ANNUAL GENERAL MEETING The 2012 AGM of the company was held on Saturday 10th November at 10:00am. There were 28 Members represented at the meeting. Immediately prior to the AGM, there was a Special General Meeting to consider the notified Constitutional Amendments. These changes were duly approved. Regular business was then attended to with a vigorous and productive discussion on the financial state of the company and the presentation of the audited financial statements. An abbreviated version of the minutes of both meetings is published on page 12.

STATE CONFERENCE 2012 Congratulations to the Ipswich Branch and the organising committee for hosting an excellent, refreshing, and informative State Conference. Over 130 delegates were rewarded with a selection of high profile people who delivered quality presentations. See pages 6-7 for a review of Conference proceedings.

President’s Report Dear Colleagues The QJA has expanded its number of branches and contact groups to 33, with new Branches of Warwick, Brisbane South and Hornibrook with prospects for further expansion at Gatton, Roma, Maryborough and Bowen. Membership of the Association is currently at over 5,300 and the Registrar is contacting some members to remind them their fees are due. Membership expansion continues to be a focus for the Board with the ongoing extension of the Branch network, investigating new niche markets (such as the Corporate sector) and membership retention from the training courses.

The QJA now not only provides training using qualified trainers who work in Signing Centres and at various Courthouses, but also marks the official JP Branch Assessment Books and issues the Statement of Attainment. We now have added responsibilities in keeping more stringent records and employ a casual data entry person to cope with the increased level of work. As a Registered Training Organisation, the QJA is now answerable to the new Australian Standards Quality Authority. I would also thank our trainers and assessors for the work they have undertaken in the training area at such short notice.

The QJA lnternational Women’s Day was a sell-out success again earlier this year at Southbank TAFE, along with similar well attended functions in Bundaberg and lngham. The IWD Committee under direction from Vice President Mrs Marian Vierveyzer and Registrar Ms Angela Yin are organising similar functions for 2013.

I attended this year’s Australasian Council of Justices’ Associations (ACJA) conference in Wellington, New Zealand with Vice President Mr Bob Pilkington. Delegates from all Australian States and New Zealand attended. Discussions included the Appointment of JPs, Education and Training and Role/Duties of JPs. The next ACJA Conference will be in Darwin 2013 and in Brisbane 2014.

The QJA Website has been completely redeveloped and includes more user-friendly menus. The site now includes the QJA merchandise shop where members can order and pay on line through a secure E-Commerce Site. Payment options include Credit Card, Bank Transfer, Cheque and Pay Pal. The Members only section includes a professional development section which includes training videos and a general knowledge JP and C.Dec quiz. This environment will ultimately provide various learning mechanisms to assist with developing new JP and C.Dec skills, refining existing skills and updating skills when legislation or procedural changes occur.

The lpswich Branch organised the QJA State Conference at lpswich on Saturday 20th October. The conference was opened by our Patron, the Hon Paul de Jersey AC, Chief Justice of Queensland with guest speakers including the Attorney General and Minister for Justice, the Hon Jarrod Bleijie, member for Kawana and the Deputy Mayor Mr Andrew Antonolli. The Conference was also attended by the local member for lpswich Mr lan Berry MP. The Conference was a success and well attended. The next State Conference will be held in Bundaberg on the 9th October 2013.

Many thanks to Director Keith Revell for his continuing work in improving the website and its content. As from July 2012, the QJA has delivered JP and C.Dec training across the State at Cairns, Townsville, Mackay, Rockhampton, lpswich and State Office. Further training was delivered for the Moreton Bay Regional Council, lpswich City Council and the Toowoomba Regional Council. Training for the Burnett Shire Council and the Dalrymple Electorate is scheduled to take place in 2013. A full schedule of training for 2013 has been placed on the website.

I would like to thank all of the Board Directors, Registrar Ms Angela Yin and Trainee Administration Assistant Mr Michael Minks-Bungard for their dedication and hard work over 2012 which has made the QJA more efficient and effective in its business operations.

News in Brief Update to JP Guide Updates to chapter 5 “Statutory Declarations” and chapter 9 “Justice Examination Orders” have been released and are available to download from the website. Chapter 11 ‘Relationship Issues‘, chapter 15 “Domestic Violence Order Applications”, chapter 16 “Issuing a Summons under the Peace and Good Behaviour Act 1982“ and chapter 24 “Bail and Sureties“ are under review and will be available shortly. Those Members who have registered their purchase with State Office and have an email address will be notified. There will also be

a notice on the QJA website in the Members Only section. This will be a substantial update so we urge you all to download and read this update when it is released. For further information please contact State Office.

News in Brief Another update to the Website released

Directors Recognised

The QJA website has just undergone another significant release and the QJA training module is now available for use.

Congratulations to President Ray Burrows and Director Keith Revell on being presented with a Award of Appreciation at the QJA State Conference in October by the Attorney-General the Hon Jarrod Bleijie.

When you log in to the Members Only area select the Professional Development option on the Member Menu. This will automatically take you to the new service. When you have finished simply click the Home button on the top menu and log out as normal. A number of generic sample courses have been installed in order to test the capabilities of the system. These sample courses consist of a variety of generic office procedures (eg Fire Safety & Stress in the Office), computer courses (Basic IT and several Microsoft courses), plus some courses on “How to develop online courses”. Some of these sample courses have been loaded from full course backups so have all the features available of a standard course. Some have been loaded from a “SCORM” backup which means they have limited features and are mainly a package running within the course framework (the Microsoft courses are an example of this). Note! While you are free to access and use the sample courses that have been loaded, please bear in mind that the QJA cannot determine whether the sample course content is relevant or up-to-date for the Australian market. All the previous QJA Professional Development videos have now been transferred to this new environment and a general knowledge JP / C.Dec quiz has been created. Our aim is to use this environment to create more quizzes and courses. For each one of the videos we will be creating an associated quiz to enhance the learning methods. This environment will ultimately provide various learning mechanisms to assist with developing new JP and C.Dec skills, refining existing skills, and updating skills when legislative or procedural changes occur.

The awards were presented to Ray & Keith in appreciation for their dedicated service and support to the JPs in the Community program.

Australasian JP Association meeting The 2012 meeting of the Australasian Council of Justices’Association (ACJA) was held in October at Wellington NZ. QJA President, Ray Burrows and Vice-President, Bob Pilkington were both in attendance as shown in the photo below (Bob top right, Ray centre right). The 2013 meeting will be held in Darwin with Brisbane being the host in 2014.

Website Hints & Tips Have you wondered how you can find that link or document on the QJA website. Well here’s how to use the search bar. At the top right of your screen you will see a tab with a “+” symbol which looks like this.

When you click on the “+” symbol the tab will open up into a search bar like this. Now simply type the topic you want to search for and a selection list will be provided.

QCAT Trial to begin early 2013 The role of JPs is about to be expanded for some. A four-year, $3.5 million pilot program for Maroochydore, Ipswich, Southport, Brisbane and Townsville will use JPs to help solve smaller-scale disputes in a way that delivers “swift and fair justice”. It is to begin in early 2013. Queensland Attorney-General Jarrod Bleijie said these JPs would work on behalf of the Queensland Civil and Administrative Tribunal,

State Office closed over Festive Break

Speaking at the Queensland Justices Association annual state conference, Mr Bleijie said there was greater scope to use the knowledge of JPs.

QJA State Office will close on Wednesday 19th December and will reopen on Monday 7th January, 2013. During this time if you have any questions please refer to the QJA website initially for general information or contact your local Branch or the Director in your region for further assistance.

“There are currently 80,000 JPs in Queensland who make a valuable contribution to our community and our justice system,” Mr Bleijie said. “The pilot program will utilise the skills of JP (Magistrates Court) and JP (Qual) to come up with common sense solutions to minor civil disputes of less than $3000 (now $5000) in QCAT.” From October 29, JPs can lodge an expression of interest online on the JP Branch website. http://www.qcat.qld.gov.au/about-qcat/jp-trial.

Orders placed on the QJA Shop, and new website Registrations will be accepted but not processed until the office reopens in January.

Congratulations - VP is 80 years Young! On 22 September 2012 at Rockhampton’s Ocean City Chinese Restaurant, family, friends and colleagues joined with QJA longserving Vice President Ray Young OAM as he celebrated his 80th birthday. The Rockhampton Grammar School old boy has spent a lifetime throwing his whole effort into every community project he has been involved in. These include gymnastics, St Paul’s Cathedral, Rotary, the Masonic Lodge, QJA and the Order of Australia Association. He has also received numerous national, state and local awards for his service to gymnastics and the Rockhampton community and he is a Rotary Paul Harris Fellow. International Women’s Day A number of International Women’s Day events will be hosted by the QJA across Queensland in early March 2013. A Registration Form along with event information is inside for the Brisbane event which will be held on Friday March 8th, 2013. In previous years these events have sold out quickly so we urge you to submit your registrations early to avoid disappointment. Regional IWD events will also be conducted. All Branches have been asked to consider whether an IWD event in their area would be appropriate.

State Conference 2012 By Marian Vierveyzer (Vice President) Ipswich branch of the QJA would like to give thanks to all the members who attended the 19th annual State Conference. Visitors outnumbered locals, coming to Ipswich from all over the state to hear high calibre guest speakers. Uncle Albert Holt, Aboriginal Elder welcomed guests and spoke of his own story from his pre-retirement role in the Queensland Police Force, his involvement in the Murri Court, and his involvement in many voluntary roles for which he has received numerous acknowledgements. Uncle Albert graced the audience with words of wisdom and advice for an amicable future. Councillor Andrew Antoniolli represented Ipswich Lord Mayor Paul Pisasale and brought the amazing Ipswich to life with a journey through history, its battle through the floods of 2011 and Ipswich’s bright future including staggering growth statistics. Ripley Valley alone is to become the largest planned sustainable community in Australia, with an expected growth of 120,000 people to the area. QJA Patron, the Honourable Paul de Jersey AC – Chief Justice of Queensland spoke of the judicial system and the new Ipswich Court House. His Honour also invited members to arrange a tour of the new Law Court recently opened in Brisbane. However it was Queensland Attorney General, Hon Jarrod Bleijie MP who aroused the interest of the audience by announcing a four-year, $3.5 million pilot program for Maroochydore, Ipswich, Southport, Brisbane and Townsville that will use JP(Quals) alongside trained and experienced court employees of the Queensland Civil and Administrative Tribunal (QCAT) to help solve smaller-scale disputes less than $5,000 with the hope of reducing a long list of claims. Jarrod Bleijie went on to talk about the Newman Government’s Vision for JP’s. Mr Bleijie outlined the new focus for the JP Branch away from training and more towards administrative duties. He also floated possible re-accreditation as a means to ensure JP’s remain active and continue to develop their professional knowledge. Sergeant Nadine Webster – Officer In Charge, District Crime Prevention Unit spoke on Personal Safety making the audience aware of simple steps they could take to ensure their personal safety both as a JP and in their personal life. Chris Young – Qld Mental Health Officer spoke on the subject of Justice Examination Orders. Chris is a Registered Nurse and an Authorised Mental Health practitioner and has worked as Court Liaison Officer based at the Ipswich courthouse since 2006. His role is to see persons with mental health problems who are in court or in the watch-house and to ensure they receive appropriate treatment and care, including an assessment in hospital if necessary. 6

State Conference 2012 George Dean spoke on topics regarding the Muslim faith and dispelled some myths when dealing with Muslim women. This was an eye opening presentation for JP’s. Representatives of Heritage Bank, a major supporter of the QJA, were on hand to answer any questions. Tracee Clothier, Manager of the Ipswich branch made a brief presentation on products available and gave a brief outline and the recent transition from a Building Society to a Bank. After lunch Magistrate Jacqueline Payne walked the audience through the proceedings of the Murri Court bringing to life an actual case where the outcome for the accused was favourably influenced by the manner in which he was dealt with in the court. The Murri court is laid out informally and allows the accused to speak directly to the Court. Magistrate Payne played a recording of the conversation she had with the accused in the court and the JPs present were able to understand the proceedings. In this case Magistrate Payne was given a better understanding of what brought the accused to this point and also gave her more options and a more appropriate manner to deal with the accused. Paul Trevethen, Physiotherapist and director of Body Leadership, gave everyone present a few tips on muscles and explained his SSTM (Squeeze Stretch Trigger Move) technique. He led the attendees in some quick stretches giving their “flat spots” some relief and a revitalising laugh. Detective Senior Sergeant Troy Salton finished off the day with information about attending a “Record of Interview”. Det Salton has worked in the child Protection field for the past 14 years within the Ipswich District as an Investigator, Senior Investigator, Team Leader and Acting Officer in Charge of the Ipswich District child Protection and Investigation Unit (CPIU), formerly known as the Juvenile Aid Bureau (JAB). He shared his experience with the audience, highlighting the way in which the law differentiates between children, juveniles and adults. There were clear and unclear aspects to how and when a person not yet an adult is treated within the law that depended on the offence amongst other things. The day ended with a short question and answer period. The President of the QJA Ray Burrows announced the 2013 State conference would be held in Bundaberg. The Master of Ceremonies and Vice President Bob Pilkington, President Ray Burrows and Vice President Marian Vierveyzer answered questions submitted by the audience on behalf of the day’s speakers. The QJA Ipswich branch presented each speaker with an engraved Tumbler with the 2012 QJA Conference logo. T-Shirts were also offered to commemorate the conference and although the team shirts were exclusive to the team, they were so popular that they were also offered for purchase by order only. The day ended with a dinner also at the Metro Hotel who sponsored the major raffle prize of the day. Many of the attendees of the day went home with raffles prizes from the numerous sponsors for the Conference. Ipswich City Council and the Mayor’s office contributed to the day to ensure the entry fee for voluntary justices was kept at a minimum. AGM President’s Report 2011-2012 President’s Report Annual General Meeting 10th November 2012 Ladies and Gentlemen Welcome to the 2012 Annual General Meeting of the Queensland Justices Association. Since the 2011 AGM, the QJA has expanded its number of branches and contact groups to 33, with new Branches of Warwick, Brisbane South and Hornibrook, plus prospects for further expansion at Gatton, Roma, Maryborough and Bowen. Membership of the Association is currently at over 5,500 and the Registrar is contacting some members to remind them their fees are due. Membership expansion continues to be a focus for the Board with the ongoing extension of the Branch network, investigating new niche markets (such as the Corporate sector) and membership retention from the training courses. The QJA has held membership fees steady for a number of years but due to increased costs of our lease and utilities, and upkeep of equipment and repairs that the QJA is responsible for, the QJA has had to increase the regular fees to $55.00 and Concessional fees to $41.80. The financial result for the 2011/2012 financial year is a deficit of $8,012, compared a surplus in the previous financial year, however there are a number of reasonable explanations for this, including the inability of the organisation to undertake training activities for most of 20112012 and the receipt and expenditure of some monies in different financial years. More detail will be provided in Agenda Item 5. Many thanks to Vice President Mr Bob Pilkington for his continuing liaison with our partner Heritage Bank for their continuing support for QJA Refresher Days and the State Conference. The QJA International Women’s Day was a success again earlier this year at Southbank TAFE, along with similar well attended functions in Bundaberg and Ingham. The IWD Committee under direction from Vice President Mrs Marian Vierveyzer and Registrar Ms Angela Yin are organising similar functions for 2013. The QJA Website has been completely redeveloped and includes more user friendly menus. The site now includes the QJA merchandise shop where members can now order and pay on line through a secure E-Commerce Site. Payment options include Credit Card, Bank Transfer, Cheque and Pay Pal. The Members Only section includes a professional development section which includes training videos and a general knowledge JP and C.Dec quiz. This environment will ultimately provide various learning mechanisms to assist with developing new JP and C.Dec skills, refining existing skills and updating skills when legislation or procedural changes occur. Many thanks to Director Keith Revell for his continuing work in improving the website and its content. As a result of the Board’s 2010 Strategic Planning process, Mission and Vision Statements were created. These can be found on the QJA website. Following on from this initial phase, a five year Strategic Plan was developed. This plan consists of eight Goals, they being (in no particular order):1.

Deliver quality honorary Justice training,

Provide quality professional development to honorary Justices,

3.

Increase membership recruitment,

4.

Engage with existing Members effectively,

5.

Engage in effective community development,

6.

Lobby and advocate in the interests of honorary Justices,

A strong leadership and governance.

Each Goal has been assigned to Director(s) with responsibility to expand the Goals into Strategic Actions. These Actions are then assigned to appropriate people to achieve. As you can imagine there are dozens of Actions within each Goal, but remember this is a five year plan and not everything will be achieved immediately. The Strategic Plan as well as the Policy and Procedure Manual are being continually reviewed. As from July 2012, the QJA has delivered JP and C.Dec training across the State at Cairns, Townsville, Mackay, Rockhampton, Ipswich 10

AGM President’s Report 2011-2012 and State Office. Further training was delivered for the Moreton Bay Regional Council, the Ipswich Council and the Toowoomba Regional Council. Training for the Burnett Shire Council and the Dalrymple Electorate is scheduled to take place in 2013. A full schedule for training for 2013 has been placed on the website. The QJA now not only provides training using qualified trainers who work in Signing Centres and at various Court houses, but also marks the official JP Branch Assessment Books and issues the Statement of Attainment. We now have added responsibilities in keeping more stringent records and employ a casual data entry person to cope with the increased level of work. As a Registered Training Organisation, the QJA is now answerable to the new Australian Standards Quality Authority. I would also thank our trainers and assessors for the work they have undertaken in the training area at such short notice. As from 1 January 2014, all Registered Training Providers must include a Unique Student Identifier (USI) when sending data to all National Collection Agencies. The QJA has already complied with a request from the Department of Education, Employment and Workplace Relations (DEEWR) to register our details by the 7th November, 2012. I attended this year’s Australian Council of Justices’Associations (ACJA) in Wellington, New Zealand with Vice President Mr Bob Pilkington. Delegates from all Australian States and New Zealand attended. Discussions included the Appointment of JPs, Education and Training and Role/Duties of JPs. The next ACJA Conference will be in Darwin, 2013 and in Brisbane 2014. The Ipswich Branch organised the QJA State Conference at Ipswich on Saturday 20th October. The conference was opened by our Patron, the Honourable Paul de Jersey AM, Chief Justice of Queensland with guest speakers including the Attorney General and Minister for Justice, Mr Jarrod Bleijie, Member for Kawana and the Deputy Mayor Mr Andrew Antonolli. The Conference was also attended by the local member for Ipswich Mr Ian Berry MP. The Conference was a success and well attended. The next State Conference will be held in Bundaberg on the 9th October 2013. I would like to thank all of the Board Directors, Registrar Ms Angela Yin and Trainee Administration Assistant Mr Michael Minks-Bungard for their dedication and hard work over the last financial year which has made the QJA more efficient and effective in its business operations. Abbreviated Minutes of 2012 SGM & AGM The Special General Meeting notified in the Spring edition of the QJA Journal took place at 10am on Saturday 10 November 2012 at QJA House, 751 Stanley Street, Woolloongabba. There were 18 members in attendance and 10 more were represented by proxies. SGM after Apologies were recorded for 9 members. One observer present. The sole item of business for the SGM was consideration of the amendments proposed to the company’s constitution to introduce the corporate category of membership. The Board was asked to explain the rationale for the proposed changes. Director Keith Revell, on behalf of the Board, explained: In the 2010 strategic planning process, membership growth was identified as a key driver of QJA success. During discussion of this strategic success factor, it became apparent to the Board that many people who become JPs and C.Decs do so for work purposes. They are employed within companies who utilise the services of JPs and C.Decs. This includes banks, real estate firms and legal firms. These JPs are unlikely to be involved in volunteering at signing facilities at shopping centres, but they are still active in the community. Many of them may have the attitude that they only witness the odd document for work and therefore do not feel compelled to join a professional association, and are therefore not being kept up-to-date. QJA views offering Corporate Membership as an opportunity to promote the benefits of QJA and membership as a professional development mechanism for employers to offer their employees. We anecdotally surveyed some organisations and received positive feedback. This change to the Constitution will allow us to have the conversation with organisations that we have never been able to have before. This is an opportunity to give us access to a market that was previously difficult to reach. So rather than charge each individual a membership fee, this allows us to charge the company a Corporate Membership Fee rate to enrol their company and benefit their employees. We would look at pricing it so that there is an attractive discount to individual membership. A Corporate Member is entitled to have one Representative who can vote at AGMs. They can have any number of JPs who are employed, but they only have access to our resources – they do not have voting rights. They can attend Conferences and Refreshers and access the Journal the website etc. The Board still has some work to do in finalising the details of implementing this change, including scaling the fees according to different tiers of Corporate Membership so that it is enticing for them to join. A small company may have up to 5 JPs, a medium company may have up to 10 JPs and a larger company may have 30-40 JPs. It is QJA’s hope that individual employees see the benefit of membership and if they leave, decide to stay on as an individual member. 12

QJA will approach smaller industry groups, such as real estate business and law firms. We all know such organisations in our local areas and they may wish to sign up to it.” After an explanation of the procedural nature of new rule 109, the motion to accept all the changes (notified in the 2012 Spring edition of the Journal) was carried. At 10:15am, the 2012 Annual General Meeting of the QJA commenced. 1. Attendance. There were 18 members in attendance, a further 10 represented by proxy and 9 apologies recorded. One observer present. 2. Minutes. The minutes of the 2011 AGM as published in the Summer 2011 edition of the Journal were accepted as true and correct. It was agreed there was no business outstanding from the minutes. 3. President’s Report. This report (see pp10-11 in this Journal) was distributed to meeting attendees. Following some discussion about the content of the report, the motion to accept the report was carried. 4. Directors’ Report. This report was published in the Spring 2012 edition of the Journal. After discussion of the content, the motion to accept the Directors Report was carried. 5. Financial Statements 2011-2012. These statements were published in the Spring 2012 edition of the Journal. The Income Statement for the year ended 30 June 2012 revealed a financial loss of $8,102 whilst the Balance Sheet disclosed Net Assets of $171,224. After some questions about the composition of Marketing Expenses and Cash and Equivalents for which satisfactory responses were provided, discussion turned to the nature and content of the Intangible Assets of $16,055 reported in the Balance Sheet. It was explained that this item comprised the costs of development/ acquisition of the company’s Membership Database and Constitution. Member AC advised the meeting that as a practicing qualified accountant specialising in financial reporting, she believed the Constitution costs should more properly have been expensed rather than regarded as an intangible asset. This would affect (increase) the reported loss for 2011-2012. AC further suggested that the Financial statements as published may not comply with Australian Accounting Standards because of the treatment of the Constitution development costs as an intangible asset. Board Directors acknowledged they were not experts in this area and relied on the more informed view of the auditor engaged to examine the accounts and statements. In view of the opinion expressed in the meeting, the Board agreed to investigate this matter further and if necessary to republish the statements. Either way, members will be informed of the outcome. Subject to this understanding, the motion to accept the Financial Statements was carried. 6. Other Business. The Board was asked why the QJA Proxy Form allowed only the appointment of a proxy without allowing the member to indicate a “for”, against” or “abstain” vote. Board agreed this was a sensible change and proposed investigation. Motion Carried. Meeting closed at 10:55am.

Does a document have to be signed in my presence? Your duty is to “witness” a signature and this cannot be done if the document is already signed before it arrives. All parties whose signatures are being witnessed must be in your presence. It is also important to note that the words ”before me” on a document mean “in front of me”, not “before I came here”.

Does the person signing the document have to understand what they are signing?

A)

You should always ask whether the person understands the nature, contents and practical effect of the document that is being signed. This should be done every time that you witness a document. If the person doesn’t appear to understand, it may be necessary to ask some open ended questions that check for understanding. Sometimes it may be necessary to explain clearly to the deponent what the practical effect of signing the document will be.

If more than one person is required to sign a document, but not all of those persons are present, it is wise to annotate the document as follows: “Signature of [insert full name] only witnessed”.

Assessing the person’s “capacity” to understand the nature of the document is pivotal when witnessing Powers of Attorney, Advanced Health Directives and wills. The validity of these documents relies completely on the principal’s capacity at the time the document was signed and witnessed. Any conjecture about the principal’s or testator’s capacity is grounds for these documents to be contested in a court of law. It is your responsibility as the JP and independent witness to assess and verify capacity.

The person who is not present is likely to have their signature witnessed by any other JP or C.Dec. By inserting the phrase listed above, you are sending a clear message to the receiving authority the extent of your involvement in witnessing the document. If a person arrives with the document already signed, you must ask them to sign again, either on the document or on a blank piece of paper. If the signatures are obviously different, you should refuse to witness the document. Q2)

Do I have to see the contents of the document?

A)

There may be times where, for personal reasons, the signatory may not wish to reveal the contents of the document to you, nor are they obliged to do so. You may come across this situation in witnessing wills and victim impact statements for the Office of the Director of Public Prosecutions and Victims Assist, as well as other statutory declarations and affidavits. On the other hand it is hoped that the person concerned will also understand that you need to exercise your duties of office prudently. Should a signatory not wish to show you the contents of the document, you can still witness it, but underneath your signature, it is recommended that you write the words “SIGNATURE ONLY WITNESSED, CONTENTS NOT DISCLOSED”.

Do I have to ask the signatory for identification?

A)

It is prudent to check that the person named in the document is the person that is signing the document. If you have any concerns, it is suggested that you request identification; however providing proof of identity is only mandatory when the legislation relating to the document, or the document itself, asks for it. An example of mandatory identification is when witnessing land title documents. You may also notice that many pre-printed log books allow for you to record the identification sighted. The expectation is that when it is necessary to sight ID, photographic government issued identification is the preferred standard, particularly where legislation mandates that the person be identified. If such identification is not available, it would be expected that a number of non photographic forms of identification (again preferably government issued) be produced concurrently to accurately verify a person’s identity. These forms of ID, when combined, must be satisfactory to the JP as verifying the identity of the person.

What warning should I give before witnessing a document?

A)

You should ensure the Declarant (for Statutory Declarations) or Deponent (for Affidavits) is fully aware of the repercussions for making false or misleading statements and you should stress the importance of telling the truth. You can provide this warning by saying – for example:

Sometimes, cultural and/or religious sensitivity may be required when sighting identification. For example a woman of the Islamic / Muslim faith may not remove a niquab or burka to satisfy you of their identity if you are a male. In such a case, it may be necessary to refer the person to a female Justice of the Peace or Commissioner for Declarations.

“It is my obligation to warn you that the information contained in this document cannot be untrue or misleading. If so this can be seen as a criminal offence and may be punishable by a monetary fine or jail term or both” (or words to that effect). You may then give the person an opportunity to amend the document.

The other issue that arises with identification is whether you need to write down the licence number or passport number etc when you sight the identification. At the moment the Department of Justice and Attorney-General has advised that this should not be done for privacy reasons. JP awarded National Service Medal

QJA has its 33rd regional group – Hornibrook Branch.

The NATIONAL EMERGENCY MEDAL established by Her Majesty the Queen by Letters Patent during Her Majesty’s visit to Australia in October 2011 was awarded to QJA Trainer Chris Lancaster recently.

On 15 September at the Clontarf Beach State School, with local MPs Kerry Millard, Scott Driscoll and Reg Gulley in attendance, more than 100 honorary justices attended a meeting which featured presentations from Dimitri Glianos (JP Branch), Karalise Goodwin (Land Titles office) and Keith Revell (QJA Board). The members present voted to establish a QJA branch to service Sandgate, Redcliffe and surrounds. th

Proposed Branches at Gatton and Bowen Expressions of interest from local QJA Members has resulted in the Board investigating opportunities to convene meetings to propose the establishment of new Branches at Gatton and Bowen. Vice-Presidents Marian Vierveyzer and Bob Pilkington headed to Gatton on Saturday, 17 November 2012 to form the 34th branch of QJA. An open forum was held at the Masonic Lodge, with both the local MP and the Mayor attending to address the audience. More details next issue.

Recognition for Hervey Bay Stalwart The Board and the QJA Hervey Bay Branch members presented Dr Ron Just a plaque to recognise his valued contribution to the Hervey Bay Branch as Secretary to the Branch and a wise and valued source of counsel and assistance especially in the organisation and running of the State Conference in Hervey Bay. We regret Ron’s resignation due to severe ill health and wish Ron as much GOOD health as he can get in the coming years.

The NATIONAL EMERGENCY MEDAL is awarded to individuals who rendered significant and sustained service to others during a nationally significant emergency. Chris Lancaster, a J.P.(Qual) for approximately seven years and accredited Trainer with the QJA was employed by Lifeline Community Care Queensland during the 2010/2011 Queensland Floods and Severe Tropical Cyclone Yasi, as State Manager for Community Recovery Operations. In this role Chris was responsible for deploying Community Recovery Counsellors, Social Workers and Psychologists into disaster struck regions of Queensland. Particularly significant was the role Chris played at Cardwell in Far North Queensland; one of the worst disaster affected areas caused by Cyclone Yasi, where he led a team from Lifeline into the area and spent weeks there. “The town was almost completely destroyed with no power, many living in tents, caravans and shelters” he said. “One of the major problems was that many older residents were eating food that was unrefrigerated and was dangerous to their health, causing sickness.” “Diabetics in the town were also injecting themselves with insulin that was warm and unrefrigerated which is rendered not only useless medication but dangerous to their health”, he said. With the help from several outlying Lions Clubs, Chris was able to raise thousands of dollars to provide generators and free fuel vouchers to issue to the residents. It cost $30 per day to run a generator to enable power and refrigeration to all who lived there, especially to pensioners and those in poor health. Chris also assisted victims of the Queensland Floods in South East Queensland, organising evacuations, counselling and support to thousands of residents who either lost their homes or had them significantly damaged. Chris was a member of the State Human Social Recovery Group attached to the State Community Disaster Response Committee, and was also involved with the Disaster Community Recovery Committee on the Sunshine Coast. The award was nominated by his employer- Lifeline Community Care Queensland and approved by the Commonwealth Governor General.

Logan Volunteer of the Year Volunteers are a special kind of people - dedicated and selfless, always putting the needs of others before their own. Logan City Council said thank you to some of those volunteers in the Logan community at a special event at Underwood Park on Sunday 14 October 2012. Logan Mayor Pam Parker (below right) said she was delighted to join in the day of celebration as well as present the distinguished 2012 Frank Lenz Volunteer of the Year award. Cr Parker said this year’s winner of the Frank Lenz Volunteer of the Year, Keith Revell (second from right, QJA Logan Branch Secretary and QJA Director) was a deserving recipient who had been making an outstanding contribution to the local community since 1987.

Chairman Daphne Horne was very disappointed at the poor response to take a tour of the new Gympie Police Station on Tuesday 18th September 2012. The four interested JPs were welcomed by Senior Sergeant Graham Reeves and Sargeant Vic Tipman. Vic then escorted the group through the offices, explaining what each department was for and introducing the staff who were on duty at their desks. When all had been shown Daphne thanked Vic for his time and his interesting and informative explanations. Those attending were Daphne Horne, Betty Smith, Melodie Zylstra and Jim Buchanan
