A Closer Look at the Costs of Building a New Home By David Anderson, President Acadian Home Builders Association If you’re in the market for a new home, you may be wondering about the factors that contribute to the total cost of the home. The National Association of Home Builders recently published a Cost of Construction Survey, which details the various costs of building a typical new single-family home. Many of the results show that costs have remained consistent in recent years. According to the 2015 survey, the biggest single component of a home’s price is construction costs, which accounts for 62 percent of the cost. The cost of the finished lot is the second largest factor at 18.2 percent. Survey respondents further broke down construction costs into eight major construction stages: •Interior finishes: 30 percent •Framing: 18 percent •Exterior finishes: 15 percent •Major system rough-ins: 13 percent

The average home in 2015 had 2,802 square feet of finished space, compared to 2,402 in 2009. The size of the lot has increased significantly, too, jumping to 20,129 square feet (nearly half an acre) in 2015, from 14,359 square feet just two years ago. Although building practices and the cost of labor, land and materials can vary widely across the country, these national averages provide an encouraging snapshot of the building industry and our nation’s housing recovery. The upward trend of home buyer confidence and home price appreciation is inspiring more and more consumers to build the home of their dreams. GENERAL COUNSEL MY NEIGHBOR IS THE REAL LIFE GRINCH Q: MY NEIGHBOR HAS THREATENED TO SUE ME OVER MY CHRISTMAS LIGHT DISPLAY. HE CLAIMS THAT THE LIGHTS ARE OBNOXIOUS, KEEPING HIM UP AT NIGHT, INTERFERING WITH HIS HOME LIFE AND CAUSING TRAFFIC ISSUES WITH ENTERING AND EXITING HIS DRIVEWAY. HE HAS THREATENED TO REPORT ME TO THE HOMEOWNER’S ASSOCIATION AND SUE ME. IT’S CHRISTMAS; CAN HE REALLY SUE ME FOR MY LIGHT DISPLAY? A: Many subdivisions have restrictions in an effort to have a general plan governing building standards, specified uses and improvements. The first thing you need to do is review the restrictions. You can get a copy from the courthouse in the parish you reside.

If there are restrictions on Christmas décor, you have possible defenses to the homeowners associations attempt to make you remove your décor in compliance with the restriction. Under Louisiana law, an action for the violation of a building restriction must be brought within two years from commencement of the violation. Depending on when you began decorating your front yard in violation of the restrictions, the homeowners association may no longer be able to file a cause of action against you, and your house is freed of the restriction that was violated. These restrictions can also be terminated by abandonment. If several other houses in your subdivision decorate in the same manner as you without reprimand the restriction may be considered abandoned as evidenced by the numerous property owners who violated the restriction.

Unfortunately, office parties can provide rich settings for misconduct and sexual harassment. A recent study shows that that 40% of respondents had engaged in inappropriate behavior or knew someone that had, and 23% were reprimanded or knew someone who had been. Employers have a duty to protect workers from sexual harassment in the workplace. If they fail to do so, then the employer may face liability. The law provides this protection to ensure that a worker’s right to retain his or her job or be considered for a promotion isn’t based on performance of sexual acts. Courts have considered company-sponsored holiday parties, regardless of location, part of the workplace and imposed liability of sexual harassment occurs there. Examples of sexual harassment include, but are not limited to, unwanted sexual advances, physical touching or assault, verbal or written sexual comments (including slurs and jokes), and offering employment benefits in exchange for sexual favors. To constitute sexual harassment, the conduct of the harasser must either be severe or pervasive (or both). For example, a single incident would probably not constitute harassment unless it was severe. That is, a single sexual comment or hand gesture by a manager directed at an employee would probably not be enough, but a single incident of inappropriate sexual touching could constitute sexual harassment. On the other hand, repeated incidents, even if each individual incident was relatively minor, could collectively be deemed pervasive and constitute sexual harassment. For example, a single inappropriate look by a male manager of a female employee (e.g., staring at the employee’s body) would probably not be enough, but repeated inappropriate looks could constitute sexual harassment. At a holiday party, the most likely situation to arise is a severe single incident of sexual harassment on the night of the party, but it is also possible that statements made or actions taken by a co-worker during the party might be part of a larger, pervasive pattern of sexual harassment. The combination of a social setting plus alcohol often leads people to take patent actions or make bold statements that reflect and confirm more subtle actions they have taken in the past. If you think you were subject to sexual harassment or witnessed it at the holiday office party, you should discuss your concerns with HR. It probably is not a bad idea to discuss your concerns anyway as it sounds like some changes should be made before next year’s party.
