A: When having real estate appraised, it is important to hire a knowledgeable and educated individual who has experience in the all aspects of the field. Generally, professional real estate appraisers should have a formal education in real estate, training in the principles of valuation, experience in buying and selling real estate, extensive knowledge of the levels of value, and a good working knowledge of retail values.

Another good way to find a good appraiser is to ask a reputable lender who they suggest. Lenders often have a list of qualified appraisers and they should be able to provide you with current information on their education and experience. That way, you can look at their qualifications and experience and decide who you want to go with. When calculating the value of your home, appraisers take into consideration numerous factors. To start, they consider general data about the region you live in. This includes things like the geographic location of your home, the climate, educational, health care, and religious facilities, public utilities, sports and recreation, arts and entertainment, shopping centers, retail stores, the amount and kind of businesses and industries that are near by, and the road systems. Social, economic, governmental, and environmental forces can also have an impact on the value of your home. Appraisers also look at specific information and the characteristics of your home to determine its value. They typically examine the size and shape of your lot, the streets and access roads to the property, utilities (water sewer, gas and electric), and whether or not the neighbor hood has curbs, sidewalks, paved roads, and signs.

IF THINGS DON’T WORK OUT. A FRIEND OF OURS SUGGESTED FORMING AN L.L.C. WHAT EXACTLY IS AN L.L.C. AND WHAT ARE THE BENEFITS OF AN L.L.C. OVER A CORPORATION OR A PARTNERSHIP? A: A Limited Liability Company, commonly referred to as an L.L.C., is an unincorporated form of a business organization. It is similar to a general or limited partnership in some ways, but unlike a partnership, members of an L.L.C. are shielded from liability to the same extent stockholders of a corporation are insulated from the corporation’s debts and obligations. Without knowing what kind of business you and your wife are contemplating, it is virtually impossible for me to tell you what type of business entity would be best for you. However, I can give you some general information about L.L.C.s in Louisiana. Under Louisiana L.L.C. law, an L.L.C. is formed when an Initial Report and the Articles of Organization are filed with the Secretary of State. The Secretary of State’s filing fee is $75.00. Unlike a partnership, which has partners, and a corporation, which has shareholders, an L.L.C. has members. A member of an L.L.C. is not liable for the obligations or debts of the L.L.C. solely by virtue of being a member of the L.L.C. In Louisiana, you can have an L.L.C. with just one member, or you can have multiple members. Single member L.L.C.s are usually disregarded for federal and state (Louisiana) income tax purposes. For a L.L.C. with more than two members, unless the L.L.C. elects otherwise, it will be treated like a partnership for federal and state income tax purposes (at least in Louisiana). As a pass-through entity for tax purposes, an L.L.C. is generally more advantageous for closely held businesses than an S-Corporation. Louisiana L.L.C. law governs the internal affairs of an L.L.C., however, the members can enter into an Operating Agreement that controls the operation of the L.L.C. Some L.L.C.s have very general Operating Agreements while others have very specific Operating Agreements. I would certainly recommend that any Operating Agreement be in writing because if it is not in writing, Louisiana L.L.C. law establishes the relationship between the parties. Also, if the Operating Agreement fails to address a particular issue, Louisiana L.L.C. law governs. Unless otherwise specified (in the Articles of Organization and/or the Operating Agreement), each member has one (1) vote. And, unless the Articles of Organization and/or Operating Agreement specify otherwise, an L.L.C. is managed by all of its members. You can have a manager managed L.L.C., where one or more individuals are appointed to act on behalf of the L.L.C., and conduct its day to day business affairs, but this should be spelled out in your Operating Agreement. Generally, if one member of an L.L.C. dies, their interest is transferable, however, their successor does not become a member without the unanimous consent of the other members of the L.L.C., unless provided for otherwise in the Operating Agreement or the Articles of Organization. To determine what type of entity is best for you, you should consult an attorney with experience in business and commercial litigation.
