ACADIAN HOME BUILDERS ASSOCIATION

AHBA & PWB Hold Annual Awards Luncheon The Acadian Home Builders Association (AHBA) and the Professional Women in Building (PWB) held their Annual Awards & Installation Luncheon on Friday, November 20th where several exceptional members were recognized with the organizations’ most distinguished awards. Also at the event, the 2016 Board of Directors and Executive Committee members were installed. During the awards portion of the program, the Professional Women in Building, a supporting organization of AHBA, granted their 2015 Woman of the Year Award to Senora Stancliff of Bradley & Moreau Real Title Co. Senora joined PWB a few years ago and immediately became involved in many aspects of the organization, and she soon accepted a position on the Board of Directors. She puts her all into the organization, volunteering at any opportunity, working events for both PWB and AHBA and helping out with community projects whenever needed. Glen Robison of Quality Plus Insurance, Inc. received the AHBA Big SPIKE Award for recruiting the most new members during 2015. Glen has been a member of AHBA for decades and has always been committed to growing the organization and promoting the building industry in Acadiana. For over ten years, he has received the Big SPIKE Award as his efforts to constantly recruit new members go unmatched. The AHBA Associate of the Year Award was bestowed upon Larry Comeaux of Acadiana Security Plus who has been highly involved in AHBA for many years. He has sat on the Board of Directors and attended countless events. His company always serves as a sponsor of AHBA’s annual golf tournament and has participated in The Home, Garden & Lifestyle Show for decades. Larry is very active in many community organizations and well deserving of the award.

AHBA & PWB Hold Annual Awards Luncheon AHBA’s coveted Builder of the Year Award was given to Doug Trahan of TMR Construction. Doug is son of L.J. and Lou Trahan and a second generation builder in Acadiana. He is on the AHBA Board of Directors and will serve as Treasurer for the association in 2016. He also serves on the Louisiana Home Builders Association Board of Directors. No matter the task, Doug can always be counted on to lend a helping hand and volunteer. He constantly and humbly gives of himself to the organization and the community. In 2014, Doug built the Home for the Holidays raffle house which raised $150,000 that year for shelter-related charities in Acadiana. Doug is currently on the leadership ladder and will be president of AHBA in 2018. Finally, AHBA awarded its highest honor, the Randolph Trappey Distinguished Service Award, to Carol Ross of Edge Communications. This award is not given every year and is reserved for those members who have gone above and beyond the call of duty both within the organization and in the community. Carol has served on AHBA’s Board of Directors for many years and has been in charge of the association’s marketing and public relations for decades. She is a constant presence at AHBA events and serves as a voice of the housing industry and small business in Acadiana. She is involved in many local organizations and has become a very recognizable public figure. AHBA truly appreciates Carol’s wisdom, expertise, and advocacy for the industry. After the awards, the 2016 AHBA Board of Directors were installed including Steve Ashy, April Becquet, Brian Blanchard, Corey Burgess, Jimmy Gremillion, Ty Greneaux, Hart Littell, Victor Manuel, Phil Melancon, Bill Schoeffler, Mark Ste. SELLER PROBABLY NOT LIABLE FOR LEAKY ROOF DISCOVERED AFTER THE SALE Q: THE PREVIOUS OWNERS OF OUR HOME HAD THE ROOF REPLACED BEFORE WE BOUGHT IT. UNFORTUNATELY, THE ROOFER DIDN’T INSTALL ENOUGH FLASHING, AND A SUBSTANTIAL LEAK HAS DEVELOPED, CAUSING THE CEILING TO BUBBLE. NEITHER MY INSPECTOR NOR I NOTICED THE FLASHING PROBLEM BEFORE I BOUGHT THE HOUSE. SHOULD I CONTACT THE PREVIOUS OWNERS ABOUT THIS? A: Yes, you should. But keep in mind, if the sale was “AS IS”, you probably can’t hold the seller legally responsible for your problem. That’s because your inspector failed to find it, which likely trumps the lack of any disclosure the seller was obliged to give you. And that obligation only existed if the seller knew of the problem. If the leak didn’t develop until recently, it is unlikely that the seller knew of the problem before the sale.

So why should you contact the seller? Because there’s a possibility that the roof has a warranty, and that it may be transferable to you. At the very least, the seller should be able to tell you who did the roof work. Once you get that information, contact the roofer to see exactly what kind of work they did, when they did it, and if there are any warranties. If nothing else, you might find that the roofer who made the mistake is willing to fix it more cheaply than another company would.

A CLOSING DATE IS NOT SET IN STONE Q: MY WIFE AND I ARE IN THE PROCESS OF SELLING OUR HOUSE. WE AGREED WITH THE BUYERS THAT WE WOULD CLOSE BY NOVEMBER 30TH AND EVERYTHING APPEARED TO BE ON TRACK, BUT A FEW DAYS AGO, WE RECENTLY RECEIVED A CALL FROM THE CLOSING ATTORNEY NOTIFYING US THAT THE CLOSING WOULD HAVE TO BE DELAYED A FEW DAYS. WHAT TYPE OF THINGS CAN CAUSE A CLOSING TO BE DELAYED? A: The closing is the last step in the home buying or selling process. The closing is where the seller receives closing funds from the buyer, and the buyer gets proof of ownership. While everyone does their best to meet the closing date, it is important to remember that many things can delay the closing. For example, the lender may discover problems with the buyer’s credit history that has to be explained. Or, the attorney may run into unforeseen delays in receiving the paperwork from the lender. There may be delays in receiving a copy of the property’s appraisal, or the inspection may reveal necessary repairs that must be done before closing can take place. The closing attorney may also discover liens or judgments against the property that have to be resolved prior to closing. And, the buyer or seller may have personal problems (i.e. work conflicts, family conflicts, etc.) that lead to rescheduling. Just remember, delays in closing don’t necessarily mean the transaction is falling apart. Most transactions do eventually close, and most problems can be straightened out in a few days. The keys are patience and flexibility. Good luck.
