Get Creative with Your Empty Nest By Doug Trahan, AHBA President Many baby boomers are finally saying goodbye to their adult children, who are moving out of the house and starting the next chapter in their lives. While some empty nesters are excited about this new phase, it can be a stressful time for others as they deal with this time of transition in their lives. When your kids move out and you’re faced with an empty nest, lots of questions come to mind. Should you move and downsize? If you stay, how should you use the kids’ rooms? What other changes should you make as you get older? If you’ve made the decision to stay in your home – at least for now – it’s time to figure out how your house can work better for you in this the next chapter of your life. Focus on Small DIY Jobs With the kids out of the house, you may be surprised at how much free time you have. Use this time to tackle some of those home renovation jobs that have been on your to-do list for a while. Before you begin any project, however, look at your house – room by room – with a fresh set of eyes. Now that your house doesn’t need to accommodate a growing family, how do you want to use each of the rooms to fit your new lifestyle? Perhaps the mudroom is no longer needed, but a craft room has always been on your wish list. Now you can focus on making those changes. Create a Home Office You may be an empty nester, but you are still a very active member of the workforce. An extra bedroom or den previously used for family activities would be a great place to turn into a home office.

Home offices are becoming less of a luxury and more of a necessity with more people telecommuting or running their own businesses from their house. Expand Your Space Depending on the age of your home, you may find that your master bedroom or bath is too small for comfort. Expand into space that isn’t being used to build the master bath of your dreams or to create a separate seating or dressing area in your bedroom. Incorporating these changes will not only create a home that suits your new lifestyle, they also may increase the value of your home when you decide to finally sell. Many empty nesters hire expert remodelers to adapt their home to make it easy to use and maintain. Stairs often become a problem, but moving the master bedroom and the laundry room to the ground floor can be part of a solution that gives home owners many more years in the home they love. Building professionals who have earned the National Association of Home Builders’ Certified Aging-in-Place Specialist (CAPS) designation have received training on how to build or renovate a home so that the occupants can live in the home ssafely, independently and comfortably, regardless of their age or ability level. While most CAPS professionals are remodelers, aan increasing number are general contractors, designers, architects aand health care professionals.

GENERAL COUNSEL HELP! MY BUSINESS IS BEING POACHED!

FIRED OVER FACEBOOK? Q: I AM A REGISTERED NURSE WHO UNTIL RECENTLY WORKED FOR A PEDIATRICIAN. I WAS FIRED LAST MONTH, AND JUST FOUND OUT IT WAS BECAUSE OF MY FACEBOOK ACCOUNT. APPARENTLY, HUMAN RESOURCES LOOKED AT MY FACEBOOK PROFILE WHICH CONTAINED DISPARAGING COMMENTS ABOUT WORK AND SOME OF MY CO-WORKERS THAT I TYPED AFTER A FRUSTRATING WEEK AT WORK. I DON’T THINK MY FACEBOOK PAGE HAS ANY RELATION TO MY JOB PERFORMANCE AS A REGISTERED NURSE. CAN A PERSON REALLY BE FIRED OVER FACEBOOK?

A: Yes, a person can be fired over the contents of their Facebook page, and the effects of social media are very far reaching in today’s world. Louisiana is an “at will” employment state, which means employees can be terminated from their employment with or without cause. You are likewise free to terminate your employment without a reason. Of course, there are certain exceptions to the at-will doctrine which require an employer to provide a reason for the termination that do not seem to be an issue here. Your employer cannot retaliate against you for exercising statutory rights by complaining about discrimination; filing a worker’s compensation claim; union activities; complaining about environmental activities; making an OSHA complaint; or for whistle-blowing activities. Many companies perform background checks during the hiring process which includes your online presence, i.e. Facebook, MySpace and/or Twitter accounts. Often times, as your human resources director did, employers monitor these popular social networking sites for precisely the type of information you posted, or inappropriate photos, or to monitor usage while on the clock. You should keep in mind that once you post something (a comment, video or photo) on the internet, it can remain forever even if you delete. People can and will take a “screenshot” of the online posting and forward it in an email or repost it to their page, and BAM! the regrettable comment, post, tweet, photo, etc. is still there somewhere. Just because you are sitting in the privacy of your home/office/cubicle/wherever does not mean that things you share online won’t be seen by people you don’t want to see them.

Q: I AM A SMALL BUSINESS OWNER OF A PHOTOGRAPHY STUDIO SPECIALIZING IN WEDDINGS, CHILDREN AND FAMILY SESSIONS. I HAVE AN EMPLOYMENT CONTRACT MY PHOTOGRAPHERS AND ASSISTANTS MUST SIGN UPON HIRING. I HAVE RECENTLY DISCOVERED THAT ANOTHER PHOTOGRAPHER IN THE AREA IS TRYING TO POACH MY EMPLOYEES AND MY CLIENTS BY URGING MY EMPLOYEES TO BREACH THEIR CONTRACTS. A: Who knew the photography business was so cut throat? Unfortunately, you do not have a cause of action against this guy for attempting to hire your employees and steal your clients. Louisiana law does recognize a cause of action for tortious interference with a contract when it involves a corporate officer who intentionally interferes with a contract of his corporation without justification. So, unless this photographer is for some reason a corporate officer of your business, you do not have a cause of action against him. If your employees breach the Employment Agreement, you will likely have a cause of action against them. Certainly this is the case if you have a valid Non-Competition Agreement in the contract pursuant to Louisiana law. To be enforceable, the Non-Competition Agreement must restrict the employee from carrying on or engaging in a like business of the employer, be limited in duration not to exceed two years, contain a geographic limitation by specifying the parish(es) restricted as long as you do business in those parishes. As for your clients, nothing prohibits the other photographer from going after them. If your product is satisfactory, especially in an area such as photography, I wouldn’t worry too much.

There are precautions you can take to protect your social networking profile. Facebook offers Privacy Settings for you to control the information accessible to certain friends and persons searching your Profile. You can also control comments/photos posted by others that make reference to you that you may not want out there for all to see.
