The 5th Annual Acadiana Commercial Outlook was held on April 2nd at LITE. Over 180 real estate professionals and community leaders gathered to view projected forecast on the commercial market for the remaining year.

GENERAL COUNSEL POWER OF ATTORNEY CAN BE REVOKED Q: MY MOTHER RECENTLY ENTERED A NURSING HOME AND EXECUTED A POWER OF ATTORNEY GIVING MY BROTHER CONTROL OF HER FINANCIAL DECISIONS. SHE’S GETTING BETTER NOW AND WANTS TO CHANGE THE POWER OF ATTORNEY. HOW DOES SHE NEED TO GO ABOUT DOING THIS? A. Your mother can revoke the existing power of attorney that she gave to your brother by signing a separate document called a Revocation of Power of Attorney. Then, your mother can sign a new power of attorney – if she wants - that contains different terms or the name of a new agent and power of attorney. Please remember however, that simply signing a new power of attorney will not automatically revoke the existing one.

Also, if your mother filed the existing power of attorney with the parish Clerk of Court, she will need to file the revocation with the same parish Clerk of Court. By filing the revocation, it makes it very difficult for the agent named in the revoked power of attorney to conduct real estate transactions on your mother’s behalf. Any good closing attorney will check to make sure a power of attorney is still valid before relying in it. If your mother is still uneasy about the old power of attorney being out there and wants to make doubly certain that the existing power of attorney is never used, she should contact the banks, brokerage firms, and other institutions where she does business and let them know the power of attorney has been revoked. It also can’t hurt to send each of them a letter along with a copy of the revocation, letting them know the power of attorney is no longer valid.

STUDENT-LOAN DEBT PROBABLY WON’T CAUSE LENDERS TO REJECT YOUR HOME LOAN APPLICATION Q: I WOULD LIKE TRY TO BUY MY FIRST HOUSE. I HAVE A GOOD JOB, BUT AM WORRIED THAT I WILL BE TURNED DOWN FOR A LOAN BECAUSE I HAVE A LOT OF STUDENTLOAN DEBT. WILL LENDERS REJECT MY LOAN APPLICATION FOR THIS REASON? A: If you have a college degree and a good job, you are probably in better shape than you think. To be sure though, you will have to ask a loan officer. Lenders usually look at a person’s total debt and how that debt is being handled. If you have been paying your student loan payments on time, you will be in a much better position than if you are delinquent on them. Lenders also look at the type of debt a person has. Student loans and auto loans are considered installment debt, meaning you have a certain amount of time to pay the loans off – and normally, the amount of the debt is not going to increase over time. A credit card or a line of credit on the other hand, is commonly referred to as revolving debt, meaning the balance can go up and down over time. Generally, lenders look more favorably on student loan debt than credit card debt. This is because even though you may have been paying your credit cards down, you could always run those balance back up again. If you have credit cards with high credit limits, and you are not using them, it wouldn’t hurt to get your credit limit reduced before applying for a loan. With student loans, the payments and the interest rate are usually low compared to the amount borrowed. Student loans are also usually financed over a long period of time – ten years is common. With such a low interest rate and a long period of time to pay off the debt, they may not hinder your chances of getting a loan as much as you think. Typically, lenders are interested in the amount of the monthly payment, not the entire amount of the loan. Even if your student loans keep you from getting a low interest mortgage, you may still qualify for one with a slightly higher interest rate. And, once you have paid your student loans down some, you could always refinance.
