You don’t need to spend a lot of money on new appliances or significant renovations to show your home that you care. There are many simple ways to show your home some love. Here are a few suggestions.

House Hunters Episode Featuring Local Couple Premieres Monday

For the first time, an Acadiana couple will appear on an episode of HGTV’s “House Hunters” that premieres Monday, Feb. 8 at 9 p.m. Dr. David and Nancy Fontenot will be featured as they search for a Lafayette home with the help of a local REALTOR, Carolyn Groner with Keller Williams. The wildly popular show follows a simple format: in each episode, homebuyers tour three potential homes, then choose their favorite. HGTV producers connected with Groner with the help of interior designer Monique Breaux of Posh Interiors, who has been featured in several HGTV programs. Groner said the Fontenots immediately came to mind. “I have been friends with David and Nancy for years,” said Groner. “They are a fun couple with very strong personalities and opinions.” Nancy Fontenot said she and her husband were planning to move from New Iberia to Lafayette. “Although we love New Iberia and still have strong connections there, we wanted to be even closer to family.” Once the Fontenots selected a home, they reached out to Groner ’s husband to help them complete the sale. GENERAL COUNSEL UNSATISFACTORY INSPECTION MAY BE ENOUGH TO BACK OUT OF DEAL

HOMEOWNER’S ASSOCIATION SLOW TO RESPOND TO PROBLEMS

Q: MY WIFE AND I RECENTLY SIGNED A PURCHASE AGREEMENT ON AN OLDER HOME HERE IN LAFAYETTE. WE ARE GOING TO HAVE IT INSPECTED PRIOR TO CLOSING. IF THE INSPECTION IS NOT SATISFACTORY, CAN WE BACK OUT OF THE DEAL?

Q: I OWN A TOWNHOUSE HERE IN LAFAYETTE AND IT IS CURRENTLY FOR SALE. A FEW MONTHS AGO, I DISCOVERED A LEAK IN THE UPSTAIRS BEDROOM. I HAVE NOTIFIED THE HOMEOWNER’S ASSOCIATION AND THEY ARE WORKING WITH ME TO GET IT FIXED, BUT IT’S SLOW GOING AND THE DAMAGE IS ONLY GETTING WORSE. CAN I JUST HAVE THE LEAK REPAIRED MYSELF AND SEEK REIMBURSEMENT FROM THE ASSOCIATION?

A: It depends. If your purchase agreement included an “inspection contingency clause” and set forth a maximum amount of repairs you would pay for, and the inspection reveals that more repairs than agreed upon are necessary, you should be able to get out of the deal.

Typically, small problems, like leaky faucets, loose light fixtures or doors that don’t close properly, can be fixed rather easily by the seller. More substantial problems, however, like a defective heater or water damage require more substantial repairs and probably require a professional. If your purchase agreement states that you agree to pay for repairs up to a certain amount (i.e. $1,000) and the inspection reveals that the necessary repairs exceed that amount (i.e. the air conditioner doesn’t work properly or the roof needs to be repaired, etc.) you can probably back out of the contract. To be sure, you need to carefully review the language of your purchase agreement. Some purchase agreements include language allowing the parties to renegotiate if the necessary repairs exceed a certain amount, or allow the seller to pay the difference. If after reading your purchase agreement you are still not sure if you can back out, you should consult an experienced real estate attorney to assist you.

A: That depends. Oftentimes, the roof of a townhouse/condo is common property and it is the responsibility of the homeowner’s association to maintain it. Whether or not you can make the repairs yourself and then seek reimbursement from the association probably depends on the association’s governing documents: its condominium declaration, covenants, conditions, restrictions, and bylaws. There should be something in these documents that addresses emergency repairs and the documents might also outline how the repair is to proceed. Typically, these rules will also stipulate whether you can make the repair yourself and then withhold that amount from your next dues payment, or whether the association must make the repairs. First, if you have not already done so, you should notify the association in writing of your problem. Be specific. You should include information about where the leak is and when it started. You should also state that the leak needs to be repaired promptly because it is getting worse and if it is left unchecked, it will necessitate additional repairs. If you think the association is stalling, let them know that you think they have had ample time to fix the problem and that if they don’t repair it within a short period of time, you will have the repairs done yourself and might deduct the amount from you association dues. This should get them moving in the right direction. Good luck.
