MY HOUSE HAS MOLD! Q: I RECENTLY BOUGHT A HOUSE IN LAFAYETTE, AND A COUPLE OF WEEKS AFTER THE CLOSING, I DISCOVERED SOME WATER DAMAGE AND MOLD BEHIND ONE OF THE BATHROOM WALLS. THE PROPERTY DISCLOSURE FORM COMPLETED BY THE SELLER INDICATED THAT HE HAD NO KNOWLEDGE OF THESE PROBLEMS. CAN I GET THE SELLER TO PAY FOR REPAIRING THESE ISSUES?

A: It depends. Did you have the property inspected? Though there is no guarantee that an inspection would have revealed the water and mold problems in your home, it would have been wise to have an inspection done prior to purchasing the home. Had an inspector discovered the problems you describe; the cost of repairs could have been negotiated with the seller prior to purchase. Had the seller been unwilling to make reasonable allowances for the necessary repairs, or if the cost of repairs exceeded a certain amount, the purchase agreement would likely have allowed you to simply walk away from the deal. Since the standard property disclosure form used in Louisiana, which was presumably the same form completed by the seller of your home, does not require the seller to have specific knowledge
of every aspect of the home he is selling, it is permissible for a seller to truthfully indicate that he has no knowledge of certain conditions or defects exist in the home. Though you could attempt to pursue the seller in court, you will likely have a difficult time proving that he knew or should have known that the water and mold issues existed, based on your description of these problems. If you fail to prove that the seller knew or should have known of the water and mold problems, such that he did nothing wrong in completing the disclosure, then he will not likely be found liable to you. On the other hand, if the problems were clear, at least some responsibility for detecting these problems will be placed upon you. Also, since the home you purchased was presumably not a new construction, the sale document for the home likely contained a provision that the home was sold to you “AS IS”, meaning that you were purchasing the home in its present condition and with any defects it may have had. As indicated above, there is no guarantee that a pre-purchase inspection would have revealed the water and mold problems in your home. However, having an inspection done would have given you a chance of detecting these problems.

Q: WHAT HAPPENS TO A REVERSE MORTGAGE IF MY PARENTS BECOME ILL OR DIE? A: A reverse mortgage is a debt incurred by the borrowers. It is mortgage loan, usually secured over a residential property, that enables the borrower to access the unencumbered value of the property. The loans are marketed to older homeowners and typically do not require monthly mortgage payments. Borrowers are still responsible for property taxes and homeowner’s insurance. These types of mortgages allow elderly people to access the home equity they have built up in their homes now, and defer payment of the loan until they die, sell, or move out of the home. If your parents become deceased, then the entire principal plus accrued interest and service fees must be paid in full before the heirs can take possession of the home. In some cases, the debt may exceed the actual market value of the

home, although depending on where you look you may find conflicting opinions on this. Pro-reverse mortgage lenders will advise that the lender has limits and the borrower will never owe more than the value of the home. But we all know you cannot guarantee a stable real estate market in perpetuity. So what happens to the borrowed amount when your parents die? All in all, it may affect the heirs. If it is a family home that your parents intend on keeping in the family a reverse mortgage is not a realistic option for them. When considering a reverse mortgage, your parents should consider their age and health. Do they want to eventually move out the home and into assisted living? What are the plans when one of the spouses predeceases the other? We recommend consulting a financial planner and/ or an experience elder law attorney before doing anything. There may be less costly ways to deal with the need for money without having to get a reverse mortgage.
