Summer is a time known for vacations, beaches and higher than usual utility bills. The average U.S. residential customer’s electricity bills will total $412 between June and August this year, according to the U.S. Energy Information Administration. Consuming less energy can help you save money on utility bills. Fortunately, there are several easy ways to reduce your energy costs during the dog days of summer. Fix Air Leaks Control ventilation to help control costs. When air enters and leaves your home through cracks and openings, you have an air leak. Look for possible leaks outside and inside of your home. Exterior areas where two different building materials meet such as siding and chimneys are havens for air leaks. Inside your home, gaps can be found in places such as door and window frames, baseboards and attic hatches. Depending on the type of leak, you can caulk, seal or add weatherstripping to reduce air leaks in your home and potentially save money. Seek out Energy Vampires If you have an electronic gadget or appliance that uses electricity when plugged in but not in use, you have an “energy vampire.” Electronics plugged into your wall outlets can add to your utility bill. Common household items that are plugged in and zap electricity when not in use include: hair dryers, video game consoles, cable boxes and portable fans. Unplug devices to save energy and eliminate energy vampires.

Check Your Home Insulation Heat flows from warmer to cooler temperature spaces. Insulation provides a protective layer between the heat radiating on your roof and the interior of your home. If your home is not properly insulated, heat can enter your home and your air conditioner will have to work harder to keep your it cool. Older homes may have little to no insulation in the ceiling and in the walls. Seek out a professional to determine how much insulation to add. You can also make sure your attic door is insulated and closed tight. Attic vents should never be blocked by insulation.

GENERAL COUNSEL REAL ESTATE AGENT’S REFUSAL TO PRESENT OFFER IS UNACCEPTABLE Q: MY SON IS LOOKING FOR A HOUSE, AND RECENTLY FOUND WHAT HE THOUGHT WAS THE PERFECT HOME FOR HIM AND WANTED TO OFFER $150,000 FOR THE HOUSE. THE REAL ESTATE AGENT INSISTS $150,000 IS TOO LOW A SALES PRICE AND IS RELUCTANT TO WRITE UP THE OFFER. IS THIS LEGAL? I THOUGHT AGENTS WERE REQUIRED TO PRESENT ALL OFFERS. A: The seller’s agent is legally obligated to present all offers to the seller. In fact, this sort of agent behavior is not appropriate. And, if the scope and price of the work you have described is accurate, the initial offer doesn’t seem out of line. If your son feels that his agent is refusing to present his offer, he can file a complaint with the Louisiana Real Estate Commission, or with his local Board of Realtors. In Lafayette, that agency is called the Realtor Association of Acadiana (“RAA”). If RAA is unable to assist your son, they should be able to point him in the right direction. He may also file a complaint with the National Association of Realtors (their Headquarters is in Chicago), if the agent in question is a member of the Realtors.

Q: I HAVE BEEN MARRIED FOR A FEW YEARS NOW, AND MY WIFE AND I HAVE TWO CHILDREN. WE FEEL THAT IT IS TIME TO HAVE A WILL PREPARED. WE DIDN’T HAVE MUCH WHEN WE GOT MARRIED, AND I DON’T WANT TO HAVE TO SPEND A BUNCH OF MONEY ON A WILL. WE ARE GOING TO LEAVE EVERYTHING TO EACH OTHER, SO CAN’T WE JUST PREPARE ONE WILL? A: Joint wills are not permitted by Louisiana law. There are two forms of wills under Louisiana law: the notarial testament and the olographic testament. The wills we have prepared for you are notarial. Your will is a document that allows you to transfer the property that you own on your death to the people or groups that you choose. As a practical matter, a joint will does not make much sense. What if you want to revoke the will, but your spouse does not? What happens if you divorce? What if one of your children falls out of your favor and you want to disinherit the child, but your spouse does not? What if your spouse dies and you want to change the will after her death? As you can probably tell, theproblems that arise from a joint will can be seemingly endless. Under Louisiana law, if your will does not comply with either the notarial testament or olographic testament it will be invalidated and your assets will be distributed under Louisiana intestate law. In Louisiana if there is no will stating otherwise, a spouse receives nothing from the estate of the deceased spouse if the couple has children, other than usufruct of the community property. Your spouse could very well end up with nothing if you prepare a joint will as it will be invalidated by the court. You should consult an attorney who can advise on the preparation of your will and comply with Louisiana law so that your will will not be invalidated on your death.
