Preparing for Your First Mortgage By Mac Gibson, President Acadian Home Builders Association

Buying your first house can be very exciting, but financing your home purchase can be overwhelming. In both cases, knowledge is power, and if you do your research and shop carefully, you will have a successful home-buying experience. Advance preparation is important when getting ready to buy a home. You need to decide how much to spend on your home and which type of mortgage will work best for you, as well as understand the closing process. Before you visit a sales office, model home or open house, you should take advantage of the many resources that can help you get prepared, and take some steps to ensure you’re in the best possible financial situation: Figure out what you can comfortably pay on a monthly basis. Write down all your monthly expenses including loan payments, utilities, insurance, and credit cards, and don’t forget food, clothing and entertainment expenditures. When determining the monthly payment you can afford, remember that in addition to the monthly principal and interest, you will also be paying into escrows for property taxes, hazard insurance and possibly mortgage insurance or a home owners association assessment. Many real estate and banking websites have mortgage calculators that are a great way to figure out what your monthly payments would be based on current interest rates and down payment amounts.

The Safety Talk You Need to Have With Clients

Keep all parties safe in a transaction by offering buyers and sellers these important tips.

1.Stow away valuables Valuables include everything from the mail left on the countertops (which may contain personal information and bank statements) to such items as jewelry, artwork, cellphones, and gaming systems. 2.Remove family photos Many real estate professionals advise sellers to remove family photos from their home. But the conversations are often framed around staging and making it so prospective buyers can imagine themselves living there. Instead focus on the safety of their family, as their variations of all people who will walk through the home. 3. Make a house safe for the buyers and the agent Turn on the lights prior to showings — whether it’s daytime or evening — so that agents and buyers can move safely through the home and not have to face

any dark unknowns. (During the initial safety check of a listing, practitioners should ensure all rooms have adequate lighting as well.) Also, sellers should make sure there are no potential hazards in their home, like loose floorboards or carpets. They don’t want to risk someone tripping and falling in their home and potentially open themselves up to liability.

5.Beware of unexpected visitors coming to your doorstep. You may need to warn your clients that when their house is for sale, they may also get some unexpected visitors who ask to see their home. Instruct your clients of the proper procedures for showings: Only real estate professionals using the lockbox should gain access to their home.

4.Keep the house locked Doors need to be kept locked at all times. A home is being presented to the public, and it may attract intruders. Talk to the home sellers about deadbolt locks and explain why they’re safer. Motion-sensor lights can be a good option for outdoor areas for added security. Windows should be checked to make sure they are locked securely.

Q: THERE IS A CANDIDATE RUNNING FOR LAFAYETTE CITY-PARISH COUNCIL, WHO I KNOW DOES NOT RESIDE WHERE HE CLAIMS TO. WHAT CAN I DO TO OBJECT TO HIS CANDIDACY?

Q: DOES A CANDIDATE FOR OFFICE HAVE TO HAVE A PERMIT TO FOR HIS POLITICAL SIGNS? ARE THERE RULES WITH REGARD TO PLACEMENT OF THESE SIGNS WHEN IT COMES TO BLOCKING MY ABILITY TO SEE THE ROAD?

A: According to the Lafayette City-Parish Consolidated Government Home Rule Charter, to qualify to run for cityparish council the candidate must be at least 18 years of age and a qualified elector of the district from which elected at the time of qualification. The Council member shall have been legally domiciled and shall have actually resided for at least one (1) year in the parish and six (6) months immediately preceding the time established by law for qualifying for office in an area which, at the time of qualification, is within the district from which elected.

You have raised a concern about the residence of a candidate. The candidate must be domiciled and resided for at least a year in Lafayette Parish, and at least for six months immediately preceding qualifications (September 8-10, 2015) have actually resided in the district that person is seeking to qualify as a candidate. Domicile is generally defined as residence plus intent to remain. Normally, a party’s uncontroverted testimony regarding intent may be enough to establish domicile, in the absence of any documentary evidence to the contrary. However, in the absence of a formal declaration, when documentary or other objective evidence casts doubt on a person’s statements regarding intent, he courts will weigh the evidence presented in order to determine domicile in fact. Some of the types of documentary evidence commonly considered by courts to determine domicile in fact include such things as voter registration, homestead exemptions, vehicle registration records, driver’s license address, statements in notarial acts, and evidence that most of the person’s property is housed at that location. Obviously, the more of these items presented by a party opposing candidacy in a given case to show lack of domicile in the district, the more difficult it will be for the candidate to overcome the plaintiff’s evidence.

A: Zoning ordinances are usually the place to look with regard to regulations related to signs. Assuming you are writing about political signs in Lafayette CityParish, our Zoning ordinance contains such regulations. Temporary political signs are regulated with regard to location. A political sign on private property does not require a permit. This applies to all areas of the City of Lafayette and unincorporated areas of Lafayette Parish. Signs cannot be placed within what is called the “sight triangle” on a corner property. The triangular area of a corner lot is required to remain unobstructed so that motorists can see. Also, no sign may be placed in a street right-of-way. If you have a particular concern with a sign blocking motorists’ view or obstructing a right-of-way, you have two options. First, you can reach out to the candidate and discuss your concerns. He or she may not realize that their sign is blocking your ability to see while driving, and will more than likely agree to re-locate the sign. If this is unsuccessful, you can contact the Lafayette Consolidated Government, Planning & Zoning Department who will address your concerns by removing the sign if it does in fact violate the above rules. Good Luck! *Don’t forget, the last day to register to vote for the upcoming election is September 23, 2015.

An action objecting to candidacy shall be commenced in a court of competent jurisdiction (in this case the 15th Judicial District Court) within seven days after the close of qualifications for candidates in the primary election. According to the Lafayette Parish Clerk of Court, the deadline to object to candidacy is September 17, 2015. If your action objecting to the candidacy of this particular person is not timely filed, then no action can be taken against the candidate based on your grounds for disqualification. Due to the time constraints, you should probably consult an attorney who can help with the filing of your action and make further recommendations after reviewing your case. Good Luck!
