GENERAL COUNSEL DON’T OVERLOOK LOCAL BUILDING CODES Q: HOW DO BUILDING CODES WORK? A: Building codes are usually established by local governments to set minimum public-safety standards for building design, construction, quality, use, occupancy, location, and maintenance. There are also specialized codes for things such as plumbing, electrical, and fire. These specialized codes usually involve separate inspections and specialized inspectors. A building permit and a certificate of occupancy must be issued before a building can be used. Some local governments require that these permits and/or certificates be displayed in the building during construction and even after construction is complete.

During construction or remodeling, housing inspectors must make periodic checks at key points. Building codes are usually enforced a number of ways (i.e. denying permits, denying occupancy certificates, or by imposing a fine upon the owner). In addition to new constructions, building codes also cover most major remodeling projects. So, if you are buying a house that was recently remodeled, you might want to ask for proof of the permits involved before you purchase it. That way, you can avoid future liability for any fines assessed against the owner during the remodeling process.

UPPER. I AM INSPIRED TO START MY OWN COMPANY DOING WHAT THEY DO ON THE T.V. SHOW. IS A “FIXER UPPER” REALLY WORTH THE MONEY AND WORK? A: A fixer upper is basically a house that has been poorly maintained and has a lower market value than other houses in the immediate area. Whether or not it is a good investment depends on a few things. Surprisingly, you can find fixer uppers in most neighborhoods, even the wealthier ones. The hard part is determining whether the property you are interested in is a wise investment. First, you need to figure out what an average house in the same neighborhood sells for. You also need to get an idea of what the most desirable houses in the area sell for and what they are like. Some experts suggest that if it is your first time buying a fixer upper, you start with a home that only needs cosmetic work (i.e. new paint, carpet, window coverings, etc).

Some fixer uppers require a lot more than cos-

metic work, and the necessary repairs can be too costly to make the investment a wise one. You should avoid run-down houses that need major structural repairs. A house price that looks too good to be true probably is, and a smart buyer will find out why the house is priced so low before making an offer.
