Keeping Our Local Waterways Healthy

We all enjoy the benefits of having healthy local water resources – and that means we all have an important role to play in keeping our waterways safe and healthy for everyone to enjoy. After it rains or snows, the excess flow of water — and the contaminants that it carries — can pollute local water sources. That’s why managing this stormwater runoff is essential to maintain the health of native fish and wildlife, as well as the quality of water that your family uses every day. It also helps to reduce flooding. This is called stormwater management. Home builders control stormwater runoff during construction by installing silt fences or rows of hay bales, digging retention ponds and/or by using other measures. But once a community is completed, home owners have a responsibility to help ensure that our local waterways remain clean and healthy. You may not even realize how you could be endangering our local water — or the simple steps you can take to protect it. Think Twice Before Fertilizing When it rains, lawns that are over-fertilized can wash pesticides and herbicides into the storm drains on your street, eventually carrying it to the local water source — possibly the source of your drinking water. Before you spend the time and money to fertilize your lawn, you should perform a simple soil test to determine if fertilization is even necessary. Most garden and home-improvement stores sell soil test kits that you can easily use at home. If you do need to fertilize your lawn: • Keep it on the grass, use it sparingly, and consider using organic products • Hold off if there is a chance of a rain storm shortly after applying it to your lawn • When you mow, don’t bag the grass. The clippings will naturally fertilize your lawn. But sweep those fertilizer-rich clippings off the sidewalk and roadway so they don’t go down the storm drain. Plant it Yourself: Trees and Gardens Enhancing your yard with new trees, flowers and shrubs is great way to help keep polluted stormwater from reaching storm drains. A tree’s roots help rain water filter back into the soil, cutting down on excess runoff. As an added benefit, trees can help cut

DRAINAGE ISSUES UNDER LOUISIANA LAW

I HAVE OWNED MY HOME FOR MORE THAN 10 YEARS, AND RAIN WATER HAS ALWAYS NATURALLY RUN DOWNHILL INTO MY NEIGHBOR’S YARD. WELL, I HAVE NEW NEIGHBORS OF LATE, AND HAVE NOTICED THAT THEY HAVE BUILT SOMETHING THAT IS CAUSING THE WATER TO BACK UP INTO MY YARD. THEY CAN’T DO THIS CAN THEY?

A:

No, your new neighbors are not allowed to do this under Louisiana law. Our Civil Code directly addresses this situation. Your property is characterized as being the “dominant estate” in situations such as these. Your neighbor’s property, falls into the category known as the “servient estate”.

In Louisiana, the owner of the servient estate is obligated to allow water which naturally flows from the dominant estate to run onto his property, and may not do anything to prevent or alter this natural flow. Therefore, your neighbors’ construction that has disrupted the natural flow of water onto their property and caused an accumulation of water on your property, is not allowed. It is important to note that you, as the owner of the dominant estate are prevented from doing anything which would make the flow of water more burdensome to the servient estate owner. If you have done anything to increase or change the natural flow of water onto your neighbors’ land, your actions would also be prohibited. I suggest that you speak to your neighbors and politely request that they remove whatever they constructed because it has caused water to accumulate on your property. If they are unwilling to cooperate with your request, you should explain to them that you believe what they have done is improper under Louisiana law. You may need to obtain the services of an attorney to assist you if your neighbors continue to refuse to remove their construction. However, if it is possible to resolve this situation amicably, I urge you to do so, since life will be much more pleasant for you and your neighbors if you can avoid a nasty conflict or legal battle. Please keep in mind that your neighbors may not realize that their construction project has caused a problem for you, or that what they have done is against the law. I hope that once they are made aware of these facts, they will agree to resolve the problem amicably.

HOW MUCH MORTGAGE CAN YOU AFFORD?

Q:

I AM A YOUNG PROFESSIONAL SHOPPING FOR MY FIRST HOUSE. I KNOW HOW MUCH I CAN AFFORD, BUT HOW DOES A LENDER DETERMINE HOW MUCH MORTGAGE I CAN AFFORD? I DON’T WANT TO GET IN OVER MY HEAD.

A:

There are a few main areas lenders examine to determine the size of mortgage you can handle. Usually, they look at your monthly income, your non-housing expenses (credit card debt, car note, etc), and cash available for a down payment. The most common method lenders use to interpret these variables to estimate your mortgage capacity is the Percentage Method. As a general rule, you shouldn’t spend more than 28% of your income on housing costs. This includes your mortgage, your homeowners’ insurance and your real estate taxes. And, your housing costs plus your long-term debts (car loans, child support payments, minimum credit card payments, student loans, etc.) shouldn’t exceed 36% of your income. Some lenders have more relaxed ratios, but as a general rule, most lenders apply the above ratios. Some lenders also use the Multiplier Method formula as a general rule of thumb to determine how much mortgage you can afford. Typically, most lenders allow a family to carry a mortgage that is two to three times its gross annual income (income before taxes and expenses are taken out). For example, if your gross average income is $75,000, most lenders would allow you to carry a mortgage of between $150,000 and $225,000. There are several useful sites on the internet that will help you determine what you can afford. But remember, each person’s situation is different. Just because the ratios used by a lender suggest you can afford a $200,000 mortgage, doesn’t necessarily mean you will want to contribute that much of your monthly income towards a mortgage payment. You should do your research, and make sure you are not getting in over your head.
