Home Financing 101 for First-Time Home Buyers By David Anderson, President Acadian Home Builders Association With spring in full swing, many first-time home buyers are gearing up to become home owners. While this can be exciting, many may also be stressing about the financial burden of homeownership. Advance preparation is key when getting ready to buy a home. You need to decide how much to spend on your home and which type of mortgage will work best for you, as well as understand the settlement process. Before you visit a sales office, model home or open house, you should take advantage of the many sources that can help you get prepared, and take some steps to ensure you’re in the best possible financial situation. Be Realistic About What You Can Afford Figure out what you can comfortably pay on a monthly basis. Write down all your monthly expenses including loan payments, utilities, insurance, credit cards and don’t forget food, clothing and entertainment expenditures. When determining the monthly payment you can afford, remember that in addition to the monthly principal and interest, you will also be paying into escrows for property taxes, hazard insurance and possibly mortgage insurance or a home owners association assessment. Many real estate-focused websites have mortgage calculators that are a great way to figure out what your monthly payments would be based on current interest rates and down payment amounts. Pay Down Your Debts Debt that you carry on your credit cards will limit the amount of a loan a lender will be willing to give you. Lenders typically want to see a total debt service ratio that is less than 40 percent of your monthly income. Get Objective Advice Attend a first-time home buying seminar or talk to a credit counselor who does not work for a lender. The U.S. Department of Housing and Urban Development (HUD) offers free housing counseling and seminars; visit www.hud. gov or call HUD’s interactive voice system at: (800) 569-4287 for more information. Pre-Qualify for Your Home Mortgage To ensure that the financing process goes smoothly, buyers should consider pre-qualifying for a mortgage and having a financing commitment in place before shopping for a new home. Buyers also may find that some home builders have arranged favorable financing for their customers or offer financial incentives. Pre-approval also enables you to quickly make an offer when you find a home, and is attractive to sellers who are considering multiple offers. A lender’s pre-approval would still be subject to a final verification of your credit and a satisfactory appraisal. Qualifying for a mortgage and saving up for a downpayment remain primary obstacles to homeownership. Fannie Mae and Freddie Mac have attempted to address this issue by putting in place low-downpayment mortgage programs geared primarily toward the first-time home buyer market. This allows more creditworthy borrowers who lack the funds for a large downpayment to obtain a home mortgage.

FAIR HOUSING ACT PROTECTS PERSONS WITH DISABILITIES Q: I AM RECENTLY WHEEL CHAIR BOUND BECAUSE OF SEVERE ARTHRITIS. I RENT A CONDO IN LAFAYETTE, AND MY LANDLORD INDICATED THAT HE WILL HAVE TO INCREASE MY RENT IN ORDER TO MAKE MY CONDO WHEELCHAIR ACCESSIBLE. CAN HE DO THIS? A: Federal laws define a person with a disability as “any person who has a physical or mental impairment that substantially limits one or more major life activities; has a record of such impairment; or is regarded as having such an impairment.” As a general rule, a physical or mental impairment includes hearing, mobility and visual impairments, chronic mental illness, AIDS, and mental retardation that substantially limits one or more of a person’s major life activities. Major life activities include things such as walking, talking, hearing, seeing, breathing, learning, performing basic manual tasks, and caring for oneself.

Regardless of whether you live in private or public housing, as a person with a disability, you have some basic rights. One, it is unlawful for a housing provider to refuse to rent or sell to a person simply because he or she has a disability. Two, a landlord may not impose different application or qualification criteria upon people with disabilities, nor may they charge a disabled person higher rental fees or sales prices. And three, a disabled person is entitled to the same rental or sales terms and conditions as people who are not disabled. For example, a landlord may not refuse to rent to you simply because he/she is uncomfortable with your disability. This would violate the Fair Housing Act because it denies a person housing solely on the basis of their disability.

Federal law also requires housing providers to make reasonable accommodations for people with disabilities. As a general rule, a reasonable accommodation is defined as a change in the rules, policies, practices, or services so that a person with a disability will have an equal opportunity to use and enjoy the house/apartment or common space. This does not however mean the housing provider has to undertake an undue financial or administrative burden to accommodate a disabled person. An example of a reasonable accommodation might be the housing provider agreeing to provide a tenant who is mobility impaired with a reserved parking space in front of their apartment, even though the rest of the tenants don’t have reserved parking.

Also, federal law requires housing providers to allow people with disabilities to make reasonable modifications to their house or apartment. For example, they might have to allow the disabled person to install a ramp to get into the house, or to install grab bars in the bathroom. BOARD MEMBER SHOULDN’T GET AWAY WITH NOT PAYING HER HOMEOWNERS’ ASSOCIATION DUES Q: ONE MEMBER OF HOMEOWNER’S ASSOCIATION IS SEVERAL MONTHS BEHIND IN PAYING HER HOMEOWNERS’ ASSOCIATION DUES. THE BOARD NEVER LETS OTHER HOMEOWNERS GET AWAY WITH LATE PAYMENTS. IS THERE ANYTHING I CAN DO? A: There is not particular law enforcement agency that enforces homeowners’ association rules and regulations because breaking them is not a criminal issue. Instead, it’s a civil issue. If the board of directors is not doing what it’s supposed to be doing, it’s the association owners who need to resolve the situation. This means you need to carefully read your association’s bylaws to determine the duties, obligations and authority of your board of directors. The association’s bylaws will tell you what’s supposed to happen when an owner falls behind on paying his dues. Once you know what the board’s duties and obligations are, you should write a letter to the board demanding that it follow its own rules and regulations in dealing with the delinquent board member. As a general rule, this means the board will have to inform the person that her dues are delinquent and must be paid, otherwise her account will be turned over to an attorney or collection agency for collection. Of course, if the past-due board member has extenuating circumstances (i.e. serious illness, job loss, etc.) the board probably has some discretion to give her some leeway – at least for a short period of time, until her circumstances improve. This might include working out a payment plan, if she can’t pay the delinquent dues all at once. But if she is able to pay, and just doesn’t, then there’s really no excuse for letting her slide. If you’re uncomfortable tackling this issue by yourself, consider gathering support from other homeowners. If the situation is as you describe, I suspect other members would feel the same way you do.
