Fight the Winter Blues by Bringing the Outdoors In

People are spending significantly more time at home as a result of COVID-19, which has led to shifts in habits and a renewed focus on how their homes live and breathe. With winter in full swing, healthy habits and homes will become increasingly important: Approximately 20% of the population suffers from seasonal depression. Here are three ways to help fight the winter blues by bringing the outdoors in.
Use Natural Materials Wood is a great way to add warmth to any home, whether in flooring, furniture or finishes. Various options and colors are available — from light ash and bamboo to deep mahogany and cherry — to match your décor. Other materials, such as stone and organic fibers, can make an impact as well. Studies have also shown the benefits of indoor plants, including improved air quality and reduced stress — both of which are highly beneficial to a work-from-home environment.
Incorporate Nature-Inspired Finishes and Design In addition to natural finishes, patterns that reflect natural elements — from leaves to birds to shells — can also infuse the outdoors into your décor. Experts anticipate rich earth tones will also be popular to contribute warmth to homes in 2021, and a number of paint companies have selected calming shades of blue as their 2021 color of the year, reflecting natural elements such as water and the sky. Examples include Benjamin Moore’s Aegean Teal, Sherwin Williams’ Urbane Bronze and PPG’s palette of Transcend, Big Cypress and Misty Aqua.
Pay Attention to Lighting A bonus for many who are able to work from home is the decreased exposure to fluorescent lighting, which can increase the risk for migraines and eye strain. Instead, try to allow as much natural light into your home as possible. Daylight provides access to vitamin D, a nutrient linked to fighting illness, heart disease and depression, as well as boosting weight loss. Incorporating circadian lighting — which mimics the range of color temperatures and intensity throughout the day — can also boost your mood, especially where natural light may not be available, and improve your sleep.

BUYER’S REMORSE IS NOT A VALID EXCUSE FOR BACKING OUT OF PURCHASE AGREEMENT

Q: I RECENTLY SIGNED A PURCHASE AGREEMENT ON A HOME HERE IN LAFAYETTE. AFTER A MORE CAREFUL EXAMINATION OF NEARBY HOMES THAT HAVE SOLD RECENTLY, I THINK I MIGHT BE PAYING TOO MUCH FOR THE PROPERTY. I TOLD THE SELLERS ABOUT MY CONCERNS, BUT BASICALLY THEIR RESPONSE WAS “TOO BAD, SO SAD”. I WOULD LIKE TO CANCEL THE AGREEMENT, BUT DON’T THINK THE SELLERS ARE GOING TO DO SO WITHOUT A FIGHT. CAN THEY FORCE ME TO BUY THEIR HOME? CAN I GET OUT OF THE CONTRACT? A: It sounds like you are having a bad

case of buyer’s remorse. Unfortunately, unless you made buyer’s remorse a condition of the contract, and I highly doubt you did, it doesn’t give you the legal right to bow out of the deal. The seller’s remedies against you depend on what your purchase agreement says. If your purchase agreement provides for specific performance, arguably, the seller can force you to buy the home, just as you could force the sellers’ to sell it to you if they suddenly got seller’s remorse. The sellers would have to file a lawsuit to force you to proceed to closing and
purchase their home, for the price agreed upon in the purchase agreement. If the contract doesn’t provide for specific performance, it probably specifies that if you back out of the deal, you automatically forfeit your deposit. The purchase agreement may also provide that the sellers can get damages from you because you backed out of the deal. In your case, the sellers’ damages would be the difference between what you originally agreed to pay for the home and what they will be able to get for it if they are forced to put it back on the market. Interestingly, you did not mention whether or not the house appraised for what you offered to pay for it. The majority of purchase agreements are contingent upon appraisal, meaning, if the home doesn’t appraise for the purchase price, the parties can re-negotiate. You should check your purchase agreement to see if it is contingent upon appraisal. If it is, and the home doesn’t appraise for the agreed upon purchase price, you might be able to get out of the purchase agreement. It is unfortunate that you were unable to discern the true value of the home prior to making an offer and signing on the dotted line. Next time, I would suggest doing your homework first – it costs everyone a lot less money and headaches. Q: MY FATHER AND STEPMOTHER PURCHASED A HOME TOGETHER BEFORE THEY DIED. MY FATHER PASSED AWAY BEFORE MY STEPMOTHER DID, AND HE DID NOT LEAVE A WILL. AS HIS ONLY SON, I AM THE ONLY HEIR. A FEW YEARS AFTER MY FATHER PASSED AWAY, MY STEPMOTHER REMARRIED. A FEW YEARS LATER, SHE DIED – ALSO WITHOUT A WILL. SHE DOESN’T HAVE ANY CHILDREN, BUT SHE DOES HAVE THREE NEPHEWS. HER HUSBAND STILL RESIDES IN THE HOME. DOES HE HAVE THE RIGHT TO CONTINUE TO LIVE IN THE HOUSE? WHAT IS THE PROPER DIVISION OF THE PROPERTY? A: Since you did not mention a prenuptial agreement between your father and stepmother, I assume the house was community property. That being said, when your father died without a
will, according to Louisiana testate law, his onehalf interest in the community home passed to you, subject to your stepmother’s usufruct – the right to live in the home until her death. When your stepmother died without a will, her one-half interest in the home passed to her “heirs” as determined by Louisiana law. Unfortunately, you did not give me enough information to tell you who would inherit her estate under Louisiana law. Nevertheless, the house is no longer subject to a usufruct and you now own a full one-half of the home. Before you can do anything however, you will need hire an attorney to probate your father’s succession. You would be co-owners in indivision with whoever your stepmother’s heirs are. If you and the other co-owner(s) cannot agree on how to use the house, or you want to sell it and the other co-owner(s) don’t, you have the right to demand a judicial partition. The court can order a partition by licitation (sheriff’s sale) or by private sale. Once this has been done and costs had been paid, the proceeds would be distributed to the co-owners in proportion to their shares.
