Homeownership: A New Year’s Resolution That Lasts By David Anderson, President Acadian Home Builders Association January 1 has come and gone, and millions of Americans are once again thinking about the resolutions they have made for the New Year. Why not make this year’s resolution one that will last into the future – long after you’ve stop bothering to set the alarm an hour early to go for a run. Deciding to become a home owner is one of the best resolutions you can make. Here are some tips to help you make good decisions for your homeownership resolution. Figuring Out Your Finances First, determine how much you can afford. This depends on many factors including your credit rating, current expenses, cost of a downpayment and interest rates. Don’t forget that you will need a downpayment up front as well as money to make monthly mortgage payments. Check your credit reports carefully. Inaccurate information on your credit report could result in lenders offering you loans with higher-than-market interest rates or denying your application altogether. Finding the Right Mortgage Next, find a lender you trust. Ask your friends, family and neighbors who own their homes for recommendations. Work with a qualified lender on getting together a budget and collecting helpful advice before buying a home. When shopping for a mortgage, consider all of your options. There are many choices in terms of a loan and not every one is right for every buyer. Don’t forget to research Federal Housing Administration (www.fha.com) programs that offer loans with lower down payments. They are often a good option for first-time buyers. Keep in mind that there are tax advantages to being a home owner that can help offset costs. Depending on your specific situation, often the closing costs and some other first-year costs of purchasing a home are deductible. And the mortgage interest deduction (MID) enables many home owners to reduce their taxable income by the amount of interest paid on their mortgage loan each year. More than 70 percent of home owners with a mortgage are able to claim the MID in a given year. The U.S. Housing and Urban Development website (portal.hud.gov) has loads of information for home buyers, including tools to help you figure out how much you can afford, how to shop for a loan, information on how to avoid predatory lending and an explanation of the settlement process. Selecting Your Neighborhood Finally, learn about the neighborhoods where you are interested in buying. Visit areas you are interested in at different hours, talk to people who live there, and find a real estate agent that you trust and knows the neighborhoods you like. With careful and thorough planning, you will be moving into your new home before you know it. THE PLAN WAS FOR EVERYONE TO HAVE A DESIGNATED DRIVER, CALL A CAB OR USE UBER IF THEY WERE GOING TO PARTAKE IN DRINKING. EVERYONE WAS OF AGE, BUT A FEW DID SNEAK OUT AND DRIVE THEMSELVES HOME. ONE OF THE GUESTS CRASHED HIS CAR INTO A NEIGHBOR’S FENCE CAUSING SOME PROPERTY DAMAGE, AND WAS ARRESTED. AM I ON THE HOOK FOR THE NEIGHBOR’S FENCE SINCE IT WAS MY PARTY?

A: Probably not. In Louisiana, the law provides that the cause of the alcohol related injury or damage is the person who consumed the alcohol, not the person who served or provided the alcohol. When a party guest is intoxicated and goes on the cause the accident, the party host is generally immune from liability pursuant t Louisiana Revised Statute 9:2800.1. There are two exceptions to the immunity. The first exception applies when a guest is forced to consume alcohol, and the second exception applies when the host falsely represents that beverages served did not contain alcohol. It does not appear that either of these exceptions apply to your situation, and you would be immune from liability for damages to the neighbor’s fence and other possible claims by the intoxicated party guest. While you may not be held liable for damages resulting from an intoxicated party goer, as a host of a party involving alcohol you should still be aware of your guests’ drinking. Injuries can occur from falls, fights, and vehicle crashes when someone drinks too much, planning ahead and serving alcohol responsibly will give you a better chance of keeping your guests safe (and other people in your community).
RETURNING GIFTS CAN BE TRICKY Q: HE GUY AND I BROKE UP RIGHT AFTER CHRISTMAS. I WANT TO RETURN EVERY GIFT HE AND HIS CRAZY FAMILY GAVE ME. A: Gift returns can be tricky especially a refurbished or previously owned IPhone. You are in luck though as many retailers and carriers have begun offering some sort of “sell your iPhone” deal in exchange for a new iPhone or change of carrier. You can also sell your item on Ebay, which may result in more cash than going through a retailer or carrier. Or there is always the good old fashioned “for sale by owner” technique, try posting a sign at your work or post it on your social media account. As for your other gifts, it depends on the condition of the packaging, where the item was purchased, and what it is. Online shopping makes returning gifts more difficult as well. If the item is personalized or perishable, it will not be returnable. You will need a gift receipt, original unopened packaging, and/or the tags still on the item. You will also need to know where it was purchased, which could make things a little awkward between you and the gift giver. Many retailer returns policies are extended and may be more lenient over the holidays, but time is of the essence. If all else fails you can always re-gift or donate to charity! Some people may drink more if they are given unlimited access to free booze. o Avoid serving shots or doubles. Don’t allow drinking games or contests.
