OPEN SUNDAY 1:00-3:00PM EMERGENCY PAID SICK LEAVE STILL REQUIRED? Q: IS THE LAW THAT REQUIRES EMPLOYERS TO PROVIDE PAID SICK LEAVE TO EMPLOYEES WITH COVID STILL IN EFFECT? A: In short, no. The Families First Coronavirus Response Act of 2020 (“FFRCA”) that mandated employers with fewer than 500 employees provide emergency paid “sick leave” and paid expanded “family and medical leave” to eligible employees was not extended beyond December 31, 2020. This means an employee is no longer entitled to FFCRA-leave for COVID-19 reasons. In December, 2020, the Relief Bill was passed and signed into law which amends certain provisions of the FFRCA to allow employers to take a payroll tax credit for providing emergency paid “sick leave” and paid expended “family and medical leave” through March 31, 2021. This allows for an employer to recover costs of providing required FFRCA leave in 2020, and to voluntarily provide paid emergency “sick leave”

and emergency “family and medical leave” through the end of March. Obviously, the pandemic is nowhere near over, and employers are dealing with the same issues that they did before the FFRCA was enacted. For example, what happens when employees must quarantine, or care for children if schools or daycares are closed due to COVID-19? The extension of tax credits is an option for employers at least through the end of March. Employers may also consider modifications to paid and/or unpaid leave policies, as well as remote working options. If you need guidance in re-working your policies, or navigating tax credits, you should consult an attorney who is knowledgeable in employment and human resource issues.

BREAKS ARE NOT REQUIRED Q: MY BOSS IS THREATENING TO TAKE AWAY BREAK TIME BECAUSE TOO MANY EMPLOYEES HAVE BEEN LATE IN RETURNING FROM BREAKS OR TAKING MORE THAN THE ALLOTTED TWO BREAKS A DAY. IS THIS LEGAL? A: Your boss is probably not violating any laws by threatening to or ultimately taking away breaks. Some exceptions may apply in civil service, the Americans with Disabilities Act or when employing minors; but in most cases an employer is not required to give breaks—not even a meal break. There is no requirement under federal law or Louisiana state law for an employer to give break time or meal breaks to an employee who is over the age of 18. If an employer does give

breaks, then the employee must be paid for breaks taken that are less than 20 minutes. The employee will not be paid for meal breaks as long as he/she is not doing any work during the break. Again, there may be exceptions for employees who require accommodation or work in civil service, etc. Also, refusing to give breaks can have some negative consequences with employee morale, etc. Nevertheless, if it continues to be an issue your employer can change his/ her break policy.

Home Improvement Projects Grow in Popularity The pandemic transformed the way we live, work and spend money. If you’ve purchased interior paint for your home, new flooring or worked with a remodeler recently, you’re not alone. Home owners have shifted their spending from entertainment and travel to home improvement projects, according to HomeAdvisor’s latest “State of Home Spending” survey. By Bill Schoeffler, President

HomeAdvisor conducts a survey every year of home owners across the U.S. who have completed projects within the last 12 months. The survey revealed that home owners spent an average of $13,138 on home-improvement projects in 2020, compared to $9,081 in 2019. Rising costs for material and labor are contributing factors to the increase in spending. Increased home buying is also a factor, primarily driven by millennials, the oldest of whom are now at or close to the median age of first-time home buyers, according to the National Association of Home Builders. Home maintenance projects, such as cleaning and landscaping, saw the biggest year-over-year increase, rising from $1,105 in 2019 to $3,192 in 2020. Contributing factors include people using their homes more, resulting in more wear and tear, and spending more time at home, making problems more noticeable. Home improvement and home emergency spending rose $745 and $124, respectively, over 2019. The top home improvement projects included interior painting projects, bathroom remodels and new flooring installations. Respondents to HomeAdvisor’s survey indicated that interior painting projects would remain the top project leading into 2021 — a departure from prior years, in which room remodels generally held the top spot. According to the report, “painting was one of the most popular projects across nearly all age groups, because it is relatively affordable and offers a lot of visual value in terms of the look and feel of a room.” The report also examined the way that home owners are using their homes in the wake of COVID-19. Seven in 10 respondents indicated that COVID-19 had increased their need for home cooking, 50 percent were working from home and 40 percent were incorporating more home entertaining.
