Questions to Help You Find Your Answer

It’s becoming clear that you’d really like a kitchen where two of you can cook at the same time. A playroom that’s not the living room. Increasingly it seems like there are too many people and not enough bathrooms. Or maybe you’re looking ahead and want your place to be more safe and usable as you age. You’re ready to make a change and now you have to decide: Remodel or relocate? There’s no one right answer for every situation. So before you look at houses for sale while also sketching out plans to redo your current master bath and expand your kitchen, take a look at which approach best suits your wants and cans. That way, you can decide the best option to pursue and focus your efforts toward that goal. Answering these questions can help you sort it out: •

How do you feel about your neighborhood? Do your friends and your kids’ friends live there, is your favorite park or coffee shop within walking distance, are the schools a great fit for your family? Or do you keep wishing you were closer to work, had more open space nearby, had shops within walking distance, or a bigger or smaller yard? How does your home compare in value to others in the neighborhood? Would your ideal remodel make your home the priciest on the street? If you’re thinking about ease and value of resale, it’s best not to have the most high-end home around. On the other hand, if you’re more concerned that your house be comfortable and convenient for you so that you can stay there a long time, relative value may not matter as much as other factors. How long do you expect this change to suit you? If your house is feeling small because of kids, how old are they? How much longer do you expect them to be living there? Would converting the basement to a play room give you enough room to spread out? Does square footage per person seem totally inadequate? Or are you looking ahead to retirement? If so, will you want a smaller home, with less square footage to clean and maintain? Or are you happy with your current home’s size but would like it better configured and equipped for aging? What is your tolerance for being under construction compared with the difficulties of a move? How many changes are on your remodeling “to do” list and how long and disruptive would the remodeling process be? Moving is costly. In addition to purchase price, there are costs for closing, fixing up your current house to sell, and making the move. And once you do move, there may also be costs for fixing up the new house. What’s the market for the type of home you want? How likely are you to find a place that you can afford with the features you’re seeking in a neighborhood of your choice? Q: I AM GOING TO SELL MY AUNT’S HOME FOR SALE BY OWNER. I HAVE A GENERAL POWER OF ATTORNEY. WHEN I GET A BUYER, HOW DO I CONSUMMATE THE DEAL IF THERE IS NO REALTOR INVOLVED? A: Your question raises a number of issues with regard to selling a house without a realtor and through a general power of attorney. This week, we’ll address the general power of attorney. A general power of attorney should give you the authority to sell your aunt’s immovable property. It may include language that references all “real, personal or mixed”, “immovable”, or “real estate” property. As long as the general power of attorney gives you this authority, the closing attorney should accept the power of attorney. The original power of attorney must be either attached to the sale documents or recorded and

referenced in the sale documents. If you only have one original power of attorney, you may consider a special power of attorney for the sale of the property only. If you were the buyer, then a general power of attorney will not be acceptable to purchase immovable property. The lender requires a special power of attorney that includes the legal description and terms of the sale. Before you put your aunt’s house on the market, you should review the general power of attorney and confirm it authorizes you to sell her immovable property. If not or if you decide you want a specific power of attorney, then I recommend you consult an attorney to help navigate you through the process. Stay tuned next week as well will address other issues to consider when selling a home without a realtor.

MAKING YOUR HOA TAKE ACTION! Q: I LIVE IN A GATED COMMUNITY WITH A HOMEOWNER’S ASSOCIATION; HOWEVER OUR GATE HAS NOT FUNCTIONED IN MONTHS. HOW DO I GET MY HOA TO ACT?

A: You have a couple of options in handling your homeowners’ association depending on the reason the HOA is not already doing so. You may want to attempt to remove one or more members of the HOA’s board of directors, amend the governing documents, or file a lawsuit against the HOA. Before you make a decision on a course of action, you need to know what the obligations of your HOA are. In most developments, maintaining, repairing, and replacing the common areas are among the HOA’s major duties. Look at its governing documents, the articles of incorporation, bylaws, declarations, conditions, restrictions, and easements and any other rules and regulations. These should have been provided when you bought the property. If the HOA is not meeting the common area maintenance and repair obligations that it is responsible for, you should first attempt to solve the problem by discussing it with the HOA. Perhaps there is good reason why the gate has

remained unrepaired. Ideally, your complaints will be heard and appropriate action will be taken by the Board. If not, more serious action may be required such as removal or a lawsuit. Removal of a board member may be appropriate if you discover the HOA is not doing its job because of a nonperforming or incompetent board members. The procedure for doing so should be set forth in the HOA’s governing documents but the problem is that this may be a slow process. It likely requires the vote of the other board members or all the other members of the HOA. Another option to make the HOA take action might be to initiate lawsuit. This should be your last course of action. Such a lawsuit may be for breach of the HOA’s fiduciary duties owed to the homeowners. To fulfill these duties, the HOA must exercise ordinary care, in a reasonable manner and in good faith. An example of a breach may be if the reason for HOA has failed to repair the gate is the result of mismanagement of the HOA fees, you may have an action against the HOA or an individual board member. Hopefully your issue can be resolved through a civil discussion with your HOA. If not, I suggest you consult an attorney who can help you take further action. Good luck!

He was the recipient of the Louisiana Realtor of the Year Award in 2015. He served as President of the REALTOR® Association of Acadiana in 2006 and has been involved in the local, state, and national political action team for a number of years. He loved spending time with others and meeting new people which made this job absolutely perfect for him. Through his real estate connections he was able to become a lifelong friend to many and inspired others to be better.

He was in charge of charitable auctions for many schools including his alma mater, Teurlings High. For over seventeen years he went to St. Rose School in Birmingham, Alabama where he used his talent as an auctioneer in fund raising events. Along the way he became loved by many in business and in his personal life. If you were a friend of Al’s you were a friend for life. He maintained close friendships from his childhood days.

He has been said to have a personality that is bigger than life and was always able to make others feel comfortable. When it came to telling stories, his energetic and animated personality kept everyone entertained. Al had an unwavering commitment to his family. He was often first to arrive and last to leave a family gathering. Everyone loved Uncle Al. Al was known to challenge his son in a game of pool and they were witnessed casting humorous jabs at each other. He cherished the time spent with his family, but most importantly with his beloved grandchildren who affectionately called him "PapAl". He enjoyed many summer days at the pool teaching them to swim and eating his son’s barbeque. While he was talkative with all adults he was equally social with kids at birthday parties and could bring a smile out of the smallest child. He was a trustworthy and dependable man who touched the lives of all he knew.
