While single-family homes remain the most desired type of dwelling among home buyers, al-ternative living spaces are making headway. Accessory dwelling units (ADUs), also known as “granny flats,” “mother-inlaw suites” or “secondary dwelling units,” are ideal for individuals seeking out a non-traditional living space. ADUs are self-contained living units with their own kitchen, bedroom and bathroom. You can find ADUs on the same grounds or attached to a single-family home.

ONE CO-OWNER CAN FORCE THE SALE OF PROPERTY, EVEN IF THE OTHER CO-OWNERS DON’T AGREE Q: MY BROTHER AND I INHERITED SEVERAL ADJACENT TRACTS OF LAND FROM OUR FATHER WHEN HE DIED. UNFORTUNATELY, WE HAD A FALLING OUT SHORTLY AFTER OUR FATHER’S DEATH AND HAVEN’T SPOKEN TO EACH OTHER IN SEVERAL YEARS. THE TAXES AND THE UPKEEP HAVE GOTTEN RATHER EXPENSIVE. IS THERE ANY WAY I CAN FORCE MY BROTHER TO SELL HIS HALF SINCE HE HAS NOT CONTRIBUTED ANYTHING FOR THE UPKEEP OR TAXES ON THE PROPERTY? A: You can file a lawsuit seeking to force the sale or partition of the land. In Louisiana, any co-owner of real estate has the right to partition or divide property that is co-owned, if it can be fairly divided, or, if a tract of land, because of its shape, size, or the number of owners, can’t be equitably divided, a co-owner may file suit to force the sale of the land, even when the other co-owner or co-owners refuse. However, a court-ordered sale is not cheap, and should be your last resort. When you go to court, the judge will either order that the property be partitioned, if it can be, or if it can’t be fairly divided, the judge will order that the property sold at private sale or at a sheriff’s sale. Regardless, you and your brother would probably make more if you sold the property without going through the court. The best thing would be for you and your brother to try and agree on a sales price and then hire a real estate agent to market and sell the property. Before hiring an attorney, you should try contacting your brother again. Explain to him that you are planning on hiring an attorney to file suit to force a sale. He should understand that even if he doesn’t want to sell the property, you can force the sale. Remind him that the two of you will likely end up with less money after the property is sold, if you are forced to file suit. You should also mention that even if he outlives you, he still won’t get all of the property or profits from the sale of the property. Instead, you will probably leave your share of the property to your wife or your children, and your brother will still be left with just his half. Before hiring a lawyer and filing suit, you should try to persuade his brother to sell the property and thereby maximize the amount you both receive.

Q: EARLIER THIS YEAR, MY HUSBAND AND I SIGNED A CONTRACT WITH A LOCAL BUILDER AND WE SPECIFICALLY TOLD THE DEVELOPER THAT WE WANTED TO BUILD ON THE LAST LOT OF THE STREET BECAUSE WE DIDN’T WANT A HOUSE NEXT TO US. HE TOLD US THAT NO ONE COULD BUILD ON THE LOT NEXT TO OURS BECAUSE IT WAS TOO NARROW, AND THERE WERE SOME EASEMENTS OR SERVITUDES IN PLACE THAT PREVENTED HIM FROM BUILDING ON IT. A FEW WEEKS AGO, I NOTICED A “FOR SALE” SIGN ON THE LOT NEXT TO OUR HOUSE. WHEN I CALLED THE DEVELOPER TO ASK HIM ABOUT IT, HE SAID HE HAD CHANGED HIS MIND, AND THOUGHT THE LOT WAS MARKETABLE. HE IS ASKING $32,000 FOR THE LOT BUT SAID HE WOULD SELL IT TO US FOR $15,000 INSTEAD. SHOULD WE PAY TO BUY THE LOT? A: It does not sound like your previous agreement with the seller was in writing and unfortunately, there may not be recourse against the seller for going back on his word. As a general rule, conditions that are specific to a real estate are not enforceable unless they are in writing. Unfortunately, even though you and the developer had an agreement, since it is not in writing, there is not much you can do to enforce it now. The good news is you have a remedy that is not outrageously expensive. If you buy the lot for $15,000 you might never regret purchasing it, but if you don’t, and someone chooses to buy it and build on it, you could be sorry. It sounds like the developer knows he will have a tough time selling that lot and is looking to make a little extra cash. Whether or not you decide to buy the lot is up to you. Good luck!
