WHEN LIFE GIVES YOU PECANS, MAKE PECAN PIE… Q: I LIVE IN AN ESTABLISHED SUBDIVISION IN LAFAYETTE AND HAVE POOL IN MY BACK YARD. MY NEIGHBOR HAS VERY LARGE PECAN TREES IN HIS BACK YARD, AND THE TREES DROP PECANS LEAVES INTO MY YARD AND POOL ON A DAILY BASIS. MY BACK YARD IS LITTERED WITH PECANS. I WANT TO POISON THE TREES I AM SO FRUSTRATED. I HAVE TO SPEND MORE TIME THAN I SHOULD TO CLEAN THE LEAVES OUT OF MY POOL, AND I AM WORRIED THAT THE PECANS WILL DAMAGE MY LAWNMOWER. IS MY NEIGHBOR RESPONSIBLE FOR REMOVING THE TREE OR TRIMMING ITS BRANCHES?
A: Put the poison down and walk away. Louisiana Civil Code Article 688 provides you with a legal remedy if your neighbor’s tree branches or roots extend over onto your property and interfere with the enjoyment of your property. That said, since the falling pecans and leaves appear to be causing you to contribute a considerable amount and time and effort each day to keep your pool clean and because of the concern with regard to your lawn maintenance equipment, a court might reasonably
conclude that your neighbor’s tree was interfering with the enjoyment of your property. Given your situation, more than likely, you do have the right to demand that your neighbor trim the branches that extend over onto your property at his expense. Before doing anything, you should try and talk to your neighbor about the problem. He may not realize the extent of the problem, or what a hassle the falling leaves and pecans are for you. Ask him to come over one afternoon and look at all the leaves in your pool and pecans in the yard. Once he realizes that his tree’s falling leaves and pecans are making it difficult to enjoy your backyard and pool, he might be more cooperative. Finally, by notifying your neighbor of the problem, you have put him on notice, and this might be important if he entirely refuses to cooperate and you are forced to take legal action sometime down the line. In the meantime, recruit some neighborhood kids to collect the pecans and then use them in a homemade pecan pie, and at least you have some benefit to the mess.
SOME CREDIT INQUIRIES ARE COMMON AND DO NOT AFFECT YOUR CREDIT SCORE Q: I RECENTLY REVIEWED MY CREDIT REPORT AND NOTICED A LOT OF INQUIRIES. I HAVE NOT APPLIED FOR ANY CREDIT. IS THIS LEGAL? IS THERE ANYTHING I CAN DO TO PREVENT THIS?
A: If you did not apply for credit with any of the companies listed, the type of entries you are referring to are probably what are frequently referred to “soft entries”. This type of entry usually appears under the credit inquiries section of your credit report. Since you did not request credit yourself, they should not affect your credit rating. Your own requests for your credit report are also called soft inquiries, and this type of request shouldn’t affect your credit rating either. It is not unusual or illegal for your current creditors to check you credit months after you have been approved, or throughout the life of your account. Creditors are entitled to check their customers’ credit reports for dramatic changes in their financial situation. In fact, many credit agreements give the creditor the right to revoke your credit at any time based on drastic changes to your financial situation. Checkups like these do not affect your credit rating. A “hard inquiry” on the other hand, occurs when you apply for credit and the lender obtains your credit report. Hard inquires work like this: Say you’re interested in buying a new car, and you visit three or four dealerships to locate the best deal. At each dealership, sales personnel obtain your name and address, and possibly you Social Security number. ACADIANA HOMEFINDER
While you’re sitting in the showroom or doing a test drive, the dealership may be running a quick credit check on you, to check if you’re really qualified to handle the purchase. Every one of those credit checks ends up as an inquiry on your electronic file, and they can affect your credit rating. An excess of hard inquiries within a six-month period can lower your credit rating. If you think your credit score has been affected by soft entries or improperly affected by hard inquiries, you should contact the credit reporting agency that is reporting the item in question. You will need to get a printed copy of your report from them, which you may be eligible to receive free of charge. After you send written documentation of the inaccuracy, the credit reporting agency will review it and if necessary, conduct an investigation. In doing so, they will then provide notification of your dispute, including the relevant information you submitted, to the source that furnished the disputed information to them. The source will then review the information, conduct their own investigation, and report back. The credit reporting agency will then make appropriate changes to your credit file based on the investigation and notify you of the update. If the dispute is resolved in your favor, you may want to get your credit report from the other two agencies to see if their reports contain the same error. After you’ve corrected an error with one agency, the other agencies should eventually receive the corrected information, but for a prompt correction, it’s best to contact each of the three agencies yourself.
