A: A short sale can a reasonable alternative to foreclosure because the lender will likely lose less money in a short sale than if the property is foreclosed on. Depending on the agreement between the lender and the borrower, there may also be a deficiency owed by the borrower and the lender is not prevented from pursuing the borrower for the difference between the short sale and the amount owed by the borrower.

A short sale can negatively impact your mother’s credit if it is reported by the creditor, as it is a negotiation resulting in a reduction of the amount a borrower (your cousin) owes toward a debt. Lender’s guidelines might reject lending to a borrower who has obtained a short sale in the past. However, new Fannie Mae guidelines in 2016 allow a person who has sold a home as a short sale to re-apply for a mortgage in four year with a 10% down payment, or if you can show extenuating circumstances, you may be able to get a loan after just two years. FHA loans may be available after just one year. One the other hand, if a home is foreclosed on there is usually a seven year waiting period to re-apply for a mortgage, unless there are extenuating circumstances. These times periods are not guaranteed, as they can be changed by the bank, so be sure and ask the loan officer for clarification. An upside to the short sale is that the seller is in control of the sale rather than the bank as would be the case in a foreclosure. So your mother will have some say so on what happens. Your mother should be very clear about the particulars of the short sale, including whether or not a deficiency will be owed following the sale of the property. Good luck!

Q: ABOUT 8 YEARS AGO, I PURCHASED A HOUSE AND SOME LAND IN RURAL LAFAYETTE PARISH. AT THE CLOSING, I AGREED TO ALLOW THE SELLER TO RESERVE THE MINERAL RIGHTS AFFECTING THE PROPERTY. I AM NOW PREPARING TO SELL THIS PROPERTY TO A THIRD PARTY. I AM NOT SURE THAT I UNDERSTAND WHAT MINERAL RIGHTS ARE, BUT WOULD LIKE TO RESERVE THEM IN THE SALE. PLEASE HELP. A: Unfortunately for you, the mineral rights are not yours to reserve. Therefore, you cannot lawfully reserve these rights in a sale of your property to the third party. A mineral servitude is a right to enjoy land belonging to another for the purpose of exploring for and producing minerals. When you purchased your property approximately seven years ago, you created a mineral servitude in favor of your seller, because at that time your seller reserved the right to explore for and produce minerals contained in property that you own. Mineral servitudes normally expire if they are not used within ten years of their creation. Assuming no mineral exploration has occurred on the property, we know the mineral servitude on your property still exists, because 10 years have not passed since you purchased the property. The mineral servitude will remain in favor of your seller for three more years. If you still own the property when the 10 year expiration period ends and no one has used the servitude to explore for minerals, the mineral rights on your property would automatically “revert” and return to you. Louisiana law characterizes this return of mineral rights as a “reversionary interest” in the mineral rights, and your entitlement to recapture the mineral rights upon expiration of the prescription period is characterized as an “expectancy in the extinction of a mineral servitude.” Under Louisiana law, an expectancy interest in the extinction of the mineral servitude on your property cannot be conveyed to a third party or reserved. Meaning, even if your buyer agrees to let you reserve the mineral rights, Louisiana law prohibits you from doing so. Only an owner of mineral rights may reserve them in a sale of real property.
