GENERAL COUNSEL

PAYMENT OF PROPERTY TAXES SHOULD BE ADDRESSED AT CLOSING Q: A FEW YEARS AGO, MY WIFE AND I BOUGHT A HOUSE NEAR LAFAYETTE. THE TAXES FOR 2013 WERE SUPPOSED TO BE PAID, AND THE TAXES FOR 2014 WERE SUPPOSED TO HAVE BEEN PRO-RATED AS OF THE DATE OF CLOSING. WHEN WE RECEIVED OUR 2015 TAX BILL, IT INCLUDED THE 2015 TAXES, AS WELL AS A LATE FEE. WHAT WOULD YOU SUGGEST TO BE THE BEST COURSE OF ACTION TO RESOLVE THIS? A: If you bought your home during the middle of 2014, what you said about the taxes being pro-rated makes sense. You should have worked out who owed what and to whom at the closing. And, whatever agreement you reached regarding the taxes should have been reflected on the Settlement State and on the Cash Sale.

Unless a closing takes place very close to the end of the year, taxes for the current year are usually pro-rated as of the date of closing. Typically, the seller pays a portion of the taxes, in advance, at closing, and the buyer gets a credit for what the seller pays. When the end of the year comes, the buyer is responsible for paying the taxes. For example, if your closing took place on October 31, 2014, normally the seller would have paid the taxes for January through October (approximately 84% of the total owed), and you would have been responsible for the taxes for the months of November and December. If the closing took place during December, it is possible that the closing attorney collected for the taxes at closing, and paid them directly, on your behalf, to the tax assessor. However, this would have also been reflected on your Settlement Statement. You have to review the paper work from the closing to see who owed what and who should have paid the tax bills. Once you have this information, you can determine how to proceed. If you don’t have a copy of the Settlement Statement, the attorney that did your closing should be able to provide you with one.

If they were supposed to be paid out of the closing proceeds, you need to contact the closing attorney and see what happened. It may have just been an oversight. WHEN IT CAME TIME FOR US TO MOVE IN, MY WIFE IMMEDIATELY NOTICED THAT THE WASHER AND DRYER, WHICH WERE EXPENSIVE AND ALMOST

NEW, HAD BEEN REPLACED BY THE SELLERS WITH AN OLDER SET. THEY OLDER SET WORKS, BUT THEY’RE NOT WHAT WE THOUGHT WE WERE GETTING. IS THERE ANYTHING WE CAN DO ABOUT THIS? A: Generally, appliances, be they a washer, dryer, or a refrigerator, are considered personal property. This means, that they are not part of the house itself and not automatically included in the sale. However, it is not uncommon for sellers to include at least some of the appliances in the sale. Oftentimes, they just don’t want the hassle of moving them, or their new home already has appliances. If the buyers and sellers agree that some or all of the appliances are to be included in the sale, it should be specifically stated in the purchase agreement. Although model or serial numbers aren’t included in the purchase agreement, the industry standard is that the appliances that are there when you’re looking at the house, are supposed to be the ones there after the house becomes yours. Unfortunately, the key is, do you have proof that the newer appliances were there when you and your wife initially looked at the house? Photos are ideal for this, but oftentimes buyers don’t take photos. I would suggest that any buyer, who is seriously considering making an offer, spend a few bucks on a disposable camera, and take pictures of the inside and outside of the house. This is an inexpensive way to document the condition of the house in case something like this happens later on. If you had an inspection, there is a possibility that the inspector noted the condition and/or type of appliances. And, most appraisers take pictures of the home during the appraisal process, so there is a chance that the washer and dryer are included in one of the appraiser’s pictures. Although your seller is technically in agreement with the sales contract, the appliances you got are probably worth a lot less than the newer ones, which means you didn’t get what you paid for. The real question is, however, how should you handle the situation? If no real estate agents were involved, you will have to handle the problem yourself. To start, you should bring this up directly with the seller, verbally or in writing, and request a resolution. If you had a real estate agent, by all means, contact them and ask them to help. This is one of the reasons you hire them. If the seller refuses to resolve this issue amicably, and you are set on pursing it, you may have to take this matter to small claims court. Your agent will be of valuable help to you there, and ultimately, could help bring this matter to a successful resolution. Good luck!
