According to a recent survey by the National Association of Home Builders (NAHB), 60 percent of buyers prefer new homes, the highest level since 2007. Buyers have the option to select large open areas to accommodate any lifestyle or growing family. Many new homes have the type of spaciousness that are not typically found in older homes. Modern designs are not limited to flexible spaces. New homes are equipped with the latest technological features and appliances. Another benefit of purchasing a new home is the energy efficient options available. Many builders have
embraced green building techniques, so a home is cost-effective to operate, has healthy indoor air quality and has a minimal impact on environmental resources. NAHB recently surveyed more than 3,000 home buyers, both recent and prospective, on the types of features they prefer to have in their home, including eco-friendly components and designs. Some of the top features desired by home buyers include ENERGY STAR-rated windows and appliances and efficient lighting that uses less energy than traditional bulbs. Not only can a new home save

A: Before you transfer any interest in the property, I suggest that you have an attorney review the mortgage which you executed in connection with the purchase of the home. Many mortgages contain provisions which state that you must obtain permission from your lender before transferring an interest in the mortgaged property to anyone else. The referenced provisions also typically provide that if you do transfer an interest in the property without the lender’s permission, you could be subject to certain repercussions, such as acceleration of the loan amount. interest in the property without the lender’s consent. Once the lender’s written permission is obtained, you could transfer an interest in the property to your fiancée in a number of ways. Many people in your position simply donate an interest in the property, meaning that you would be giving your fiancée an interest in your home without receiving monetary compensation from her in return. Alternatively, you could sell her an interest, in which case you would receive compensation from her in return for the transfer. An attorney familiar with real estate matters should be able to prepare whatever documents will be necessary for the transfer. Finally, I suggest you consult with a CPA or other tax professional before transferring the interest in the home to determine what tax consequences, if any, may result from the proposed transfer. This person should also be able to give you advice regarding the best means of transferring the property, so that undesirable tax consequences are avoided.

A: If you purchase the land for less than half its fair market value, the seller may rely on a principle called lesion in demanding that you either return the land to him or supplement the purchase price. Lesion is a remedy available only to sellers of immovable property, who have sold their property for less than half of fair market value. Though the seller may be able to “go back on the deal” you should
keep in mind that it is up to you, as the buyer, whether to supplement the purchase price or return the land to the seller. Also, please keep in mind that lesion must be determined by ascertaining the value of the land at the time of the sale. For example, let’s assume that the land in question was worth $40,000 at the time of the sale, and is worth $80,000 six months after the sale. Let’s also assume that you paid $35,000 for the land. Under this hypothetical situation, the seller would not be entitled to claim lesion, since the land was sold for over half its fair market value at the time of the sale. Also, a claim of lesion is subject to a one year peremptive period. This means that the seller only has one year to bring an action under a theory of lesion. In other words, if the seller does not bring an action for lesion within one year of the sale, he will lose the right to do so.
