Modern log home owners spend less money than conventional home owners on heating and cooling their home. The logs play a significant role in conserving energy. While there are a number of reasons for this, maintenance of property values in the subdivision is often at the top of the list. Therefore, while you may feel that you have enough space for your needs, it is possible that your neighbors would view the subdividing of your lot as having a negative effect on property values. Also, since some of them may have bought homes in the neighborhood specifically because of the large lots you mentioned, they would probably be unhappy to see multiple houses placed on a lot that was designed to accommodate only one home. As indicated previously, you should check the restrictions for your subdivision to determine whether your lot may be subdivided. If the provisions are unclear to you, you should contact an attorney who deals with real estate and ask that he review the restrictions and interpret them for you.
WHAT YOU SEE IS NOT ALWAYS WHAT YOU GET Q: MY WIFE AND I RECENTLY BOUGHT A HOUSE. THE PURCHASE AGREEMENT SPECIFIED THAT ALL OF THE APPLIANCES WERE TO REMAIN. WHEN IT CAME TIME FOR US TO MOVE IN, MY WIFE IMMEDIATELY NOTICED THAT THE REFRIGERATOR AND WASHER AND DRYER HAD BEEN REPLACED BY THE SELLERS WITH AN OLDER SET. THE APPLIANCES WORK, BUT THEY’RE NOT WHAT WE THOUGHT WE WERE GETTING. IS THERE ANYTHING WE CAN DO ABOUT THIS? A: Generally, appliances, be they a washer, dryer, or a refrigerator, are considered personal property. This means, that they are not part of the house itself and not automatically included in the sale. However, it is not uncommon for sellers to include at least some of the appliances in the sale. Oftentimes, they just don’t want the hassle of moving them, or their new home already has appliances. If the buyers and sellers agree that some or all of the appliances are to be included in the sale, it should be specifically stated in the purchase agreement. Although model or serial numbers aren’t included in the purchase agreement, the industry standard is that the appliances that are there when you’re looking at the house, are supposed to be the ones there after the house becomes yours. Unfortunately, the key is, do you have proof that the newer appliances were there when you and your wife initially looked at the house? Photos are ideal for this, but oftentimes buyers don’t take photos. I would suggest that any buyer, who is seriously considering making an offer, spend a few bucks on a disposable camera, and take pictures of the inside and outside of the house. This is an inexpensive way to document the condition of the house in case something like this happens later on. If you had an inspection, there is a possibility that the inspector noted the condition and/or type of appliances. And, most appraisers take pictures of the home during the appraisal process, so there is a chance that the washer and dryer are included in one of the appraiser’s pictures. Although your seller is technically in agreement with the sales contract, the appliances you got are probably worth a lot less than the newer ones, which means you didn’t get what you paid for. The real question is, however, how should you handle the situation? If no real estate agents were involved, you will have to handle the problem yourself. To start, you should bring this up directly with the seller, verbally or in writing, and request a resolution. If you had a real estate agent, by all means, contact them and ask them to help. This is one of the reasons you hire them. If the seller refuses to resolve this issue amicably, and you are set on pursing it, you may have to take this matter to small claims court.
