Homeownership Tax Incentives Still Important to Americans By: President of Acadian Home Builders Association

As House and Senate lawmakers consider slashing tax breaks as part of their tax reform process, they should listen to the voters who put them in office and they will hear a loud and clear message: Americans overwhelmingly believe the mortgage interest deduction is an important middle-class tax provision that is worth keeping. The latest poll documenting this strong belief is a United Technologies/National Journal Congressional Connection Poll conducted in July 2013.

When the surveyed adults were asked how important it is to keep the mortgage interest deduction for people who own homes, 61 percent of respondents said it was “very important,” and an additional 25 percent said it was “somewhat important.”

Surveys conducted in 2011 and 2012 on behalf of the National Association of Home Builders by the Public Opinion Strategies and Lake Research Partners polling firms had similar results. GENERAL COUNSEL FROM YARD WASTE TO COMPOST Q: MY FAMILY AND I ARE PLANNING A BIG WORK WEEKEND THIS WEEKEND TO GET OUR MUCH NEGLECTED AND OVERGROWN YARD UNDER CONTROL. THERE WILL BE LOTS OF TREE TRIMMING, GRASS CUTTING, AND REMOVAL OF SHRUBBERY. DO YOU KNOW OF ANY LAW OR ORDINANCE IN LAFAYETTE REQUIRING DISPOSAL OF CERTAIN YARD WASTE, OR CAN WE JUST LOAD UP THE GARBAGE CANS? A: Sounds like you have quite a project on your hands! There is no law or city ordinance requiring that you dispose of your yard waste in a certain manner. If you live outside of the city limits, I am sure you have witnessed people burning their yard waste, which I do not recommend!

Lafayette Consolidated Government Public Works Department has a composting program. The Dean Domingue Compost Facility is located in north Lafayette Parish, and according to the LCG website, the compost facility turns “green waste” such as tree branches, grass and shrub trimmings into a nutrient rich soil additive. Sheila Prejean with Lafayette Consolidated Government (LCG) is your contact person who can answer any and all questions about composting. She advised that yard debris pick up is included in your Allied Waste garbage fee if you reside in the City of Lafayette or unincorporated Lafayette Parish. According to Ms. Prejean, the yard waste should be placed on your curb either in a pile, in an open garbage can, or grass, pine needles, shrub trimmings can be placed in black garbage bags for pick up. There is no need to contact Allied Waste for pick-up. If you have tree branches 18 inches in diameter or larger, they must be cut into 4 feet pieces or smaller. The grinder at the compost facility cannot grind larger pieces than that. If you do use a garbage can for disposal of your yard waste, it cannot be larger than 35 gallons or weigh more than 50 pounds; garbage bags cannot weigh more than 35 pounds.

RIGHTS OF SPOUSE VS. RIGHTS OF KIDS Q: MY HUSBAND AND I HAVE BEEN MARRIED FOR THIRTY (30) YEARS AND EACH HAVE GROWN CHILDREN FROM PREVIOUS MARRIAGES. WE DO NOT HAVE ANY CHILDREN TOGETHER. IF ONE OF US DIES, WHAT HAPPENS TO OUR SAVINGS, CHECKING ACCOUNTS, CARS AND CAMPER? A: Since you do not mention a prenuptial agreement between you and your husband, I assume the savings, checking accounts, cars and camper are community property. If you and your husband have not prepared wills disposing of your separate and community property then, under Louisiana law, your one-half interest in the community passes to your heirs (children) subject to your husband’s usufruct. A usufruct is your husband’s right to use the community property until his death or remarriage and vice versa. Your children and your husband’s children would be co-owners in indivision. Upon your death, your children will have to hire an attorney to probate your succession. The same will apply to your husband’s children upon his death. You and your husband are better able to resolve potential conflict that may arise upon one or both of your deaths by preparing a will. In Louisiana, there are two types of wills: the olographic will and the notarial will. The olographic will is entirely written, dated and signed by you (the testator). The notarial will requires that you declare the document is your will and you must sign each page in the presence of a notary and two witnesses. The witnesses and notary are required to sign the will as well. With the preparation of a will, you and your husband can each designate exactly how your separate and community property should be dispersed upon your death.

Ms. Prejean advises that you contact her (337) 291-5637 prior to picking up compost to make sure there is compost available, the hours for pick-up, and that you are in an appropriate vehicle. Go-big upgrades that can help a lingering home sell at last Everyone knows spring and summer are the best months in which to sell a home.
