about one third of our members volunteer in the JPs in the Community program – many others are JPs through their work or privately and both are making a big contribution to society at large. Many of our members fall into the “working age” category and are not yet retired but working full-time. Our age demographic has dropped by an average of 10 years as membership flows on from the pre-appointment training. The challenges we face relate to how we can provide service to members, how we communicate and how we think of our members and their different needs. In member associations as I’ve learnt, it’s about having value, being available and having a profile. For the newly appointed JPs and C.Decs we need to respond to their need to get started. For the working JPs we need to engage them but they are too busy to volunteer more, attend meetings and go to workshops. For the active members and long-standing JPs they may want to give back to the community but they’re doing all the work. In essence, as an association – it’s about connection. I would like to take this opportunity to thank my team. Aaron and Cindy have both come a long way and every day work so hard to provide service to our members in merchandise, membership and training enrolments. I’d also like to thank Linda, who has now left the team. Her knowledge and contribution to the training program and as a member of our team will be missed. I wish her well in her new endeavours. I’d like to thank the volunteers at our signing centre here, who everyday provide such great service to clients. It’s been nice to get to know you all. I’d like to also acknowledge the fantastic trainers we have, who always get good feedback from students. I would also like to thank our board, who have been a pleasure to work with in the last year and incredibly supportive. In particular I’d like to thank Keith Revell for his guidance, support and encouragement. Most of all, I want to 10

Titles Registry Alert 120 Issued on 14 May 2015, this document (reproduced below for your information) is an alert to lenders, solicitors and conveyancers concerning the requirements for having Land Registry forms witnessed: The persons qualified to witness the execution of Titles Registry forms are prescribed in Schedule 1 of the Land Title Act 1994 (the Act) and section 162 of the Act imposes strict obligations on witnesses to the execution of Titles Registry forms by individuals. Qualified witnesses including Justices of the Peace (JP) and Commissioners for Declarations (C.Dec) are required, among other things, to take reasonable steps to ensure the individual (the signatory) is the person entitled to sign the instrument. In order to fulfil their lawful obligation, witnesses normally ask signatories to provide at least one form of photographic proof of identity showing their signature (such as a driver licence) as well as supporting documentation (such as a current certificate of title, title search statement or local government rates notice) linking the individual to the property the subject of the instrument presented for execution and witnessing. Should any of your clients fail to provide a witness with proof of identity or adequate supporting documentation, the JP or C.Dec may decline to witness their signature. Feedback received both from the Registrar of the Justices of the Peace Branch and directly from qualified witnesses, including through branches of the Queensland Justices Association, indicates many individuals present themselves to witnesses without being able to provide appropriate proof of identity and supporting documentation regarding their entitlement to sign an instrument. Consequently, JPs and C.Decs have on numerous occasions been subjected to verbal abuse when they declined to witness the signature of an individual who is not able to immediately satisfy the necessary standards of proof. This is unacceptable and such situations are easily avoided if signatories are properly informed beforehand. Please inform your clients that if they intend to ask a JP or C.Dec to witness their signature on a Titles Registry form—particularly a Form 1 Transfer or Form 2 Mortgage—it will be necessary for them to provide the witness with adequate proof of identity and, documentation that helps to confirm their own entitlement to sign the Titles Registry form. Attached is a handout that may be printed and distributed to your relevant clients to help ensure they are prepared and able to provide the witness with appropriate documentation. Your cooperation in providing this information to your clients is appreciated. It is anticipated that this will help to ensure that volunteer JPs and C.Decs can continue to freely offer their valuable time and services without fear of altercation with individuals who arrive ill-prepared to have their signature witnessed in accordance with statutory requirements. Q&A If an original will is a stapled document, the staple/s should not subsequently be removed or replaced.

Clarification/Correction In the last issue of the QJA Journal, an answer was provided to a question about witnessing an Application for a Post-Search Approval Order. The published answer was incorrect in some respects. Thank you to the feedback from QJA members (including QJA Director Chris Porter) drawing attention to the inaccuracies in the information provided on that occasion.

The existence of additional staple/pin holes in an original will may have serious consequences, especially for Land Title purposes (in these circumstances the Land Title Registry will automatically assume an additional testamentary document exists).

As a witnessing officer, you might make the testator aware of the potential issues associated with a stapled will. If the testator still wishes to proceed, there is no impediment to your witnessing the will (assuming a second witness is also present). However, you should note your logbook concerning the appearance of the document and the matters you discussed with the testator.

So, is it okay for a JP(Qual) to witness a Post-Search Approval Order Application? Answer: Firstly (as indicated in the answer provided in the previous issue), section 160 of the Police Powers and Responsibilities Act 2000 prescribes that as soon as reasonably practicable after conducting an unwarranted search, a police officer must make a sworn, written application to a Magistrate for a post-search approval order. This means a JP(Qual) is not authorised to issue this category of order. However, in practice, magistrates are not always immediately available to receive such applications. To address these circumstances, the magistracy has agreed to a procedure where the Application may be witnessed by a JP(Qual) [or a Magistrate] but only a Magistrate may actually approve/refuse the Order. To implement this procedure, the Queensland Police Service has drafted two separate documents - form QP0713 is the Application and form QP0714 is the Approval Order. So, a JP(Qual) is permitted to witness an Application for a Post-Search Approval Order. However, unlike a Search Warrant Application - where the justice is required to ascertain whether or not the evidence in the application justifies the issue of a warrant – with a Post-Search Application, the justice is simply witnessing the sworn statement of the police officer. It is important the witnessing officer places the police officer under Oath or Affirmation for the Application must be a sworn document. Unfortunately, the standard wording in the Application form (QP0713) is a little confusing in this regard. It infers the deponent “declares” the contents of the application are true and correct but the witness signs that the application was “sworn”. Q1 Should we witness a will that is a stapled document? The current Handbook/Guide says “ensure that the will is not stapled, clipped or pinned together’. Do we remove the staples? A1 The issue with staples is that, as a non-permanent form of fixing, they conceivably could subsequently be removed and substitute pages inserted. Stapled documents are perhaps more vulnerable to tampering (or accusations thereof) than properly bound documents.

This is not to say a stapled will is invalid. The law does not mandate that wills must be bound. In fact, section 10 of the Succession Act 1981, makes no comment on how the pages of a will should be held together.

Q2 What should I do if a person presenting a traffic infringement statutory declaration mentions they wish to “take the points” even though they were not the driver? A2 If the intended deponent admits they are planning to make a false declaration, you cannot witness the document and you should advise them accordingly. You should also warn them it is an offence (with serious penalties) to make a false declaration and record in your log book that you declined to witness and the reason for your refusal. The person may have been unaware they were about to commit a serious offence and by providing the appropriate warning, you may prevent a crime from being committed. Q3 Do I really need to record ID in my logbook for certified copies? It seems superfluous especially if there is a queue of people waiting for service. A3 Before we look at the specifics of your enquiry, let’s consider the overall purpose of keeping a logbook. Firstly, it is a record of when you performed your role as an honorary justice and how many clients you serviced. Secondly, in respect of each client, it records who you saw and what document(s) you processed for that client. Thirdly, it records the evidence you sighted to satisfy yourself the service you provided was appropriate. All these matters may be important should the service you provided ever be the subject of further enquiry.

Now we turn to client identification. For some JP functions (like witnessing Land Title documents), the provision of client identification is a mandatory obligation (required by legislation) to actually performing the task. For many other functions, it is a matter of “how much identification is appropriate for the service I am performing”. In other words, what is “best practice”?

For example, when you are witnessing a Statutory Declaration or Affidavit, there is an expectation you will satisfy yourself the person signing the document


VOLUME 12 • NUMBER 3 • SPRING 2015 is the deponent named therein. To be so satisfied, the provision of appropriate ID is necessary and you are within your rights to decline to witness such documents if you do not have the necessary supporting identification.

Now we consider Certified Copies. To some extent, the identity of the person presenting the documents is not directly related to the function you are performing. You are certifying that one document is a true copy of an original document you have sighted. The owner of the document does not need to be the person presenting the document to be certified. So, should you record the name of the client and ask for identification?

Please answer True (T) or False (F) to each of the following: Land Title Documents Q1 When witnessing Land Title documents, it is a requirement of a JP(Qual)/C.Dec to complete all identification documents supplied by a mortgagor. Q2 Under the provisions of the Land Title Act 1994, a JP(Qual)/C.Dec must take steps to ensure that the person signing the land title documents has an interest (ownership or potential ownership) in the land.

Whilst neither of these are mandatory nor essential to perform the task of certifying “this document is a true copy of the original----”, the question that might be asked is “what should my log show in the event this certified copy subsequently becomes a matter of disputation”? If the copy you have certified is called into question, you might be expected to know who presented the document for certification and what evidence you sighted to satisfy yourself the name provided was valid.

Q3 Under the provisions of the Land Title Act 1994, a JP is required to identify the individual who is signing the land title document.

So, best practice for all documents (including certified copies) is to record the name of the client and type of ID sighted. This does not mean you should decline to perform this certification task if the client is unable to provide ID. As indicated above, sighting of ID is not a prerequisite for certifying a copy. However, it is “good practice” when you consider where the copy might finish up and what questions you might be then asked about it.

Statutory Declarations

If the client has no ID with them, you would simply record this fact in your log (using your own abbreviation). Should a question ever be asked, this notation demonstrates you followed sound practice in seeking to confirm the identity of the client. Of course, the chance of a question ever being asked about a copy you have certified may be very low and you may be prepared to accept the associated (very low) risk of this occurring. The related issue is that, as honorary justices, we are an important part of the justice administration system. We are not just signing machines. The time taken to make brief, relevant notes in our log is an integral part of what we do (and in many respects this professional process sets us apart from others who might be permitted to carry out similar functions). We should not allow the pressure of a queue of waiting clients to compromise our professional practices.

Q4 When witnessing a Land Title document, it is necessary to place the deponent under Oath. Q5 If land is being purchased jointly, then both signatories must be present when land title documents are being witnessed by a JP(Qual)/C.Dec. Q1 As part of the witnessing procedure for a Statutory Declaration, you must warn the deponent of the consequences of not telling the truth. Q2 If the recipient of a speeding or red light camera offence was in charge of the vehicle at the time of the offence, a statutory declaration would not be required. Q3 As part of the witnessing procedure for a Statutory Declaration, the deponent must solemnly and sincerely declare that the contents of the declaration are true and correct to the best of their knowledge and belief. Q4 If 28 days has expired since the time of a speeding or red light camera offence, you, as a JP(Qual) or C.Dec, should refuse to witness the Statutory Declaration. Q5 In all cases with a speeding or red light offence, the person who is making the declaration is the person who should be signing the form. Q6 A Queensland Statutory Declaration can be witnessed by more groups of people than a Commonwealth Statutory Declaration. Q7 A Queensland Statutory Declaration is sworn under the Statutory Declarations Act 1959. Q8 The penalty for making a false statement in a Statutory Declaration is substantial and may include jail. Q9 A Statutory Declaration must always be sworn under oath. Q10 If a Statutory Declaration is already signed when the document is brought to you, then as a JP(Qual) or C.Dec, you must refuse to witness the document. REGIONAL ROUNDUP Brisbane North Thanks to the volunteers from the QJA Brisbane North Branch (BNB), a JP booth service was launched at The Prince Charles Hospital (TPCH) on 4 July. For the past 2 years, a team of six JPs has been providing a patient visitation service, responding to referrals from Social Work staff twice a week. Over this period the team has witnessed and certified more than 270 documents for hospital patients, including 200 Enduring Power of Attorney documents. With many patients facing life-threatening surgery or serious illness, this service has brought great peace of mind to hospital patients and families, and has assisted treating teams to help families make healthcare decisions that reflect the patients’ wishes.

Hornibrook While many JPs have attended training sessions that include steps for witnessing Customs documents, it is unlikely that most of us will ever visit the restricted secure area at Brisbane airport where the behind the scenes business of customs officers is carried out.

Mackay QJA Branch has been co-coordinating the JPs in the Community Signing Centre at Canelands Central Mackay since January 2013. We currently have 14 volunteers who generously provide their services from 9.00am until 12.00pm on Tuesday, Thursday and Saturday of each week. In the last 12 months they have provided their services to 3000 customers and seen 10400 documents. 84% of the work is certifying true copies of documents and 10% have been statutory declarations. The other 6% are a combination of all other documents. Our volunteers have also been assisting JAG with the mentoring program. We have been getting requests throughout the year for mentoring of new or inexperienced JPs/C Dec’s. Pictured is a future new volunteer Warren being mentored by Tracey. A recent opportunity to visit the Customs area of Brisbane International Airport was taken up by 23 JPs, with the majority of these represented by Hornibrook Branch folk. After signing in at the security desk, we were escorted into the main area already familiar to most of us who have navigated through the smartgates and facial recognition now part & parcel of overseas travel. Next we were shown the inner workings of the security team where search types and procedures were explained and an “ionwand” was demonstrated. This device will detect minute illegal substances with a quick swipe into your handbag, including traces that may be attached to credit cards and toothbrushes. While there is not a frequent call for JP services and the call-out hours are typically at inconvenient times of night, we were assured that a taxi or parking would be paid for if individual JPs were interested in this unique aspect of witnessing. Maroochydore A Refresher Course for Justices of the Peace and Commissioners of Declarations was held at Maroochydore, Millwell Road Community Centre on Saturday 18th July. Organised by the Maroochydore Branch, the one day workshop was attended by approximately ninety (90) delegates.

Senior Constable Laurelin Gratton from Logan Police Station spoke in regard to the role of a JP when attending a record of Interview, issuing summonses and hearing a bail application. Karen Orsborn of the Land Titles Office in Nambour spoke in relation to the correct procedure when witnessing land title documents. Senior Sergeant David Bradley (the Senior Prosecutor on the Sunshine Coast) gave an excellent talk on the issuing of Search Warrants, while Mr. Kevin Martin, the Public Guardian from the Public Guardian’s office spoke in relation to the witnessing of General Powers of Attorney and Enduring Powers of Attorney. Those attending were able to ask questions of the speakers and the day was very informative and interesting. The final speaker was our own President, Keith Revell who spoke on Affidavits and the Family Law requirements and the expectations of JPs when witnessing these type of documents. Feedback on the event was positive with one attendee stating that all topics were very relevant and most helpful.

The Maroochydore Branch under its Trainer Chris Lancaster is now planning an all weekend training course for Justices of the Peace and Commissioners of Declarations to be conducted on the last weekend of September. Rockhampton On the 28th May, the QJA Rockhampton Branch had its last official meeting after 11 years at the Corporate Business Centre. Over the years we have been able to organise and conduct our QJA Training Courses, Seminars & Refresher Workshops, and our monthly meetings. South Pine South Pine Branch continues to offer two after-hours services, one on Thursday evenings at the Albany Creek library, and one on Saturday afternoons at Peter Campbell Realty, Albany Creek. The realty recently moved to new premises and the Principal, Matt Campbell, has provided a very comfortable and private office for us to work from. The Saturday receptionist at the realty is a dynamic university student, Catarina. Although her employment is in the realty, she goes out of her way to assist the JP on duty and our clients in a very unobtrusive but efficient and effective way. Chairman Gordon Farmer and I were very happy to recognize her assistance recently with the presentation of a QJA Certificate of Appreciation.

It is amazing how many clients arrive on Saturday at 3pm needing papers signed URGENTLY because “the solicitor wants them on Monday”. Occasionally the papers are not correct or supporting documentation is not available. Readers can imagine how fraught such a situation can be. More than once, Catarina has been able to calm clients and assist in finding what is necessary. We really value her presence there. Our members are also heavily involved in the mentoring programme of JAG and find this very fulfilling. We currently have two mentees working with us. A JP(Qual) course is planned for October and preliminary planning is in hand to hold a refresher seminar next year.
