Preparing for Severe Summer Weather By Mac Gibson, President Acadian Home Builders Association
A
s the weather begins to warm up in Acadiana, the likelihood for severe weather increases too. Hurricanes, tornadoes, heavy rains, and flash flooding all threaten to wreak havoc on homes and communities during summer months. Taking the time to prepare your family and home now will help ensure that you are ready when the forecast calls for severe weather.
Create an Emergency Supply Kit Having an emergency supply kit ready and easily accessible will help you with any type of natural disaster. This kit will be important if you are in your home without electricity or if you are forced to evacuate your home. Your kit should contain: a three-day supply of bottled water and non-perishable food, a battery-operated radio, flashlights, batteries, a first-aid kit, family prescription medicines, pet supplies and important family documents. Develop a Communications Plan
Family
Since your family may not all be together when an emergency occurs, it’s important for everyone to know your communication plan. Ready.gov recommends choosing one family member for everyone to contact. Make sure children know their parents’ cell phone numbers. It’s also helpful to send text messages, as they are more likely to go through than phone calls during an emergency. Parents should also know the emergency plans in place at their children’s day care and schools. Your family should also have a meeting place if you are forced to evacuate your home. This includes a spot in your neighborhood and a place to meet if your neighborhood is evacuated. Practice evacuation drills during the day and at night so that everyone knows where to go.
Weatherproof Your Home There are also a few steps you can take to protect your home against severe weather. •Clean out clogged gutters and downspouts. If the rain that accompanies a heavy storm can’t run through the gutters and downspouts, it will spill over the sides, landing in areas where it can soak through to your home’s foundation, causing flooding and structural damage. •Keep the elements out. Try to prevent wind and water from entering through windows, cracks, entry doors and garage doors. Especially in hurricane-prone South Louisiana, it is important to seal your windows and doors as tightly as possible. You can even purchase and install special storm shutters to cover your windows. •Secure all doors. High winds can easily tear through double doors, French doors and sliding patio doors that have no structural support between the two sides. You may need to purchase and install special hardware to more adequately secure the doors where they meet. Try bolts that fasten the door into the framing at the top and the bottom. Another option is to consider installing steel entry doors instead of wood. •Check your roof. A strong roof is another essential element in preparing your house to withstand a severe storm. Apply sealing around your home’s chimney or vent pipes. This will help prevent water from seeping into your home. Hire a contractor to check the structural integrity of the roof system. INHERITANCE BETWEEN SIBLINGS IS NOT ALWAYS SIMPLE Q: MY FATHER DIED ALMOST A YEAR AGO AND DIDN’T LEAVE A WILL. MY MOTHER DIED ABOUT 5 YEARS AGO WITHOUT A WILL AS WELL. THEY HAD A HOUSE THAT I’VE LIVED IN ALMOST MY ENTIRE LIFE. MY FATHER MOVED INTO ANOTHER HOME YEARS BEFORE HE DIED AND I TOOK OVER ALL MAINTENANCE, BILLS AND TAXES ON THE HOUSE. SINCE MY FATHER’S DEATH, MY THREE SIBLINGS HAVE TRIED TO EVICT ME FROM THE HOME. HOW DO I GAIN OWNERSHIP OVER THE HOUSE SINCE NEITHER OF MY PARENTS LEFT A WILL? A: Your biggest problem is that you own only one-fourth of the house. Since you didn’t mention a stepmother, I presume your father was not married at the time of his death. That said when your mother died without a will, her separate property passed and her share in the community to you and your siblings. Assuming the house was community property, your father had usufruct over the house and you and your siblings were the naked owners. When he died without a will, the usufruct terminated. You and your four siblings own the house in equal shares. In determining your rights, it is irrelevant that you have lived there for several years and that you have been maintaining the house since your father’s death. In order for you to gain ownership, you will first need to open your mother’s and father’s succession. You may be able to do a small succession depending on the value their estate. This is a simplified procedure that will establish you and your siblings as co-owners. However, if they owned other assets (separate or community) then this type of proceeding may not be available. Once the succession proceeding is complete, you can negotiate the purchase of the house from your siblings. To start, the four of you will need to agree on how much the house is worth. Then, you will need to pay each of them their one-fourth share.

They may agree to owner-finance the sale, meaning you could pay them over time without having to get a loan from a bank. However, don’t be surprised if they want their money upfront. If they do, you will need to secure a loan from a lender. If the four of you can’t reach an agreement on the value of the property, or they don’t want to sell their shares to you, it will need to be sold to a third party and the proceeds split four ways. Given your disagreements thus far, selling house may not be easy. And, if you decide to sell the house, the four of you will have to agree on other things, such as who to use as the listing agent, whether you can continue living there until the house is sold, how much to list the house for, how much to sell it for, and other terms of the sale. If the four of you can’t reach an agreement on

your own, then any one of you can go to court and seek a court-ordered sale of the property. This last option is not a good one, as it will likely reduce the amount of money each of you will ultimately receive, and it will add a considerable amount of time to the sales process. When negotiating with your siblings, you can try to recover some of the expenses you have paid over the past two years; however, they may contend that you should have been paying them rent all that time. In the end, it may be easiest for the four of you to call it even agree that all of your expenses were about equal to what you would have paid them in rent. MOTHER’S CREDIT CARD DEBT NECESSARILY DAUGHTER’S DEBT

Q: MY MOTHER IS IN A NURSING HOME, AND I HAVE HAD A POWER OF ATTORNEY FOR HER FOR SOME TIME NOW. SHE RAN UP SEVERAL CREDIT CARDS A FEW YEARS AGO, AND I HAVE BEEN PAYING THEM OFF, WITH MY OWN MONEY, OVER TIME, BUT WHAT IF SHE DIES BEFORE THEY ARE PAID OFF? WILL I BE REQUIRED BY THE CREDIT CARD COMPANIES TO KEEP PAYING ON THE CARDS AFTER HER DEATH? A: No, you will not be required to keep paying off the credit cards after your mother dies. Your mother’s credit card debt is her debt alone. You are not personally obligated to make those payments while she is alive or after she dies. It does not matter that you have a power of attorney for your mother and have been making the payments for her. When the credit card companies issued the credit cards, they agreed to look solely to your mother for repayment, not you. Accordingly, neither you nor any other person is liable for the payments on your mother’s cards. Of course, after your mother’s death, her estate will be liable for her debts. If her estate has sufficient assets that can be sold to make the payments, then it will be the job of the executor of her estate to do so. And, if the credit cards don’t get paid, the credit card companies may very well take steps to collect this amount from your mother’s estate. Sometimes, credit card companies will actually file a claim against the succession, and other times, if enough money is involved, they file suit to collect the outstanding debt. When smaller, less significant amounts are owed, they oftentimes just send demand letters. So, after your mother’s death, even though you will not be personally liable for payment of her debts, you may find your inheritance reduced by the amounts that are paid to the credit card companies.
