DECISIONS MADE IN MY YOUTH HAVE COME BACK TO HAUNT ME Q: I AM TRYING TO BUY A HOUSE, AND JUST FOUND OUT THERE IS A JUDGMENT AGAINST ME FROM AN OLD CREDIT CARD DEBT FROM YEARS AGO. I HAD HONESTLY FORGOTTEN ALL ABOUT IT! OOPS! WHAT DO I DO?

A: A creditor likely obtained a judgment in its favor, adverse to you on the debt owed on the credit card. To ensure payment of the debt, the judgment was recorded in the mortgage records which fived the creditor the right to be paid from the proceeds of the sale of your property. This is called a judgment lien. In Louisiana, the judgment lien attaches to the debtor’s real estate (immovable property) such as a condo, house, land, or an interest in property. To satisfy the judgment and cancel the lien, the amount of the judgment must be paid. You did mention that the judgment was an old credit card debt from many years ago. Under Louisiana law, the judgment lien only affects your property for 10 years. Therefore, if it has been ten years or more since the judgment was recorded, you may request cancellation of the judgment without paying the debt. This can be done by written request to the Recorder of Mortgages through the Clerk of Court in the Parish where the mortgage was recorded. Many clerk’s offices have a form that can be completed to obtain cancellation of the judgment. The form for Lafayette Parish can be found on www.lpclerk.com. Good luck!
Q: MY FIRST COUSIN JUST PASSED AWAY WITHOUT A WILL. SHE WAS AN ONLY CHILD WITH NO CHILDREN OF HER OWN AND NEVER MARRIED. HER PARENTS HAVE LONG BEEN DECEASED. I AM HER CLOSEST LIVING RELATIVE, AND TOOK CARE OF HER DURING HER ILLNESS. SHE DID NOT HAVE A LOT OF THINGS WITH MONETARY VALUE BY THE TIME SHE DIED. SHE HAD A CAMPER, AND A LITTLE BIT OF MONEY IN HER CHECKING AND SAVINGS ACCOUNT. I’M UNSURE OF WHAT TO DO NEXT. A: It sounds as though your cousin’s estate may qualify as a small estate under Louisiana law. If that is the case, then her assets/property can be transferred through a small estate affidavit. In order to qualify for a small estate, she must have died without a will and with less than seventy-five thousand ($75,000.00) in property. Until recently, if the deceased owned real property, i.e. real estate, then the estate did not qualify. However, the law was revised in 2011 to remove any distinction between real estate and other assets as long as the gross value of her estate is less than $75,000.00. Louisiana law has special rules about who must sign the Louisiana Small Estate Affidavit. These rules differ depending on the decedent’s family situation. From the facts you provided, the affidavit must be signed by two adult heirs. If she had no other adult heirs, other than you then you must sign along with any other person who has knowledge of the facts listed in the small estate affidavit. As long as your cousin’s estate meets the definition of a small estate (less than $75,000) and qualifies for distribution by a Louisiana Small Estate Affidavit, the property can be transferred without having to open a succession in court. You should consult with an attorney to confirm the estate qualifies and can be transferred via an affidavit. Sorry to hear of your loss and good luck!
