Now Is a Great Time to Buy a Home

A

s America’s home builders celebrate National Homeownership Month in June, lower interest rates and home prices are boosting housing affordability across the country. According to the latest NAHB/Wells Fargo Housing Opportunity Index, 66.5% of new and existing homes sold between January and the end of March were affordable to families earning the U.S. median income of $65,800. This follows a similar improvement in affordability at the end of 2014, making now a great time for consumers to buy a home. While today’s historically low interest rates are helping home buyers find affordable housing options, it’s important to keep in mind that interest rates are sensitive to market forces and can change quickly. There’s no indication that rates will suddenly surge upward, but even a slight rate increase can push monthly payments to the point that a buyer might miss out on their first choice for a new home. First-time home buyers also can find help qualifying for a mortgage. Fannie Mae and Freddie Mac recently announced new low-downpayment mortgage programs geared primarily toward the first-time home buyer market. These lenders will now offer mortgages with 3% downpayments, allowing more creditworthy borrowers who lack the funds for a large downpayment to obtain a home mortgage.

Benefits of Homeownership As housing affordability continues to improve, now is a great time to discover the many benefits of homeownership, including the fact that homeownership is a primary source of net worth for many Americans, and is an important step in accumulating personal financial assets over the long term. Acadiana was thankfully insulated from the housing market downturn a few years ago. Although property values have declined in many other markets, Americans still have more than $10.8 trillion of equity in their homes. For most families, home equity represents the largest share of net worth. Homeownership strengthens communities as well as families. Home building increases the property tax base that supports local schools and communities. When a family owns their home, it is an asset that has a direct impact on their financial security and future. People are more likely to take care of things they own so they remain valuable. And a home’s value is determined by how well it is maintained as well as by the condition of the neighborhood it is located in. So, home owners have incentive to spend their time and resources improving their neighborhood, even if it is just to protect the value of their investment. Homeownership builds stronger communities, provides a solid foundation for family and personal achievement and improves the quality of life for millions of people.

The REALTOR® Association of Acadiana (RAA) was one of over 800 local associations to attend the National Association of REALTORS® annual Legislative Conference in Washington DC May 11th-16th. RAA was represented by Lori McCarthy, 2015 President, Allen Duhe, President elect, Carole Horn, RAA member, Eloise Gauthier, ACPAC Chair, and Susan Holliday, CEO for the REALTOR® Association of Acadiana. Each year RAA members take an active role to advance the real estate industry, public policy and issues facing REALTOR® Members in Louisiana. During the week-long conference McCarthy, Duhe and Holliday met with U.S. Senators David Vitter and Bill Cassidy and U.S. House of Representative member, Charles Boustany. During these meetings the importance of Flood Insurance reform, maintaining mortgage interest deductions and the importance of Fannie May and Freddie Mac in securing homeownership. Mike Huckabee, former Governor of Arkansas and 2016 Presidential candidate informed attendees about the current political landscape in his presentation on “ The Beltway to Beyond”. “As the leading advocate for homeownership and real estate issues I was grateful to meet with some of our country’s leaders to make sure critical issues in the Louisiana real estate industry remain at the top of their priorities”, said Lori McCarthy, 2015 RAA President. “ It was an honor to represent the 1250 members of the REALTOR® Association of Acadiana for these important meetings in our nation’s Capital”.

SALE OF PROPERTY FOR A VERY LOW PRICE MAY PROVE PROBLEMATIC Q: I HAVE FOUND A PIECE OF PROPERTY FOR SALE FOR A VERY LOW PRICE, WHICH I AM CONSIDERING PURCHASING. HOWEVER, I AM CONCERNED ABOUT WHETHER THERE IS ANY WAY THE SELLER COULD GO BACK ON THE DEAL AFTER THE SALE. DO YOU KNOW IF THE SALE COULD BE REVOKED AFTER THE FACT DUE TO THE LOW PRICE?

A: If you purchase the land for less than half its fair market value, the seller may rely on a principle called lesion in demanding that you either return the land to him or supplement the purchase price. Lesion is a remedy available only to sellers of immovable property, who have sold their property for less than half of fair market value. Though the seller may be able to “go back on the deal” you should keep in mind that it is up to you, as the buyer, whether to supplement the purchase price or return the land to the seller. Also, please keep in mind that lesion must be determined by ascertaining the value of the land at the time of the sale. For example, let’s assume that the land in question was worth $40,000 at the time of the sale, and is worth $80,000 six months after the sale. Let’s also assume that you paid $35,000 for the land. Under this hypothetical situation, the seller would not be entitled to claim lesion, since the land was sold for over half its fair market value at the time of the sale. Also, a claim of lesion is subject to a one year peremptive period. This means that the seller only has one year to bring an action under a theory of lesion. In other words, if the seller does not bring an action for lesion within one year of the sale, he will lose the right to do so.

Q: I RECENTLY PURCHASED A HOME IN MY NAME, BUT SINCE I AM ENGAGED, I’D LIKE TO TRANSFER AN OWNERSHIP INTEREST IN THE PROPERTY TO MY FIANCEE. IS THERE ANY PROBLEM WITH THIS, AND IF NOT, HOW WOULD I GO ABOUT GETTING THIS DONE? A: Before you transfer any interest in the property, I suggest that you have an attorney review the mortgage which you executed in connection with the purchase of the home. Many mortgages contain provisions which state that you must obtain permission from your lender before transferring an interest in the mortgaged property to anyone else. The referenced provisions also typically provide that if you do transfer an interest in the property without the lender’s permission, you could be subject to certain repercussions, such as acceleration of the loan amount. In other words, the mortgage may give the lender a contractual right to demand that you pay the entire amount of your loan back immediately, if you transfer an interest in the property without the lender’s consent. Once the lender’s written permission is obtained, you could transfer an interest in the property to your fiancee in a number of ways. Many people in your position simply donate an interest in the property, meaning that you would be giving your fiancee an interest in your home without receiving monetary compensation from her in return. Alternatively, you could sell her an interest, in which case you would receive compensation from her in return for the transfer. An attorney familiar with real estate matters should be able to prepare whatever documents will be necessary for the transfer. Finally, I suggest you consult with a CPA or other tax professional before transferring the interest in the home to determine what tax consequences, if any, may result from the proposed transfer. This person should also be able to give you advice regarding the best means of transferring the property, so that undesirable tax consequences are avoided.
