Q: LAST YEAR DURING MARDI GRAS, I WAS HIT WITH A BAG OF BEADS IN THE FACE. IT HURT REALLY BAD, AND I HAD A NICE BLACK EYE BUT NO REAL INJURIES. NOW THAT THE PARADES ARE HERE AGAIN, I AM JUST WONDERING IF THE FLOAT RIDERS HAVE ANY RESPONSIBILITY TO THE CROWDS. IF I HAD BEEN REALLY INJURED, COULD I HAVE SUED?
Q: I AM INTERESTED IN BUYING A BUILDING IN LAFAYETTE TO USE AS AN OFFICE, BUT I DON’T MY INTENDED USE IS PERMITTED UNDER THE LOCAL ZONING ORDINANCES. WHAT CAN I DO?
A: Unfortunately, when you attend a Mardi Gras parade you take on the risk of being struck by objects thrown during the parade. There is a law in Louisiana protecting Mardi Gras krewes and organizations from lawsuits for damages or injuries caused by throws. The law states that “no person shall have a cause of action again any krewe or organization: that participates in a Mardi Gras parade. It goes on the state that a person who attends a parade “assumes the risk of being struck by any missile whatsoever which has been traditionally thrown, tossed, or hurled by members of the krewe. These items include, but are not limited to, beads, cups, doubloons, and coconuts. There is an exception for a person who acted deliberately without care or concern, i.e. was grossly negligent. Gross negligence can be difficult to prove. Gross negligence is defined as carelessness in reckless disregard for the safety or lives of others, which is so great it appears to be a conscious violation of other people’s right to safety. The person bring the action must be able to prove that the actions arose to such a level. Louisiana courts have addressed the issue of whether throwing an entire bag of beads is grossly negligent, and has decided that the person tossing the bag of beads was not grossly negligent.
A: You may be able to get the zoning changed or perhaps the Lafayette Planning and Zoning Commission could grant you a variance or exception so that you can use the building the way you would like to. In order to get a variance or have the zoning changed, you will have to file an application with the Lafayette Planning and Zoning. Since you don’t want to buy the property if you won’t be able to use it the way you want to, there are a couple of ways you can proceed and still protect yourself. You could sign a purchase agreement, but include a clause in the purchase agreement that that makes your obligation to close on the property contingent upon your being able to change the zoning or getting a variance from Planning and Zoning Commission your intended use. Another possibility is for you to purchase a short term option to buy the property from the owner. Then, you can investigate the possibility of a getting a variance or getting the zoning changed. If you are able to accomplish what you want during the option period, you can exercise your option and buy the property.
Be careful and pay attention so that you can get out of the way if a bag comes hurling toward you. Happy Mardi Gras!
